The attorney`s role in risk-based corrective action (RBCA) decisions and remedy selections

Risk-Based Corrective Action (RBCA) is a new cost-effective and more realistic alternative to stringent uniform cleanup standards. Many states have adopted some form of RBCA concerning corrective action. By utilizing the risk assessment process, RBCA remediation activities can be directed by site specific data and assumptions. This paper is written to generally describe the legal issues that may develop in risk-based remediation decisions and the attorney`s role in working with the environmental professional. Legally, RBCA represents a transition and shift from uniform cleanup criteria to site specific criteria with a significant role for the environmental attorney to fulfill. RBCA has its basis in predictive modeling and toxicology. RBCA, in some form, has been adopted in many state regulatory programs.
