Title: Threatened and endangered species evaluation for 75 licensed commercial nuclear power generating plants

The Endangered Species Act (ESA) of 1973, as amended, and related implementing regulations of the jurisdictional federal agencies, the U.S. Departments of Commerce and Interior, at 50 CFR Part 17. 1, et seq., require that federal agencies ensure that any action authorized, funded, or carried out under their jurisdiction is not likely to jeopardize the continued existence of any threatened or endangered species or result in the destruction or adverse modification of critical habitats for such species. The issuance and maintenance of a federal license, such as a construction permit or operating license issued by the U.S. Nuclear Regulatory Commission (NRC) for a commercial nuclear power generating facility is a federal action under the jurisdiction of a federal agency, and is therefore subject to the provisions of the ESA. The U.S. Department of the Interior (through the Fish and Wildlife Service), and the U.S. Department of Commerce, share responsibility for administration of the ESA. The National Marine Fisheries Service (NMFS) deals with species that inhabit marine environments and anadromous fish, while the U.S. Fish and Wildlife Service (USFWS) is responsible for terrestrial and freshwater species and migratory birds. A species (or other distinct taxonomic unit such as subspecies, variety, and for vertebrates, distinct population units) may be classified for protection as `endangered` when it is in danger of extinction within the foreseeable future throughout all or a significant portion of its range. A `threatened` classification is provided to those animals and plants likely to become endangered within the foreseeable future throughout all or a significant portion of their ranges. As of February 1997, there were about 1067 species listed under the ESA in the United States. Additionally there were approximately 125 species currently proposed for listing as threatened or endangered, and another 183 species considered to be candidates for formal listing proposals.
