EPA specifies point at which hazardous municipal waste combustion ash becomes subject to RCRA

On May 2, 1994, the U.S. Supreme Court ruled that ash generated from the combustion of municipal solid waste is not exempt from possible regulation under RCRA Subtitle C. This decision became law on June 1, 1994. As a result, all municipal waste combustion (MWC) facilities that generate, transport, treat, store, or dispose ash that exhibits a hazardous waste characteristic must comply with the requirements of 40 CFR Parts 260-270.
