Natural resource damages assessments: Beyond the science and economics

The US Department of the Interior (DOI) and National Oceanic and Atmospheric Administration (NOAA) have published regulations to assess injuries and damages resulting from releases of hazardous substances and discharges of oil. The current and proposed regulations establish an administrative process that includes opportunities for public review and comment. Various departments of the United States, states and Indian tribes may all be trustees for the same or related natural resources. The US Environmental Protection Agency is not a trustee for natural resources, but its selection of remedial actions will often determine residual injuries for which the natural resource trustees can seek damages. The trustees may seek damages for the public interest in certain privately owned resources, and private parties may pursue their own claims. The press, state legislatures, local and county governments, environmental and community groups, are also frequently interested in the assessment. The numerous parties and their varying interests requires planning, communication, coordination, and cooperation beyond a more limited environmental case.
