PHC and CHIA: an update on regulations, hearings, decisions and appeals

Mining operations must be planned and conducted to minimize changes to the prevailing hydrologic balance in both the permit and adjacent areas. Steps to be taken to protect and hydrologic balance are to be included in an operator's permit application and approved by the regulatory authority with the permit. In performing the pre-mining analysis, the operator is responsible for submitting to the regulatory authority an analysis of the probable hydrologic consequences (PHC) of the proposed mining operations. Based upon the PHC and other available data, the regulatory authority must review the permit application to ensure that the regulatory requirements are met, and complete a cumulative hydrologic impact assessment (CHIA) of the proposed mine and all other anticipated mining. This paper presents a topical update of the developments in the legal and regulatory requirements for submitting, preparing and approving statements pertaining to the probable hydrologic consequences (PHC), and cumulative hydrologic impact assessment (CHIA) of mining.
