This bill would amend the Nuclear Waste Policy Act of 1982 to allow commercial nuclear utilities that have contracts with the US DOE under section 302 of that Act to receive credits to offset the cost of storing spent fuel that the DOE is unable to accept for storage on and after January 31, 1998. The amount of the credit will be 0.56 mil per kilowatt-hour for electricity generated by the civilian nuclear power reactor and sold during the period the facility is eligible for the credit. The credit will end for a particular nuclear power plant at the time the DOE first accepts spent fuel from that facility.
