The Oil Pollution Liability and Compensation Act of 1986 provides for claims against the discharge of oil by either onshore or offshore facilities or vessels as well as for the removal of the pollutants. The legislation establishes responsibility for removal costs and liability claims on the operator or owner of a vessel or facility. The US Treasury will establish a fund for the payment of claims and removal costs and establishing the extent of injury or liability. Owners and operators must demonstrate that they possess the financial responsibility to meet their liabilities in order to operate on navigable waters. The legislation requires conforming amendments to existing laws affecting liability on the high seas, water pollution control, and operations on the continental shelf.
