Texas Voluntary Cleanup Program -- Jurisdictional and other legal aspects

The 1995 Texas Legislation enacted H.B. 2296, which established the new Voluntary Cleanup Program under the TNRCC. The program creates strong incentives favoring the cleanup and redevelopment of environmentally impaired properties, including expedited agency review, permit exemptions and subsequent immunity from later, additional cleanup demands. Despite the adoption of implementing rules in April 1996, interpretive issues remain, and interested parties are advised to review the rules and available guidance carefully in order to understand the limits of the program and maximize its available benefits. This paper explores various implementation issues, such as program eligibility and the actual extent of permit exemptions and enforcement immunity.
