Regulatory agency accountability: theory alone is not enough

Regulatory commissions and reviewing courts must evaluate large volumes of purely theoretical constructs and computer model performance presented as evidentiary support during regulatory proceedings to determine whether the evidence meets standards. The authors discuss the implications of a federal court of appeals ruling which provides guidance in showing what can happen when agencies ignore traditional forms of evidence in favor of theory alone. In the Wisconsin Electric Power case, the court held that regulators are accountable for their decisions, with accountability measured by the congruence between agency action and reasoned decision making based on substantial evidence.
