NRC policy on State Cooperation

The purchase by New York of the Shoreham nuclear power plant in February 1989 as well as the June 1989 agreement between Pennsylvania and PECO on the Peach Bottom nuclear power plant both required the acquiescence and approval of the NRC. In both instances, the NRC, perhaps without choice, appeared to acknowledge and accommodate the political demands with which New York and Pennsylvania were confronted for additional involvement in the control of the radiological hazards associated with the two nuclear plants. With respect to the Shoreham plant, the NRC repeatedly has expressed the view that it is not authorized, in the absence of unusual circumstances, to require LILCO to operate the nuclear plant that the NRC already has licensed. With respect to the Peach Bottom plant, the NRC has approved an agreement under which the utility is committed to numerous initiatives that are intended to contribute to the safe operation of the nuclear plant but that are not NRC requirements. The role of the NRC in the licensing and operation of these two nuclear power plants is discussed.
