The author cites several recent public utility commission cases involving the proper way to treat unused property held for future use when setting utility rates. At issue are the questions of whether current ratepayers will benefit in the foreseeable future and the equity of charging them for future benefits. Complicating the problem are the nature and extent of utility planning, possible time limits for out-of-service property, the definition of what is in the ratepayers' best interest, whether to accrue the profits of land sales to rate payers, and other standards.
