Hazardous- and solid-waste laws and regulations: effects on the mining of coal and other minerals

The authors describe how the Environmental Protection Agency (EPA) role in managing coal mining waste evolved and how the national solid and hazardous waste controversy relates to coal and other mineral mining. Their discussion covers the 1984 Resource Conservation and Recovery Act amendments and anticipated 1986 amendments to the Superfund. They conclude that the intrusion by the EPA and the tendency of courts to apply Resource Conservation and Recovery Act (RCRA) and Superfund definitions to mining threatens industry-specific regulation of surface coal mining through federal and state enforcement of the Surface Mining Control and Reclamation Act (SMRCA). The coal industry may be coerced into the national controversy surrounding RCRA and CERCLA in this way.
