Federal and state regulation of tribal utilities

Native Americans have developed or plan to develop, their own electric utility systems. In addition, many Native American tribes are members of electric cooperatives that have constructed extensive transmission systems located on tribal lands that are used to serve both Indian and no-Indian customers. With the encouragement of Congress in the Energy Policy act of 1992, tribes may seek to develop their own natural gas utilities as well. This article addresses whether the federal government or the states may regulate tribal utilities or utility service provide on tribal territory, and focuses primarily on state and federal regulations of electric utility service.
