Producers vs pipelines: an update of current natural gas litigation

An update on current natural gas litigation notes that yesterday's contracts were negotiated in a different time and market. While many parties settle out of court, many suits are still pending involving producer claims over take-or-pay, severance taxes, and claims relating to breach of price redetermination. Defenses by the pipelines fall into four major categories: procedural, legality, general contract law, and specific contract language. Counterclaims raised by pipelines include wet-to-dry refund, undedicated gas, and inadequacies of pressure and quality. A list of current suits follows the article.
