A sequence of negative levels in /sup 44/Sc was recently identified at 68 keV (1/sup -/), 235 keV (2/sup -/), 425 keV (3/sup -/) and 631 keV (4/sup -/) ; it was suggested that they belong to a k = 0- band, whose head term 0/sup -/ is the level at 146 keV. The 0/sup -/ assignment was based on the fact that the 146 yields 68 keV transition has a predominantly M1 internalconversion coefficient, so spins 0/sup -/, 1/sup -/, 2/sup -/ are left; then 1/s up -/ and 2/sup -/ were excluded on the basis of an argument based on the analysis of the 146 yields 68 yields 0 cascade. An independent way to discriminate between the 1/sup -/ and 0/sup -/ assignments is proposed, which consists in comparing the excitation functions of levels at 68 and 146 keV in the reaction /sup 44/Ca(p,n). The analysis is based on the statistical model. (LBS)
