    This report is a summary of the data submitted by DOE and DOE contractors for 1979 for 104,986 employees, representing 81% of all DOE and DOE contractor employees. Of all employees monitored, 47.6% received a dose equivalent that was less than measurable, 50.8% a measurable exposure less than 1 rem, and 1.6% an exposure greater than 1 rem. Only three DOE contractor employees at three separate facilities received whole-body dose equivalents greater than 5 rem during 1979. The two reported cases of internal depositions were both less than the annual dose-equivalent standard and resulted from accidental exposures. (PSB)

    This plan has been developed by Westinghouse Hanford Company (WHC), and its subcontractors ICF Kaiser Hanford (ICF KH) and BCS Richland, Inc. (BCSR), at the direction of the US Department of Energy (DOE), Richland Operations Office (RL). WHC and its subcontractors are hereafter referred to as the Maintenance and Operations (M and O) Contractor. The plan identifies actions involving the M and O Contractor that are critical to (1) prepare for a smooth transition to the Project Hanford Management Contractor (PHMC), and (2) support and assist the PHMC and RL in achieving transition as planned, with no or minimal impact to ongoing baseline activities. The plan is structured around two primary phases. The first is the pre-award phase, which started in mid-February 1996 and is currently scheduled to be completed on June 1, 1996, at which time the contract is currently planned to be awarded. The second is the follow-on four-month post-award phase from June 1, 1996, until October 1, 1996. Considering the magnitude and complexity of the scope of work being transitioned, completion in four months will require significant effort by all parties. To better ensure success, the M and O Contractor has developed a pre-award phase that is intended to maximize readiness for transition. Priority is given to preparation for facility assessments and processing of personnel, as these areas are determined to be on the critical path for transition. In addition, the M and O Contractor will put emphasis during the pre-award phase to close out open items prior to contract award, to include grievances, employee concerns, audit findings, compliance issues, etc.

The objective of the audit was to determine whether Nevada and its Management and Operating (M&O) contractors were following Federal and Department policies with regard to directed support service subcontracts. The audit showed that program offices in Nevada and Headquarters were directing the Nevada M&O contractor to award subcontracts to specific companies or individuals. The subcontractors reported either directly to a program office or to a national laboratory. Furthermore, the subcontractors` work products were delivered directly to the requesting program office. The M&O contractor had only administrative responsibility for the subcontracts awarded. This occurred because Nevada had not established adequate internal controls over the process of procuring support service. As a result, the M&O contractor was paid a higher award fee for managing the Department`s contracts and may have incurred additional costs in staffing its procurement office. We recommended that the Manager, Nevada Operations Office, discontinue directed support service subcontracts to its M&O contractor and act to strengthen internal controls over subcontracting. Nevada management partially concurred with the recommendations but did not believe the directed procurements cited in the report were inappropriate.     Changes in the oil and gas industry have been dramatic in recent years. Operators have consolidated field office facilities and downsized staffing at many of their remaining facilities. As a result, operators are turning to independent Contractors as a method of controlling both peak personnel demands and selected production functions. With these changes in the business environment, the role of the specialized contractor has been greatly expanded. Emergency response can no longer be considered a secondary issue. Every contractor, small or large, must be equally prepared for an emergency. Their ability to address emergency incidents will have a direct effect in their success. This paper is a presentation of the actual learning experiences of one oilfield contractor confronted with the ask of emergency preparedness, more specifically a small contractor. Oilfield service contractors commonly employ field personnel who work for extended periods of time without direct supervision. These employees may singularly or collectively float between sites or anchor one site. Operating sites might be localized or spread over a vast geographical area. Because of the uniqueness of their situation, direct supervision is minimal and the employees will shoulder greater responsibilities and authority. The contractor must evaluate operating conditions and develop an approach which will achieve the optimum results.

In 1991, the Department, through the Accountability Rule, increased contractor fees as an incentive to improve contractor performance and accountability.     The Department of Energy (Department) uses contractors to operate its facilities and compensates contractor employees based on their skills, complexity of jobs, and work performance. Thirty-one of the Department`s major contractors reported a total payroll of $4.3 billion and $4.4 billion during 1994 and 1995, respectively. The 31 contractors also reported awarding salary increases of $18 million for 1994 and $200 million for 1995. The purpose of the audit was to review the process used to determine and approve the amount of salary increases for contractor employees. The specific audit objective was to determine whether salary increases received by contractor employees were in accordance with Departmental policies and procedures. The Department of Energy Acquisition Regulation (DEAR) requires that contractor salary actions be within specific limitations, supportable, and approved prior to incurrence of costs. In addition, the Secretary of Energy imposed a 1 year salary freeze on the merit portion of management and operating contractor employee salaries for each contractor`s Fiscal Year 1994 compensation year. However, a fund for promotions and adjustments was approved but limited to 0.5 percent of payroll for the year. A review of eight major contractors showed that six complied with the Department`s policies on salary increases. The other two gave salary increases that were not always in accordance with Departmental policies. This resulted in both contractors not fully complying with the pay freeze in 1994 and exceeding their salary increase fund budgets in 1995. If these two contractors had implemented Department and contract requirements and contracting officers had properly performed their contract administrative responsibilities concerning salary increase funds, both contractors would have frozen salary increases and would not have exceeded their annual budgets.

    In 1994, the Departmental contract reform team recommended that the Department`s major for-profit operating contractors assume greater financial responsibility. IN response, the Department developed model contract provisions to increase contractor financial responsibility and accountability. The objective of the audit was to determine if the Government is protected from liabilities such as fines, penalties, third-party claims, and damage to or loss of Government property incurred by contractors who manage and operate Department facilities and sites. The Government was not adequately protected against contractor created liabilities on 16 of its 20 major for-profit operating contracts awarded by the Department of Energy. The auditors recommend that the Director for Procurement and Assistance Management negotiate changes in major for-profit operating contracts to include contract reform liability provisions and ensure that performance guarantees with indemnification provisions are executed with subsidiary contractors` parent or corporate business entities. They also recommend that the Director for Procurement and Assistance Management issue regulatory rulemaking that requires indemnification provisions be included in performance guarantees signed by the parent or corporate business entity of subsidiary contractors.

    This report outlines findings resulting from a U.S. Department of Energy Building America expert meeting to determine how HVAC companies can transition from a traditional contractor status to a service provider for whole house energy upgrade contracting. IBACOS has embarked upon a research effort under the Building America Program to understand business impacts and change management strategies for HVAC companies. HVAC companies can implement these strategies in order to quickly transition from a 'traditional' heating and cooling contractor to a service provider for whole house energy upgrade contracting. Due to HVAC service contracts, which allow repeat interaction with homeowners, HVAC companies are ideally positioned in the marketplace to resolve homeowner comfort issues through whole house energy upgrades. There are essentially two primary ways to define the routes of transition for an HVAC contractor taking on whole house performance contracting: (1) Sub-contracting out the shell repair/upgrade work; and (2) Integrating the shell repair/upgrade work into their existing business. IBACOS held an Expert Meeting on the topic of Transitioning Traditional HVAC Contractors to Whole House Performance Contractors on March 29, 2011 in San Francisco, CA.     Many operating companies rely on engineering/procurement/construction (EPC) contractors to provide needed services during expansions and other capital project ventures. These service providers are obligated to work under the same process safety management (PSM) guidelines as the operating company. So what are the responsibilities for the operating company (client), contractor and others under PSM? Following the checklist, EPC contractors and operating companies can develop and assign process safety responsibilities early in project planning. Under these conditions, all involved project parties are fully aware of their individual obligations as mandated by 29 CFR 1910.119 Process Safety Management of Highly Hazardous Chemicals (OSHA PSM). Fully disclosing individual party responsibilities ensures dialogue between the client and the EPC contractor and other involved service providers. Clearly defining and communicating project responsibilities may influence project execution and associated costs considerably. The paper describes the project planning under PSM, PSM elements, process safety information, process hazard analysis, operating procedures, training, contractor programs, pre-startup safety review, mechanical integrity, incident investigations, emergency planning and response, and compliance audits.

The practices in this guide should be considered when planning or reviewing employee training and facility management programs. Contractors are advised to adopt procedures that meet the intent of DOE Order 5480.19. Operations Aspects of Unique Processes is an element of an effective Conduct of Operations program. The complexity and array of activities performed in DOE facilities dictate the necessity for all personnel to coordinate interrelated activities affecting unique processes.

    Foreign companies engaging in business in Cameroon, Congo, Gabon, and Ivory Coast are subject to a broad range of regulations. This article deals only with those aspects of the regulations that are most important to petroleum contractors intending to engage in business in these countries. The regulator scheme actually applicable in a given case will depend on the legal structure through which a corporation operates. An American corporation may envisage engaging in business on a long-term basis through a local subsidiary or branch. On the other hand, it may wish only to perform temporary activities pursuant to one or more fixed-duration contracts with petroleum companies operating in one of countries. Each of these situations is dealt with. Common features of each area of regulation were described and the differences in regulations were presented. These topics were included: exchange control regulation, corporate forms of business association, authorization to engage in business, requirement of government or local participation in capital, investment code incentives, labor law requirements, taxation of corporations, taxation of profits, taxation of income from movable capital, taxation of amounts paid abroad as technical assistance fees, royalties and similar compensation, turnover taxes, payroll taxes, taxation of business performed without forming a local company or branch, taxation of employees and Social Security contributions.     Section 1.3 of the Operational Procedures for Enforcement, published in June 1998, provides the opportunity for the Office of Price-Anderson Enforcement (OE) to periodically issue clarifying guidance regarding the processes used in its enforcement activities. Such guidance is typically issued in the form of an Enforcement Guidance Supplement (EGS). As part of the investigation of potential nuclear safety noncompliances, OE routinely reviews the contractor's investigation of the noncompliance, the associated causal analysis, and the corrective actions developed by the contractor to resolve the noncompliance and prevent recurrence. A high percentage of enforcement actions undertaken by OE feature recurrent events or deficiencies, indicating weaknesses associated with contractor processes to develop and implement effective corrective actions. In response, OE has developed this EGS to disseminate information regarding observed deficiencies as a potential lessons -learned for the DOE contractor community. Attachment A provides enforcement case examples highlighting performance deficiencies specific to this subject area.

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    On July 2, 2013 the DOE Office of the Inspector General issued Audit Report Number 0890 entitled, "Follow-up Audit on Term Assignments of Contractor Employees." The audit was conducted as a follow-up of the FY 2005 audit of "Management of Facility Contractors Assigned to the Washington D.C. area DOE/IG 0710." The earlier report found instances where assignment justifications were insufficient, costs appeared excessive and allowances inconsistent. The follow-up audit recognized improved management of assignments but noted assignment justifications and cost management could be improved. The report recommended DOE determine prior year actual costs to assist in calculating the estimated costs for the upcoming year of multi-year assignments and ensure assignment records in the Departmental Management and Tracking System (DMATS) are accurate.

    U.S. Department of Energy (DOE) employees and contractors frequently work with Indian tribes or nations as part of their jobs. The purpose of this guide is to help DOE employees and contractors initiate contact with tribes and build effective relationships. DOE maintains a unique government-to government relationship with tribal nations. This guide presents an overview of the history of the relationship between the tribes and the Federal government, as well as the laws and Executive Orders that define that relationship. The guide discusses the Federal government’s trust responsibility to the tribes, tribal treaty rights, and the Department of Energy’s American Indian policy. The guide also discusses important cultural differences that could lead to communication problems if not understood and provides examples of potential cultural misunderstandings. In particular the guide discusses tribal environmental beliefs that shape tribal responses to DOE actions. The guide also provides pointers on tribal etiquette during meetings and cultural ceremonies and when visiting tribal reservations. Appendix 1 gives examples of the tribal nations with whom DOE currently has Memoranda of Understanding. While this guide provides an introduction and overview of tribal relations for DOE staff and contractors, DOE has also designated Tribal Issues Points of Contacts at each of its facilities. A list of these Points of Contact for all DOE facilities is provided in Appendix 2. DOE staff and contractors should consult with the appropriate tribal representatives at their site before initiating contact with a tribal nation, because many tribes have rules and procedures that must be complied with before DOE staff or contractors may go on tribal lands or conduct interviews with tribal members.     Fifty-four of DOE`s major contractors reported expending $44.3 million in liability insurance costs for the last 3 years of operation. Purpose of this audit was to evaluate how DOE implemented its policy to assume the risk of losses for its contractors rather than to insure them commercially. Contractors are required to use self-insurance if combined annual premiums for commercial insurance exceed $10,000. Review of 18 major contractors showed that DOE was not consistently following its policy and that contractors using commercial insurance incurred higher costs. Required approvals were not always obtained prior to purchasing certain other types of liability insurance. It is recommended that DOE`s policies requiring self-insurance be fully implemented; that requests for approval for commercial insurance when annual premiums exceeded $10,000 be fully justified; and that the commercial insurance policies specifically define the liability coverage prior to approval and payment. It is also recommended that the contracts include clauses limiting reimbursements for insurance expenditures to actual losses and administrative costs.

    On Jan. 27, the US Supreme Court refused to review a recent federal circuit court decision allowing a California public utility to enter into energy-related contractor activities; this may set a precedent for future related cases, according to an attorney for the contractor plaintiffs. The Supreme Court's refusal lets stand the 9th Federal Circuit Court of Appeals decision on Grason Electric Co. et al. vs. the Sacramento Municipal Utility District (SMUD). That decision allows SMUD - a public utility - to engage in energy-related businesses such as the installation of energy management systems and lighting retrofits, according to the attorney. The plaintiffs in the case, 13 electrical contractors in the Sacramento area, originally brought the case against SMUD on antitrust grounds because, they alleged, the utility was encroaching upon their businesses.

    This report is intended to provide home performance contractor trainers with a resource to keep both their workers and home residents safe and healthy. This document is an attempt to describe what we currently believe is safe, what we believe is unsafe, and what we’re unsure about. It is intended to identify health and safety issues and provide historical context and current understanding of both risks and mitigation strategies. In addition, it provides links to more in-depth resources for each issue. When we tighten the thermal envelope of a house to improve comfort and reduce energy use, we have to be sure that we are not compromising the indoor air quality of the home. This means identifying and mitigating or eliminating pollution sources before and after you make changes to the home. These sources can include materials and finishes in the home, exhaust gasses from combustion appliances, soil gasses such as radon, and moisture from a bathroom, kitchen, or unvented clothes dryer. Our first responsibility is to do no harm — this applies both to our clients and to our employees. Currently, there are many new products that are widely used but whose health effects are not well understood. Our in ability to have perfect information means the directive to do no harm can be difficult to obey. Each home is a little bit different, and in the face of a situation you’ve never encountered, it’s important to have a solid grasp of the fundamental concepts of building science when the hard and fast rules don’t apply . The home performance industry is gaining momentum, and has the potential to expand greatly as energy costs continue to rise. It is imperative that we remain vigilant about protecting the health and safety of our workers and our customers. It only takes a few news stories about a family that got sick after their home was tightened by a home performance contractor to scare off potential customers and taint the reputation of the entire industry.     The Department of Energy, Richland Operations (DOE-RL) recently restructured its Hanford work scope, awarding two new contracts over the past several months for a total of three contracts to manage the sites cleanup efforts. DOE-RL met with key contractor personnel prior to and during contract transition to ensure site welding activities had appropriate oversight and maintained code compliance. The transition also provided an opportunity to establish a single site-wide function that would provide welding and materials engineering services to the Hanford site contractors: CH2M HILL Plateau Remediation Company (CHPRC); Mission Support Alliance (MSA); Washington River Protection Solutions (WRPS); and Washington Closure Hanford (WCH). Over the years, multiple and separate welding programs (amongst the several contractors) existed at the Hanford site leading to inefficiencies resulting from duplication of administrative efforts, maintenance of welding procedures, welder performance certifications, etc. The new, single program eliminates these inefficiencies. The new program, co-managed by two of the sites' new contractors, the CHPRC ('owner' of the program and responsible for construction welding services) and the MSA (provides maintenance welding services), provides more than just the traditional construction and maintenance welding services. Also provided, are welding engineering, specialty welding development/qualification for the closure of radioactive materials containers and materials evaluation/failure analysis. The following describes the new Hanford site welding program.

    This document is only a guideline for contractors to use in formalizing a safety program or preparing a safety plan. It contains a format of a suggested safety plan as well as pertinent safety elements which should be considered for inclusion. However, consideration of only those items listed may not be sufficient. Each contractor should include in the safety plan particular reference to those elements peculiar to the inherent hazards of the contractor's specific type of construction services, whether the hazard is shown in the list of safety elements or not. Each safety plan should be reviewed annually by the contractor's management. Reissue of the safety plan is mandatory if safety requirements have changed, or if the contractor's address or management (approval signature) has changed.

    This Quality Assurance Program Plan (QAPP) provides the primary requirements for the integration of quality functions into all Technical Assistance Contractor (TAC) Project organization activities. The QAPP is the written directive authorized by the TAC Program Manager to accomplish this task and to implement procedures that provide the controls and sound management practices needed to ensure TAC contractual obligations are met. The QA program is designed to use monitoring, audit, and surveillance functions as management tools to ensure that all Project organization functions are executed in a manner that will protect public health and safety, promote the success of the Project, and meet or exceed contract requirements. The key to ensuring compliance with this directive is a two-step professional approach: utilize the quality system in all areas of activity, and generate a personal commitment from all personnel to provide quality service. The quality staff will be experienced, trained professionals capable of providing maximum flexibility to Project goal attainment. Such flexibility will enable the staff to be more cost effective and to further improve communication and coordination. To provide control details, this QAPP will be supplemented by approved standard operating procedures that provide requirements for performing the various TAC quality-related activities. These procedures shall describe applicable design input and document control activities and documentation.
