Title: Progress in operating permit flexibility: Beyond EPA's project XL and P4

Progress in flexible permitting continues to be made, including through recent contributions by projects performed by Imation Corp. under the regulatory reinvention programs Project XL and P4 (Pollution Prevention in Permitting Pilot). This paper examines regulatory mechanisms that were used in a flexible Title V operating permit written under the P4 program and the potential for similar mechanisms to be used elsewhere, most particularly in a Project XL-based regulatory experiment. While additional regulatory experiments in this area are needed, progress is being made toward greater manufacturing flexibility within operating permits written within the context of or beyond the tenure of either of the reinvention programs Project XL and P4.
