Easy lease arrangements periled by Congress foes

The safe harbor leasing provision that offers advantages to users of conservation equipment is threatened with a repeal retroactive to February 19, 1982. Lawyers are advising those who qualify to avoid the arrangements until the matter is settled because of the strong Congressional criticism. Objectors to the safe harbor provision claim it allows companies to sell tax benefits by leasing to companies with a higher tax burden at a revenue loss to the US Treasury. Supporters point out that it allows the leasing of limited use property, which true leasing discourages, and it gives the user the option of purchasing leased equipment. (DCK)
