Role of state regulatory agencies in implementing the natural gas policy act
The NGPA has six parts: Title I defines the new pricing criteria and sets the ceiling prices; Title II covers incremental pricing; Title III, certain additional authorities and requirements; Title IV, new curtailment policies; Title V the administrative and enforcement; Title VI defines the interplay of the NGPA and the NGA. An overview of the NGPA was included. State procedures for NGPA implementation are supposed to conform to existing methods of doing business. The states will reach determinations whether a well qualifies as new gas, new onshore production, high cost gas or stripper well gas, according to the Commission's regulations. The NGPA sets up rules whereby an intrastate seller determines what price can be charged now that the NGPA is in effect. In conclusion the FERC is continuing to work with the states and USGS to develop criteria for eligibility that are commensurate with the abilities of the varying agency regulatory programs, and to institute procedures that will streamline the administrative process from application though agency decision to final FERC action. Minimum exposure to refunds and to FERC remands will be sought. (DP)
