Minnesota Environmental Response and Liability Act
The Minnesota Environmental Response and Liability Act (MERLA), which deals with retroactive liability for tort damages, liability for clean-up efforts, comparative fault schemes, revisions to required proof of causation in personal-injury cases, and various codified defenses to strict liability is the result of a number of compromises, inconsistencies, and ambiguities that will discourage its use as a credible model for legislative reform in other states, although states will feel pressure because of it to deal with these issues. A description of the provisions under MERLA and a comparison to the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA) covers clean-up, liability for personal injury and economic loss, and general provisions. 163 references.
