Volume 3 contains copies of two reports that document the DOE/ORO regulatory oversight inspection and enforcement history for each gaseous diffusion plant site. Each report provides a formal mechanism by which DOE/ORO could communicate the inspection and enforcement history to NRC. The reports encompass the inspection activities that occurred during July 1, 1993 through March 2, 1997.

    On July 1, 1993, a Regulatory Oversight (RO) organization was established within the United States Department of Energy (DOE), Oak Ridge Operations (ORO) to provide regulatory oversight of the DOE uranium enrichment facilities leased to the United States Enrichment Corporation (USEC). The purpose of the RO program was to ensure continued plant safety, safeguards and security while the Paducah and Portsmouth gaseous diffusion plants (GDPs) transitioned to regulatory oversight by the Nuclear Regulatory Commission (NRC). These activities were performed under the authority of the lease agreement between DOE and USEC until NRC issued a Certificate of Compliance or approved a Compliance Plan pursuant to Section 1701 of the Atomic Energy Act of 1954, as amended, and assumed regulatory responsibility. This report chronicles the formal development, operation and key activities of the RO organization from its beginning in July 1993, until the turnover of the regulatory oversight responsibility to the NRC on March 3, 1997. Through its evolution to closure, the RO program was a formal, proceduralized effort designed to provide consistent regulation and to facilitate transition to NRC. The RO Program was also a first-of-a-kind program for DOE. The process, experience, and lessons learned summarized herein should be useful as a model for transition of other DOE facilities to privatization or external regulation.

  3. Independent oversight review of the Department of Energy Quality Assurance Program for suspect/counterfeit parts. Revision 1

    To address the potential threat that suspect/counterfeit parts could pose to DOE workers and the public, the Office of the Deputy Assistant Secretary for Oversight initiated a number of activities beginning in mid-1995. Oversight placed increased emphasis on the field`s quality assurance-suspect/counterfeit parts programs during safety management evaluations, in keeping with the Office of Environment, Safety and Health (EH) oversight responsibilities, which include oversight of the Department`s quality assurance (QA) programs. In addition, Oversight reviewed relevant policy documents and occurrence reports to determine the nature and magnitude of the problem within the Department. The results of that review, contained in an Office of Oversight report, Independent Oversight Analysis of Suspect/Counterfeit Parts Within the Department of Energy (November 1995), indicate a lack of consistency and comprehensiveness in the Department`s QA-suspect/counterfeit parts program. A detailed analysis of the causes and impacts of the problem was recommended. In response, this review was initiated to determine the effectiveness of the Department`s QA program for suspect/counterfeit parts. This study goes beyond merely assessing and reporting the status of the program, however. It is the authors intention to highlight the complex issues associated with suspect/counterfeit parts in the Department today and to present approaches that DOE managers might consider to address these issues.

    The Expert Panel Oversight Committee (EPOC) has been overseeing the implementation of selected parts of Recommendation III of the final report, Expert Panel workshop for Hanford Site Double-Shell Tank Waste Chemistry Optimization, RPP-RPT-22126. Recommendation III provided four specific requirements necessary for Panel approval of a proposal to revise the chemistry control limits for the Double-Shell Tanks (DSTs). One of the more significant requirements was successful performance of an accelerated stress corrosion cracking (SCC) experimental program. This testing program has evaluated the optimization of the chemistry controls to prevent corrosion in the interstitial liquid and supernatant regions of the DSTs.

    The purpose of this document is to identify and describe the duties and responsibilities of Facility Security and Safeguards (FSS) Safeguards and Security (SS) organizations (groups/offices) with oversight functions over the Protection Force (PF) subcontractor. Responsible organizations will continue their present PF oversight functions under the Cost Plus Award Fee (CPAF) assessment, but now will be required to also coordinate, integrate, and interface with other FSS S and S organizations and with the PF subcontractor to measure performance, assess Department of Energy (DOE) compliance, reduce costs, and minimize duplication of effort. The role of the PF subcontractor is to provide the Laboratory with effective and efficient protective force services. PF services include providing protection for the special nuclear material, government property and classified or sensitive information developed and/or consigned to the Laboratory, as well as protection for personnel who work or participate in laboratory activities. FSS S and S oversight of both performance and compliance standards/metrics is essential for these PF objectives to be met.

    A five-line (23 mile) reflection- seismic survey was conducted at the Hot Pot geothermal prospect area in north-central Nevada under the USDOE (United States Department of Energy) Geothermal Technologies Program. The project objective was to utilize innovative seismic data processing, integrated with existing geological, geophysical and geochemical information, to identify high-potential drilling targets and to reduce drilling risk. Data acquisition and interpretation took place between October 2010 and April 2011. The first round of data processing resulted in large areas of relatively poor data, and obvious reflectors known from existing subsurface information either did not appear on the seismic profiles or appeared at the wrong depth. To resolve these issues, the velocity model was adjusted to include geologic input, and the lines were reprocessed. The resulting products were significantly improved, and additional detail was recovered within the high-velocity and in part acoustically isotropic basement. Features visible on the improved seismic images include interpreted low angle thrust faults within the Paleozoic Valmy Formation, which potentially are reactivated in the current stress field. Intermediate-depth wells are currently targeted to test these features. The seismic images also suggest the existence of Paleogene sedimentary and volcanic rocks which potentially may function as a near- surface reservoir, charged by deeper structures in Paleozoic rocks.

    A trio of tenets state regulators can use to maximize benefits from natural gas and emission allowance markets. A dramatic change has occurred in recent years in the role markets and competition play in achieving the nation's economic policy objectives. In regulating sectors as diverse as telecommunications and natural gas pipelines, change has taken the form of deregulation, service unbundling, and increased reliance on markets and competition to determine prices and industry structure. In environmental regulation, passage of the Clean Air Act Amendments of 1990 was a major step toward implementing economic incentive-based approaches to control environmental externalities through a system of tradable emission allowances. Public utility commissions governing local utilities are finding that unleased markets are remarkably fluid and complicated. With so many new options and players to content with, state policymakers are struggling with big questions: How do they fulfill their mandated obligations to ensure that local utilities are behaving prudently and providing gas and electricity under just and reasonable terms How do they ensure that utilities buying major inputs in newly created, or at least newly freed, markets act in the best interest of ratepayers This article describes the elements of state regulatory oversight of local distribution companies and electric utilities that rely on competition and appropriate incentives.

    The FCC-ee aims to improve on electroweak precision measurements, with goals of 100 ke V on the Z mass and width, and a fraction of MeV on the W mass. Compared to LEP, this implies a much improved knowledge of the center-of-mass energy when operating at the Z peak and WW threshold. This can be achieved by making systematic use of resonant depolarization. A number of issues have been identified, due in particular to the long polarization times. However the smaller emittance and energy spread of FCC-ee with respect to LEP should help achieve a much improved performance.

    In October of 1990, the New Mexico Environment Department entered into an agreement with the US Department of Energy (DOE) to create the Department of Energy Oversight and Monitoring Program. This program is designed to create an avenue for the State to ensure DOE facilities are in compliance with applicable environmental regulations, to allow the State oversight and monitoring independent of the DOE, to allow the State valuable input into remediation decision making, and to protect the environment and the public health and safety of New Mexicans concerning DOE facility activities. This agreement, called the Agreement in Principle (AIP), includes all four of New Mexico`s DOE facilities: Los Alamos National Laboratory in Los Alamos; Sandia National Laboratories and the Inhalation Toxicology Research Institute on Kirtland Air Force Base in Albuquerque; and the Waste Isolation Pilot Plant near Carlsbad.

    In October 1990 an Agreement-in-Principle (AIP) was entered into between the US Department of Energy (DOE) and the State of New Mexico for the purpose of supporting State oversight activities at DOE facilities in New Mexico. The State`s lead agency for the Agreement is the New Mexico Environment Department (NMED). DOE has agreed to provide the State with resources over a five year period to support State activities in environmental oversight, monitoring, access and emergency response to ensure compliance with applicable federal, state, and local laws at Los Alamos National Laboratory (LANL), Sandia National Laboratories (SNL), the Waste Isolation Pilot Plant (WIPP), and the Inhalation Toxicology Research Institute (ITRI). The Agreement is designed to assure the citizens of New Mexico that public health, safety and the environment are being protected through existing programs; DOE is in compliance with applicable laws and regulations; DOE has made substantial new commitments; cleanup and compliance activities have been prioritized; and a vigorous program of independent monitoring and oversight by the State is underway. This report relates the quality and effectiveness of the facilities` environmental monitoring and surveillance programs. This report satisfies that requirement for the January--December 1992 time frame.

    Wind has provided energy for thousands of years: some of the earliest windmill engineering designs date back to ancient Babylonia and India where wind would be used as a source of irrigation. Today, wind is the quickest growing resource in Americas expanding energy infrastructure. However, to continue to positively diversify Americas energy portfolio and further reduce the countrys reliance of foreign oil, the industry must grow substantially over the next two decades in both turbine installations and skilled industrial manpower to support. The wind sector is still an emergent industry requiring maturation and development of its labor force: dedicated training is needed to provide the hard and soft skills to support the increasingly complex wind turbine generators as the technology evolves. Furthermore, the American workforce is facing a steep decline in available labor resources as the baby boomer generation enters retirement age. It is therefore vital that a process is quickly created for supporting the next generation of wind technicians. However, the manpower growth must incorporate three key components. First, the safety and technical training curriculum must be standardized across the industry - current wind educational programs are disparate and dedicated standardization programs must be further refined and implemented. Second, it is essential that the wind sector avoid disrupting other energy production industries by cannibalizing workers, which would indirectly affect the rest of Americas energy portfolio. The future wind workforce must be created organically utilizing either young people entering the workforce or train personnel emerging from careers outside of energy production. Third, the training must be quick and efficient as large amounts of wind turbines are being erected each year and this growth is expected to continue until at least 2035.     The Defense Nuclear Facilities Safety Board (Board) is an independent federal agency established by Congress in 1988 to provide nuclear safety oversight of activities at U.S. Department of Energy (DOE) defense nuclear facilities. The activities under the Board's jurisdiction include the design, construction, startup, operation, and decommissioning of defense nuclear facilities at DOE sites. This paper reviews the Board's safety oversight of decommissioning activities at DOE sites, identifies the safety problems observed, and discusses Board initiatives to improve the safety of decommissioning activities at DOE sites. The decommissioning of former defense nuclear facilities has reduced the risk of radioactive material contamination and exposure to the public and site workers. In general, efforts to perform decommissioning work at DOE defense nuclear sites have been successful, and contractors performing decommissioning work have a good safety record. Decommissioning activities have recently been completed at sites identified for closure, including the Rocky Flats Environmental Technology Site, the Fernald Closure Project, and the Miamisburg Closure Project (the Mound site). The Rocky Flats and Fernald sites, which produced plutonium parts and uranium materials for defense needs (respectively), have been turned into wildlife refuges. The Mound site, which performed R and D activities on nuclear materials, has been converted into an industrial and technology park called the Mound Advanced Technology Center. The DOE Office of Legacy Management is responsible for the long term stewardship of these former EM sites. The Board has reviewed many decommissioning activities, and noted that there are valuable lessons learned that can benefit both DOE and the contractor. As part of its ongoing safety oversight responsibilities, the Board and its staff will continue to review the safety of DOE and contractor decommissioning activities at DOE defense nuclear sites.

    This report summarizes a study and corresponding model development conducted in support of the United States Pacific Command (USPACOM) as part of the Federal Energy Management Program (FEMP) American Reinvestment and Recovery Act (ARRA). This research was aimed at developing a mathematical programming framework and accompanying optimization methodology in order to simultaneously evaluate energy efficiency (EE) and renewable energy (RE) opportunities. Once developed, this research then demonstrated this methodology at a USPACOM installation - Camp H.M. Smith, Hawaii. We believe this is the first time such an integrated, joint EE and RE optimization methodology has been constructed and demonstrated.

    In this program, we are developing next-generation SOFC materials and architectures for use with biomass-derived fuel streams, with a focus on addressing the technical challenges and the required operating windows associated with carbon-deposit formation. We are developing fuel-processing strategies for processing landfill- and anaerobic-digester-derived biomass streams for use in SOFCs. Similarly, we are examining processing of biomass-derived liquid fuels for use in solid-oxide fuel cell systems. We conduct extensive computational modeling work to support the materials-development and fuel-processing tasks. Modeling is conducted across a broad range of length scales, from the microscopic level to examine the fundamental underpinnings of cell operation, to the mesoscopic level to examine and optimize fuel-reformer design, and to the system level to craft optimal integration and dynamic-control solutions.

    The Exxon Valdez spill abruptly brought to the nation's attention the risks of transporting crude oil. While oil tanker transportation received many of the headlines, the safety of pipelines carrying oil and the terminals that store it have also been called into question. GAO testified on the adequacy of regulatory oversight of the 800-mile Trans-Alaska Pipeline System and the terminal at Valdez, Alaska. This paper reports increased and coordinated regulatory oversight as a major component of an effective operational and emergency response strategy for the pipeline. The current lack of comprehensive and systematic oversight is of particular concern because of recent revelations of significant corrosion problems in the pipeline.

    Motivated by the possibility that the amplitude for neutrinoless double beta decay may be much smaller than the planned sensitivity of future experiments, we study Ansaetze for the neutrino mass matrix with M{sub ee}=0. For the case in which CP is conserved, we consider two classes of real-valued mass matrices: ''Class I'' defined by |M{sub e{mu}|}=|M{sub e{tau}|}, and ''Class II'' defined by |M{sub {mu}{mu}|}=|M{sub {tau}{tau}|}. The important phenomenological distinction between the two is that Class I permits only small values of V{sub e3} up to {approx}0.03, while Class II admits large values of V{sub e3} up to its empirical upper limit of 0.22. Then we introduce CP-violating complex phases into the mass matrix. We show that it is possible to have tribimaximal mixing with M{sub ee}=0 and |M{sub {mu}{tau}|}=|M{sub {mu}{mu}|}=|M{sub {tau}{tau}|} if the Majorana phase angles are {+-}{pi}/4. Alternatively, for smaller values of |M{sub {mu}{tau}|}=|M{sub {mu}{mu}|}=|M{sub {tau}{tau}|} it is possible to obtain |V{sub e3}|{approx}0.2 and generate relatively large CP-violating amplitudes. To eliminate phase redundancy, we emphasize rephasing any mass matrix with M{sub ee}=0 into a standard form with two complex phases. The discussion alternates between analytical and numerical but remains purely phenomenological, without any attempt to derive mass matrices from a fundamental theory.

The report focuses in particular on Higgs-boson, top-quark and electroweak precision physics, but also discusses several models of beyond the standard model physics such as supersymmetry, little Higgs models and extra gauge bosons. The connection to cosmology has been analysed as well.

    Measurements of air showers made using the hybrid technique developed with the fluorescence and surface detectors of the Pierre Auger Observatory allow a sensitive search for point sources of EeV photons anywhere in the exposed sky. A multivariate analysis reduces the background of hadronic cosmic rays. The search is sensitive to a declination band from –85° to +20°, in an energy range from 10{sup 17.3} eV to 10{sup 18.5} eV. No photon point source has been detected. An upper limit on the photon flux has been derived for every direction. The mean value of the energy flux limit that results from this, assuming a photon spectral index of –2, is 0.06 eV cm{sup –2} s{sup –1}, and no celestial direction exceeds 0.25 eV cm{sup –2} s{sup –1}. These upper limits constrain scenarios in which EeV cosmic ray protons are emitted by non-transient sources in the Galaxy.

    This report presents the results of a preliminary review of chemical safety within the Department of Energy (DOE). The review was conducted by Chemical Safety Oversight Review (CSOR) Teams composed of Office of Environment, Safety and Health (EH) staff members and contractors. The primary objective of the CSOR was to assess, the safety status of DOE chemical operations and identify any significant deficiencies associated with such operations. Significant was defined as any situation posing unacceptable risk, that is, imminent danger or threat to workers, co-located workers, the general public, or the environment, that requires prompt action by EH or the line organizations. A secondary objective of the CSOR was to gather and analyze technical and programmatic information related to chemical safety to be used in conjunction with the longer-range EH Workplace Chemical Accident Risk Review (WCARR) Program. The WCARR Program is part of the ongoing EH oversight of nonnuclear safety at all DOE facilities. `` The program objective is to analyze DOE and industry chemical safety programs and performance and determine the need for additional or improved safety guidance for DOE. During the period June 6, 1992, through July 31, 1992, EH conducted CSORs at five DOE sites. The sites visited were Los Alamos National Laboratory (LANL), Savannah River Site (SRS), the Y-12 Plant (Y-12), Oak Ridge National Laboratory (ORNL), and Lawrence Livermore National Laboratory (LLNL).

    A thorough search of the sky exposed at the Pierre Auger Cosmic Ray Observatory reveals no statistically significant excess of events in any small solid angle that would be indicative of a flux of neutral particles from a discrete source. The search covers from -90 Degree-Sign to +15 Degree-Sign in declination using four different energy ranges above 1 EeV (10{sup 18} eV). The method used in this search is more sensitive to neutrons than to photons. The upper limit on a neutron flux is derived for a dense grid of directions for each of the four energy ranges. These results constrain scenarios for the production of ultrahigh energy cosmic rays in the Galaxy.

    Under the authorization provided by Section 634 of the Energy Independence and Security Act of 2007 (P.L. 110-140), in 2009 FAU was awarded U.S. Congressionally Directed Program (CDP) funding through the U.S. Department of Energy (DOE) to investigate and develop technologies to harness the energy of the Florida Current as a source of clean, renewable, base-load power for Florida and the U.S. A second CDP award in 2010 provided additional funding in order to enhance and extend FAU’s activities. These two CDPs in 2009 and 2010 were combined into a single DOE grant, DE-EE0000319, and are the subject of this report. Subsequently, in July 2010 funding was made available under a separate contract, DE-EE0004200. Under that funding, DOE’s Wind and Water Power Program designated FAU’s state of Florida marine renewable energy (MRE) center as the Southeast National Marine Renewable Energy Center (SNMREC). This report discusses SNMREC activities funded by the DE-EE0000319 grant, but will make reference, as appropriate, to activities that require further investigation under the follow-on grant. The concept of extracting energy from the motions of the oceans has a long history. However, implementation on large scales of the technologies to effect renewable energy recovery from waves, tides, and open-ocean currents is relatively recent. DOE’s establishment of SNMREC recognizes a significant potential for ocean current energy recovery associated with the (relatively) high-speed Florida Current, the reach of the Gulf Stream System flowing through the Straits of Florida, between the Florida Peninsula and the Bahamas Archipelago. The proximity of the very large electrical load center of southeast Florida’s metropolitan area to the resource itself makes this potential all the more attractive.     Test Area North (TAN) -607, the Technical Support Facility, is located at the north end of the Idaho National Laboratory (INL) Site. U.S. Department of Energy Idaho Operations Office (DOE-ID) is proposing to decommission the northern section of the TAN-607 facility, hereinafter referred to as TAN-607 Hot Shop Area, under a Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) non-time-critical removal action (NTCRA). Despite significant efforts by the United States (U.S.) Department of Energy (DOE) to secure new business, no future mission has been identified for the TAN-607 Hot Shop Area. Its disposition has been agreed to by the Idaho State Historical Preservation Office documented in the Memorandum of Agreement signed October 2005 and it is therefore considered a surplus facility. A key element in DOE's strategy for surplus facilities is decommissioning to the maximum extent possible to ensure risk and building footprint reduction and thereby eliminating operations and maintenance cost. In addition, the DOE's 2006 Strategic Plan is ''complete cleanup of the contaminated nuclear weapons manufacturing and testing sites across the United States. DOE is responsible for the risk reduction and cleanup of the environmental legacy of the Nation's nuclear weapons program, one of the largest, most diverse, and technically complex environmental programs in the world. Once a state's plan is approved, the Federal role becomes one of oversight. This hearing examines Pennsylvania's programs and what happens when there is a disagreement between state and Federal authorities.     The Lawrence Berkeley National Laboratory (LBNL) Issues Management Program encompasses the continuous monitoring of work programs, performance and safety to promptly identify issues to determine their risk and significance, their causes, and to identify and effectively implement corrective actions to ensure successful resolution and prevent the same or similar problems from occurring. This document describes the LBNL Issues Management Program and prescribes the process for issues identification, tracking, resolution, closure, validation, and effectiveness of corrective actions. Issues that are governed by this program include program and performance deficiencies or nonconformances that may be identified through employee discovery, internal or external oversight assessment findings, suggested process improvements and associated actions that require formal corrective action. Issues may also be identified in and/or may result in Root Cause Analysis (RCA) reports, Price Anderson Amendment Act (PAAA) reports, Occurrence Reporting and Processing System (ORPS) reports, Accident Investigation reports, assessment reports, and External Oversight reports. The scope of these issues may include issues of both high and low significance as well as adverse conditions that meet the reporting requirements of the University of California (UC) Assurance Plan for LBNL or other reporting entities (e.g., U.S. Environmental Protection Agency, U.S. Department of Energy). Issues that are found as a result of a walk-around or workspace inspection that can be immediately corrected or fixed are exempt from the requirements of this document.

    This document provides a writeup of all contributions to the workshop on "High precision measurements of $\\alpha_s$: From LHC to FCC-ee" held at CERN, Oct. 12--13, 2015. The workshop explored in depth the latest developments on the determination of the QCD coupling $\\alpha_s$ from 15 methods where high precision measurements are (or will be) available. Those include low-energy observables: (i) lattice QCD, (ii) pion decay factor, (iii) quarkonia and (iv) $\\tau$ decays, (v) soft parton-to-hadron fragmentation functions, as well as high-energy observables: (vi) global fits of parton distribution functions, (vii) hard parton-to-hadron fragmentation functions, (viii) jets in $e^\\pm$p DIS and $\\gamma$-p photoproduction, (ix) photon structure function in $\\gamma$-$\\gamma$, (x) event shapes and (xi) jet cross sections in $e^+e^-$ collisions, (xii) W boson and (xiii) Z boson decays, and (xiv) jets and (xv) top-quark cross sections in proton-(anti)proton collisions. The current status of the theoretical and experimental uncertainties associated to each extraction method, the improvements expected from LHC data in the coming years, and future perspectives achievable in $e^+e^-$ collisions at the Future Circular Collider (FCC-ee) with $\\cal{O}$(1--100 ab$^{-1}$) integrated luminosities yielding 10$^{12}$ Z bosons and jets, and 10$^{8}$ W bosons and $\\tau$ leptons, are thoroughly reviewed. The current uncertainty of the (preliminary) 2015 strong coupling world-average value, $\\alpha_s(m_Z)$ = 0.1177 $\\pm$ 0.0013, is about 1\\%. Some participants believed this may be reduced by a factor of three in the near future by including novel high-precision observables, although this opinion was not universally shared. At the FCC-ee facility, a factor of ten reduction in the $\\alpha_s$ uncertainty should be possible, mostly thanks to the huge Z and W data samples available.

    At the time of LTC’s application we were home to a small / mid-sized Wind Energy Research and Teaching Center, funded in part by We Energies, and offered the state of Wisconsin’s first Associate of Applied Science (A.A.S.) Degree in Wind Energy Technology. With President Obama promising investment in wind, LTC and its partners were uniquely situated to meet the challenge through an organized career pathways approach that utilized industry drivers and occupationally verified curriculum to train the workers who “transform our energy sector.” LTC’s employer partners validated the findings of the “20% Wind Energy by 2030: Increasing Wind Energy's Contribution to U.S. Electricity Supply” report by the US Department of Energy which recognized programs like LTC’s as an “excellent beginning,” noting that many more like them are necessary to meet the challenges of the 20% Wind scenario.One of the focuses of the study was the lack of trained technicians to work on installation and maintenance of renewables (and more specifically for our grant application wind turbines). LTC’s goal, made possible with the funding provided in this grant, was to increase the number of skilled graduates to help meet this national objective. LTC was already a leader in wind for the state of Wisconsin but wanted to upscale from a single school to a statewide (and potentially regional) center for wind energy. LTC planned to leverage our facilities, curriculum, and faculty expertise to meet this goal.

This procedure sets forth the requirements for management determination and the selection of RCA methods and implementation of RCAs that are a result of significant findings from Price-Anderson Amendments Act (PAAA) violations, occurrences/events, Significant Adverse Conditions, and external oversight Corrective Action Requests (CARs) generated by the Office of Enforcement (PAAA headquarters), the U.S. Environmental Protection Agency, and other oversight entities against Lawrence Berkeley National Laboratory (LBNL). Performance of an RCA may result in the identification of issues that should be reported in accordance with the Issues Management Program Manual.

    As Canada's nuclear regulator, the Canadian Nuclear Safety Commission (CNSC) is responsible for licensing all aspects of uranium mining, including remediation activities at legacy sites. Since these sites already existed when the current legislation came into force in 2000, and the previous legislation did not apply, they present a special case. The Nuclear Safety and Control Act (NSCA), was written with cradle-to- grave oversight in mind. Applying the NSCA at the end of a 'facilities' life-cycle poses some challenges to both the regulator and the proponent. When the proponent is the public sector, even more challenges can present themselves. Although the licensing process for legacy sites is no different than for any other CNSC license, assuring regulatory compliance can be more complicated. To demonstrate how the CNSC has approached the oversight of legacy sites the history of the Commission's involvement with the Gunnar uranium mine and mill site provides a good case study. The lessons learned from the CNSC's experience regulating the Gunnar site will benefit those in the future who will need to regulate legacy sites under existing or new legislation. (authors)

    Data from the Pierre Auger Observatory are analyzed to search for anisotropies near the direction of the Galactic Centre at EeV energies. The exposure of the surface array in this part of the sky is already significantly larger than that of the fore-runner experiments. Our results do not support previous findings of localized excesses in the AGASA and SUGAR data. We set an upper bound on a point-like flux of cosmic rays arriving from the Galactic Centre which excludes several scenarios predicting sources of EeV neutrons from Sagittarius A. Also the events detected simultaneously by the surface and fluorescence detectors (the ''hybrid'' data set), which have better pointing accuracy but are less numerous than those of the surface array alone, do not show any significant localized excess from this direction.

    The 1977 Surface Mining Control and Reclamation Act (SMCRA) requires mine operators to post reclamation bonds before mining begins. The Federal Office of Surface Mining Reclamation and Enforcement (OSMRE) has approved alternative bond systems in seven states. These systems, rather than requiring bond amounts at the full cost of reclamation, require operators to submit only a flat rate, acreage specific bond. Additional reclamation costs should be covered by a supplemental fund composed generally of permit fees, taxes, or penalties. In many cases, alternative bond systems fail to ensure that funds will be available to reclaim coal mined land in the event of operator default, as required by SMCRA. OSMRE needs to take a more active role in oversight of existing state alternative bond systems to ensure that reclamation occurs.

    This deep drilling activity is one element of the Pen Branch Fault Program at Savannah River Site (SRS). The effort will consist of three tasks: the extension of wells PBF-7 and PBF-8 into crystalline basement, geologic and drilling oversight during drilling operations, and the lithologic description and analysis of the recovered core. The drilling program addresses the association of the Pen Branch fault with order fault systems such as the fault that formed the Bunbarton basin in the Triassic.

    Here, we study angular observables in themore » $$ {e}^{+}{e}^{-}\\to ZH\\to {\\ell}^{+}{\\ell}^{-}b\\overline{b} $$ channel at future circular e$$^{+}$$ e$$^{-}$$ colliders such as CEPC and FCC-ee. Taking into account the impact of realistic cut acceptance and detector effects, we forecast the precision of six angular asymmetries at CEPC (FCC-ee) with center-of-mass energy $$ \\sqrt{s}=240 $$ GeV and 5 (30) ab$$^{-1}$$ integrated luminosity. We then determine the projected sensitivity to a range of operators relevant for he Higgs-strahlung process in the dimension-6 Higgs EFT. Our results show that angular observables provide complementary sensitivity to rate measurements when constraining various tensor structures arising from new physics. We further find that angular asymmetries provide a novel means of both probing BSM corrections to the HZγ coupling and constraining the “blind spot” in indirect limits on supersymmetric scalar top partners.« less

    The introduction of retail wheeling is changing the roles of regulators and the courts. When states unbundle the vertically integrated investor-owned utility (IOU) into generation companies, transmission companies, and distribution companies, antitrust enforcement and policy setting by the state public utility/service commissions (PUCs) will be paramount. As was seen in the deregulation of the airline industry, vigorous enforcement of antitrust laws by the courts and proper policy setting by the regulators are the keys to a successful competitive market. Many of the problems raised in the airline deregulation movement came about due to laxity in correcting clear antitrust violations and anti-competitive conditions before they caused damage to the market. As retail wheeling rolls out, it is critical for state PUCs to become attuned to these issues and, most of all, to have staff trained in these disciplines. The advent of retail wheeling changes the application of the State Action Doctrine and, in turn, may dramatically alter the role of the state PUC--meaning antitrust law and regulatory oversight must step in to protect competitors and consumers from monopolistic abuse.
