Allowable uses of HTMR slags may be based on generic exclusion levels

Under RCRA, EPA has encouraged the use of innovative technologies that allow recovery and reuse of heavy metals, such as chromium, lead, nickel, and zinc. High-temperature metals recovery (HTMR) is one such process that recovers heavy metals while treating metal-bearing hazardous wastes. However, HTMR can also produce nonwastewater residues, such as slag, which require treatment or disposal. EPA has evaluated the human health and environmental impacts of using (recycling) these slags in a manner constituting disposal (i.e., directly placing materials containing hazardous wastes onto the land). Based on its evaluation, the agency is proposing full compliance with RCRA Subtitle C requirements for any use of slag materials generated from HTMR processing of K061, K062, and F006 wastes, unless these slags meet the generic exclusion levels at 40 CFR {section}261.3(c)(2)(ii)(C) and are disposed or used in a manner specified in that section.
