For the fourth straight year this paper provides an updated summary of recent state and federal legislative efforts to protect the confidentiality of voluntary environmental compliance audit results. This paper summarizes the state audit privilege statutes, EPA`s final audit policy statement, and the common-law privileges that may protect compliance audit results from discovery by regulatory agencies and private party plaintiffs. This paper also focuses on the following specific issues: is confidentiality consistent with ISO 14001; do the state audit privilege statutes provide protection from disclosure of the results of multi-facility audits involving facilities in different states; how have EPA and the courts viewed claims of privilege for the results of environmental audits?
