    Brookhaven National Laboratory was established in 1947 on the site of the former Army Camp Upton. Brookhaven is a multidisciplinary Laboratory that carries out basic and applied research in the physical, biomedical and environmental sciences, and in selected energy technologies. Associated Universities, Inc. managed the Laboratory, under contract with the US Department of Energy until April 30, 1998. On March 1, 1998, Brookhaven Science Associates LLC (BSA) was awarded a contract by the US Department of Energy to manage the Laboratory. Brookhaven Science Associates has taken responsibility for all aspects of the existing Royalty Use Program from the prior contractor, AUI. This report is limited to FY 1998 activities of the Royalty Use Program that were funded by royalty income from prior fiscal years. Any FY 1998 royalty income allocated in FY 1998 shall be reported in the FY 1999 Royalty Use Program Report.

    In response to the U.S. Department of Energy (DoE)’s goal of achieving market ready, net-zero energy residential and commercial buildings by 2020 and 2025, Eaton partnered with the Department of Energy’s National Renewable Energy Laboratory (NREL) and Georgia Institute of Technology to develop an intelligent load identification and management technology enabled by a novel “smart power strip” to provide critical intelligence and information to improve the capability and functionality of building load analysis and building power management systems. Buildings account for 41% of the energy consumption in the United States, significantly more than either transportation or industrial. Within the building sector, plug loads account for a significant portion of energy consumption. Plug load consumes 15-20% of building energy on average. As building managers implement aggressive energy conservation measures, the proportion of plug load energy can increase to as much as 50% of building energy leaving plug loads as the largest remaining single source of energy consumption. This project focused on addressing plug-in load control and management to further improve building energy efficiency accomplished through effective load identification. The execution of the project falls into the following three major aspects; An intelligent load modeling, identification and prediction technology was developed to automatically determine the type, energy consumption, power quality, operation status and performance status of plug-in loads, using electric waveforms at a power outlet level. This project demonstrated the effectiveness of the developed technology through a large set of plug-in loads measurements and testing; A novel “Smart Power Strip (SPS) / Receptacle” prototype was developed to act as a vehicle to demonstrate the feasibility of load identification technology as a low-cost, embedded solution; and Market environment for plug-in load control and management solutions

    Against the backdrop of more than 20 years of increasingly stringent environmental regulation, ever-expanding exploration and development moratoria on the Outer Continental Shelf (OCS), and reductions in producer tax incentives, oil and natural gas exploration companies active in deep waters of the Gulf of Mexico recently won a significant legislative victory. On Nov. 28, 1995, President Clinton signed into law S.395, the Alaska Power Administration Sale Act. Title 3 of S.395 embodies the Outer Continental Shelf Deep Water Royalty Relief Act. This landmark legislation provides substantial incentives for oil and natural gas production in the gulf of Mexico by temporarily eliminating royalties on certain deepwater leases. It is the first direct incentive for oil and gas production enacted at the federal level in many years. This paper reviews the elements used to arrive at this successful legislation including the congressional leadership. It describes debates, cabinet level discussions, and use of parlimentary procedures.

    The U.S. Environmental Protection Agency (EPA) has been regulating air toxics (hazardous air pollutants) under Section 112 of the 1970 Clean Air Act Amendments. To date, EPA has established emission standards for seven hazardous air pollutants. They include arsenic, asbestos, benzene, beryllium, mercury, vinyl chloride and radionuclides. EPA had determined that the low risks associated with electric utility fossil fuel power plant radionuclide emissions did not justify regulation under Section 112. The Clean Air Act Amendments of 1990 greatly expand EPA's rulemaking authority over toxic or hazardous air pollutants. The law lists 189 chemicals that would be subject to control. Sources that emit 10 tons/yr or more of any one pollutant, or 25 tons/yr or more of any combination thereof, must apply maximum available control technology (MACT). By definition, MACT is at least as stringent as best available control technology (BACT) for similar sources. However, consideration of the cost and feasibility of control, energy impacts and environmental factors will be given in MACT. Under the new amendments, the EPA will conduct a three-year study of the public health hazards from exposure to toxic emissions from utilities and report to Congress. EPA can regulate such emissions only if the regulations are appropriate based on this study. Two additional studies addressing mercury are also required. The first directs the EPA to conduct a four-year study of mercury emissions from electric utility steam generating units, municipal waste combustion units, and other sources. Included in this paper are evaluations of the rate and mass of such emissions, of health and environmental effects, and of the available control technologies and their costs.

    In recognition of the increasing pressures upon the nation`s coastal resources, Congress enacted the Coastal Zone Management Act in 1972. Its purpose is to encourage states to preserve, protect, develop, and, where possible, restore or enhance such valuable natural resources as wetlands, floodplains, estuaries, beaches, dunes, barrier islands, and coral reefs, as well as the fish and wildlife utilizing those habitats. A unique feature of the Act is that participation by states is voluntary. One key provision for encouraging states to participate is the availability of federal financial assistance to any coastal state or territory, including those on the Great Lakes, which is willing to develop and implement a comprehensive coastal management program. Additionally, the Coastal Barrier Resources Act (CBRA) was passed in 1983. This report contains the legislative history and statues associated with each Act. Regulations for implementation and other guidance are included.

  12. Selectively reducing offshore royalty rates in the Gulf of Mexico could increase oil production and federal government revenue

    The US government leases large areas in the Outer Continental Shelf in the Gulf of Mexico for the development of oil resources and receives royalties on the oil produced. Conventional methods of oil recovery have recovered or are expected to recover about half of the 16 billion barrels of oil discovered in this area. Other oil recovery methods, collectively known as enhanced oil recovery (EOR), could potentially increase production by about 1 billion barrels of oil. EOR in the Gulf is expensive and does not appear to be economically justified in most cases. Under existing economic conditions and federal policies, GAO's review indicates that utilizing EOR methods will probably produce only about 10 percent of the additional recoverable oil. However, financial incentives in the form of royalty reductions could increase both oil production and federal government revenue if applied on a project-by-project basis. Universal applications of royalty reduction for EOR, however, while achieving increased oil production, would not increase federal government revenue. GAO recommends that the Department of the Interior's Minerals Management Service initiate action that would allow for selective royalty reductions for EOR projects in the Gulf in instances where both total oil production and federal government revenue will increase. 6 figs., 1 tab.

    The Saskatchewan Uranium Royalty System, in operation since 1976, is the provincial government's prime policy vehicle towards the uranium industry. The enunciated objectives of the royalty system are (Sask., 1977): (a) to ensure a minimum return to the province from the extraction of uranium; (b) to capture a fair share of the ''excess'' profits; (c) to provide the producers with an adequate rate of return on investment; and (d) to leave marginal production decisions unaffected.     The Occupational Safety and Health Administration promulgates and enforces regulations that govern the health and safety of workers. OSHA rules often are considered to govern what happens {open_quotes}inside the fence line,{close_quotes} or within the physical boundaries of the facility. In some ways, the U.S. Environmental Protection Agency takes over where OSHA leaves off. The U.S. EPA is responsible for environmental programs {open_quotes}outside the fence line.{close_quotes} The concept is as simple as drawing a line, or is it? Anyone developing and implementing compliance programs, whether for OSHA or EPA, will tell you nothing is that simple. EPA`s recent promulgation of rules pertaining to risk management programs is a case in point. A new EPA rule is intended to compliment OSHA requirements under the Process Safety Management (PSM) rule. Under the OSHA rule, plant operators developed programs that ensure safe measures are in use when handling certain chemicals. During the past three years, waste-to-energy facilities faced difficult decisions when complying with the PSM requirements. Earlier this year, the US EPA promulgated its 112(r)(7) rule that is intended to `complement` OSHA`s PSM requirements. This is not always the case. Unfortunately, these new Clean Air Act requirements do not always complement, but may instead confuse plant operators. For example, EPA`s 112(r) rule may force plant operators to change, once again, their decisions on the use of selected chemicals. The US EPA estimates that approximately 66,000 facilities, including the 114 waste-to-energy facilities nationwide, may be affected by the list and risk management planning rules. The facilities include chemical and many other manufacturers, cold storage facilities with ammonia refrigeration systems, public water treatment systems, wholesalers and distributors of these chemicals, propane retailers, utilities, and federal facilities.

    The Department of Energy's (Department) Office of Energy Efficiency and Renewable Energy (EERE) provides grants to states, territories and the District of Columbia (states) to support their energy priorities through the State Energy Program (SEP). Federal funding is based on a grant formula that considers the population and energy consumption in each state, and amounted to $25 million for Fiscal Year (FY) 2009. The American Recovery and Reinvestment Act of 2009 (Recovery Act) expanded the SEP by authorizing an additional $3.1 billion to states using the existing grant formula. EERE made grant awards to states after reviewing plans that summarize the activities states will undertake to achieve SEP Recovery Act objectives, including preserving and creating jobs; saving energy; increasing renewable energy sources; and, reducing greenhouse gas emissions. EERE program guidance emphasizes that states are responsible for administering SEP within each state, and requires each state to implement internal controls over the use of Recovery Act funds. The State of Louisiana received $71.6 million in SEP Recovery Act funds; a 164-fold increase over its FY 2009 SEP grant of $437,000. As part of the Office of Inspector General's strategy for reviewing the Department's implementation of the Recovery Act, we initiated this review to determine whether the Louisiana State Energy Office had internal controls in place to efficiently and effectively administer Recovery Act funds provided for its SEP program. Louisiana developed a strategy for SEP Recovery Act funding that focused on improving energy efficiency in state buildings, housing and small businesses; increasing Energy Star appliance rebates; and, expanding the use of alternative fuels and renewable energy. Due to a statewide hiring freeze, Louisiana outsourced management of the majority of its projects ($63.3 million) to one general contractor.     This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    The Environmental Management Site Specific Advisory Board (EM SSAB) is comprised of eight Citizens' Advisory Boards, chartered under the Federal Advisory Committee Act (FACA) by the Assistant Secretary for Environmental Management for the U. S. Department of Energy (DOE). The purpose of the EM SSAB is to provide the DOE with recommendations regarding Environmental Management issues from legacy waste produced at major sites across the DOE Complex. The Northern New Mexico Citizens' Advisory Board (NNMCAB) is the site specific advisory board to the DOE on issues of environmental monitoring, remediation, waste management and long-term stewardship at Los Alamos National Laboratory (LANL). The other boards are located at: Hanford, Idaho, Nevada, Paducah, Portsmouth, Oak Ridge and Savannah River. Using broad citizen outreach and input, the SSAB provides an official mechanism for the citizenry at each of these sites to monitor current activities affecting the region and also to have input into the prioritization of future activities. 'The mission of the EM SSAB is to more directly involve stakeholders in EM Planning and decision-making processes for the nuclear weapons complex cleanup. DOE has various means of involving the public in its planning and decision-making processes; the EM SSAB is only one component of EM's public participation program, and is not intended to be an exclusive means of public participation. It is the policy of DOE and EM to conduct it programs in an open and responsive manner, thereby encouraging and providing the opportunity for public participation in its planning and decision-making processes. EM SSAB members are appointed to a two year term and may serve up to three terms.     This final scientific report documents the Industrial Technology Program (ITP) Stage 2 Concept Development effort on Data Center Energy Reduction and Management Through Real-Time Optimal Control (RTOC). Society is becoming increasingly dependent on information technology systems, driving exponential growth in demand for data center processing and an insatiable appetite for energy. David Raths noted, 'A 50,000-square-foot data center uses approximately 4 megawatts of power, or the equivalent of 57 barrels of oil a day1.' The problem has become so severe that in some cases, users are giving up raw performance for a better balance between performance and energy efficiency. Historically, power systems for data centers were crudely sized to meet maximum demand. Since many servers operate at 60%-90% of maximum power while only utilizing an average of 5% to 15% of their capability, there are huge inefficiencies in the consumption and delivery of power in these data centers. The goal of the 'Recovery Act: Decreasing Data Center Energy Use through Network and Infrastructure Control' is to develop a state of the art approach for autonomously and intelligently reducing and managing data center power through real-time optimal control. Advances in microelectronics and software are enabling the opportunity to realize significant data center power savings through the implementation of autonomous power management control algorithms. The first step to realizing these savings was addressed in this study through the successful creation of a flexible and scalable mathematical model (equation) for data center behavior and the formulation of an acceptable low technical risk market introduction strategy leveraging commercial hardware and software familiar to the data center market. This strategic options report sets out the recommendations of Issue Table members for the management of toxic substances. The introduction includes an industry profile and a review of the provincial management of electric power sector strategic options priority (SOP) substances. Chapter 2 discusses what substances are toxic, estimates releases of SOP substances from the sector, and reviews Issue Table approaches to risk assessment. Chapter 3 outlines Issue Table activities. Chapter 4 screens toxic substance management options, with evaluation of options against 13 groups of criteria.     The Georgia General Assembly passed the Shore Assistance Act in 1979 in order to fill a regulatory gap in the state's management of its coastal resources. A review of its legislative history, purposes, applications, and effects in terms of the sand sharing system of sand dunes, beaches, sandbars, and shoals concludes that the Act is poorly drafted. In its application on the oceanfront, it betrays its intent and protects the oceanfront owner. It has failed to satisfy the requirements of the public trust in the tidal foreshore. Amendments to clarify its understanding of the functions and values of the sand-sharing system should also conform with the state's duties under the public trust. 139 references.

The principal issue at trial was Interior's interpretation of the wilderness study provisions contained in Section 603 of the Act, which directed that activities on oil and gas leases in proposed wilderness areas be managed so as to prevent impairment of wilderness values. The United States Court for the District of Wyoming, Kerr, J., held that strict application of the non-impairment standard of Section 603, FLPMA, by the Department of the Interior virtually halted oil and gas exploration in proposed wilderness areas, and is therefore statutorily erroneous, clearly contrary to Congressional intent, and counter-productive to public interest. The Trial Court's decision is being appealed to the Tenth Circuit Court of Appeals under the title Rocky Mountain Oil and Gas Association v. Watt. 91 references.

    Two laws governing activities in the marine environment are considered in this Reference Book. The Marine Protection, Research, and Sanctuaries Act (MPRSA, P.L. 92-532) regulates ocean dumping of waste, provides for a research program on ocean dumping, and provides for the designation and regulation of marine sanctuaries. The Marine Mammal Protection Act (MMPA, P.L. 92-522) establishes a federal program to protect and manage marine mammals. The Fishery Conservation and Management Act (FCMA, P.L. 94-265) establishes a program to regulate marine fisheries resources and commercial marine fishermen. Because the Department of Energy (DOE) is not engaged in any activities that could be classified as fishing under FCMA, this Act and its regulations have no implications for the DOE; therefore, no further consideration of this Act is given within this Reference Book. The requirements of the MPRSA and the MMPA are discussed in terms of their implications for the DOE.

    A high-current, fast-acting switch is designed for utilization as a crowbar switch in a high-current circuit such as used to generate the magnetic confinement field of a plasma-confining and heat device, e.g., Pyrotron. The device particularly comprises a cylindrical housing containing two stationary, cylindrical contacts between which a movable contact is bridged to close the switch. The movable contact is actuated by a differential-pressure, airdriven piston assembly also within the housing. To absorb the acceleration (and the shock imparted to the device by the rapidly driven, movable contact), an adjustable air buffer assembly is provided, integrally connected to the movable contact and piston assembly. Various safety locks and circuit-synchronizing means are also provided to permit proper cooperation of the invention and the high-current circuit in which it is installed. (AEC)

    This paper explores the nexus between project management and the National Environmental Policy Act (NEPA) activities for developing the Nevada Rail Line to Yucca Mountain. In many federal agencies, the responsibility for project management is completely separate from the responsibility for NEPA implementation; however, each Department of Energy (DOE) Departmental Element has a NEPA Compliance Officer. This ensures effective integration between NEPA and project management activities. As the project management and NEPA activities are implemented, it becomes clear that they are very complimentary processes. This paper will describe the integration of NEPA and project management activities for development of a rail line to the Yucca Mountain geologic repository in Nye County, Nevada. (authors)

    A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    The five acts, i.e. Power Plant and Industrial Fuel Act, Public Utilities Regulatory Policies Act, Natural Gas Policy Act, Energy Tax Act of 1978, and the National Energy Conservation Policy Act, which comprise the National Energy Act (NEA) were signed into law on November 9, 1978. The goal of the five acts is to reduce national dependency on foreign oil. Major portions of the NEA rely on state agencies for implementation. This report examines the statutory authority of those agencies to carry out the NEA mandates: Legislative measures to improve state response to the NEA are also described.

    A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.

    The ACTS Collection is a set of software tools that help developers or programmers write high performance parallel codes for their scientific applications. PyACTS is a Python-based interface to some of the tools in the ACTS Collection. The main purpose of developing PyACTS is to provide a uniform easy-to-use external interface to existing ACTS tools,and support ACTS users to rapidly prototype their codes with the tools. In particular, for users who are new to ACTS, they will find PyACTS helpful to test and try the functionality available in the collection. Further, this training will allow users to acquire the necessary experience to develop their own applications. In the current development phase of PyACTS, part of the ScaLAPACK subroutines are being made available. This report illustrates how we develop the idea of wrapping the ACTS Collection with a high level scripting language, like Python, and a status of the development of the Python front-end interface and future plans.

    The purpose of this memorandum is to emphasize the important role that National Environmental Policy Act (NEPA) Document Managers play in the success of the DOE's NEPA compliance program and to help maximize their effectiveness.

    CH2M HILL Plateau Remediation Company (CH2M HILL) is the U.S. Department of Energy (DOE) prime contractor responsible for the environmental cleanup of the Hanford Site Central Plateau. As part of this responsibility, the CH2M HILL is faced with the task of complying with thousands of environmental requirements which originate from over 200 federal, state, and local laws and regulations, DOE Orders, waste management and effluent discharge permits, Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) response and Resource Conservation and Recovery Act (RCRA) corrective action documents, and official regulatory agency correspondence. The challenge is to manage this vast number of requirements to ensure they are appropriately and effectively integrated into CH2M HILL operations. Ensuring compliance with a large number of environmental requirements relies on an organization’s ability to identify, evaluate, communicate, and verify those requirements. To ensure that compliance is maintained, all changes need to be tracked. The CH2M HILL identified that the existing system used to manage environmental requirements was difficult to maintain and that improvements should be made to increase functionality. CH2M HILL established an environmental requirements management procedure and tools to assure that all environmental requirements are effectively and efficiently managed. Having a complete and accurate set of environmental requirements applicable to CH2M HILL operations will promote a more efficient approach to: • Communicating requirements • Planning work • Maintaining work controls • Maintaining compliance

    The mission of the Uranium Mill Tailings Remedial Action (UMTRA) Project is explicitly stated and directed in the Uranium Mill Tailings Radiation Control Act of 1978, Public Law 95-604, 42 USC 7901 (hereinafter referred to as the Act''). Title I of the Act authorizes the Department of Energy (DOE) to undertake remedial actions at 24 designated inactive uranium processing sites and associated vicinity properties containing uranium mill tailings and other residual radioactive materials derived from the processing sites. The Act, amended in January 1983, by Public Law 97-415, also authorizes DOE to perform remedial actions at vicinity properties in Edgemont, South Dakota. Cleanup of the Edgemont processing site is the responsibility of the Tennessee Valley Authority. This document describes the plan, organization, system, and methodologies used to manage the design, construction, and other activities required to clean up the designated sites and associated vicinity properties in accordance with the Act. The plan describes the objectives of the UMTRA Project, defines participants' roles and responsibilities, outlines the technical approach for accomplishing the objectives, and describes the planning and managerial controls to be used in integrating and performing the Project mission. 21 figs., 21 tabs.

This guidance document informs RCRA permit writers and enforcement officials of procedures to be used in conducting RCRA Facility Assessments. The RCRA corrective-action program was established to investigate and require clean up of releases of hazardous wastes or constituents to the environment at facilities subject to RCRA permits. Releases to ground water, surface water, air, soil, and subsurface strata may be addressed.

    The Genetic Privacy Act is a proposal for federal legislation. The Act is based on the premise that genetic information is different from other types of personal information in ways that require special protection. Therefore, to effectively protect genetic privacy unauthorized collection and analysis of individually identifiable DNA must be prohibited. As a result, the premise of the Act is that no stranger should have or control identifiable DNA samples or genetic information about an individual unless that individual specifically authorizes the collection of DNA samples for the purpose of genetic analysis, authorized the creation of that private information, and has access to and control over the dissemination of that information.

    An overview of the Electric Consumers Protection Act of 1986 identifies it as the most important federal legislation dealing with hydroelectric development standards since the Federal Water Power Act of 1920. The author summarizes its major components, and identifies some of the existing and potential issues relation to its implementation. The most controversial issue is the selection of a new licensee for a project once the original licensee's term has expired. Other issues concern environmental criteria, comprehensive planning, amendments to the Public Utility Regulatory Policies Act, and enforcement procedures. The article concludes with a summary of miscellaneous provisions, including antitrust, modifications and time calculations of projects, wheeling, and other concerns.

    The model offshore wind power legislation focused on two aspects: compensation for use of ocean space and environmental assessment. In particular, the model legislation recommends the adoption of a rent and royalty scheme that is premised on high rent and low royalties in order to stimulate qualified bids from developers who are motivated to begin production as early as possible and to discourage sham bidding. The model legislation also includes a provision that sets royalties at a lower rate in the early years of project operation, and that provides states with the discretion to waive or defer rent and/or royalties for a period of time to meet the goals and objectives of energy independence, job creation, reduced emissions of conventional pollutants and greenhouse gases and increased state requirements for electricity from renewable sources. The environmental impact assessment (EIA) is structured to provide a systematic and interdisciplinary evaluation of the potential positive and negative life-cycle effects of a proposed offshore wind project on the physical, biological, cultural and socio-economic attributes of the project.

In addition, potential safety structures, systems, and components for processes associated with operating TREAT and onsite handling of nuclear fuels and experiments are listed. If this alternative is selected, a safety basis will be prepared in accordance with 10 CFR 830, “Nuclear Safety Management,” Subpart B, “Safety Basis Requirements.”
