Coal severance taxes: outbreak of the domestic energy war

Some coal-producing states are imposing such high severance taxes that legislation is sought to put a ceiling on what states can charge and to limit their rights to impose such taxes. The authors examine the legal question of what constitutes a reasonable tax rate, the proper federal role, and other issues raised in the recent Commonwealth Edison Co. v. Montana Supreme Court decision. These issues involve precedents under the commerce clause and the supremacy clause. Both concurring and dissenting views are presented. 76 references. (DCK)
