EPA required attestations and compliance issues for RFG and conventional gasoline

The Clean Air Act Amendments of 1990 and associated EPA regulations mandate extensive operational and administrative requirements for reformulated (RFG) and conventional gasolines. In addition, there are penalties and liabilities associated with noncompliance. Fines of per violation are possible. Presumptive liability makes everyone in the supply and distribution chain susceptible when a violation occurs. Compliance is monitored, in part by an annual attestation. The attestation, however, only covers a minor part of the total compliance activities required of refiners, carriers, and marketers.
