The Resource Conservation and Recovery Act (RCRA) currently excludes cement kiln dust (CKD) from regulation under Subtitle C. The exclusion, commonly referred to as the Bevill Amendment, has been pending, awaiting completion of a report to Congress (RTC) which is required under RCRA. Then the US Environmental Protection Agency (USEPA) Administrator must either to promulgate regulations under Subtitle C or determine that regulations are unwarranted. Five management scenarios were outlined in the December 1993 RTC. Three of the scenarios incorporate Subtitle C regulations to some degree. The other two suggest CKD management remain exempt from Subtitle C, with an emphasis on alternatives for recycling and reuse of the CKD material. A review of the overall report indicates that there may neither be sufficient cause nor factual basis for requiring Subtitle C regulation of CKD. The conclusions derived from data do not consider the necessary operating parameters and variables involved in the manufacture of CKD. Additional input is necessary in order for the RTC to provide information relevant to the generation and characteristics of CKD, as well as, the existing regulatory controls available for CKD management.
