Municipal annexation of utility service territory

When a municipality that provides utility services annexes an outlying area served by another utility, a conflict arises over who shall serve the annexed territory. The problem raises unique legal issues. Customer preference, customer needs, proximity of facilities, or economic considerations can resolve the problem when two private utilities claim the same customers. Some states resolve the issue by statute; others by dual certification. These and other alternatives have as their common goal the provision of dependable service without wasteful duplication.
