    This bill amends the Energy Reorganization Act of 1974 to add a new section 205A that establishes within the Nuclear Regulatory Commission (NRC) a statutory Office of Investigation (OI) and establishes a director of this office who reports directly to the five NRC Commissioners. The new section also sets out the responsibility of the office for initiating and conducting investigations into violations of laws the NRC implements that relate to violations involving wrongdoing. The OI is charged with reporting violations of federal criminal law to the Department of Justice. The Committee on Energy and Commerce considered the bill, report favorably on it without amendment, and recommend its passage by the whole House of Representatives.

    The detection of nuclear or radioactive materials for homeland or national security purposes is inherently difficult. This is one reason detection efforts must be seen as just one part of an overall nuclear defense strategy which includes, inter alia, material security, detection, interdiction, consequence management and recovery. Nevertheless, one could argue that there has been a revolution in detection affairs in the past several decades as the innovative application of new technology has changed the character and conduct of detection operations. This revolution will likely be most effectively reinforced in the coming decades with the networking of detectors and innovative application of anomaly detection algorithms.

    This report presents the findings of a regulatory impact survey of nuclear materials licensees of the United States Nuclear Regulatory Commission (NRC). Commissioners of the NRC directed staff to provide the Commission with first hand information from licensees that could be used to improve the overall regulatory program. A self-administered, mail-out survey questionnaire was used to collect data from a sample of licensees who had interaction with the NRC during the previous 12 months. A total of 371 respondents of the 589 who were sent questionnaires returned completed surveys, for a response rate of 63%. The body of the report presents the findings of the survey including a brief introduction to the approach used, followed by survey findings regarding regulations, policies and regulatory guidance; experience with licensing applications, renewals and amendments; inspections; reporting requirements; and enforcement actions. The appendices of the report include a copy of the survey as administered to licensees, a fuller description of the survey design and data collection methods, and detailed graphic material describing survey responses.

    This report summarizes the occupational exposure data that are maintained in the U.S. Nuclear Regulatory Commission’s (NRC) Radiation Exposure Information and Reporting System (REIRS). The bulk of the information contained in the report was compiled from the 2010 annual reports submitted by five of the seven categories of NRC licensees subject to the reporting requirements of 10 CFR 20.2206. Because there are no geologic repositories for high-level waste currently licensed and no NRC-licensed low-level waste disposal facilities currently in operation, only five categories will be considered in this report. The annual reports submitted by these licensees consist of radiation exposure records for each monitored individual. These records are analyzed for trends and presented in this report in terms of collective dose and the distribution of dose among the monitored individuals. Annual reports for 2010 were received from a total of 190 NRC licensees. The summation of reports submitted by the 190 licensees indicated that 192,424 individuals were monitored, 81,961 of whom received a measurable dose. When adjusted for transient workers who worked at more than one licensee during the year, there were actually 142,471 monitored individuals and 62,782 who received a measurable dose. The collective dose incurred by these individuals was 10,617 person-rem, which represents a 12% decrease from the 2009 value. This decrease was primarily due to the decrease in collective dose at commercial nuclear power reactors, as well as a decrease in the collective dose for most of the other categories of NRC licensees. The number of individuals receiving a measurable dose also decreased, resulting in an average measurable dose of 0.13 rem for 2010. The average measurable dose is defined as the total effective dose equivalent (TEDE) divided by the number of individuals receiving a measurable dose.     This annual report is prepared pursuant to the National Emission Standards for Hazardous Air Pollutants (NESHAPs; Title 40 Code of Federal Regulations [CFR] Part 61, Subpart H). Subpart H governs radionuclide emissions to air from Department of Energy (DOE) facilities. NESHAPs limits the emission of radionuclides to the ambient air from DOE facilities to levels resulting in an annual effective dose equivalent (EDE) of 10 mrem (100 {micro}Sv) to any member of the public. The EDEs for the Lawrence Livermore National Laboratory (LLNL) site-wide maximally exposed members of the public from operations in 2005 are summarized here. Livermore site: 0.0065 mrem (0.065 {micro}Sv) (41% from point source emissions, 59% from diffuse source emissions). The point source emissions include gaseous tritium modeled as tritiated water vapor as directed by EPA Region IX; the resulting dose is used for compliance purposes. Site 300: 0.018 mrem (0.18 {micro}Sv) (48% from point source emissions, 52% from diffuse source emissions). The EDEs were calculated using the EPA-approved CAP88-PC air dispersion/dose-assessment model, except for doses for two diffuse sources that were estimated using measured radionuclide concentrations and dose coefficients. Specific inputs to CAP88-PC for the modeled sources included site-specific meteorological data and source emissions data, the latter variously based on continuous stack effluent monitoring data, stack flow or other release-rate information, ambient air monitoring data, and facility knowledge.

    Over the years, I've daydreamed about stealing a Vermeer, a Picasso, or Rembrandt. It tickles me, as much as watching the reboot of The Thomas Crown Affair. Why is it, do you suppose, so much fun to think about stealing a world renowned piece off the wall of a major metropolitan museum? Is it the romantic thoughts of getting away with it, walking past infrared detectors, and pressure sensors ala Indiana Jones with the sack of sand to remove the idol without triggering the security system? Is it the idea of snatching items with such fantastic prices, where the romance of possessing an item of such value is less intoxicating than selling it to a private collector for it to never be seen again? I suspect others share my daydreams as they watch theater or hear of a brazen daylight heist at museums around the world, or from private collections. Though when reality sets in, the mind of the security professional kicks in. How could one do it, why would one do it, what should you do once it's done? The main issue a thief confronts when acquiring unique goods is how to process or fence them. They become very difficult to sell because they are one-of-a-kind, easy to identify, and could lead to the people involved with the theft. The whole issue of museum security takes up an ironic twist when one considers the secretive British street artist 'Banksy'. Banksy has made a name for himself by brazenly putting up interesting pieces of art in broad daylight (though many critics don't consider his work to be art) on building walls, rooftops, or even museums. I bring him up for a interesting take on what may become a trend in museum security. In March of 2005, Banksy snuck a piece of his called 'Vandalized Oil Painting' into the Brooklyn Museum's Great Historical Painting Wing, plus 3 other pieces into major museums in New York.     The Interstate Oil and Gas Compact Commission (IOGCC) engaged in numerous projects outlined under the scope of work discussed in the United States Department of Energy (DOE) grant number DE-FC26-04NT15456 awarded to the IOGCC. Numerous projects were completed that were extremely valuable to state oil and gas agencies as a result of work performed utilizing resources provided by the grant. There are numerous areas in which state agencies still need assistance. This additional assistance will need to be addressed under future scopes of work submitted annually to DOE's Project Officer for this grant. This report discusses the progress of the projects outlined under the grant scope of work for the 2005-2006 areas of interest, which are as follows: Area of Interest No. 1--Regulatory Streamlining and Improvement: This area of interest continues to support IOGCC's regulatory streamlining efforts that include the identification and elimination of unnecessary duplications of efforts between and among state and federal programs dealing with exploration and production on public lands. Area of Interest No. 2--Technology: This area of interest seeks to improve efficiency in states through the identification of technologies that can reduce costs. Area of Interest No. 3--Training and Education: This area of interest is vital to upgrading the skills of regulators and industry alike. Within the National Energy Policy, there are many appropriate training and education opportunities. Education was strongly endorsed by the President's National Energy Policy Development group. Acting through the governors offices, states are very effective conduits for the dissemination of energy education information. While the IOGCC favors the development of a comprehensive, long-term energy education plan, states are also supportive of immediate action on important concerns, such as energy prices, availability and conservation.     The Joint Center for Information Security Technology (JCIST) at Oak Ridge, Tennessee, under an interagency agreement between the Department of State (DOS) and the Department of Energy (DOE), has been tasked with the security certification testing of the Foreign Affairs Information system (FAIS) Early Operational Capability (EOC) software. The basis for this certification is the FAIS (EOC) Security Requirements Allocation (SRA) document. This document defines the security requirements for the FAIS EOC software. Security certification of the FAIS system is the responsibility of the Office of Information Systems Security, Bureau of Diplomatic Security (DS/ST/ISS). The overall FAIS EOC certification will be completed in two general steps. First, a test of a stand-alone FAIS EOC system against the SRA requirements which is currently in progress. Second is a test of all FAIS network system interfaces against the SRA requirements as expanded to adequately address the network security issues. This accumulation of requirements is referred to as the FAIS EOC Network Security Criteria. 5 refs.

Lightning protection is becoming increasingly important with the advent of digital and low-voltage analog systems in NPPs. These systems have the potential to be more vulnerable than older analog systems to the resulting power surges and electromagnetic interference (EMI) when lightning strikes facilities or power lines. This paper discusses the technical basis for guidance to licensees and applicants covered in Regulatory Guide (RG) 1.204, Guidelines for Lightning Protection of Nuclear Power Plants, issued August 2005. RG 1.204 describes guidance for practices that are acceptable to the NRC staff for protecting nuclear power structures and systems from direct lightning strikes and the resulting secondary effects.     DOE`s Office of Technology Development manages an aggressive national program for applied research, development, demonstration, testing, and evaluation. This program develops high, payoff technologies to clean up the inventory of DOE nuclear component manufacturing sites and to manage DOE-generated waste faster, safer, and cheaper than current environmental cleanup technologies. OTD programs are designed to make new, innovative, and more effective technologies available for transfer to users through progressive development. Projects are demonstrated, tested, and evaluated to produce solutions to current problems. Transition of technologies into more advanced stages of development is based upon technological, regulatory, economic, and institutional criteria. New technologies are made available for use in eliminating radioactive, hazardous, and other wastes in compliance with regulatory mandates. The primary goal is to protect human health and prevent further contamination. OTD technologies address three specific problem areas: (1) groundwater and soils cleanup; (2) waste retrieval and processing; and (3) pollution prevention.

    This document has been prepared by the Department of Energy`s (DOE) Environmental Management (EM) Office of Technology Development (OTD) in order to highlight research, development, demonstration, testing, and evaluation (RDDT&E) activities funded through the Idaho Operations Office. Technologies and processes described have the potential to enhance DOE`s cleanup and waste management efforts, as well as improve US industry`s competitiveness in global environmental markets. OTD programs are designed to make new, innovative, and more cost-effective technologies available for transfer to DOE environmental restoration and waste management end-users. Projects are demonstrated, tested, and evaluated to produce solutions to current problems. Transition of technologies into more advanced stages of development is based upon technological, regulatory, economic, and institutional criteria. New technologies are made available for use in eliminating radioactive, hazardous, and other wastes in compliance with regulatory mandates. The primary goal is to protect human health and prevent further contamination. OTD`s technology development programs address three major problem areas: (1) groundwater and soils cleanup; (2) waste retrieval and processing; and (3) pollution prevention. These problems are not unique to DOE, but are associated with other Federal agency and industry sites as well. Thus, technical solutions developed within OTD programs will benefit DOE, and should have direct applications in outside markets.

    The results of a commerical office photoelectrically controlled, dimmable lighting demonstration in New York City have shown that daylighting can be used to conserve energy and limit peak electrical demand.     A review was performed for the Office of Standards Development, NRC, of Title 10 of the Code of Federal Regulations (CFR) and NRC Regulatory Guides. This review was to determine to what extent these portions of the NRC regulatory base would have to be changed to include degraded core accidents in the licensing process. The review focused on 10 CFR Parts 50, 55, and 100, and the Division 1 Regulatory Guides, although other sections of these documents also were examined. This study identifies those changes that could be mandated due to the direct conflict of existing regulations with the concept of a degraded core rule or with its basis.

Approximately thirty-eight people attended the meeting, including representatives of ten different tribes, as well as representatives of the Colorado Indian Tribes, the All Indian Pueblo Council and the Inter-Tribal Council of Arizona.
