The policy goal is an adequate supply of energy at reasonable costs. Strategies include minimizing federal control and involvement in energy markets while maintaining public health and safety and environmental quality and promoting a balanced and mixed energy resource system. Federal programs and actions in energy are reviewed.

    One of the dangers in policy debates, especially those involving many complex and interrelated subjects, is that the debate will plunge into the depths of details to the exclusion of firmly establishing overarching logic and principles. Sometimes this is because it is extremely difficult for the human brain simultaneously to think of many things at many levels. Sometimes it is because that central logic is forgotten along the way or, worse, never in place to begin with. The policy debate on electricity industry restructuring is no exception. This danger of concentrating on the details and obscuring the central principles permeates the wide-ranging restructuring debates, and certainly has contaminated questions about the subissue of the Public Utility Holding Company Act (PUHCA).

    Titles I and III of the Public Utility Regulatory Policies Act of 1978 (PURPA) establish retail regulatory policies for electric and natural gas utilities, respectively, aimed at achieving three purposes: conservation of energy supplied by electric and gas utilities; efficiency in the use of facilities and resources by these utilities; equitable rates to electricity and natural gas consumers. PURPA also continues the pilot utility implementation program, authorized under Title II of the Energy Conservation and Production ACT (ECPA), to encourage adoption of cost-based rates and efficient energy-management practices. The purpose of this report is twofold: (1) to summarize and analyze the progress that state regulatory authorities and certain nonregulated utilities have made in their consideration of the PURPA standards; and (2) to summarize the Department of Energy (DOE) activities relating to PURPA and ECPA. The report provides a broad overview and assessment of the status of electric and gas regulation nationwide, and thus helps provide the basis for congressional and DOE actions targeted on the utility industry to address pressing national energy problems.

    The report concludes that, to effectively deal with our national energy problems, gas rate structures should be designed to reflect the costs which the nation avoids if gas is efficiently used and substituted for oil. Current pipeline and distribution company rate structures generally do not meet this test. Although gas is a substitute for oil in many applications, and conserved gas can reduce oil imports, gas rate structures often fail to convey to consumers the fact that, from a national perspective, gas is as valuable as oil. The provisions of the Natural Gas Policy Act of 1978 (NGPA) take a strong first step in correcting these problems. But, as clearly recognized in both NGPA and PURPA, these provisions need to be supplemented by updating pipeline and distribution company rate designs to address the problems of the 1980's - rather than the problems of the 1950's. In this regard, NGPA mandates incremental pricing, which raises the average price of gas to certain industrial users only. The Department of Energy (DOE) study suggests an alternate approach: pipeline and distribution rate structures that reflect in their tailblocks, for all customer classes, the economic costs of gas usage. Such rates would convey to all users the costs incurred by the nation as a consequence of their decisions to use or conserve gas. Such rate structures should promote the three purposes of PURPA - end-use conservation, efficient use of utility resources, and equitable rates - to a greater extent than do traditional accounting cost rate designs, which reflect decisions made in the distant past.

    First, the comments on May 3, 1979 Notice of Inquiry of DOE relating to the Gas Utility Rate Design Study Required by Section 306 of PURPA are presented. Then, comments on the following are included: (1) ICF Gas Utility Model, Gas Utility Model Data Outputs, Scenario Design; (2) Interim Model Development Report with Example Case Illustrations; (3) Interim Report on Simulation of Seven Rate Forms; (4) Methodology for Assessing the Impacts of Alternative Rate Designs on Industrial Energy Use; (5) Simulation of Marginal-Cost-Based Natural Gas Rates; and (6) Preliminary Discussion Draft of the Gas Rate Design Study. Among the most frequent comments expressed were the following: (a) the public should be given the opportunity to review the final report prior to its submission to Congress; (b) results based on a single computer model of only four hypothetical utility situations cannot be used for policy-making purposes for individual companies or the entire gas industry; (c) there has been an unobjective treatment of traditional and economic cost rate structures; the practical difficulties and potential detrimental consequences of economic cost rates are not fully disclosed; and (d) it is erroneous to assume that end users, particularly residential customers, are influenced by price signals in the rate structure, as opposed to the total bill.

    An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies.     In February of 1980 the Federal Energy Regulatory Commission (FERC) promulgated a set of rules that were to commence the implementation process of Section 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). Of particular interest to economists are the pricing provisions in the rules that pertain to integrating dispersed sources of electric power generation into conventional electric utility systems. The full avoided cost pricing provision couples a utility mandate to purchase power from qualified dispersed facilities (cogenerators, wind power, small hydro facilities, etc., hereafter denoted QFs) with the requirement that the price the utility pays for such purchases be equal to the full extent of the cost it avoids by not generating the power itself. The simultaneous purchase and sale billing scheme requires a utility to purchase the gross power output of a QF at the full avoided cost rate and simultaneously sell back to the QF its power requirement on the applicable retail tariff. Theoretical investigation of these two provisions reveals that, properly defined, they are consistent with improving economic signals with respect to electricity generation.

    The objective of this project was to evaluate the feasibility of utilizing PPG's commercial organic coatings systems as efficient, modernized encapsulants for low cost, high performance, thin film photovoltaic modules. Our hypothesis was that the combination of an anticorrosive coating with a more traditional barrier topcoat would mitigate many electrochemical processes that are now responsible for the significant portion of photovoltaic (PV) failures, thereby nullifying the extremely high moisture barrier requirements of currently used encapsulation technology. Nine commercially available metal primer coatings and six commercially available top coatings were selected for screening. Twenty-one different primer/top coat combinations were evaluated. The primer coatings were shown to be the major contributor to corrosion inhibition, adhesion, and barrier properties. Two primer coatings and one top coating were downselected for testing on specially-fabricated test modules. The coated test modules passed initial current leakage and insulation testing. Damp Heat testing of control modules showed visible corrosion to the bus bar metal, whereas the coated modules showed none. One of the primer/top coat combinations retained solar power performance after Damp Heat testing despite showing some delamination at the EVA/solar cell interface. Thermal Cycling and Humidity Freeze testing resulted in only one test module retaining its power performance. Failure modes depended on the particular primer/top coating combination used. Overall, this study demonstrated that a relatively thin primer/top coating has the potential to replace the potting film and backsheet in crystalline silicon-based photovoltaic modules. Positive signals were received from commercially available coatings developed for applications having performance requirements different from those required for photovoltaic modules.     A system for electronically publishing the requirements of a buyer that reduces the time and paperwork required by vendors to transact business with the buyer. The electronic publication includes one or more categorized lists of items that the buyer is seeking to procure. Each listed item includes the name of the item, a brief description of the item, the name of a contact person within the buyer's organization, and one or more dates relevant to the item. The name of the item is presented as a hyperlink that leads to a detailed description of the item and a list of electronically editable forms required by the buyer. The name of the contact person is also presented as a hyperlink that leads to contact information for the contact person. Within the electronic publication, vendors can register with the buyer regarding any listed item(s). Registered vendors receive automatic updates relating to items for which they registered. An administration section, accessible only to the buyer, allows the buyer to organize information and forms submitted by the vendors.

    Numerous authors have discussed the massive changes in the new regulatory environment and the necessary impact of these changes on the roles, responsibilities, structure, function, and mission of the public utility commission. In fact, when public utility commissioners gathered in Denver for the NRRI/NARUC Commissioners Summit in April 1995, {open_quotes}they made it clear that they embraced change as necessary to effective commission functioning in new regulatory environments and made it clear that they were prepared to direct that change.{close_quotes} The Commissioners identified the following trends of change: (1) Dichotomy of customers in core and noncore groupings. (2) Unbundling and new service offerings. (3) Deregulation of certain services and markets. (4) Increased use of market-based pricing and incentive ratemaking. (5) Large users seeking lowest-cost service providers. (6) Shift from old regulatory compact [of] territorial exclusivity and assured recovery. (7) Changing obligation to serve. (8) Utility diversification into other businesses and use of holding company structures. (9) Increased business risk for utilities. (10) Uncertainty as to continued attention to social goals. In response to these changes, they identified five clusters of core missions for public utility commissions: (1) Protection of those customers who would not reap the full benefits of competition. (2) Support of competition balanced with an interest in fair and effective competition. (3) The provision of timely and clear decisions to utility managers and allowing utilities the flexibility to adapt to new conditions. (4) Preserving the commitment to social goals compatible with the competitive market. (5) Addressing the impact of new corporate structures, jurisdictional changes, necessary change in regulatory methods, and customer protection in the new environment.

    The five acts, i.e. Power Plant and Industrial Fuel Act, Public Utilities Regulatory Policies Act, Natural Gas Policy Act, Energy Tax Act of 1978, and the National Energy Conservation Policy Act, which comprise the National Energy Act (NEA) were signed into law on November 9, 1978. The goal of the five acts is to reduce national dependency on foreign oil. Major portions of the NEA rely on state agencies for implementation. This report examines the statutory authority of those agencies to carry out the NEA mandates: Legislative measures to improve state response to the NEA are also described.

    The Georgia General Assembly passed the Shore Assistance Act in 1979 in order to fill a regulatory gap in the state's management of its coastal resources. A review of its legislative history, purposes, applications, and effects in terms of the sand sharing system of sand dunes, beaches, sandbars, and shoals concludes that the Act is poorly drafted. In its application on the oceanfront, it betrays its intent and protects the oceanfront owner. It has failed to satisfy the requirements of the public trust in the tidal foreshore. Amendments to clarify its understanding of the functions and values of the sand-sharing system should also conform with the state's duties under the public trust. 139 references.

    An overview of the Electric Consumers Protection Act of 1986 identifies it as the most important federal legislation dealing with hydroelectric development standards since the Federal Water Power Act of 1920. The author summarizes its major components, and identifies some of the existing and potential issues relation to its implementation. The most controversial issue is the selection of a new licensee for a project once the original licensee's term has expired. Other issues concern environmental criteria, comprehensive planning, amendments to the Public Utility Regulatory Policies Act, and enforcement procedures. The article concludes with a summary of miscellaneous provisions, including antitrust, modifications and time calculations of projects, wheeling, and other concerns.

    A proposed amendmnt (S. 573) to section 252 of the Energy Policy and Conservation Act extending the antitrust exemption expiration date from March 15 to December 31, 1981 is intended to protect US oil companies that are participating in an International Energy Agency program to reduce dependence on imported oil. If the exemption expires, the oil companies could withdraw from the oil-sharing network. The text of S. 573 is followed by statements of four witnesses, including one from the Justice Department to the effect that no adverse impacts on competition or small businesses were discerned.     On October 24, 1992, President Bush signed into law the National Energy Policy Act of 1992. The bill is a sweeping, comprehensive overhaul of the Nation`s energy laws, the first in more than a decade. Among other provisions, the National Energy Policy Act reforms the licensing process for new nuclear power plants by adopting a new approach developed by the US Nuclear Regulatory Commission (NRC) in 1989, and upheld in court in 1992. The NRC 10 CFR Part 52 rule is a three-step process that guarantees public participation at each step. The steps are: early site permit approval; standard design certifications; and, combined construction/operating licenses for nuclear power reactors. Licensing reform increases an organization`s ability to respond to future baseload electricity generation needs with less financial risk for ratepayers and the organization. Costly delays can be avoided because design, safety and siting issues will be resolved before a company starts to build a plant. Specifically, early site permit approval allows for site suitability and acceptability issues to be addressed prior to an organization`s commitment to build a plant. Responsibility for site-specific activities, including communications and public participation, rests with those organizations selected to try out early site approval. This plan has been prepared to assist those companies (referred to as sponsoring organizations) in planning their communications and public involvement programs. It provides research findings, information and recommendations to be used by organizations as a resource and starting point in developing their own plans.

    The National Environmental Policy Act of 1969 (NEPA) sets forth national policy for the protection of the environment. The NEPA process is intended to help officials of the federal government make decisions that are based on an understanding of environmental consequences, and take actions that protect, restore, and enhance the environment. The California Environmental Quality Act of 1970 (CEQA) is similar to NEPA. The California legislature established CEQA to inform both state and local governmental decision-makers and the public about potential significant environmental effects of proposed activities, to identify ways to avoid or reduce environmental impacts, and to disclose to the public the reasons why a project is approved if significant environmental effects are involved. Lawrence Berkeley Laboratory (LBL), complies with the provisions of both NEPA and CEQA. This document defines the responsibilities and authorities for NEPA/CEQA compliance at LBL.

    A triple acting radial seal used as an interstage seal assembly in a gas turbine engine, where the seal assembly includes an interstage seal support extending from a stationary inner shroud of a vane ring, the interstage seal support includes a larger annular radial inward facing groove in which an outer annular floating seal assembly is secured for radial displacement, and the outer annular floating seal assembly includes a smaller annular radial inward facing groove in which an inner annular floating seal assembly is secured also for radial displacement. A compliant seal is secured to the inner annular floating seal assembly. The outer annular floating seal assembly encapsulates the inner annular floating seal assembly which is made from a very low alpha material in order to reduce thermal stress.

    A high-current, fast-acting switch is designed for utilization as a crowbar switch in a high-current circuit such as used to generate the magnetic confinement field of a plasma-confining and heat device, e.g., Pyrotron. The device particularly comprises a cylindrical housing containing two stationary, cylindrical contacts between which a movable contact is bridged to close the switch. The movable contact is actuated by a differential-pressure, airdriven piston assembly also within the housing. To absorb the acceleration (and the shock imparted to the device by the rapidly driven, movable contact), an adjustable air buffer assembly is provided, integrally connected to the movable contact and piston assembly. Various safety locks and circuit-synchronizing means are also provided to permit proper cooperation of the invention and the high-current circuit in which it is installed. (AEC)

    A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    While a large number of fuels conversions have occurred since the 1973-1974 oil embargo, there are still many opportunities for additional conversions. Many of the conversions which have occurred to date have been under federal order because of the legal benefits which accrue to them under the Clean Air Act. The Omnibus Budget Reconciliation Act changed the thrust of the federal program from a mandatory one to a voluntary one. A number of utilities have remained in the program or elected for certification under the new regulation because of the same Clean Air Act benefits. The DOE Office of Fuels Conversion, aside from being responsible for grants of Clean Air Act exemptions, possesses certain unique resources, including capabilities for engineering, finance, fuel supply, transportation, and environmental analysis. These capabilities are available to assist utilities seeking to convert to coal in numerous ways. In addition, assistance can be and is being provided to a state public service commission. 2 figures.

    We report findings from a national Internet survey and a subset of questions administered by telephone in mid-2011 on public assessments of contemporary and emerging interstate nuclear threats, support for strategic arms control, and preferences for responding to limited nuclear attacks on the United States. Additionally, we analyze public views of the threat of terrorism, including cyber attacks, assessments of progress in the struggle against terrorism, and preferences for responding to an act of radiological terrorism against the United States. Also, we report findings from an Internet survey and a subset of questions administered by telephone among the American public in mid-2011 on US energy and environmental security. Key areas of investigation include public views on energy requirements, preferences for energy sources, energy conservation versus development, energy independence, implications of events at Fukushima, Japan, for US public support of nuclear generation, preferences for managing used nuclear fuel, and trust in nuclear risk assessments from government and other public sources. Where possible, findings from each survey are compared with previous surveys in this series for analyses of trends.

    Public acceptance is a decisive factor of growing importance, although economics has been and will remain the most decisive factor in ordering new nuclear capacity. Nuclear energy can make an important contribution toward preventing and reducing the greenhouse effect. Many politicians tend to base their decisions not on facts but rather on so called public opinion and consequently to overreact in particular on environmental issues. The entire debate hinges on public confidence rather than on a lack of information. There is no 100% guarantee that technical facilities will operate completely accident-free. Therefore, standards should be harmonized, plants should be operated safely and consequences of possible accidents should be limited. There needs to be some kind of early information system between countries concerning upcoming issues as a prerequisite for acting instead of reacting, because this is an essential tool in convincing the public that they can have more confidence. Technical information alone does not answer the real questions of the public. Political, technical, and economic matters as well as public opinion are interwoven and cannot be separated from each. Therefore, the exchange of experience gained in all these sectors on an international basis must be improved.

    S. 2415 (which started out as a bill to encourage solar and geothermal power generation) now would amend the Atomic Energy Act of 1954 to redirect uranium enrichment enterprises to further the national interest, respond to competitive market forces, and to ensure the nation's common defense and security. It would establish a United States Enrichment Corporation for the following purposes: to acquire feed materials, enriched uranium, and enrichment facilities; to operate these facilities; to market enriched uranium for governmental purposes and qualified domestic and foreign persons; to conduct research into uranium enrichment; and to operate as a profitable, self-financing, reliable corporation and in a manner consistent with the health and safety of the public. The bill describes powers and duties of the corporation; the organization, finance, and management; decontamination and decommissioning. The second part of the bill would ensure an adequate supply of domestic uranium for defense and power production; provide assistance to the domestic uranium industry; and establish, facilitate, and expedite a comprehensive system for financing reclamation and remedial action at active uranium and thorium processing sites. The third part of the bill would remove the size limitations on power production facilities now part of the Public Utility Regulatory Policies Act of 1978. Solar, wind, waste, or geothermal power facilities would no longer have to be less than 80 MW to qualify as a small power production facility.

    DOE is developing guidelines for the voluntary reporting of greenhouse gas emissions and their reductions, under Section 1605(b) of the Energy Policy Act of 1992. The establishment of this voluntary program should encourage the reduction of greenhouse gases while providing the opportunity to share innovative approaches to achieving such reductions. This social learning aspect is an important element of the program. In addition to greenhouse gas reductions achieved during a given year, reporters are encouraged to also report their actual emissions of such gases for 1987 through 1990. Due to the voluntary nature of this program, and the myriad differences among the potential reporting entities and possible uses for the data reported, the guidelines will need to be structured so as to maximize participation without compromising the usefulness of the data collected. Through a broad notice of inquiry, published in the Federal Register on July 27, 1993, the Department began seeking input into development of the guidelines. Subsequently, to gain a better understanding of the various sectors of the economy, six public workshops were held during the 1993. One workshop addressed institutional issues of potential interest to all sectors of the economy, with the other five workshops focusing more on matters of concern to specific sectors. These meetings were structured so as to provide broad representation from potential reporting entities along with public interest organizations. It is clear that there are significant variations among those reporting greenhouse information. Presently voluntary, the program will need flexibility to encourage broad participation.

    This article outlines the legislative history of the Surface Mining Control and Reclamation Act of 1977 and describes the forces that promoted a federalist arrangement of shared powers and responsibility for implementing the environmental reclamation provisions of the Act. The major components of the Act are reviewed and the Act is examined in terms of its general effectiveness in promoting reclamation as well as its contribution to the practice of American federalism and the capacity of state government to implement complex regulatory programs.     This paper analyzes the correspondence between public opinion on energy issues during and immediately after the oil embargo and the energy policies acted on by Congress. The purpose of the study is to identify some of the conditions under which congruence between public opinion and public policy is likely to occur. Representatives were found to act contrary to public preferences only when they believed they were more knowledgeable than the public. In general, representatives' actions were congruent with public opinion on issues where public feeling was widespread and intense, when there was a clear majority preference, and when an interactive process had taken place involving public response to a governmental initiative. When the public was divided, representatives tended to divide, or postponed resolution of the issue. This study suggests a number of other possible conditions affecting congruence related to crisis situations, new problems, and the direction of public opinion. 20 references, 4 tables.

    Magnetically levitated passenger-transportation vehicles, using attractive and repulsive magnetic forces, are currently in the development or prototype-revenue stages in Japan and Germany. The basic principles of these technologies have been understood for several decades, but their practical applications awaited advances in high-power electronic devices, modern controls, superconducting magnets, and improvements in our transportation infrastructures. A considerable amount of work was devoted to magnetic-levitation (maglev) transportation system in the late 1960s and the 1970s. Detailed development was sustained primarily in Germany and Japan. This listing of publications was begun as the initial phase of a design study for a maglev development facility sponsored by the State of Illinois. The listing has been continually updated under programs sponsored by the Federal Railroad Administration and the US Army Corps of Engineers. In 1991, the National Maglev Initiative issued 27 contracts for the study of technical issues related to maglev and four contracts for the definition of maglev systems. In December 1991, the Intermodal Surface Transportation Efficiency Act was enacted, mandating the development of a US-designed maglev system in a six-year period. This listing is offered as an aid to those working on these projects, to help them locate technical papers on relevant technologies. The design and installation of a maglev transportation system will require the efforts of workers in many disciplines, from electronics to economics to safety. Accordingly, the references have been grouped in 14 different sections to expedite review of the listing. In many case, the references are annotated to indicate the general content of the papers. Abstracts are not available. A list of information services from which the listed documents might be obtained and an author index are provided.

    A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.
