Environmental compliance guide: guidance manual for Department of Energy compliance with the Endangered Species Act

This document provides guidance for Department of Energy (DOE) officials responsible for complying with Section 7 of the Endangered Species Act of 1973, as amended. The Endangered Species Act requires federal agencies such as DOE to ensure that none of their actions jeopardize the continued existence of endangered or threatened species or result in the destruction or adverse modification of designated critical habitat for such species. The Department is required to consult with the US Fish and Wildlife Service and/or the National Marine Fisheries Service, and if advised by these agencies that an endangered or threatened species or critical habitat may be affected, prepare a biological assessment of the effects of the proposed action. The content of a biological assessment is based on existing information on the federally protected species and habitats, data and observations from limited site surveys or visits, and consultations with local experts on the species. Information in the biological assessment is used by the responsible agencies as a basis for evaluating the effects of the proposed DOE action on species federally protected.
