Consent requirements in compulsory fieldwide unitization

The Rule of Capture, which allows a landowner to drain oil and gas from beneath his neighbor's land without liability, is an incentive for each landowner to drill and produce as rapidly as possible. Recent economic conditions have led to a re-evaluation of this rule because of possible undesirable effects. New restrictions to counter these undesirable effects include well spacing rules, the use of allowables as limits on production, establishment of pooled units, and the recent development of compulsory fieldwide unitization. The latter should prevent unnecessary drilling. There are a number of issues ripe for dispute in the consent requirements of fieldwide unitization statutes. Only the cooperative nature of the oil industry and the recognition of the benefits to be gained have prevented significant litigation. Legislation may be necessary if the consent statutes are inadequate to withstand future challenges.
