  1. Group NPDES stormwater permit application: The Conoco experience

    The US Environmental Protection Agency (USEPA) has reported that stormwater runoff is a major cause of pollution and use impairment to waters of the nation. Diffuse pollution sources (stormwater runoff) are increasingly important as controls for industrial process dischargers. On November 16, 1990 the Federal Clean Water Act National Pollutant Discharge Elimination System (NPDES) rules governing the discharge of stormwater were published (56 FR 40948). These rules potentially affect every type of business enterprise conducting work associated with industrial activity.'' Dischargers of stormwater associated with industrial activity ar required to either seek coverage under a federal or state general permit using notice of intent, apply for an individual permit, or apply for a permit through a two-part group application process. Conoco, Inc. Supply and Transportation (S and T) elected the latter alternative to attempt to comply with these new evolving complex, broad-ranging permitting requirements. This paper discusses specific details of S and T's strategy, BMP designs, data acquisition activities, monitoring results, as well as economic impacts on the corporation as a result of storm water permit requirements. S and T operates approximately 170 unique wholly and jointly owned petroleum product storage and transport facilities across the nation. Approximately one-third of these facilities were subject to stormwater permit application requirements.

    The promulgation of EPA's NPDES stormwater discharge regulations occurred during the latter planning stages for Boston's Central Artery/Tunnel Project, making this project, one of the largest single urban highway projects ever built, one of the first to be permitted under new regulations. The Project consists of 128 land miles of new highway, including numerous ramps and interchanges, and a harbor tunnel, with stormwater discharging during construction from at least 38 separate points. Complicating the permitting situation, stormwater is combined with dewatering discharges from excavations in filled and former industrial areas. Working closely with EPA Region 1 and the Massachusetts Department of Environmental Protection, the Massachusetts Highway Department submitted a permit application combining estimates of dewatering discharge quality derived from groundwater sampling with all the elements of a NPDES application for construction stormwater. The resulting permit contained two separate sets of monitoring requirements for the same discharge points, one for stormwater and one for dewatering. Quarterly monitoring was required for both dewatering and stormwater for metals, suspended solids, TPH, and VOC. Limits of 50 mg/1 TSS and 5 mg/1 TPH were established for dewatering only.

    The NPDES permit issued to the Savannah River Site (SRS) in 2003 contained very low metals limits for several outfalls. Copper, lead and zinc limits were as low as seven micrograms per liter (7 ug/l), 1 ug/l, and 100 ug/l, respectively. The permit contained compliance schedules that provided SRS with only three to five years to select and implement projects that would enable outfall compliance. Discharges from a few outfalls were eliminated or routed into other locations relatively inexpensively. However, some outfall problems were much more difficult to correct. SRS personnel implemented several innovative projects in order to meet compliance schedule deadlines as inexpensively as possible. These innovations included (1) connecting several outfall discharges to the site's Central Sanitary Wastewater Treatment Facility (CSWTF), (2) constructing a treatment wetlands and completing a water-effects ratio (WER) on its effluent, (3) installing a stannous chloride feed system to remove mercury in an existing air stripper, and (4) constructing a humic acid feed system to increase effluent dissolved organic carbon (DOC) content and take advantage of biotic ligand modeling to raise effluent limits.

    One of Los Angeles County Department of Public Works` many responsibilities is to manage non-point pollution that enters the storm drain network within Los Angeles County. The management of this non-point source pollution is mandated by the NPDES guidelines under the Federal Clean Water Act. These guidelines require the County to monitor the drainage network and the storm water and urban runoff flowing through it. The County covers over 3,117 square miles, with the NPDES Permit covering over 3,100 square miles and over 2500 miles of storm drains. A proposed solution to monitor and manage this vast geographic area is centered upon an Arc/Info GIS. Some of the many concerns which need to be addressed include the administration and evaluation of Best Management Practices (BMP`s), storm drain inspection for illegal connections and illicit discharges, and pollutant load assessment and modeling. The storm drain network and other coverages will be related to external data bases currently used for facility management and planning. This system would be used for query purposes to perform spatial modeling and {open_quotes}what if{close_quotes} scenarios needed to create maps and reports required by the permit and to evaluate various BMP implementation strategies.

    The U.S. Department of Energy (DOE) prepared this environmental assessment (EA) to evaluate the potential environmental impacts associated with proposed and alternative actions to achieve water quality permit compliance at 38 storm water outfalls located at the Savannah River Site (SRS) (Figure 1-1). Effluent monitoring data indicates that some of these outfalls may not presently comply with new National Pollutant Discharge Elimination System (NPDES) Storm Water General Permit effluent standards that became effective July 1, 2005 (SCR000000). The NPDES permit requires that best management practices (BMPs) be implemented and maintained, as necessary, to ensure that storm water discharges at SRS do not cause or contribute to the contravention of applicable state water quality standards (WQS).

    This manual provides general guidance for Department of Energy (DOE) officials for complying with Sect. 402 of the Clean Water Act (CWA) of 1977 and amendments. Section 402 authorizes the US Environmental Protection Agency (EPA) or states with EPA approved programs to issue National Pollutant Discharge Elimination System (NPDES) permits for the direct discharge of waste from a point source into waters of the United States. Although the nature of a project dictates the exact information requirements, every project has similar information requirements on the environmental setting, type of discharge(s), characterization of effluent, and description of operations and wastewater treatment. Additional information requirements for projects with ocean discharges, thermal discharges, and cooling water intakes are discussed. Guidance is provided in this manual on general methods for collecting, analyzing, and presenting information for an NPDES permit application. The NPDES program interacts with many sections of the CWA; therefore, background material on pertinent areas such as effluent limitations, water quality standards, toxic substances, and nonpoint source pollutants is included in this manual. Modifications, variances, and extensions applicable to NPDES permits are also discussed.

    This document, Set 2, the Hanford Facility Dangerous Waste Part B Permit Application, consists of 15 chapters that address the content of the Part B checklists prepared by the Washington State Department of Ecology (Ecology 1987) and the US Environmental Protection Agency (40 CFR 270), with additional information requirements mandated by the Hazardous and Solid Waste Amendments of 1984 and revisions of WAC 173-303. For ease of reference, the Washington State Department of Ecology checklist section numbers, in brackets, follow the chapter headings and subheadings. This permit application contains umbrella- type'' documentation with overall application to the Hanford Facility. This documentation is broad in nature and applies to all TSD units that have final status under the Hanford Facility Permit.

    The Clean Air Act Amendments of 1990, which amended the Federal Clean Air Act of 1977, required that the US Environmental Protection Agency develop a national Air Operating Permit Program, which in turn would require each state to develop an Air Operating Permit Program to identify all sources of ``regulated`` pollutants. Regulated pollutants include ``criteria`` pollutants (oxides of nitrogen, sulfur oxides, total suspended particulates, carbon monoxide, particulate matter greater than 10 micron, lead) plus 189 other ``Hazardous`` Air Pollutants. The Hanford Site, owned by the US Government and operated by the US Department of Energy, Richland Operations Office, is located in southcentral Washington State and covers 560 square miles of semi-arid shrub and grasslands located just north of the confluence of the Snake and Yakima Rivers with the Columbia River. This land, with restricted public access, provides a buffer for the smaller areas historically used for the production of nuclear materials, waste storage, and waste disposal. About 6 percent of the land area has been disturbed and is actively used. The Hanford Site Air Operating Permit Application consists of more than 1,100 sources and in excess of 300 emission points. Before January 1995, the maintenance and operations contractor and the environmental restoration contractor for the US Department of Energy completed an air emission inventory on the Hanford Site. The inventory has been entered into a database so that the sources and emission points can be tracked and updated information readily can be retrieved. The Hanford Site Air Operating Permit Application contains information current as of April 19, 1995.

    The U.S. Nuclear Regulatory Commission (NRC) has received and is reviewing three applications for early site permits (ESPs). The ESP process allows early resolution of site-related issues affecting possible construction and operation of a new nuclear power plant. The nuclear industry views a successful and predictable ESP process as an important step in assessing whether to seek authorization to construct and operate a new generation of nuclear power reactors in the United States. Because consideration of ESP applications is a first-of-a-kind activity, a number of issues have emerged prior to and during the reviews of the first three applications. Issues have included the need for design information at the ESP stage, accident analyses, quality assurance, and seismic analyses. The NRC has been working to resolve identified issues to support a Commission decision on whether to issue an ESP approximately 33-37 months after receipt of each ESP application. (authors)

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affects groundwater or has the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 (or 173-218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permit Program. This document constitutes the State Waste Discharge Permit application for the 400 Area Septic System. The influent to the system is domestic waste water. Although the 400 Area Septic System is not a Public Owned Treatment Works, the Public Owned Treatment Works application is more applicable than the application for industrial waste water. Therefore, the State Waste Discharge Permit application for Public Owned Treatment Works Discharges to Land was used.

    This document constitutes the Washington Administrative Code 173-216 State Waste Discharge Permit Application that serves as interim compliance as required by the Consent Order DE 91NM-177, for the 400 Area Secondary Cooling Water stream. As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affect groundwater or have the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 (or 173-218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permitting Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered in to Consent Order DE 91NM-177. The Consent Order DE 91NM-177 requires a series of permitting activities for liquid effluent discharges.

    This permit application documentation is for a State Waste Discharge Permit issued in accordance with requirements of Washington Administrative Code 173-216. The activity being permitted is a technology test using electrical resistance tomography. The electrical resistance tomography technology was developed at Lawrence Livermore National Laboratory and has been used at other waste sites to track underground contamination plumes. The electrical resistance tomography technology measures soil electrical resistance between two electrodes. If a fluid contaminated with electrolytes is introduced into the soil, the soil resistance is expected to drop. By using an array of measurement electrodes in several boreholes, the areal extent of contamination can be estimated. At the Hanford Site, the purpose of the testing is to determine if the electrical resistance tomography technology can be used in the vicinity of large underground metal tanks without the metal tank interfering with the test. It is anticipated that the electrical resistance tomography technology will provide a method for accurately detecting leaks from the bottom of underground tanks, such as the Hanford Site single-shell tanks.

    The current Hanford Facility Dangerous Waste Permit Application is considered to be a single application organized into a General Information Portion (this document, number DOE/RL-91-28) and a treatment, storage, and/or disposal Unit-Specific Portion, which includes documentation for individual TSD units (e.g., document numbers DOE/RL-89-03 and DOE/RL-90-01). Both portions consist of a Part A division and a Part B division. The Part B division consists of 15 chapters that address the content of the Part B checklists prepared by the Washington State Department of Ecology (Ecology 1987) and the US Environmental Protection Agency (40 Code of Federal Regulations 270), with additional information requirements mandated by the Hazardous and Solid Waste Amendments of 1984 and revisions of Washington Administrative Code 173-303. For ease of reference, the Washington State Department of Ecology checklist section numbers, in brackets, follow the chapter headings and subheadings. Documentation contained in the General Information Portion (i.e., this document, number DOE/RL-91-28) is broader in nature and applies to all treatment, storage, and/or disposal units for which final status is sought. Because of its broad nature, the Part A division of the General Information Portion references the Hanford Facility Dangerous Waste Part A Permit Application (document number DOE/RL-88-21), a compilation of all Part A documentation for the Hanford Facility.

    The A-01 NPDES outfall at the Savannah River Site receives process wastewater discharges and stormwater runoff from the Savannah River Technology Center. Routine monitoring indicated that copper concentrations were regularly higher than discharge permit limit, necessitating treatment of nearly one million gallons of water each day plus storm runoff to meet compliance standards. A conceptual design for a constructed treatment wetland was developed as the most cost-effective alternative. A pilot study was conducted using mesocosms to confirm that the design concept would reduce copper to acceptable levels. After treatment in the mesocosms, effluent copper concentrations were routinely below permit limits, even though the influent concentrations varied widely.

    Pursuant to the passage of the Clean Air Act Amendments of 1990, the US Environmental Protection Agency has promulgated what are known as Title V permitting requirements for major sources of air pollutants, including pipeline operations. In contrast to most existing air permitting programs, the new Title V regulations will require periodic certification of compliance with applicable air regulations. In the same way that water dischargers report their own discharge violations to regulatory agencies pursuant to the NPDES permitting system, Title V permittees must implement an acceptable monitoring program and similarly report violations of permit conditions or applicable air regulations. Only those facilities whose potential emissions are less than or can be controlled to be less than certain regulatory limits will be exempt from standard Title V permitting. If a facility`s throughput or the concentration levels of certain volatile toxic levels in a particular crude or natural gas were to exceed corresponding regulatory limits, then the facility could be in violation. If an operator were to expand a field, then the changes in the gathering system and emission levels could constitute a violation. Constraints on operations can be avoided by careful strategizing of an operator`s Title V permit application.

    Title V of the Clean Air Act Amendments of 1990 requires that the owners and operators of certain types of industrial plants obtain a federal operating permit. In general, any plant that meets the definition of a major source must either obtain a Title V Operating permit, or take actions to ``act out`` of the Title V program. This Technical Paper describes the experience of the authors in designing and implementing a computer system for data management and reporting of Clean Air Act Title V Permit information. Recommendations are also provided to guide companies and industry groups who are planning to undertake similar automation projects.

    This renewal application for a Recycled Water Reuse Permit is being submitted in accordance with the Idaho Administrative Procedures Act 58.01.17 “Recycled Water Rules” and the Municipal Wastewater Reuse Permit LA-000141-03 for continuing the operation of the Central Facilities Area Sewage Treatment Plant located at the Idaho National Laboratory. The permit expires March 16, 2015. The permit requires a renewal application to be submitted six months prior to the expiration date of the existing permit. For the Central Facilities Area Sewage Treatment Plant, the renewal application must be submitted by September 16, 2014. The information in this application is consistent with the Idaho Department of Environmental Quality’s Guidance for Reclamation and Reuse of Municipal and Industrial Wastewater and discussions with Idaho Department of Environmental Quality personnel.

    This document reviews and evaluates the various options for the disposal of geothermal wastewater with respect to the promulgated regulations for the protection of surface and groundwaters. The Clean Water Act of 1977 and the Safe Drinking Water Act Amendments are especially important when designing disposal systems for geothermal fluids. The former promulgates regulations concerning the discharge of wastewater into surface waters, while the latter is concerned with the protection of ground water aquifers through the establishment of underground injection control (UIC) programs. There is a specific category for geothermal fluid discharge if injection is to be used as a method of disposal. Prior to February 1982, the UIC regulations required geothermal power plant to use Class III wells and direct use plants to use Class V wells. More stringent regulatory requirements, including construction specification and monitoring, are imposed on the Class III wells. On February 3, 1982, the classification of geothermal injection wells was changed from a Class III to Class V on the basis that geothermal wells do not inject for the extraction of minerals or energy, but rather they are used to inject brines, from which heat has been extracted, into formations from which they were originally taken. This reclassification implies that a substantial cost reduction will be realized for geothermal fluid injection primarily because well monitoring is no longer mandatory. The Clean Water Act of 1977 provides the legal basis for regulating the discharge of liquid effluent into the nation's surface waters, through a permitting system called the National Pollution Discharge Elimination System (NPDES) Discharge quantities, rates, concentrations and temperatures are regulated by the NPDES permits. These permits systems are based upon effluent guidelines developed by EPA on an industry by industry basis. For geothermal energy industry, effluent guidelines have not been formulated and are not

    For purposes of the Hanford facility dangerous waste permit application, the US Department of Energy`s contractors are identified as ``co-operators`` and sign in that capacity (refer to Condition I.A.2. of the Dangerous Waste Portion of the Hanford Facility Resource Conservation and Recovery Act Permit). Any identification of these contractors as an ``operator`` elsewhere in the application is not meant to conflict with the contractors` designation as co-operators but rather is based on the contractors` contractual status with the U.S. Department of Energy, Richland Operations Office. The Dangerous Waste Portion of the initial Hanford Facility Resource Conservation and Recovery Act Permit, which incorporated five treatment, storage, and/or disposal units, was based on information submitted in the Hanford Facility Dangerous Waste Permit Application and in closure plan and closure/postclosure plan documentation. During 1995, the Dangerous Waste Portion was modified twice to incorporate another eight treatment, storage, and/or disposal units; during 1996, the Dangerous Waste Portion was modified once to incorporate another five treatment, storage, and/or disposal units. The permit modification process will be used at least annually to incorporate additional treatment, storage, and/or disposal units as permitting documentation for these units is finalized. The units to be included in annual modifications are specified in a schedule contained in the Dangerous Waste Portion of the Hanford Facility Resource Conservation and Recovery Act Permit. Treatment, storage, and/or disposal units will remain in interim status until incorporated into the Permit.     On December 23, 1991, the US DOE< Richland Operation Office (RL) and the Washington State Department of Ecology (Ecology) agreed to adhere to the provisions of the Department of Ecology Consent Order No. DE91NM-177 (216 Consent Order) (Ecology and US DOE 1991). As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site that affect groundwater or have the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 of the Washington Administrative Code, the State Waste Discharge Permitting Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered into Consent Order DE 91NM-177. The Consent Order DE 91NM-177 requires a series of permitting activities for liquid effluent discharges. Based upon compositional and flow rate characteristics, liquid effluent streams on the Hanford Site have been categorized into Phase 1, Phase 2, and Miscellaneous streams. This document only addresses the 400 Area Secondary Cooling Water stream, which has been identified as a Phase 2 stream. The 400 Area Secondary Cooling Water stream includes contribution streams from the Fuels and Materials Examination Facility, the Maintenance and Storage Facility, the 481-A pump house, and the Fast Flux Test Facility.

    In August 1993, the New Mexico Environment Department (NMED) issued a draft permit for the Waste Isolation Pilot Plant (WIPP) to begin experiments with transuranic (TRU) mixed waste. Subsequently, the Department of Energy (DOE) decided to cancel the on-site test program, opting instead for laboratory testing. The Secretary of the NMED withdrew the draft permit in 1994, ordering the State`s Hazardous and Radioactive Waste Bureau to work with the DOE on submittal of a revised permit application. Revision 5 of the WIPP`s Resource Conservation and Recovery Act (RCRA) Part B Permit Application was submitted to the NMED in May 1995, focusing on disposal of 175,600 m{sup 3} of TRU mixed waste over a 25 year span plus ten years for closure. A key portion of the application, the Waste Analysis Plan, shifted from requirements to characterize a relatively small volume of TRU mixed waste for on-site experiments, to describing a complete program that would apply to all DOE TRU waste generating facilities and meet the appropriate RCRA regulations. Waste characterization will be conducted on a waste stream basis, fitting into three broad categories: (1) homogeneous solids, (2) soil/gravel, and (3) debris wastes. Techniques used include radiography, visually examining waste from opened containers, radioassay, headspace gas sampling, physical sampling and analysis of homogeneous wastes, and review of documented acceptable knowledge. Acceptable knowledge of the original organics and metals used, and the operations that generated these waste streams is sufficient in most cases to determine if the waste has toxicity characteristics, hazardous constituents, polychlorinated biphenyls (PBCs), or RCRA regulated metals.

    The Area 5 Hazardous Waste Storage Unit (HWSU) was established to support testing, research, and remediation activities at the Nevada Test Site (NTS), a large-quantity generator of hazardous waste. The HWSU, located adjacent to the Area 5 Radioactive Waste Management Site (RWMS), is a prefabricated, rigid steel-framed, roofed shelter used to store hazardous nonradioactive waste generated on the NTS. No offsite generated wastes are managed at the HWSU. Waste managed at the HWSU includes the following categories: Flammables/Combustibles; Acid Corrosives; Alkali Corrosives; Oxidizers/Reactives; Toxics/Poisons; and Other Regulated Materials (ORMs). A list of the regulated waste codes accepted for storage at the HWSU is provided in Section B.2. Hazardous wastes stored at the HWSU are stored in U.S. Department of Transportation (DOT) compliant containers, compatible with the stored waste. Waste transfer (between containers) is not allowed at the HWSU and containers remain closed at all times. Containers are stored on secondary containment pallets and the unit is inspected monthly. Table 1 provides the metric conversion factors used in this application. Table 2 provides a list of existing permits. Table 3 lists operational Resource Conservation and Recovery Act (RCRA) units at the NTS and their respective regulatory status.

    The Kerr Hollow Quarry (KHQ) is located on U.S. Department of Energy (DOE) property at the Y-12 Plant, Oak Ridge, Tennessee. The Oak Ridge Y-12 Plant was built by the U.S. Army Corps of Engineers in 1943 as part of the Manhattan Project. Until 1992, the primary mission of the Y-12 Plant was the production and fabrication of nuclear weapons components. Activities associated with these functions included production of lithium compounds, recovery of enriched uranium from scrap material, and fabrication of uranium and other materials into finished parts for assemblies. The Kerr Hollow Quarry was used for waste disposal of a variety of materials including water-reactive and shock-sensitive chemicals and compressed gas cylinders. These materials were packaged in various containers and sank under the water in the quarry due to their great weight. Disposal activities were terminated in November, 1988 due to a determination by the Tennessee Department of Environment and Conservation that the quarry was subject to regulations under the Resource Conservation and Recovery Act of 1993. Methods of closure for the quarry were reviewed, and actions were initiated to close the quarry in accordance with closure requirements for interim status surface impoundments specified in Tennessee Rules 1200-1-11-.05(7) and 1200-1-11-.05(11). As part of these actions, efforts were made to characterize the physical and chemical nature of wastes that had been disposed of in the quarry, and to remove any containers or debris that were put into the quarry during waste disposal activities. Closure certification reports (Fraser et al. 1993 and Dames and Moore 1993) document closure activities in detail. This report contains the post-closure permit application for the Kerr Hollow Quarry site.

    Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    This renewal application for the Industrial Wastewater Reuse Permit (IWRP) WRU-I-0160-01 at Idaho National Laboratory (INL), Materials and Fuels Complex (MFC) Industrial Waste Ditch (IWD) and Industrial Waste Pond (IWP) is being submitted to the State of Idaho, Department of Environmental Quality (DEQ). This application has been prepared in compliance with the requirements in IDAPA 58.01.17, Recycled Water Rules. Information in this application is consistent with the IDAPA 58.01.17 rules, pre-application meeting, and the Guidance for Reclamation and Reuse of Municipal and Industrial Wastewater (September 2007). This application is being submitted using much of the same information contained in the initial permit application, submitted in 2007, and modification, in 2012. There have been no significant changes to the information and operations covered in the existing IWRP. Summary of the monitoring results and operation activity that has occurred since the issuance of the WRP has been included. MFC has operated the IWP and IWD as regulated wastewater land treatment facilities in compliance with the IDAPA 58.01.17 regulations and the IWRP. Industrial wastewater, consisting primarily of continuous discharges of nonhazardous, nonradioactive, routinely discharged noncontact cooling water and steam condensate, periodic discharges of industrial wastewater from the MFC facility process holdup tanks, and precipitation runoff, are discharged to the IWP and IWD system from various MFC facilities. Wastewater goes to the IWP and IWD with a permitted annual flow of up to 17 million gallons/year. All requirements of the IWRP are being met. The Operations and Maintenance Manual for the Industrial Wastewater System will be updated to include any new requirements.

    Acute (48 hour LC50) and chronic (7-day reproductive impairment) toxicity tests were conducted on Ceriodaphnia dubia in water collected from 53 NPDES outfalls. All tests were conducted at the in-stream waste concentration. only 12 of the 53 outfalls showed no evidence of toxicity. Twenty-eight of the outfalls were acutely toxic, often producing 100% mortality during the first day of exposure. Fourteen outfalls had no discharge at the time of sampling and could not be tested. Three outfalls were not tested because their toxicity has been adequately characterized in other investigations. Elevated concentrations of total residual chlorine are suspected to be responsible for the observed toxicity of many NPDES outfalls, particularly the sanitary wastewater treatment plants. Chemical data from previous studies indicate that metals may also be present in toxic concentrations at many outfalls. Toxicity identification and reduction options are discussed.

    Application is being made for a permit pursuant to Chapter 173--216 of the Washington Administrative Code (WAC), to discharge treated waste water and cooling tower blowdown from the 200 Area Effluent Treatment Facility (ETF) to land at the State-Approved Land Disposal Site (SALDS). The ETF is located in the 200 East Area and the SALDS is located north of the 200 West Area. The ETF is an industrial waste water treatment plant that will initially receive waste water from the following two sources, both located in the 200 Area on the Hanford Site: (1) the Liquid Effluent Retention Facility (LERF) and (2) the 242-A Evaporator. The waste water discharged from these two facilities is process condensate (PC), a by-product of the concentration of waste from DSTs that is performed in the 242-A Evaporator. Because the ETF is designed as a flexible treatment system, other aqueous waste streams generated at the Hanford Site may be considered for treatment at the ETF. The origin of the waste currently contained in the DSTs is explained in Section 2.0. An overview of the concentration of these waste in the 242-A Evaporator is provided in Section 3.0. Section 4.0 describes the LERF, a storage facility for process condensate. Attachment A responds to Section B of the permit application and provides an overview of the processes that generated the wastes, storage of the wastes in double-shell tanks (DST), preliminary treatment in the 242-A Evaporator, and storage at the LERF. Attachment B addresses waste water treatment at the ETF (under construction) and the addition of cooling tower blowdown to the treated waste water prior to disposal at SALDS. Attachment C describes treated waste water disposal at the proposed SALDS.

    The NPDES permit issued to the Savannah River Site (SRS) in 2003 contained copper limits as low as six micrograms per liter. It also contained compliance schedules that provided SRS with anywhere from three to five years to select and implement projects that would enable compliance at several outfalls. Some outfall problems were much more difficult to correct than others. SRS personnel implemented several innovative projects in order to meet compliance schedule deadlines as inexpensively as possible. One innovation, constructing a humic acid feed system to increase effluent dissolved organic carbon (DOC) content, has proven to be very successful.

    This document and its several appendices constitute an application for a Kentucky Permit to Construct an Air Contaminant Source as well as a Prevention of Significant Air Quality Deterioration (PSD) Permit Application. The information needed to satisfy the application requirements for both permits has been integrated into a complete and logical description of the proposed source, its emissions, control systems, and its expected air quality impacts. The Department of Energy believes that it has made every reasonable effort to be responsive to both the letter and the spirit of the PSD regulations (40 CFR 52.21) and Kentucky Regulation No. 401 KAR 50:035. In this regard, it is important to note that because of the preliminary status of some aspects of the process engineering and engineering design for the Demonstration Plant, it is not yet possible precisely to define some venting operations or their associated control systems. Therefore, it is not possible precisely to quantify some atmospheric emissions or their likely impact on air quality. In these instances, DOE and ICRC have used assumptions that produce impact estimates that are believed to be worst case and are not expected to be exceeded no matter what the outcome of future engineering decisions. As these decisions are made, emission quantities and rates, control system characteristics and efficiencies, and vent stack parameters are more precisely defined; this Permit Application will be supplemented or modified as appropriate. But, all needed modifications are expected to represent either decreases or at worst no changes in the air quality impact of the SRC-I Demonstration Plant.

    The proposed Mixed Waste Storage Unit (MWSU) will be located within the Area 5 Radioactive Waste Management Complex (RWMC). Existing facilities at the RWMC will be used to store low-level mixed waste (LLMW). Storage is required to accommodate offsite-generated LLMW shipped to the Nevada Test Site (NTS) for disposal in the new Mixed Waste Disposal Unit (MWDU) currently in the design/build stage. LLMW generated at the NTS (onsite) is currently stored on the Transuranic (TRU) Pad (TP) in Area 5 under a Mutual Consent Agreement (MCA) with the Nevada Division of Environmental Protection, Bureau of Federal Facilities (NDEP/BFF). When the proposed MWSU is permitted, the U.S. Department of Energy (DOE) will ask that NDEP revoke the MCA and onsite-generated LLMW will fall under the MWSU permit terms and conditions. The unit will also store polychlorinated biphenyl (PCB) waste and friable and non-friable asbestos waste that meets the acceptance criteria in the Waste Analysis Plan (Exhibit 2) for disposal in the MWDU. In addition to Resource Conservation and Recovery Act (RCRA) requirements, the proposed MWSU will also be subject to Department of Energy (DOE) orders and other applicable state and federal regulations. Table 1 provides the metric conversion factors used in this application. Table 2 provides a list of existing permits. Table 3 lists operational RCRA units at the NTS and their respective regulatory status.

    The Department of Energy Idaho Operations Office (DOE-ID) is applying for a synthetic minor, Sitewide, air quality permit to construct (PTC) with a facility emission cap (FEC) component from the Idaho Department of Environmental Quality (DEQ) for Idaho National Laboratory (INL) to limit its potential to emit to less than major facility limits for criteria air pollutants (CAPs) and hazardous air pollutants (HAPs) regulated under the Clean Air Act. This document is supplied as an appendix to the application, Idaho National Laboratory Application for a Synthetic Minor Sitewide Air Quality Permit to Construct with a Facility Emissions Cap Component, hereafter referred to as “permit application” (DOE-ID 2015). Air dispersion modeling was performed as part of the permit application process to demonstrate pollutant emissions from the INL will not cause a violation of any ambient air quality standards. This report documents the modeling methodology and results for the air dispersion impact analysis. All CAPs regulated under Section 109 of the Clean Air Act were modeled with the exception of lead (Pb) and ozone, which are not required to be modeled by DEQ. Modeling was not performed for toxic air pollutants (TAPs) as uncontrolled emissions did not exceed screening emission levels for carcinogenic and non-carcinogenic TAPs. Modeling for CAPs was performed with the EPA approved AERMOD dispersion modeling system (Version 14134) (EPA 2004a) and five years (2000-2004) of meteorological data. The meteorological data set was produced with the companion AERMET model (Version 14134) (EPA 2004b) using surface data from the Idaho Falls airport, and upper-air data from Boise International Airport supplied by DEQ. Onsite meteorological data from the Grid 3 Mesonet tower located near the center of the INL (north of INTEC) and supplied by the local National Oceanic and Atmospheric Administration (NOAA) office was used for surface wind directions and wind speeds. The three new sources, the Fueled Clad Fabrication System (FCFS), the Radioisotope Power Systems Facility (RPSF), and the Fuel Assembly Area (FAA), will be located in one facility, the Fuels and Materials Examination Facility (FMEF) of the 400 Area. The FMEF was originally designed to provide for post-irradiation examination and fabrication of breeder reactor fuels. These FMEF missions were cancelled before the introduction of any fuel materials or any irradiated material. The current plans are to use the facility to fabricate power supplies for use in space applications and to produce Fast Flux Test Facility (FFTF) fuel and target assemblies. The FCFS and the RPSF will produce materials and assemblies for application in space. The FAA project will produce FFTF fuel and target assemblies. The FCFS and the RPSF will share the same building, stack, and, in certain cases, the same floor space. Given this relationship, these systems will be dealt with separately to the extent possible. The FAA is a comparatively independent operation though it will share the FMEF complex.

    The revised Closure Plan was initially intended to apply to A Area, C-West, B Area, and the Walk-In Pits (WIPs) of the Bear Creek Burial Grounds (BCBG). However, a strategy was developed to include the B Area [a solid waste management unit (SWMU)] with the WIPs so that both areas would be closed under one cap. The plan was presented to the State of Tennessee on March 8, 1990, and the Department of Energy was requested to review other unique alternatives to close the site. Therefore, in November 1992, the Closure Plan for B Area and the WIPs was prepared separately from that of the other sites associated with the BCBG and was presented in a RCRA Closure Plan. The Closure Plan revision issued April 1993 was intended to reflect the placement of the Kerr Hollow Quarry debris at the WIPs, revise the closure data, and acknowledge that the disposition of a monitoring well within the closure site could not be verified. A Post-Closure Permit Application (PCPA) was to include the WIPs; however, at the time of submittal, closure of the WIPs had not been certified. This addendum contains information on the WIPs to accompany the BCBG PCPA. The purpose of this document is to supplement the information provided in the BCBG PCPA. This document is not intended to be a stand-alone document.     Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

    Mountain coal mining in the Central Appalachians faces increased challenge under the Clean Water Act (CWA). These challenges have included the US Environmental Protection Agency's (EPA) increased involvement in permitting under Section 404 of the CWA; active opposition by environmental groups to Section 404 permits; and proposed federal legislation to reduce the availability of these permits. These recent challenges culminated in a June 11, 2009, Memorandum of Understanding (MoU) between the PEA, the Department of Interior (DoI) and the Army Corps of Engineers (Corps) that will limit the use of general permits for mountaintop coal mining and increase the scrutiny applied to individual permits, while also providing a coordinated approach for reviewing the backlog of pending permit application. By entering into the MoU, the federal agencies aim to reduce the environmental impacts of mountaintop coal mining while increasing certainty and transparency for permit applications. Challenges to Section 404 permitting for mountaintop coal mining are dynamic and new developments occur almost daily. This article provides a snapshot of the current climate.

    On May 14, 2014, the Obama Administration released a comprehensive plan to accelerate and expand Federal infrastructure permitting reform government-wide. The Office of Electricity Delivery and Energy Reliability is actively engaged in this process for transmission development.
