Owners` hidden liability for construction site accidents: Work site accidents by prime construction contractors and/or subcontractors expose owner to potentially large liability claims and litigation

Specifically, this paper will discuss the liability of the facility owner and operator for the acts of the prime construction contractor and its subcontractors with respect to safety. The paper will focus upon facility owner and/or operator liability when an employee of the prime or subcontractor is injured or killed on site, the means by which the owner/operator can shift risk of loss back to the prime and subcontractor, and, most importantly, the means by which to qualify the prime and subcontractor with respect to safety and liability matters to avoid litigation in the first place. Actual cases from published decisions will be analyzed and used as case studies. The analysis will again focus on the basis of liability, ability to shift risk of loss, and safety prequalification of prime and subcontractors.
