The current dilemma on the generation, treatment and disposal of mixed hazardous and radioactive waste

The Nuclear Regulatory Commission (NRC) and the Environmental Protection Agency (EPA) have recently defined mixed waste as waste which: meets the definition of low-level radioactive waste set forth in the Low-Level Radioactive Waste Policy Amendments Act of 1985; and contains a material that is either listed as a hazardous waste in EPA regulations or exhibits any of the hazardous characteristics identified in those regulations. The agencies have also determined that, although the NRC has exclusive authority to regulate the radioactive component of mixed waste, EPA possesses the authority to regulate the hazardous component of such waste. As a result, mixed waste generators will be required to comply with the regulatory requirements of both agencies. The authors describe what they see as the dilemma resulting from this situation.
