Reinforcing the soundness of FERC's hydro licensing process

On January 10, 1992, the U.S. Court of Appeals for the District of Columbia Circuit upheld FERC licenses for 16 hydroelectric projects in the Upper Ohio River Valley. The licensing had been appealed in 1990 by the Department of Interior, several states, and two environmental organizations. This article reviews the Court's findings and its reasons for upholding FERC's granting of the licenses.
