    The Oak Ridge Institute for Science and Education (ORISE), a U.S. Department of Energy (DOE) prime contractor, was contracted by the DOE Portsmouth/Paducah Project Office (DOE-PPPO) to conduct a peak dose assessment in support of the Authorized Limits Request for Solid Waste Disposal at Landfill C-746-U at the Paducah Gaseous Diffusion Plant (DOE-PPPO 2011a). The peak doses were calculated based on the DOE-PPPO Proposed Single Radionuclides Soil Guidelines and the DOE-PPPO Proposed Authorized Limits (AL) Volumetric Concentrations available in DOE-PPPO 2011a. This work is provided as an appendix to the Dose Modeling Evaluations and Technical Support Document for the Authorized Limits Request for the C-746-U Landfill at the Paducah Gaseous Diffusion Plant, Paducah, Kentucky (ORISE 2012). The receptors evaluated in ORISE 2012 were selected by the DOE-PPPO for the additional peak dose evaluations. These receptors included a Landfill Worker, Trespasser, Resident Farmer (onsite), Resident Gardener, Recreational User, Outdoor Worker and an Offsite Resident Farmer. The RESRAD (Version 6.5) and RESRAD-OFFSITE (Version 2.5) computer codes were used for the peak dose assessments. Deterministic peak dose assessments were performed for all the receptors and a probabilistic dose assessment was performed only for the Offsite Resident Farmer at the request of the DOE-PPPO. In a deterministic analysis, a single input value results in a single output value. In other words, a deterministic analysis uses single parameter values for every variable in the code. By contrast, a probabilistic approach assigns parameter ranges to certain variables, and the code randomly selects the values for each variable from the parameter range each time it calculates the dose (NRC 2006). The receptor scenarios, computer codes and parameter input files were previously used in ORISE 2012. A few modifications were made to the parameter input files as appropriate for this effort. In doing so, the bills would, among other things, allow the corporation to set prices to maximize long-term returns; establish a fund to meet the costs of decontamination, decommissioning, and other environmental cleanup costs associated with uranium enrichment activities; transfer interest in DOE's new atomic vapor laser isotope separation (AVLIS) process to the new corporation; and, except for H.R. 145, require the government to pay its share of the costs to clean up mill tailings (mining wastes) generated under government contracts.

    Utility strategic planning for NO{sub x} compliance will be significantly influenced by not only the new Title IV Phase 2 rules but also y the pending new ozone non-attainment requirements and the proposed changes to the National Ambient Air Quality Standards (NAAQS). These regulations will have far-reaching effects on the NO{sub x} compliance strategy for most utilities. A utility`s goal is to develop a compliance plan that builds on the Phase 1 work just completed, while cost-effectively positioning themselves for the deregulated electricity market. With a typically broad mix of generating unit sizes, ages, capacity factors, fuels, and emission rates, a utility`s air emission compliance planning committee must deal with an ever growing mountain of data and options. The compliance planning committee can leverage the knowledge obtained in Phase 1 of the market-based Acid Rain Program to achieve a long-range strategy that will give the utility the flexibility to be competitive in a broad range of market conditions. This paper addresses how this monumental task can be accomplished using innovative application of proven technologies, coupled with the security of conservative risk management.

    Title V of the Clean Air Act (CAA) establishes a new permit program requiring major sources and sources subject to Title III (Hazardous Air Pollutants) to obtain a state operating permit. Historically, most states have issued operating permits for individual emission units. Under the Title V permit program, a single permit will be issued for all of the emission units at the facility much like the current National Pollutant Discharge Elimination System (NPDES) permit program. The permit will specify all reporting, monitoring, and record-keeping requirements for the facility. Sources required to obtain permits include (a) major sources that emit 100 tons per year or more of any criteria air contaminant, (b) any source subject to the HAP provisions of Title III, (c) any source subject to the acid rain provisions of Title IV, (d) any source subject to New Source Performance Standards, and (e) any source subject to new source review under the nonattainment or Prevention of Significant Deterioration provisions. The State of Tennessee Title V Operating Permit Program was approved by EPA on August 28, 1996. This paper will provide details of initiatives underway at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of requirements under the Title V Operating Permit Program. The ORR encompasses three DOE Facilities: the Y-12 Plant, Oak Ridge National Laboratory (ORNL), and the East Tennessee Technology Park (ETTP). The Y-12 Plant manufactures component parts for the national nuclear weapons program; the ORNL is responsible for research and development activities including nuclear engineering, engineering technologies, and the environmental sciences; and the ETTP conducts a variety of research and development activities and is the home of a mixed waste incinerator. Each of the three DOE Facilities is considered a major source under Title V of the CAA.

    The Title VI Stratospheric Ozone Protection Program of the Clean Air Act (CAA) requires promulgation of regulations to reduce and prevent damage to the earth's protective ozone layer. Regulations pursuant to Title VI of the CAA are promulgated in the Code of Federal Regulations (CFR) at Title 40 CFR, Part 822. The regulations include ambitious production phaseout schedules for ozone depleting substances (ODS) including chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), halons, carbon tetrachloride, and methyl chloroform under 40 CFR 82, Subpart A. The regulations also include requirements for recycling and emissions reduction during the servicing of refrigeration equipment and technician certification requirements under Subpart F; provisions for servicing of motor vehicle air conditioners under Subpart B; a ban on nonessential products containing Class 1 ODS under Subpart C; restrictions on Federal procurement of ODS under Subpart D; labeling of products using ODS under Subpart E; and the Significant New Alternatives Policy Program under Subpart G. This paper will provide details of initiatives undertaken at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of requirements under the Title VI Stratospheric Ozone Protection Program. The Stratospheric Ozone Protection Plans include internal DOE requirements for: (1) maintenance of ODS inventories; (2) ODS procurement practices; (3) servicing of refrigeration and air conditioning equipment; (4) required equipment modifications or replacement; (5) technician certification training; (6) labeling of products containing ODS; (7) substitution of chlorinated solvents; and (8) replacement of halon fire protection systems. The plans also require establishment of administrative control systems which assure that compliance is achieved and maintained as the regulations continue to develop and become effective.

    Following the issuance of Title 10 Code of Federal Regulations Part 835 (10 CFR 835), {open_quotes}Occupational Radiation Protection,{close_quotes} in the Federal Register on 14 December 1993, all DOE facilities subject to the rule provisions were required to submit a radiation protection program that Sets forth the plans, schedules, and other measures for achieving compliance with the rule by 1 January 1996. Numerous DOE facilities identified areas of the rule where their facility needed either (1) a clarification of the intent and expectation of a provisions or (2) an exemption from the provisions. In response, the DOE Office of Worker Protection Programs and Hazards Management (EH-52) prepared and disseminated eight Radiological Control Technical Positions (RCTPs). These RCTPs provided clarifications of DOE`s intent and expectations for compliance with specific provisions of the rule. EH-52 also processed requests for exemptions from provisions of 10 CFR 835 received from twelve different DOE facilities. The DOE issued 21 separate responses to these facilities, each one addressing the specific exepemtion request. Each response contained (1) an Exemption Decision and (2) a Technical Position discussing the basis for either denying or granting with conditions, as applicable, the exemption request.

    An allegation was made to the Office of Inspector General (OIG) that the integrity of the Department of Energy`s (DOE) unsolicited proposal review process may have been compromised by the actions of a former Deputy Secretary of Energy and his Executive Assistant during the review of an unsolicited proposal received from Chevron U.S.A. Production Company (Chevron) in may 1993. The Chevron unsolicited proposal was for the management and operation of DOE`s Elk Hills Naval Petroleum Reserve (Elk Hills), located near Bakersfield, California. Chevron submitted the unsolicited proposal on May 19, 1993. DOE formally rejected Chevron`s unsolicited proposal in May 1995. Although Chevron`s unsolicited proposal was eventually rejected by DOE, the complainant specifically alleged that the {open_quotes}sanctity, integrity, and sensitivity{close_quotes} of the unsolicited proposal review process had been breached in meetings during the Fall of 1993 between Chevron officials, the Deputy Secretary of Energy (Deputy Secretary), and his Executive Assistant. Based on our review of the allegation, we identified the following issue as the focus of our inspection.

    Title III, Section 112(r) of the Clean Air Act (CAA) Amendments of 1990 requires the Environmental Protection Agency (EPA) to promulgate regulations to prevent accidental releases of regulated substances and to reduce the severity of those releases that do occur. The final EPA rule for Risk Management Programs under Section 112(r)(7) of the CAA, promulgated June 20, 1996, applies to all stationary sources with processes that contain more than a threshold quantity of any of 139 regulated substances listed under 40 CFR 68.130. All affected sources will be required to prepare a risk management plan which must be submitted to EPA and be made available to state and local governments and to the public. This paper will provide details of initiatives underway at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of the Prevention of Accidental Release Rule. The ORR encompasses three DOE Facilities: the Y-12 Plant, Oak Ridge National Laboratory (ORNL), and the K-25 Site. The Y-12 Plant manufactures component parts for the national nuclear weapons program; the ORNL is responsible for research and development activities including nuclear engineering, engineering technologies, and the environmental sciences; and the K-25 Site conducts a variety of research and development activities and is the home of a mixed waste incinerator.     It is well known that cirrus clouds play a major role in regulating the earth’s climate, but the details of how this works are just beginning to be understood. This project targeted the main property of cirrus clouds that influence climate processes; the ice fall speed. That is, this project improves the representation of the mass-weighted ice particle fall velocity, Vm, in climate models, used to predict future climate on global and regional scales. Prior to 2007, the dominant sizes of ice particles in cirrus clouds were poorly understood, making it virtually impossible to predict how cirrus clouds interact with sunlight and thermal radiation. Due to several studies investigating the performance of optical probes used to measure the ice particle size distribution (PSD), as well as the remote sensing results from our last ARM project, it is now well established that the anomalously high concentrations of small ice crystals often reported prior to 2007 were measurement artifacts. Advances in the design and data processing of optical probes have greatly reduced these ice artifacts that resulted from the shattering of ice particles on the probe tips and/or inlet tube, and PSD measurements from one of these improved probes (the 2-dimensional Stereo or 2D-S probe) are utilized in this project to parameterize Vm for climate models. Our original plan in the proposal was to parameterize the ice PSD (in terms of temperature and ice water content) and ice particle mass and projected area (in terms of mass- and area-dimensional power laws or m-D/A-D expressions) since these are the microphysical properties that determine Vm, and then proceed to calculate Vm from these parameterized properties. But the 2D-S probe directly measures ice particle projected area and indirectly estimates ice particle mass for each size bin. It soon became apparent that the original plan would introduce more uncertainty in the Vm calculations

    The DOE Hydrogen Program needs to develop criteria as part of a systematic evaluation process for proposal identification, evaluation and selection. The H Scan component of this process provides a framework in which a project proposer can fully describe their candidate technology system and its components. The H Scan complements traditional methods of capturing cost and technical information. It consists of a special set of survey forms designed to elicit information so expert reviewers can assess the proposal relative to DOE specified selection criteria. The Analytic Hierarchy Process (AHP) component of the decision process assembles the management defined evaluation and selection criteria into a coherent multi-level decision construct by which projects can be evaluated in pair-wise comparisons. The AHP model will reflect management`s objectives and it will assist in the ranking of individual projects based on the extent to which each contributes to management`s objectives. This paper contains a detailed description of the products and activities associated with the planning and evaluation process: The objectives or criteria; the H Scan; and The Analytic Hierarchy Process (AHP).

    Department of Energy (DOE) nuclear facilities must comply with DOE Order 420.1C Facility Safety, which requires that all such facilities review their natural phenomena hazards (NPH) assessments no less frequently than every ten years. The Order points the reader to Standard DOE-STD-1020-2012. In addition to providing a discussion of the applicable evaluation criteria, the Standard references other documents, including ANSI/ANS-2.29-2008 and NUREG-2117. These documents provide supporting criteria and approaches for evaluating the need to update an existing probabilistic seismic hazard analysis (PSHA). All of the documents are consistent at a high level regarding the general conceptual criteria that should be considered. However, none of the documents provides step-by-step detailed guidance on the required or recommended approach for evaluating the significance of new information and determining whether or not an existing PSHA should be updated. Further, all of the conceptual approaches and criteria given in these documents deal with changes that may have occurred in the knowledge base that might impact the inputs to the PSHA, the calculated hazard itself, or the technical basis for the hazard inputs. Given that the DOE Order is aimed at achieving and assuring the safety of nuclear facilities—which is a function not only of the level of the seismic hazard but also the capacity of the facility to withstand vibratory ground motions—the inclusion of risk information in the evaluation process would appear to be both prudent and in line with the objectives of the Order. The purpose of this white paper is to describe a risk-informed methodology for evaluating the need for an update of an existing PSHA consistent with the DOE Order. While the development of the proposed methodology was undertaken as a result of assessments for specific SDC-3 facilities at Idaho National Laboratory (INL), and it is expected that the application at INL will provide a demonstration of the

    DOE needs to continue the safe and efficient management of SNF on ORR, based on the requirement for future SNF storage capacity and implementation of the ROD for the PEIS. DOE is proposing to implement the ROD through proper management of SNF on ORR, including the possible construction and operation of a dry cask storage facility. This report describes the potentially affected environment and analyzes impacts on various resources due to the proposed action. The information provided in this report is intended to support the Environmental Assessment being prepared for the proposed activities. Construction of the dry cask storage facility would result in minimal or no impacts on groundwater, surface water, and ecological resources. Contaminated soils excavated during construction would result in negligible risk to human health and to biota. Except for noise from trucks and equipment, operation of the dry cask storage facility would not be expected to have any impact on vegetation, wildlife, or rare plants or animals. Noise impacts would be minimal. Operation exposures to the average SNF storage facility worker would not exceed approximately 0.40 mSv/year (40 mrem/year). The off-site population dose within an 80-km (50-mile) radius of ORR from SNF operations would be less than 0.052 person-Sv/year (5.2 person-rem/year). Impacts from incident-free transportation on ORR would be less than 1.36 X 10{sup -4} occupational fatal cancers and 4.28 X 10{sup -6} public fatal cancers. Credible accident scenarios that would result in the greatest probable risks would cause less than one in a million cancer fatalities to workers and the public.

    This report, in fulfillment of a license requirement, presents the results of long-term surveillance and maintenance activities conducted by the U.S. Department of Energy (DOE) Office of Legacy Management in 2015 at six uranium mill tailings disposal sites reclaimed under Title II of the Uranium Mill Tailings Radiation Control Act (UMTRCA) of 1978. These activities verified that the UMTRCA Title II disposal sites remain in compliance with license requirements.

    The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

    For the past decade, the non-residential portion of California's Title-24 building energy standard has relied on DOE-2.1E as the reference computer simulation program for development as well as compliance. However, starting in 2004, the California Energy Commission has been evaluating the possible use of Energy Plus as the reference program in future revisions of Title-24. As part of this evaluation, the authors converted the Alternate Compliance Method (ACM) certification test suite of 150 DOE-2 files to Energy Plus, and made parallel DOE-2 and Energy Plus runs for this extensive set of test cases. A customized version of DOE-2.1E named doe2ep was developed to automate the conversion process. This paper describes this conversion process, including the difficulties in establishing an apples-to-apples comparison between the two programs, and summarizes how the DOE-2 and Energy Plus results compare for the ACM test cases.

    Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all Title I sites. On September 24, 1987, the EPA published proposed standards (52FR36000-36008) in response to the remand. This report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project, as well as a discussion of the DOE's position on the proposed standards. The report also contains and appendix which provides supporting information and cost analyses. In order to assess the impacts of the proposed EPA standards, this report summarizes the proposed EPA standards in Section 2.0. The next three sections assess the impacts of the three parts of the EPA standards: Subpart A considers disposal sites; Subpart B is concerned with restoration at processing sites; and Subpart C addresses supplemental standards. Section 6.0 integrates previous sections into a recommendations section. Section 7.0 contains the DOE response to questions posed by the EPA in the preamble to the proposed standards. 6 refs., 5 figs., 3 tabs.

    The U.S. Department of Energy (DOE) Office of Analysis within the Office of Health, Safety and Security (HSS) publishes the annual DOE Occupational Radiation Exposure Report to provide an overview of the status of radiation protection practices at DOE (including the National Nuclear Security Administration [NNSA]). The DOE 2011 Occupational Radiation Exposure Report provides an evaluation of DOE-wide performance regarding compliance with Title 10, Code of Federal Regulations (C.F.R.), Part 835, Occupational Radiation Protection dose limits and as low as reasonably achievable (ALARA) process requirements. In addition, the report provides data to DOE organizations responsible for developing policies for protection of individuals from the adverse health effects of radiation. The report provides a summary and an analysis of occupational radiation exposure information from the monitoring of individuals involved in DOE activities. The occupational radiation exposure information is analyzed in terms of aggregate data, dose to individuals, and dose by site over the past five years.

    The Department of Energy (DOE) has developed this Standard to assist line managers in meeting their responsibilities for implementing occupational radiological control programs. DOE has established regulatory requirements for occupational radiation protection in Title 10 of the Code of Federal Regulations, Part 835 (10 CFR 835), ``Occupational Radiation Protection``. Failure to comply with these requirements may lead to appropriate enforcement actions as authorized under the Price Anderson Act Amendments (PAAA). While this Standard does not establish requirements, it does restate, paraphrase, or cite many (but not all) of the requirements of 10 CFR 835 and related documents (e.g., occupational safety and health, hazardous materials transportation, and environmental protection standards). Because of the wide range of activities undertaken by DOE and the varying requirements affecting these activities, DOE does not believe that it would be practical or useful to identify and reproduce the entire range of health and safety requirements in this Standard and therefore has not done so. In all cases, DOE cautions the user to review any underlying regulatory and contractual requirements and the primary guidance documents in their original context to ensure that the site program is adequate to ensure continuing compliance with the applicable requirements. To assist its operating entities in achieving and maintaining compliance with the requirements of 10 CFR 835, DOE has established its primary regulatory guidance in the DOE G 441.1 series of Guides. This Standard supplements the DOE G 441.1 series of Guides and serves as a secondary source of guidance for achieving compliance with 10 CFR 835.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.
