County ordinance decision prohibiting burning of hazardous waste fuels remanded by appeals court

On June 22, 1994, the US Court of Appeals for the Tenth Circuit reversed a district court decision upholding a country ordinance that prohibited burning hazardous waste fuel (HWF) without a permit. In this case, an Oklahoma cement kiln operator chose to retrofit its facility to burn HWFs without first obtaining a conditional use permit from the county zoning authorities as required by the ordinance. As a result, the local Board of County Commissioners attempted to prohibit the fuel conversion. The company then challenged the county board`s action in district court, claiming that the local ordinance was preempted by RCRA and violated the Commerce Clause of the US Constitution. The federal district court issued summary judgement in favor of the board, which prompted appeal.
