    Mountain coal mining in the Central Appalachians faces increased challenge under the Clean Water Act (CWA). These challenges have included the US Environmental Protection Agency's (EPA) increased involvement in permitting under Section 404 of the CWA; active opposition by environmental groups to Section 404 permits; and proposed federal legislation to reduce the availability of these permits. These recent challenges culminated in a June 11, 2009, Memorandum of Understanding (MoU) between the PEA, the Department of Interior (DoI) and the Army Corps of Engineers (Corps) that will limit the use of general permits for mountaintop coal mining and increase the scrutiny applied to individual permits, while also providing a coordinated approach for reviewing the backlog of pending permit application. By entering into the MoU, the federal agencies aim to reduce the environmental impacts of mountaintop coal mining while increasing certainty and transparency for permit applications. Challenges to Section 404 permitting for mountaintop coal mining are dynamic and new developments occur almost daily. This article provides a snapshot of the current climate.

    This document constitutes the Washington Administrative Code 173-216 State Waste Discharge Permit Application that serves as interim compliance as required by the Consent Order DE 91NM-177, for the 400 Area Secondary Cooling Water stream. As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affect groundwater or have the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 (or 173-218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permitting Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered in to Consent Order DE 91NM-177. The Consent Order DE 91NM-177 requires a series of permitting activities for liquid effluent discharges.

    The U.S. Environmental Protection Agency (EPA) Region II, Underground Injection Control (UIC) Program regulates injection wells in the State of New York to protect drinking water; UIC regulations can be found under Title 40 of the Code of Federal Regulations Parts 124, 144, 146 and 147. Operators of solution mining injection wells (UIC Class IIIG) and produced fluid disposal wells (UIC Class IID) are required to obtain an UIC permit for authorization to inject. The permitting process requires submittal of drinking water, geologic and proposed operational data in order to assure that pressure build-up within the injection zone will not compromise confining layers and allow vertical migration of fluid into Underground Sources of Drinking Water (USDW). Additional data is required within an Area of Review (AOR), defined as an area determined by the intersection of the adjusted potentiometric surface produced by injection and a depth 50 feet below the base of the lowermost USDW, or a radius of 1/4 mile around the injection well, whichever is greater. Locations of all wells in the AOR must be identified, and completion reports and plugging reports must be submitted. Requirements are set for maximum injection pressure and flow rates, monitoring of brine properties of the injection well and monitoring of water supply wells in the AOR for possible contamination. Any noncompliance with permit requirements constitutes a violation of the Safe Drinking Water Act and is grounds for enforcement action, including possible revocation of permit. Presently four Class IID wells are authorized under permit in New York State. The Queenston sandstone, Medina sandstone, Salina B, Akron dolomite and Oriskany sandstone have been used for brine disposal; the lower Ordovician-Cambrian section is currently being considered as an injection zone. Over one hundred Class IIIG wells are authorized under permit in New York State and all have been utilized for solution mining of the Syracuse salt.

    This renewal application for a Recycled Water Reuse Permit is being submitted in accordance with the Idaho Administrative Procedures Act 58.01.17 “Recycled Water Rules” and the Municipal Wastewater Reuse Permit LA-000141-03 for continuing the operation of the Central Facilities Area Sewage Treatment Plant located at the Idaho National Laboratory. The permit expires March 16, 2015. The permit requires a renewal application to be submitted six months prior to the expiration date of the existing permit. For the Central Facilities Area Sewage Treatment Plant, the renewal application must be submitted by September 16, 2014. The information in this application is consistent with the Idaho Department of Environmental Quality’s Guidance for Reclamation and Reuse of Municipal and Industrial Wastewater and discussions with Idaho Department of Environmental Quality personnel.

    This section describes the chemical and physical nature of the RCRA regulated hazardous wastes to be handled, stored, and incinerated at the Consolidated Incineration Facility (CIF) at the Savannah River Site. It is in accordance with requirements of South Carolina Hazardous Waste Management Regulations R.61-79.264.13(a) and(b), and 270.14(b)(2). This application is for permit to store and teat these hazardous wastes as required for the operation of CIF. The permit is to cover the storage of hazardous waste in containers and of waste in six hazardous waste storage tanks. Treatment processes include incineration, solidification of ash, and neutralization of scrubber blowdown.

    This document constitutes the Washington Administrative Code 173-216 State Waste Discharge Permit Application that serves as interim compliance as required by Consent Order DE 91NM-177, for the 400 Area Secondary Cooling Water stream. As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site that affect groundwater or have the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 of the Washington Administrative Code, the State Waste Discharge Permitting Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered into Consent Order DE 91NM-177. The Consent Order DE 91NM-177 requires a series of permitting activities for liquid effluent discharges. Based upon compositional and flow rate characteristics, liquid effluent streams on the Hanford Site have been categorized into Phase 1, Phase 2, and Miscellaneous streams. This document only addresses the 400 Area Secondary Cooling Water stream, which has been identified as a Phase 2 stream. The 400 Area Secondary Cooling Water stream includes contribution streams from the Fuels and Materials Examination Facility, the Maintenance and Storage Facility, the 481-A pump house, and the Fast Flux Test Facility.

    Responsible deployment of marine and hydrokinetic (MHK) devices in estuaries, coastal areas, and major rivers requires that biological resources and ecosystems be protected through siting and permitting (consenting) processes. Scoping appropriate deployment locations, collecting pre-installation (baseline) and post-installation data all add to the cost of developing MHK projects, and hence to the cost of energy. Under the direction of the U.S. Department of Energy, Pacific Northwest National Laboratory scientists have developed logic models that describe studies and processes for environmental siting and permitting. Each study and environmental permitting process has been assigned a cost derived from existing and proposed tidal, wave, and riverine MHK projects, as well as expert opinion of marine environmental research professionals. Cost estimates have been developed at the pilot and commercial scale. The reference model described in this document is an oscillating water column device deployed in Northern California at approximately 50 meters water depth.

    This renewal application for the Industrial Wastewater Reuse Permit (IWRP) WRU-I-0160-01 at Idaho National Laboratory (INL), Materials and Fuels Complex (MFC) Industrial Waste Ditch (IWD) and Industrial Waste Pond (IWP) is being submitted to the State of Idaho, Department of Environmental Quality (DEQ). This application has been prepared in compliance with the requirements in IDAPA 58.01.17, Recycled Water Rules. Information in this application is consistent with the IDAPA 58.01.17 rules, pre-application meeting, and the Guidance for Reclamation and Reuse of Municipal and Industrial Wastewater (September 2007). This application is being submitted using much of the same information contained in the initial permit application, submitted in 2007, and modification, in 2012. There have been no significant changes to the information and operations covered in the existing IWRP. Summary of the monitoring results and operation activity that has occurred since the issuance of the WRP has been included. MFC has operated the IWP and IWD as regulated wastewater land treatment facilities in compliance with the IDAPA 58.01.17 regulations and the IWRP. Industrial wastewater, consisting primarily of continuous discharges of nonhazardous, nonradioactive, routinely discharged noncontact cooling water and steam condensate, periodic discharges of industrial wastewater from the MFC facility process holdup tanks, and precipitation runoff, are discharged to the IWP and IWD system from various MFC facilities. Wastewater goes to the IWP and IWD with a permitted annual flow of up to 17 million gallons/year. All requirements of the IWRP are being met. The Operations and Maintenance Manual for the Industrial Wastewater System will be updated to include any new requirements.

    The drift velocity of electrons in mixtures of gaseous water and helium is measured over the range of reduced electric fields 0.1–300 Td using a pulsed-Townsend technique. Admixtures of 1% and 2% water to helium are found to produce negative differential conductivity (NDC), despite NDC being absent from the pure gases. The measured drift velocities are used as a further discriminative assessment on the accuracy and completeness of a recently proposed set of electron-water vapour cross-sections [K. F. Ness, R. E. Robson, M. J. Brunger, and R. D. White, J. Chem. Phys. 136, 024318 (2012)]. A refinement of the momentum transfer cross-section for electron-water vapour scattering is presented, which ensures self-consistency with the measured drift velocities in mixtures with helium to within approximately 5% over the range of reduced fields considered.

    Computational capability has been developed to adjust multigroup neutron cross sections, including self-shielding correction factors, to improve the fidelity of boiling water reactor (BWR) core modeling and simulation. The method involves propagating multigroup neutron cross-section uncertainties through various BWR computational models to evaluate uncertainties in key core attributes such as core k{sub eff}, nodal power distributions, thermal margins, and in-core detector readings. Uncertainty-based inverse theory methods are then employed to adjust multigroup cross sections to minimize the disagreement between BWR core modeling predictions and observed (i.e., measured) plant data. For this paper, observed plant data are virtually simulated in the form of perturbed three-dimensional nodal power distributions with the perturbations sized to represent actual discrepancies between predictions and real plant data. The major focus of this work is to efficiently propagate multigroup neutron cross-section uncertainty through BWR lattice physics and core simulator calculations. The data adjustment equations are developed using a subspace approach that exploits the ill-conditioning of the multigroup cross-section covariance matrix to minimize computation and storage burden. Tikhonov regularization is also employed to improve the conditioning of the data adjustment equations. Expressions are also provided for posterior covariance matrices of both the multigroup cross-section and core attributes uncertainties.

    The design of nuclear reactors and neutron moderators require a good representation of the interaction of low energy (E < 1 eV) neutrons with hydrogen and deuterium containing materials. These models are based on the dynamics of the material, represented by its vibrational spectrum. In this paper, we show calculations of the frequency spectrum for light and heavy water at room temperature using two flexible point charge potentials: SPC-MPG and TIP4P/2005f. The results are compared with experimental measurements, with emphasis on inelastic neutron scattering data. Finally, the resulting spectra are applied to calculation of neutron scattering cross sections for these materials, which were found to be a significant improvement over library data.

These include land-access permits, drilling permits, seismic survey permits, underground injection control permits, and any number of local and state permits, depending on the location of the project. For the “Characterization of Most Promising Sequestration Formations in the Rocky Mountain Region” (RMCCS) project in particular, critical permits included site access permits, seismic survey permits, and drilling permits for the characterization well. Permits for these and other activities were acquired either prior to or during the project.

    Section 316(b) of the Clean Water Act (CWA) requires that “the location, design, construction, and capacity of cooling water intake structures reflect the best technology available for minimizing adverse environmental impact.” As the U.S. Environmental Protection Agency (EPA) develops new regulations to implement Section 316(b), much of the debate has centered on adverse impingement and entrainment impacts of cooling-water intake structures. Depending on the specific location and intake layout, once-through cooling systems withdrawing many millions of gallons of water per day can, to a varying degree, harm fish and other aquatic organisms in the water bodies from which the coolingmore » water is withdrawn. Therefore, opponents of once-through cooling systems have encouraged the EPA to require wet or dry cooling tower systems as the best technology available (BTA), without considering site-specific conditions. However, within the context of the broader scope of the CWA mandate, this focus seems too narrow. Therefore, this article examines the phrase “minimizing adverse environmental impact” in a holistic light. Emphasis is placed on the analysis of the terms “environmental” and “minimizing.” Congress chose “environmental” in lieu of other more narrowly focused terms like “impingement and entrainment,” “water quality,” or “aquatic life.” In this light, BTA for cooling-water intake structures must minimize the entire suite of environmental impacts, as opposed to just those associated with impingement and entrainment. Wet and dry cooling tower systems work well to minimize entrainment and impingement, but they introduce other equally important impacts because they impose an energy penalty on the power output of the generating unit. The energy penalty results from a reduction in plant operating efficiency and an increase in internal power consumption.     Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    As part of the West Coast Regional Carbon Sequestration Partnership (WESTCARB), Terralog Technologies USA, Inc., reviewed current state and federal regulations related to carbon dioxide capture and storage within geologic formations and enhanced carbon uptake in terrestrial ecosystems. We have evaluated and summarized the current and possible future permitting requirements for the six states that comprise the West Coast Regional Partnership. Four options exist for CO{sub 2} injection into appropriate geologic formations, including storage in: (1) oil and gas reservoirs, (2) saline formations, (3) unmineable coal beds, and (4) salt caverns. Terrestrial CO{sub 2} sequestration involves improved carbon conservation management (e.g. reduction of deforestation), carbon substitution (e.g., substitution for fossil fuel-based products, energy conservation through urban forestry, biomass for energy generation), and improved carbon storage management (e.g., expanding the storage of carbon in forest ecosystems). The primary terrestrial options for the West Coast Region include: (1) reforestation of under-producing lands (including streamside forest restoration), (2) improved forest management, (3) forest protection and conservation, and (4) fuel treatments for the reduction of risk of uncharacteristically severe fires (potentially with associated biomass energy generation). The permits and/or contracts required for any land-use changes/disturbances and biomass energy generation that may occur as part of WESTCARB's activities have been summarized for each state.

    Many power plants discharge large volumes of cooling water. In some cases, the temperature of the discharge exceeds state thermal requirements. Section 316(a) of the Clean Water Act (CWA) allows a thermal discharger to demonstrate that less stringent thermal effluent limitations would still protect aquatic life. About 32% of the total steam electric generating capacity in the United States operates under Section 316(a) variances. In 1991, the US Senate proposed legislation that would delete Section 316(a) from the CWA. This study, presented in two companion reports, examines how this legislation would affect the steam electric power industry. This report quantitatively and qualitatively evaluates the energy and environmental impacts of deleting the variance. No evidence exists that Section 316(a) variances have caused any widespread environmental problems. Conversion from once-through cooling to cooling towers would result in a loss of plant output of 14.7-23.7 billion kilowatt-hours. The cost to make up the lost energy is estimated at $12.8-$23.7 billion (in 1992 dollars). Conversion to cooling towers would increase emission of pollutants to the atmosphere and water loss through evaporation. The second report describes alternatives available to plants that currently operate under the variance and estimates the national cost of implementing such alternatives. Little justification has been found for removing the 316(a) variance from the CWA.

This document constitutes the State Waste Discharge Permit application for the 400 Area Septic System. The influent to the system is domestic waste water. Although the 400 Area Septic System is not a Public Owned Treatment Works, the Public Owned Treatment Works application is more applicable than the application for industrial waste water. Therefore, the State Waste Discharge Permit application for Public Owned Treatment Works Discharges to Land was used.

    The US Environmental Protection Agency (USEPA) has reported that stormwater runoff is a major cause of pollution and use impairment to waters of the nation. Diffuse pollution sources (stormwater runoff) are increasingly important as controls for industrial process dischargers. On November 16, 1990 the Federal Clean Water Act National Pollutant Discharge Elimination System (NPDES) rules governing the discharge of stormwater were published (56 FR 40948). These rules potentially affect every type of business enterprise conducting work associated with industrial activity.'' Dischargers of stormwater associated with industrial activity ar required to either seek coverage under a federal or state general permit using notice of intent, apply for an individual permit, or apply for a permit through a two-part group application process. Conoco, Inc. Supply and Transportation (S and T) elected the latter alternative to attempt to comply with these new evolving complex, broad-ranging permitting requirements. This paper discusses specific details of S and T's strategy, BMP designs, data acquisition activities, monitoring results, as well as economic impacts on the corporation as a result of storm water permit requirements. S and T operates approximately 170 unique wholly and jointly owned petroleum product storage and transport facilities across the nation. Approximately one-third of these facilities were subject to stormwater permit application requirements.

    Application is being made for a permit pursuant to Chapter 173--216 of the Washington Administrative Code (WAC), to discharge treated waste water and cooling tower blowdown from the 200 Area Effluent Treatment Facility (ETF) to land at the State-Approved Land Disposal Site (SALDS). The ETF is located in the 200 East Area and the SALDS is located north of the 200 West Area. The ETF is an industrial waste water treatment plant that will initially receive waste water from the following two sources, both located in the 200 Area on the Hanford Site: (1) the Liquid Effluent Retention Facility (LERF) and (2) the 242-A Evaporator. The waste water discharged from these two facilities is process condensate (PC), a by-product of the concentration of waste from DSTs that is performed in the 242-A Evaporator. Because the ETF is designed as a flexible treatment system, other aqueous waste streams generated at the Hanford Site may be considered for treatment at the ETF. The origin of the waste currently contained in the DSTs is explained in Section 2.0. An overview of the concentration of these waste in the 242-A Evaporator is provided in Section 3.0. Section 4.0 describes the LERF, a storage facility for process condensate. Attachment A responds to Section B of the permit application and provides an overview of the processes that generated the wastes, storage of the wastes in double-shell tanks (DST), preliminary treatment in the 242-A Evaporator, and storage at the LERF. Attachment B addresses waste water treatment at the ETF (under construction) and the addition of cooling tower blowdown to the treated waste water prior to disposal at SALDS. Attachment C describes treated waste water disposal at the proposed SALDS.

    Pursuant to the passage of the Clean Air Act Amendments of 1990, the US Environmental Protection Agency has promulgated what are known as Title V permitting requirements for major sources of air pollutants, including pipeline operations. In contrast to most existing air permitting programs, the new Title V regulations will require periodic certification of compliance with applicable air regulations. In the same way that water dischargers report their own discharge violations to regulatory agencies pursuant to the NPDES permitting system, Title V permittees must implement an acceptable monitoring program and similarly report violations of permit conditions or applicable air regulations. Only those facilities whose potential emissions are less than or can be controlled to be less than certain regulatory limits will be exempt from standard Title V permitting. If a facility`s throughput or the concentration levels of certain volatile toxic levels in a particular crude or natural gas were to exceed corresponding regulatory limits, then the facility could be in violation. If an operator were to expand a field, then the changes in the gathering system and emission levels could constitute a violation. Constraints on operations can be avoided by careful strategizing of an operator`s Title V permit application.

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    This document presents two estimates of future growth of emerging energy technology in the years 1985, 1990, and 2000 to be used as a basis for conducting Water Resources Council assessments as required by the Nonnuclear Energy Research and Development Act of 1974. The two scenarios are called the high world oil price (HWOP) and low world oil price (LWOP) cases. A national-level summary of the ASA tabulations is shown in Appendix A; the scenarios are presented at the ASA level of detail in Appendix B. The two scenarios were generally derived from assumptions of the Second National Energy Plant (NEP II), including estimates of high and low world oil price cases, growth rate of GNP, and related economic parameters. The overall national energy growth inherent in these assumptions was expressed as a detailed projection of various energy fuel cycles through use of the Fossil-2 model and regionalized through use of the Strategic Environmental Assessment System (SEAS). These scenarios are for the use of regional analysts in examining the availability of water for and the potential impacts of future growth of emerging energy technology in selected river basins of the Nation, as required by Section 13(a).

    On September 9, 1992, the US Environmental Protection Agency (EPA) issued General Permit No. WA-R-00-OOOF, Authorization to Discharge Under the National Pollutant Discharge Elimination System (NPDES) for Storm Water Discharges Associated with Industrial Activity to the US Department of Energy, Richland Operations Office (RL). RL submitted a Notice of Intent to comply with this permit to EPA in conformance with the General Permit requirements on October 1, 1992. On February 14, 1994, EPA issued a Storm Water General Permit Coverage Notice and assigned WA-R-00-Al7F as the Hanford Site`s National Pollutant Discharge Elimination System (NPDES) storm water permit number. The Hanford Site Storm Water Pollution Prevention Plan (SWPPP) (WHC 1996a) was certified by J. E Rasmussen, Director Environmental Assurance, RL, on September 24, 1996, in compliance with Part IV.B(i) of the General Permit. As required by General Permit No. WA-R-00-OOOF (WA-R-00-Al7F), Section IV, Part D, Section 4.c, an annual report must be developed by RL and retained on site to verify that the requirements listed in the General Permit are being implemented. This document fulfills the requirement to prepare an annual report and contains the results of inspections of the storm water outfalls listed in the SWPPP (WHC 1996a). This report also describes the methods used to conduct the 1100 Storm Plater Comprehensive Site Compliance Evaluation (SWCSCE) as required in Part IV, Section D.4.c in the General Permit; summarizes the results of the compliance evaluation; and documents significant leaks and spills. The reporting year for this SWCSCE report is July 1, 1996 through June 30, 1997.

    Walsh et al. (1994) reported measurements of erosion of carbon steel by fly ash and unburned char particles in the convective heat transfer section of an industrial boiler cofiring coal-water fuel and natural gas. Changes in shape of the surface were measured using a surface profiler. Time-averaged maximum erosion rates were obtained from the differences between the original surface height and the lowest points in the profiles. A model was developed by Xie (1995) to describe wastage of tube material in the presence of erosion by particle impacts and oxidation of the metal. The observed changes in erosion rate with temperature and oxygen concentration were consistent with a mechanism based upon the following assumptions: (1) metal was eroded as a ductile material, at a rate that increased with increasing temperature; (2) oxide was eroded as a brittle material, at a rate independent of temperature; (3) the oxide scale was strongly attached to the metal; (4) the erosion resistance of metal and scale was a linear combination of the resistances of the individual components; (5) oxide formed according to the parabolic rate law, with a rate coefficient proportional to the square root of the oxygen partial pressure; (6) erosion resistance from particles sticking to, or embedded in, the surface was negligible. Using the model and rate coefficients for metal and oxide erosion derived from the measurements, estimates were made of the erosion rate of a boiler tube as functions of impaction angle and gas velocity. Under the conditions of metal temperature, gas composition, particle size, particle concentration, and particle composition investigated, erosion of carbon steel is expected to be slower than 0.05 {micro}m/h when the gas velocity in the convection section is less than approximately 8 m/s.

    The Environmental Protection Agency (EPA) published the final storm water regulation on November 16, 1990. The storm water regulation is included in the National Pollutant Discharge Elimination System (NPDES) regulations. An NPDES permit was issued for the Y-12 Plant on April 28, 1995, and was effective on July 1, 1995. The permit requires that a Storm Water Pollution Prevention Plan (SWP3) be developed by December 28, 1995, and be fully implemented by July 1, 1996; this plan has been developed to fulfill that requirement. The outfalls and monitoring points described in this plan contain storm water discharges associated with industrial activities as defined in the NPDES regulations. For storm water discharges associated with industrial activity, including storm water discharges associated with construction activity, that are not specifically monitored or limited in this permit, Y-12 Plant personnel will meet conditions of the General Storm Water Rule 1200-4-10. This document presents the programs and physical controls that are in place to achieve the following objectives: ensure compliance with Section 1200-4-10-.04(5) of the TDEC Water Quality Control Regulations and Part 4 of the Y-12 Plant NPDES Permit (TN0002968); provide operating personnel with guidance relevant to storm water pollution prevention and control requirements for their facility and/or project; and prevent or reduce pollutant discharge to the environment, in accordance with the Clean Water Act (CWA) and the Tennessee Water Quality Control Act.

    The purpose of this letter is to notify the New Mexico Environment Department-Hazardous Waste Bureau (NMED-HWB) of a Class 1 Permit Modification to the Los Alamos National Laboratory (LANL) Hazardous Waste Facility Permit issued to the Department of Energy (DOE) and Los Alamos National Security, LLC (LANS) in November 2010. The modification adds structures to the container storage unit at Technical Area (TA) 54 Area G, Pad 11. Permit Section 3.1(3) requires that changes to the location of a structure that does not manage hazardous waste shall be changed within the Permit as a Class 1 modification without prior approval in accordance with Code of Federal Regulations, Title 40 (40 CFR), {section}270.42(a)(1). Structures have been added within Dome 375 located at TA-54, Area G, Pad 11 that will be used in support of waste management operations within Dome 375 and the modular panel containment structure located within Dome 375, but will not be used as waste management structures. The Class 1 Permit Modification revises Figure 36 in Attachment N, Figures; and Figure G.12-1 in Attachment G.12, Technical Area 54, Area G, Pad 11 Outdoor Container Storage Unit Closure Plan. Descriptions of the structures have also been added to Section A.4.2.9 in Attachment A, TA - Unit Descriptions; and Section 2.0 in Attachment G.12, Technical Area 54, Area G, Pad 11 Outdoor Container Storage Unit Closure Plan. Full description of the permit modification and the necessary changes are included in Enclosure 1. The modification has been prepared in accordance with 40 CFR {section}270.42(a)(l). This package includes this letter and an enclosure containing a description of the permit modification, text edits of the Permit sections, and the revised figures (collectively LA-UR-12-22808). Accordingly, a signed certification page is also enclosed. Three hard copies and one electronic copy of this submittal will be delivered to the NMED-HWB.

    Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

    Title 5 of the 1990 Clean Air Act Amendments (CAAA) establishes a massive new operating permit program, which will be administered by state agencies in accordance with federal guidelines. Formal requirements regarding operating-permits were promulgated by the US Environmental Protection Agency (EPA) on July 21, 1992 (40 CFR 70). The Title 5 program will require many chemical manufacturing facilities to apply for and obtain operating permits that address air emissions from the entire facility. A major impact of the Title 5 program is that facilities will now be required to implement measures to routinely demonstrate that they are operating in compliance with the terms of the permit. Otherwise, facilities will be considered out of compliance. Once the new permits are in place, the burden will be on the facility to prove routine compliance to prevent any enforcement action. According to EPA, the new permits are not intended to impose any new regulatory requirements on a facility. Rather, they will serve as an enforcement tool.

    Titles IV and V of the Clean Air Act Amendments of 1990 (Act or CAA) created two new stationary source permitting programs, one specific to acid rain (Title IV), and a second for operating permits in general (Title V). The Phase 2 portion of the acid rain program was designed to be implemented through the Title V operating permit program, thereby subjecting all Phase 2 acid rain sources to the requirements of Title V. Permits issued pursuant to Phase 2 of the acid rain program will be viewed as a self-contained portion of the Title V operating permit and will be governed by regulations promulgated under both Title IV and Title V. The requirements imposed by Title IV may not always be consistent with the broader operating permit program requirements of Title V, and when inconsistency occurs, the acid rain requirements will take precedence. This nonalignment will perhaps be most apparent during two stages of initial permitting: (1) the transition period following Title V program approval when permit application, issuance, and effective dates differ between the two programs, and (2) at the point when acid rain permits must be reopened to incorporate Phase 2 NO{sub x} requirements. This paper explores strategies for streamlining implementation of the two programs with particular focus on these two coordination issues.

    This thesis discusses a recent United States Supreme Court case that will have a profound influence on the licensure of hydroelectric projects and the related ability of States to protect the quality of their waters. On October 4, 1993, the Supreme Court granted a Writ of Certiorari to resolve a conflict among the state courts of last resort. This case involves two fundamental and competing national interests: the nation's thirst for cheap, dependable power versus its equally strong desire to improve the quality of its water resources. It also involves two underlying regulatory regimes that overlap and conflict with each other in some ways. This case illustrates how those two national interests and their underlying regulatory regimes cannot always be reconciled. It also demonstrates how Congress, with its muddled ways of passing legislation, can create conflicts between federal and state regulatory agencies.

    This invention provides a transverse section radionuclide scanning system for high-sensitivity quantification of brain radioactivity in cross-section picture format in order to permit accurate assessment of regional brain function localized in three-dimensions. High sensitivity crucially depends on overcoming the heretofore known raster type scanning, which requires back and forth detector movement involving dead-time or partial enclosure of the scan field. Accordingly, this invention provides a detector array having no back and forth movement by interlaced detectors that enclose the scan field and rotate as an integral unit around one axis of rotation in a slip ring that continuously transmits the detector data by means of laser emitting diodes, with the advantages that increased amounts of data can be continuously collected, processed and displayed with increased sensitivity according to a suitable computer program.

    The Central Artery/Tunnel (CA/T) Project in Boston, Massachusetts involves the replacement of the existing I-93 interstate highway (Central Artery) and the extension of I-90 (Massachusetts Turnpike) to Logan International Airport. To date, approximately 95 environmental and related permits have been obtained for the CA/T Project. At least 200 permits from federal, state and local regulatory agencies will be acquired for the entire Project. The proposed action includes construction activities and permanent structures related to the crossing of three bodies of water: Charles River, Fort Point Channel, and Boston Inner Harbor. The Project also includes work in Massachusetts filled tidelands, relocation or construction of outfalls, disposition of construction dewatering and tunnel drainage fluids, and capping of an abandoned landfill. The number of permits, interrelationships between permits and interfaces with design and construction schedules have necessitated the development and implementation of a permit tracking system. The system tracks permit applications from preparation through public and agency review to permit issuance. The issues are discussed in detail: Phased development of the tracking system; Utilization of Project standard scheduling system software, Primavera Project Planner; How the information generated by the tracking system is used at the Project; Report format and production; Construction phase services and the multidiscipline, integrated Project schedule.

    In a hydraulically powered pump for excavating and transporting slurries in hich it is immersed, the improvement of a gravel and cobble eductor including an expandable mixing section, comprising: a primary flow conduit that terminates in a nozzle that creates a water jet internal to a tubular mixing section of the pump when water pressure is applied from a primary supply flow; a tubular mixing section having a center line in alignment with the nozzle that creates a water jet; a mixing section/exit diffuser column that envelopes the flexible liner; and a secondary inlet conduit that forms an opening at a bas portion of the column and adjacent to the nozzle and water jet to receive water saturated gravel as a secondary flow that mixes with the primary flow inside of the mixing section to form a combined total flow that exits the mixing section and decelerates in the exit diffuser.

    The current Hanford Facility Dangerous Waste Permit Application is considered to be a single application organized into a General Information Portion (this document, number DOE/RL-91-28) and a treatment, storage, and/or disposal Unit-Specific Portion, which includes documentation for individual TSD units (e.g., document numbers DOE/RL-89-03 and DOE/RL-90-01). Both portions consist of a Part A division and a Part B division. The Part B division consists of 15 chapters that address the content of the Part B checklists prepared by the Washington State Department of Ecology (Ecology 1987) and the US Environmental Protection Agency (40 Code of Federal Regulations 270), with additional information requirements mandated by the Hazardous and Solid Waste Amendments of 1984 and revisions of Washington Administrative Code 173-303. For ease of reference, the Washington State Department of Ecology checklist section numbers, in brackets, follow the chapter headings and subheadings. Documentation contained in the General Information Portion (i.e., this document, number DOE/RL-91-28) is broader in nature and applies to all treatment, storage, and/or disposal units for which final status is sought.     The Clean Air Act Amendments of 1990, which amended the Federal Clean Air Act of 1977, required that the US Environmental Protection Agency develop a national Air Operating Permit Program, which in turn would require each state to develop an Air Operating Permit Program to identify all sources of ``regulated`` pollutants. Regulated pollutants include ``criteria`` pollutants (oxides of nitrogen, sulfur oxides, total suspended particulates, carbon monoxide, particulate matter greater than 10 micron, lead) plus 189 other ``Hazardous`` Air Pollutants. The Hanford Site, owned by the US Government and operated by the US Department of Energy, Richland Operations Office, is located in southcentral Washington State and covers 560 square miles of semi-arid shrub and grasslands located just north of the confluence of the Snake and Yakima Rivers with the Columbia River. This land, with restricted public access, provides a buffer for the smaller areas historically used for the production of nuclear materials, waste storage, and waste disposal. About 6 percent of the land area has been disturbed and is actively used. The Hanford Site Air Operating Permit Application consists of more than 1,100 sources and in excess of 300 emission points. Before January 1995, the maintenance and operations contractor and the environmental restoration contractor for the US Department of Energy completed an air emission inventory on the Hanford Site. The inventory has been entered into a database so that the sources and emission points can be tracked and updated information readily can be retrieved. The Hanford Site Air Operating Permit Application contains information current as of April 19, 1995.

    Important new changes to the Hazardous Waste Facility Permit (HWFP) were implemented during 2007. The challenge was to implement these changes without impacting shipping schedules. Many of the changes required advanced preparation and coordination in order to transition to the new waste analysis paradigm, both at the generator sites and at the WIPP without interrupting the flow of waste to the disposal facility. Not only did aspects of waste characterization change, but also a new Permittees' confirmation program was created. Implementing the latter change required that new equipment and facilities be obtained, personnel hired, trained and qualified, and operating procedures written and approved without interruption to the contact-handled (CH) transuranic (TRU) waste shipping schedule. This was all accomplished successfully with no delayed or cancelled shipments. Looking forward to 2008 and beyond, proposed changes that will deal with waste in the DOE TRU waste complex is larger than the TRUPACT-IIs can handle. Size reduction of the waste would lead to unnecessary exposure risk and ultimately create more waste. The WIPP is working to have the Nuclear Regulatory Commission (NRC) certify the TRUPACT-III. The TRUPACT-III will be able to accommodate larger sized TRU mixed waste. Along with this new NRC-certified shipping cask, a new disposal container, the Standard Large Box, must be proposed in a permit modification. Containers for disposal of TRU mixed waste at the WIPP must meet the DOT 7A standards and be filtered. Additionally, as the TRUPACT-III/Standard Large Box loads and unloads from the end of the shipping cask, the proposed modification will add horizontal waste handling techniques to WIPP's vertical CH TRU waste handling operations. Another major focus will be the Hazardous Waste Facility Permit reapplication. The WIPP received its HWFP in October of 1999 for a term of ten years.     In accordance with the Southern States Energy Board (SSEB) proposal, as incorporated into NETL/DE-FC26-97FT34199, the objective of this agreement is to streamline the environmental technology permitting process site-to-site, state-to-state, and industry-to-industry to achieve remediation and waste processing faster, better and cheaper. SSEB is working with member Governors, legislators and regulators to build consensus on streamlining the permitting process for new and innovative technologies for addressing the legacy of environmental problems from 50 years of weapons research, development and production. This report reviews mechanisms whereby industry consortiums and the Department of Energy (DOE) have been working with State regulators and other officials in technology deployment decisions within the DOE complex. The historic development of relationships with State regulators is reviewed and the current nature of the relationships examined. The report contains observations from internal DOE reviews as well as recommendations from the General Accounting Office (GAO) and other external organizations. The report discusses reorganization initiatives leading up to a DOE Top-to-Bottom review of the Environmental Management (EM) Program and highlights points of consideration for maintaining effective linkages with State regulators. It notes how the proposed changes will place new demands upon the National Energy Technology Laboratory (NETL) and how NETL can leverage its resources by refocusing existing EM efforts specifically to states that have DOE facilities within their borders (host-states). Finally, the report discusses how SSEB's Permitting Leadership in the United States (PLUS) program can provide the foundation for elements of NETL's technical assistance program that are delivered to regulators and other decision- makers in host-states.     The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

    This report presents proposed modifications to the Resource Conservation and Recovery Act (RCRA) Post-Closure Permit (PCP) for the Upper East Fork Poplar Creek Hydrogeologic Regime (permit number TNHW-088, EPA ID No. TN3 89 009 0001). The modifications are proposed to: (1) revise the current text for two of the Permit Conditions included in Permit Section II - General Facility Conditions, and (2) update the PCP with revised versions of the Y-12 Plant Groundwater Protection Program (GWPP) technical field procedures included in several of the Permit Attachments.     The U.S. Nuclear Regulatory Commission (NRC) has received and is reviewing three applications for early site permits (ESPs). The ESP process allows early resolution of site-related issues affecting possible construction and operation of a new nuclear power plant. The nuclear industry views a successful and predictable ESP process as an important step in assessing whether to seek authorization to construct and operate a new generation of nuclear power reactors in the United States. Because consideration of ESP applications is a first-of-a-kind activity, a number of issues have emerged prior to and during the reviews of the first three applications. Issues have included the need for design information at the ESP stage, accident analyses, quality assurance, and seismic analyses. The NRC has been working to resolve identified issues to support a Commission decision on whether to issue an ESP approximately 33-37 months after receipt of each ESP application. (authors)

    A uranium fuel reactor designed to utilize light water as a moderator is described. The reactor core is in a tank at the bottom of a substantially cylindrical cross-section pit, the core being supported by an apertured grid member and comprised of hexagonal tubes each containing a pluralily of fuel rods held in a geometrical arrangement between end caps of the tubes. The end caps are apertured to permit passage of the coolant water through the tubes and the fuel elements are aluminum clad to prevent corrosion. The tubes are hexagonally arranged in the center of the tank providing an amulus between the core and tank wall which is filled with water to serve as a reflector. In use, the entire pit and tank are filled with water in which is circulated during operation by coming in at the bottom of the tank, passing upwardly through the grid member and fuel tubes and carried off near the top of the pit, thereby picking up the heat generated by the fuel elements during the fission thereof. With this particular design the light water coolant can also be used as the moderator when the uranium is enriched by fissionable isotope to an abundance of U/sup 235/ between 0.78% and 2%.
