Federal hydropower licensing and preference system

The preference system for licensing and relicensing competing hydropower projects has evolved over the years, with preference for preliminary permits currently going to municipalities and for relicensing to existing licensees. A review of court cases suggests an effort to tighten the procedures for licensing and relicensing by the Federal Energy Regulatory Commission along with a continuing adherence to the order of preferences. The article concludes that fairness and the public interest will be served best if comparisons of competing projects are made at the preliminary permitting rather than the licensing stage.
