    The U.S. Nuclear Regulatory Commission (NRC) has received and is reviewing three applications for early site permits (ESPs). The ESP process allows early resolution of site-related issues affecting possible construction and operation of a new nuclear power plant. The nuclear industry views a successful and predictable ESP process as an important step in assessing whether to seek authorization to construct and operate a new generation of nuclear power reactors in the United States. Because consideration of ESP applications is a first-of-a-kind activity, a number of issues have emerged prior to and during the reviews of the first three applications. Issues have included the need for design information at the ESP stage, accident analyses, quality assurance, and seismic analyses. The NRC has been working to resolve identified issues to support a Commission decision on whether to issue an ESP approximately 33-37 months after receipt of each ESP application. (authors)

    Regional climate modeling using convection permitting models (CPMs) emerges as a promising framework to provide more reliable climate information on regional to local scales compared to traditionally used large-scale models (LSMs). CPMs do not use convection parameterization schemes, known as a major source of errors and uncertainties, and have more accurate surface and orography elds. The drawback of CPMs is their high demand on computational resources. For this reason, the CPM climate simulations only appeared a decade ago. In this study we aim to provide a common basis for CPM climate simulations by giving a holistic review of the topic.more » The most important components in CPM, such as physical parameterizations and dynamical formulations are discussed, and an outlook on required future developments and computer architectures that would support the application of CPMs is given. Most importantly, this review presents the consolidated outcome of studies that addressed the added value of CPM climate simulations compared to LSMs. Most improvements are found for processes related to deep convection (e.g., precipitation during summer), for mountainous regions, and for the soil-vegetation-atmosphere interactions. The climate change signals of CPM simulations reveal increases in short and extreme rainfall events and an increased ratio of liquid precipitation at the surface (a decrease of hail) potentially leading to more frequent ash oods. Concluding, CPMs are a very promising tool for future climate research. In 1970, the Federal Geothermal Steam Act was passed into law and in 1974 the Washington State Geothermal Act was passed. The legal and institutional framework thus established by the state and federal governments differed substantially in format, content, and direction. In many instances, the legal and institutional framework established left as many questions unanswered as answered, and in some cases, the framework has proven to be more of an obstacle to development than an aid. From an examination of how the state and federal governments have addressed the varying needs of geothermal development and how the courts have interpreted some of their decisions, it is clear that in order to ensure that the legal and institutional framework is adequate to serve the needs of geothermal development, it must address, at a minimum, the following topics: (1) providing developers with access and a priority right to carry out exploration and development activities; (2) characterization of the resource so as to minimize conflicts with other natural resources; (3) establishing ownership; and (4) giving careful consideration to such lease terms as rentals and royalties, lease renewals, and diligence requirements. In addition, the framework must address groundwater law and its implications for geothermal development and how geothermal development will be considered in terms of establishing utility law. At the local level, it is imperative that geothermal be given careful consideration when decisions on resource management, zoning, and regulation are made. Local governments also have the power to establish programs which can provide substantial incentives for geothermal development and, by so doing, ensure that geothermal energy contributes to economic stability and growth.

    As part of the West Coast Regional Carbon Sequestration Partnership (WESTCARB), Terralog Technologies USA, Inc., reviewed current state and federal regulations related to carbon dioxide capture and storage within geologic formations and enhanced carbon uptake in terrestrial ecosystems. We have evaluated and summarized the current and possible future permitting requirements for the six states that comprise the West Coast Regional Partnership. Four options exist for CO{sub 2} injection into appropriate geologic formations, including storage in: (1) oil and gas reservoirs, (2) saline formations, (3) unmineable coal beds, and (4) salt caverns. Terrestrial CO{sub 2} sequestration involves improved carbon conservation management (e.g. reduction of deforestation), carbon substitution (e.g., substitution for fossil fuel-based products, energy conservation through urban forestry, biomass for energy generation), and improved carbon storage management (e.g., expanding the storage of carbon in forest ecosystems). The primary terrestrial options for the West Coast Region include: (1) reforestation of under-producing lands (including streamside forest restoration), (2) improved forest management, (3) forest protection and conservation, and (4) fuel treatments for the reduction of risk of uncharacteristically severe fires (potentially with associated biomass energy generation). The permits and/or contracts required for any land-use changes/disturbances and biomass energy generation that may occur as part of WESTCARB's activities have been summarized for each state.

    This paper reviews the public service responsibilities of lawyers, and how they can fulfill the annual goal of performing pro bono services by serving certain public involvement groups, including organization involved in Constitutional issues and environmental protection matters. Public involvement groups should consider their needs for legal services and consider soliciting lawyers to serve on their boards or to volunteer legal services which will assist those lawyers in fulfilling their professional obligations under Rules of Professional Conduct. The group should identify specific activities and tasks that require the skills and training of a lawyer, including corporate governance issues; conflict-of-interest questions; the statutory construction of laws, regulations and ordinances; or analysis of potential liability. The addition of a lawyer to advisory boards for governmental agencies and for non-profit boards of charitable, religious, civic, community, environmental and educational organizations may provide those boards with knowledge, analytical approaches and insights that complement the abilities of other board members. Rules of Professional Conduct applicable to lawyers include admonitions for lawyers to provide 'Public Service'. Representative of many rules, the American Bar Association Model Rule 6.1, entitled 'Voluntary Pro Bono Publico Service' addresses every lawyer's professional responsibility to provide legal services to those 'unable to pay'.     Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

    Mountain coal mining in the Central Appalachians faces increased challenge under the Clean Water Act (CWA). These challenges have included the US Environmental Protection Agency's (EPA) increased involvement in permitting under Section 404 of the CWA; active opposition by environmental groups to Section 404 permits; and proposed federal legislation to reduce the availability of these permits. These recent challenges culminated in a June 11, 2009, Memorandum of Understanding (MoU) between the PEA, the Department of Interior (DoI) and the Army Corps of Engineers (Corps) that will limit the use of general permits for mountaintop coal mining and increase the scrutiny applied to individual permits, while also providing a coordinated approach for reviewing the backlog of pending permit application. By entering into the MoU, the federal agencies aim to reduce the environmental impacts of mountaintop coal mining while increasing certainty and transparency for permit applications. Challenges to Section 404 permitting for mountaintop coal mining are dynamic and new developments occur almost daily. This article provides a snapshot of the current climate.

    Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

    For a number of years, concerns have been raised about the length of time and the complexity involved in obtaining required permits in order to develop the geothermal resource at the Geysers. Perhaps the most important factor is jurisdiction. At the Geysers, all three levels of government - local, state, and federal - exercise significant authority over various aspects of geothermal development. In addition, several agencies within each governmental level play an active role in the permitting process. The present study is concerned primarily with the local permitting process, and the ways in which this process could be expedited. This report begins by looking at the local role in the overall permitting process, and then reviews the findings and conclusions that have been reached in other studies of the problem. This is followed by a case study evaluation of recent permitting experience in the four Geysers-Calistoga KGRA counties, and the report concludes by outlining several approaches to expediting the local permitting process.

    In accordance with the Southern States Energy Board (SSEB) proposal, as incorporated into NETL/DE-FC26-97FT34199, the objective of this agreement is to streamline the environmental technology permitting process site-to-site, state-to-state, and industry-to-industry to achieve remediation and waste processing faster, better and cheaper. SSEB is working with member Governors, legislators and regulators to build consensus on streamlining the permitting process for new and innovative technologies for addressing the legacy of environmental problems from 50 years of weapons research, development and production. This report reviews mechanisms whereby industry consortiums and the Department of Energy (DOE) have been working with State regulators and other officials in technology deployment decisions within the DOE complex. The historic development of relationships with State regulators is reviewed and the current nature of the relationships examined. The report contains observations from internal DOE reviews as well as recommendations from the General Accounting Office (GAO) and other external organizations. The report discusses reorganization initiatives leading up to a DOE Top-to-Bottom review of the Environmental Management (EM) Program and highlights points of consideration for maintaining effective linkages with State regulators. It notes how the proposed changes will place new demands upon the National Energy Technology Laboratory (NETL) and how NETL can leverage its resources by refocusing existing EM efforts specifically to states that have DOE facilities within their borders (host-states). Finally, the report discusses how SSEB's Permitting Leadership in the United States (PLUS) program can provide the foundation for elements of NETL's technical assistance program that are delivered to regulators and other decision- makers in host-states. This project helps reduce non-hardware/balance of system (BOS) costs by creating and maintaining a free and available site of permitting requirements and solar system verification software that installers can use to reduce time, capital, and resource investments in tracking permitting requirements. Software tools to identify best permitting practices can enable government stakeholders to optimize their permitting process and remove superfluous costs and requirements. Like ""a Wikipedia for solar permitting"", users can add, edit, delete, and update information for a given jurisdiction. We incentivize this crowdsourcing approach by recognizing users for their contributions in the form of SEO benefits to their company or organization by linking back to users' websites."

    The handbook consists of eight chapters addressing permitting and licensing requirements under the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended by the Superfund Amendments and Reauthorization Act of 1986 (CERCLA/SARA), the Atomic Energy Act (AEA), the Clean Air Act (CAA), the Clean Water Act (CWA), the Federal Insectide, Fungicide, and Rodenticide Act (FIFRA), the Safe Drinking Water Act (SDWA), and the Toxic Substances Control Act (TSCA). Each chapter consists of: (1) an introduction to the statute and permitting requirements; (2) a diagram illustrating the relationship between permitting requirements under the statute being discussed and permitting requirements from other environmental statutes which may have to be addressed when applying for a particular permit (e.g., when applying for a RCRA permit, permits and permit applications under the CWA, CAA, SDWA, etc. would have to be listed in the RCRA permit application); and, (3) a compilation of the permitting requirements for the regulatory program resulting from the statute.     This is the second technical report, covering the period from April 1, 2003 through September 30, 2003. This project brings together three parts of the oil exploration, development, and permitting process to form the foundation for a more fully integrated information technology infrastructure for the State of Alaska. The geo-technical component is a shared effort between the State Department of Administration and the US Department of Energy. The Alaska Oil and Gas Conservation Commission is rapidly converting high volumes of paper documents and geo-technical information to formats suitable for search and retrieval over the Internet. The permitting component is under the lead of the DNR Office of Project Management and Permitting. A web-based system will enable the public and other review participants to track permit status, submit and view comments, and obtain important project information on-line. By automating several functions of the current manual process, permit applications will be completed more quickly and accurately, and agencies will be able to complete reviews with fewer delays. Structural changes are taking place in terms of organization, statutory authority, and regulatory requirements. Geographic Information Systems are a central component to the organization of information, and the delivery of on-line services. Progress has been made to deploy the foundation system for the shared GIS based on open GIS protocols to the extent feasible. Alaska has nearly one-quarter of the nation's supply of crude oil, at least five billion barrels of proven reserves. The American Association of Petroleum Geologists report that the 1995 National Assessment identified the North Slope as having 7.4 billion barrels of technically recoverable oil and over 63 trillion cubic feet of natural gas. From these reserves, Alaska produces roughly one-fifth of the nation's daily crude oil production, or approximately one million barrels per day from over 1,800 active wells.

    The objective of this project is to eliminate three closely inter-related barriers to oil production in Alaska through the use of a geographic information system (GIS) and other information technology strategies. These barriers involve identification of oil development potential from existing wells, planning projects to efficiently avoid conflicts with other interests, and gaining state approvals for exploration and development projects. Each barrier is the result of either current labor-intensive methods or poorly accessible information. This project brings together three parts of the oil exploration, development, and permitting process to form the foundation for a more fully integrated information technology infrastructure for the State of Alaska. This web-based system will enable the public and other review participants to track permit status, submit and view comments, and obtain important project information online. By automating several functions of the current manual process, permit applications will be completed more quickly and accurately, and agencies will be able to complete reviews with fewer delays. The application will include an on-line diagnostic Coastal Project Questionnaire to determine the suite of permits required for a specific project. The application will also automatically create distribution lists based on the location and type of project, populate document templates for project review start-ups, public notices and findings, allow submission of e-comments, and post project status information on the Internet.     The information contained and/or referenced in this Annual Hanford Site Environmental Permitting Status Report (Status Report) addresses the State Environmental Policy Act (SEPA) of 1971 and Condition II.W. of the Resource Conservation and Recovery Act (RCRA) of 1976 Permit, Dangerous Waste Portion (DW Portion). Condition II.W. of the RCRA Permit specifies the Permittees are responsible for all other applicable federal, state, and local permits for the development and operation of the Hanford Facility. Condition II.W. of the RCRA Permit specifies that the Permittees are to use their best efforts to obtain such permits. For the purposes of permit condition, `best efforts` means submittal of documentation and/or approval(s) in accordance with schedules specified in applicable regulations, or as determined through negotiations with the applicable regulatory agencies. This Status Report includes information on all existing and anticipated environmental permitting. Environmental permitting required by RCRA, the Hazardous and Solid Waste Amendments (HSWA) of 1984, and non-RCRA permitting (solid waste handling, Clean Air Act Amendments of 1990, Clean Water Act Amendments of 1987, Washington State waste discharge, and onsite sewage system) is addressed. Information on RCRA and non-RCRA is current as of July 31, 1998.     The Clean Air Act of 1990 (CAA) mandated that all facilities classified as major were to obtain a Federal Title V operating permit. In addition, any facility, either major or minor, which emits certain chemicals or compounds above a specific single quantity limit or a total aggregate limit are subject to Title III requirements and are required to obtain a Title V permit as well. The problem with obtaining a Title V permit for Title III substances is there is limited data, at least for the utilities sources, on emission factors and emission rates for many of the Title III listed chemical compounds. In addition, the emission data that exists is very conservative, and if used, would show the facilities to be significant emitters of hazardous air emissions, while actual emissions are significantly less. This could lead a facility to applying for a Title V permit unnecessarily, a time consuming process at best. In Iowa, facilities submitted the first Title V permit applications in 1994. The Iowa Department of Natural Resources is currently in the process of reviewing the submittals prior to issuing operating permits. Title III has not been addressed at all in the submittals and therefore will not be included in this round of finished permits that are to be issued. The outcome of this is that the Title V permits will have to be opened and amended to include the applicable Title III operating conditions and constraints. This paper will examine the areas where Title III and Title V collide and the potential permitting and enforcement issues that will have to be faced by the facilities that operate under these permits. This paper is based on the opinions of two of the three responsible parties (facilities and consultants) that are dealing with the potential permitting and enforcement wreckage before the collision occurs.

    Permitting is a major component of the geothermal development process. Better coordination across government agencies could reduce uncertainty of the process and the actual time of permitting. This presentation highlights various forms of coordinating permit offices at the state and federal level in the western United States, discusses inefficiencies and mitigation techniques for permitting natural resource projects, analyzes whether various approaches are easily adaptable to utility-scale geothermal development, and addresses advantages and challenges for coordinating permit offices. Key successful strategies identified include: 1. Flexibility in implementing the approach (i.e. less statutory requirements for the approach); 2. Less dependence on a final environmental review for information sharing and permit coordination; 3. State and federal partnerships developed through memorandum of understanding to define roles and share data and/or developer information. A few of the most helpful techniques include: 1. A central point of contact for the developer to ask questions surrounding the project; 2. Pre-application meetings to assist the developer in identifying all of the permits, regulatory approvals, and associated information or data required; 3. A permit schedule or timeline to set expectations for the developer and agencies; 4. Consolidating the public notice, comment, and hearing period into fewer hearings held concurrently.

    Title 5 of the 1990 Clean Air Act Amendments (CAAA) establishes a massive new operating permit program, which will be administered by state agencies in accordance with federal guidelines. Formal requirements regarding operating-permits were promulgated by the US Environmental Protection Agency (EPA) on July 21, 1992 (40 CFR 70). The Title 5 program will require many chemical manufacturing facilities to apply for and obtain operating permits that address air emissions from the entire facility. A major impact of the Title 5 program is that facilities will now be required to implement measures to routinely demonstrate that they are operating in compliance with the terms of the permit. Otherwise, facilities will be considered out of compliance. Once the new permits are in place, the burden will be on the facility to prove routine compliance to prevent any enforcement action. According to EPA, the new permits are not intended to impose any new regulatory requirements on a facility. Rather, they will serve as an enforcement tool.

    Titles IV and V of the Clean Air Act Amendments of 1990 (Act or CAA) created two new stationary source permitting programs, one specific to acid rain (Title IV), and a second for operating permits in general (Title V). The Phase 2 portion of the acid rain program was designed to be implemented through the Title V operating permit program, thereby subjecting all Phase 2 acid rain sources to the requirements of Title V. Permits issued pursuant to Phase 2 of the acid rain program will be viewed as a self-contained portion of the Title V operating permit and will be governed by regulations promulgated under both Title IV and Title V. The requirements imposed by Title IV may not always be consistent with the broader operating permit program requirements of Title V, and when inconsistency occurs, the acid rain requirements will take precedence. This nonalignment will perhaps be most apparent during two stages of initial permitting: (1) the transition period following Title V program approval when permit application, issuance, and effective dates differ between the two programs, and (2) at the point when acid rain permits must be reopened to incorporate Phase 2 NO{sub x} requirements. This paper explores strategies for streamlining implementation of the two programs with particular focus on these two coordination issues.

    The Central Artery/Tunnel (CA/T) Project in Boston, Massachusetts involves the replacement of the existing I-93 interstate highway (Central Artery) and the extension of I-90 (Massachusetts Turnpike) to Logan International Airport. To date, approximately 95 environmental and related permits have been obtained for the CA/T Project. At least 200 permits from federal, state and local regulatory agencies will be acquired for the entire Project. The proposed action includes construction activities and permanent structures related to the crossing of three bodies of water: Charles River, Fort Point Channel, and Boston Inner Harbor. The Project also includes work in Massachusetts filled tidelands, relocation or construction of outfalls, disposition of construction dewatering and tunnel drainage fluids, and capping of an abandoned landfill. The number of permits, interrelationships between permits and interfaces with design and construction schedules have necessitated the development and implementation of a permit tracking system. The system tracks permit applications from preparation through public and agency review to permit issuance. The issues are discussed in detail: Phased development of the tracking system; Utilization of Project standard scheduling system software, Primavera Project Planner; How the information generated by the tracking system is used at the Project; Report format and production; Construction phase services and the multidiscipline, integrated Project schedule.

    This document, Set 2, the Hanford Facility Dangerous Waste Part B Permit Application, consists of 15 chapters that address the content of the Part B checklists prepared by the Washington State Department of Ecology (Ecology 1987) and the US Environmental Protection Agency (40 CFR 270), with additional information requirements mandated by the Hazardous and Solid Waste Amendments of 1984 and revisions of WAC 173-303.     Natural resource damages liability is a major development in environmental law. Government authorities are increasingly seeking damage claims for injury to natural resources, invoking the natural resource damages (NRD) provisions of the federal Superfund statute and the Oil Pollution Act. The number of Claims asserted is increasing, and the amounts sought range to hundreds of millions of dollars, with some claims exceeding $1 billion. Some assert that the federal NRD program is an awakening sleeping giant that could threaten to rival the Superfund cleanup program in cost and the potential for imposing far-reaching liabilities on a wide range of businesses as well as the federal government. Lawyers, economists, and other experts on NRD have become fully engaged in comprehensive analyses of the legal, economic and policy issues presented by NRD claims, including a full review of the NRD litigating record. Many critics find that existing NRD law and practice is flawed; produces excessive liability claims, skewed incentives and economic waste; and urgently needs reform. Changes have been recommended to improve the law and refocus the NRD program on achieving cost-effective restoration of injured natural resources. These analytical endeavors are especially timely because Congress is currently considering significant changes in NRD law. This overview will provide a brief background summary of the NRD program and highlight some of the central legal and scientific issues facing government policy makers and litigants in NRD cases.

    The Clean Air Act Amendments of 1990, which amended the Federal Clean Air Act of 1977, required that the US Environmental Protection Agency develop a national Air Operating Permit Program, which in turn would require each state to develop an Air Operating Permit Program to identify all sources of ``regulated`` pollutants. Regulated pollutants include ``criteria`` pollutants (oxides of nitrogen, sulfur oxides, total suspended particulates, carbon monoxide, particulate matter greater than 10 micron, lead) plus 189 other ``Hazardous`` Air Pollutants. The Hanford Site, owned by the US Government and operated by the US Department of Energy, Richland Operations Office, is located in southcentral Washington State and covers 560 square miles of semi-arid shrub and grasslands located just north of the confluence of the Snake and Yakima Rivers with the Columbia River. This land, with restricted public access, provides a buffer for the smaller areas historically used for the production of nuclear materials, waste storage, and waste disposal. About 6 percent of the land area has been disturbed and is actively used. The Hanford Site Air Operating Permit Application consists of more than 1,100 sources and in excess of 300 emission points. Before January 1995, the maintenance and operations contractor and the environmental restoration contractor for the US Department of Energy completed an air emission inventory on the Hanford Site. The inventory has been entered into a database so that the sources and emission points can be tracked and updated information readily can be retrieved. The Hanford Site Air Operating Permit Application contains information current as of April 19, 1995.

    The Title V permitting process is well underway for many industries and just beginning for others. Waste Management recently conducted the first in-depth reviews of draft Title V permits for some of its municipal solid waste (MSW) landfills. The Company`s comments on the draft permits were numerous. The draft permits contained some obvious as well as several less obvious errors. The results of these reviews identified a need to scrutinize carefully each and every draft permit issued to the Company`s landfills. The Company expects to require Title V permits for most of its 140 plus active landfills, due to the recently-enacted New Source Performance Standards for Municipal Solid Waste Landfills. Many issues of concern were encountered during the review. Had these issues not been identified, the facility would have had to live with an unnecessarily burdensome permit consisting of permit conditions that were more strict than the regulations required and lacking protections allowed by the law. This paper discusses many of the issues of concern identified during the draft permit review. Although many of the issues addressed in this paper are specific to MSW landfills, many of the issues are also applicable to Title V permits in general.

    Important new changes to the Hazardous Waste Facility Permit (HWFP) were implemented during 2007. The challenge was to implement these changes without impacting shipping schedules. Many of the changes required advanced preparation and coordination in order to transition to the new waste analysis paradigm, both at the generator sites and at the WIPP without interrupting the flow of waste to the disposal facility. Not only did aspects of waste characterization change, but also a new Permittees' confirmation program was created. Implementing the latter change required that new equipment and facilities be obtained, personnel hired, trained and qualified, and operating procedures written and approved without interruption to the contact-handled (CH) transuranic (TRU) waste shipping schedule. This was all accomplished successfully with no delayed or cancelled shipments. Looking forward to 2008 and beyond, proposed changes that will deal with waste in the DOE TRU waste complex is larger than the TRUPACT-IIs can handle. Size reduction of the waste would lead to unnecessary exposure risk and ultimately create more waste. The WIPP is working to have the Nuclear Regulatory Commission (NRC) certify the TRUPACT-III. The TRUPACT-III will be able to accommodate larger sized TRU mixed waste. Along with this new NRC-certified shipping cask, a new disposal container, the Standard Large Box, must be proposed in a permit modification. Containers for disposal of TRU mixed waste at the WIPP must meet the DOT 7A standards and be filtered. Additionally, as the TRUPACT-III/Standard Large Box loads and unloads from the end of the shipping cask, the proposed modification will add horizontal waste handling techniques to WIPP's vertical CH TRU waste handling operations. Another major focus will be the Hazardous Waste Facility Permit reapplication. The WIPP received its HWFP in October of 1999 for a term of ten years. These procedures are principally derived from the Commission`s Rules and Regulations in 10 CFR Sections 2.101, 2.102, Part 2-Appendix A, Section X, 50.33a, 50.80, 50.90, and 52.77. These procedures set forth the steps and criteria the staff uses in antitrust reviews of construction permit applications, operating license applications, combined construction permit/operating license applications, combined construction permit/operating license applications, and applications for approval of the transfer of construction permits, operating licenses, and combined licenses. In addition, the procedures describe how the staff enforces compliance with antitrust conditions appended to licenses.

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    The legal and institutional obstacles to the development of small-scale hydroelectric energy at the state level are discussed. The Federal government also exercises extensive regulatory authority in the area, and the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC is examined. The first step the small scale hydroelectric developer must take is that of acquiring title to the real property comprising the development site. The real estate parcel must include the requisite interest in the land adjacent to the watercourse, access to the underlying streambed and where needed, the land necessary for an upstream impoundment area. Land acquisition may be effectuated by purchase, lease, or grant by the state. In addition to these methods, New York permits the use of the eminent domain power of the state for public utilities under certain circumstances.

    Because the Chemical Weapons Convention (CWC) contains the best developed verification regime in multilaterial arms control history, some have raised concerns for the chemical industry that have legal implications. Chief among these are safeguarding confidential business information and protecting constitutional rights during inspections. This discussion will show how the CWC and proposed national implementing legislation work together to allay these concerns. Both concerns are legitimate. Confidential business information could be lost to a national government or the CWC governing body accidentially or purposely. The CWC regime of routine and challenge inspections are searches under the constitution and could, if abused, potentially conflict with recognized commercial privacy interests. Neither concern justifies opposition to the convention, but both need to be addressed in national implementing legislation. Proposed US legislation goes far in this direction, but can be improved.

    Now that most states have interim or full approval of the portions of their state implementation plans (SIPs) implementing Title V (40 CFR Part 70) of the Clean Air Act Amendments (CAAA), most sources which require a Title V permit have submitted or are well on the way to submitting a Title V operating permit application. Numerous hours have been spent preparing applications to ensure the administrative completeness of the application and operational flexibility for the facility. Although much time and effort has been spent on Title V permit applications, the operating permit itself is the final goal. This paper outlines the major Federal requirements for Title V permits as given in the CAAA at 40 CFR 70.6, Permit Content. These Federal requirements and how they will effect final Title V permits and facilities will be discussed. This paper will provide information concerning the Federal requirements for Title V permits and suggestions on how to negotiate a Title V permit to maximize operational flexibility and minimize enforcement liability.

    Major sources as defined in Title V of the Clean Air Act Amendments of 1990 that are required to submit an operating permit application will need to: Evaluate their compliance status; Determine a strategic method of presenting the general and specific conditions of their Model Operating Permit (MOP); Maintain compliance with air quality regulations. A MOP is prepared to assist permitting agencies and affected facilities in the development of operating permits for a specific source category. This paper includes a brief discussion of example permit conditions that may be applicable to various types of Title V sources. A MOP for a generic natural gas processing plant is provided as an example. The MOP should include a general description of the production process and identify emission sources. The two primary elements that comprise a MOP are: Provisions of all existing state and/or local air permits; Identification of general and specific conditions for the Title V permit. The general provisions will include overall compliance with all Clean Air Act Titles. The specific provisions include monitoring, record keeping, and reporting. Although Title V MOPs are prepared on a case-by-case basis, this paper will provide a general guideline of the requirements for preparation of a MOP. Regulatory agencies have indicated that a MOP included in the Title V application will assist in preparation of the final permit provisions, minimize delays in securing a permit, and provide support during the public notification process.
