Mineral Leasing Act of 1920: environmental standards set by departmental regulations

The courts determined that the Secretary of Interior does not have discretion to reject coal-lease applications on environmental grounds if the applicant has complied with appropriate regulations. The ruling is limited to 183 potential coal-lease applicants who received their prospecting permits prior to 1973. The issuance of prospecting leases for coal exploration ceased in 1973. This decision, therefore, only affects those outstanding prospecting permittees and their potential lease applications. 19 footnotes. (SAC)
