    In October 2000, the Office of Price-Anderson Enforcement (OE) issued Enforcement Guidance Supplement (EGS) 00-04, “Factual Bases for Issuing Consent Orders Pursuant to 10 CFR 820.23 and Compliance Orders Pursuant to 10 CFR subpart C.” That EGS, in part, delineated a set of criteria that OE would use to determine whether to apply its enforcement discretion, in this case through the use of Consent Orders. Those criteria provided both guidance to DOE contractors regarding situations for which the use of Consent Orders are appropriate, and a tool to assure consistency in the OE evaluation of requests for resolution of potential violations by Consent Order.

    The Federal Energy Regulatory Commission`s (FERC) Order 888 is perhaps the most important and far reaching FERC electricity order in decades. The consequences on the structure of the industry and how the industry is regulated are significant departures from past methods and regulatory philosophy. This will undoubtedly have a dramatic impact on the manner in which state public utility commissions, which are also undergoing or considering dramatic change, regulate their jurisdictional electric utilities. This report summarizes and discusses the actions that the FERC is taking and their profound repercussions on the industry and state commissions. The report is not a comprehensive summary of the entire order. Rather, it is intended to highlight the order`s more important features and discuss what this could mean for the states. The report is organized into eight sections; the first seven address Order 888 and the last section (section 8) addresses Order 889. Section 1 through 5 summarize and discuss the main features of Order 888. Section 6 (on jurisdiction) and Section 7 (on property rights) interpret the likely consequences of the order. Section 8, summarizes the FERC`s Open Access Same Time System (OASIS) and discusses some concerns about its real-world application.

    Two orders impacting DOE nuclear safety analyses were issued in 1992: DOE 5480.22, Technical Safety Requirements,'' and DOE 5480.23, Nuclear Safety Analysis Reports.'' Both orders required submitting plans and schedules for compliance with the new requirements by 6 months from the issuance dates. These assessments resulted in a major effort by the Westinghouse Savannah River Co. (WSRC) for some 30 current and future safety analyses that span three Program Secretarial Offices. Further, the local field office expressed a vital interest in determining the shape of compliance for site nuclear operations. Thus, a team of about 20 people were involved in: Interpreting and obtaining concurrence with implementation issues; identifying applicable nuclear facilities; baselining the status of compliance with previous requirements; comparing new to previous requirements; scheduling future activities to achieve compliance with the new requirements; estimating baseline and additional costs; and obtaining management approvals.

    We reviewed selected aspects of orders placed by Lawrence Livermore National Laboratory, a Department of Energy contractor, during 1979--1985 for memorabilia, models, and illustrations and the oversight of those orders by the San Francisco Operations Office (SAN). This review extends earlier audit work at a second Department contractor, Rockwell International, Rocky Flats Plant, Engineering Prototype Group, on which we issued a report dated July 12, 1988. That audit focused on the Prototype Group's providing Livermore with illustrations, models, engineering prototypes, and other articles (mementos, plaques, etc.) during October 1977 through September 1985. Issues arose during that audit which required a separate review at SAN and Livermore, to determine specifically: the propriety of, and SAN oversight of, procurement practices followed by Livermore; the basis for the Livermore orders; the adequacy of reimbursement to the Department for silver used in medallions; and the cost ceilings for memorabilia contained in the Department's contract with the University of California, which operates Livermore for the Department. Limiting the audit scope to the orders Livermore placed with Rockwell's Prototype Group, we reviewed Department and Livermore procedures for acquiring memorabilia. In addition to interviewing SAN and Livermore Legal Counsel, Special Material Office personnel, and Research and Development Program representatives, we examined SMO requisitions, accounts payable listings and related payments, and selected research and development correspondences.

    Many Federal Facility Agreement and Consent Order (FFACO) Use Restrictions (URs) have been established at various corrective action sites (CASs) as part of FFACO corrective actions (FFACO, 1996; as amended January 2007). Since the signing of the FFACO in 1996, practices and procedures relating to the implementation of risk-based corrective action (RBCA) have evolved. This document is part of an effort to re-evaluate all FFACO URs against the current RBCA criteria (referred to in this document as the Industrial Sites [IS] RBCA process) as defined in the Industrial Sites Project Establishment of Final Action Levels (NNSA/NSO, 2006c). Based on this evaluation, the URs were sorted into the following categories: 1. Where sufficient information exists to determine that the current UR is consistent with the RCBA criteria 2. Where sufficient information exists to determine that the current UR may be removed or downgraded based on RCBA criteria. 3. Where sufficient information does not exist to evaluate the current UR against the RCBA criteria. After reviewing all the existing FFACO URs, the 49 URs addressed in this document have sufficient information to determine that these current URs may be removed or downgraded based on RCBA criteria. This document presents recommendations on modifications to existing URs that will be consistent with the RCBA criteria.

    This is the report on Task IB, Familiarization with Additional Data Collection Plans of Annual Survey of BOMA Member and Non-Member Buildings in 20 Cities, of the Energy Use in Office Buildings project. The purpose of the work was to monitor and understand the efforts of the Building Owners and Managers Association International (BOMA) in gathering an energy-use-oriented data base. In order to obtain an improved data base encompassing a broad spectrum of office space and with information suitable for energy analysis in greater detail than is currently available, BOMA undertook a major data-collection effort. Based on a consideration of geographic area, climate, population, and availability of data, BOMA selected twenty cities for data collection. BOMA listed all of the major office space - buildings in excess of 40,000 square feet - in each of the cities. Tax-assessment records, local maps, Chamber of Commerce data, recent industrial-development programs, results of related studies, and local-realtor input were used in an effort to assemble a comprehensive office-building inventory. In order to verify the accuracy and completeness of the building lists, BOMA assembled an Ad-Hoc Review Committee in each city to review the assembled inventory of space. A questionnaire on office-building energy use and building characteristics was developed. In each city BOMA assembled a data collection team operating under the supervision of its regional affiliate to gather the data. For each city a random sample of buildings was selected, and data were gathered. Responses for over 1000 buildings were obtained.

    In October 1978, Mesa College entered into subcontract with Bendix Field Engineering Corporation (BFEC) to prepare a bibliographic index of the uranium raw materials reports issued by the Grand Junction Office of the US Department of Energy (DOE). Bendix, prime contractor to the Grand Junction Office, operates the Technical Library at the DOE facility. Since the early 1950s, approximately 2700 reports have been issued by the Grand Junction Office. These reports were the results of uranium investigations conducted by federal agencies and their subcontractors. The majority of the reports cover geology, mineralogy, and metallurgy of uranium and/or thorium. No single, complete list of these reports existed. The purpose of this subcontract was to compile a comprehensive index to these reports. The Mesa College geology faculty worked with the BFEC and DOE staffs to develop the format for the index.     This first edition of the Martin Marietta Energy Systems, Inc., (Energy Systems) Groundwater Program Annual Report summarizes the work carried out by the Energy Systems GWPO for fiscal year (FY) 1993. This introductory section describes the GWPO`s staffing, organization, and funding sources. The GWPO is responsible for coordination and oversight for all components of the groundwater program at the three Oak Ridge facilities [ORNL, the Oak Ridge Y-12 Plant, and the Oak Ridge K-25 Site], and the PGDP and PORTS, respectively. Several years ago, Energy systems senior management recognized that the manner in which groundwater activities were conducted at the five facilities could result in unnecessary duplication of effort, inadequate technical input to decisions related to groundwater issues, and could create a perception within the regulatory agencies of a confusing and inconsistent approach to groundwater issues at the different facilities. Extensive interactions among management from Environmental Compliance, Environmental Restoration (ER), Environmental Sciences Division, Environmental Safety and Health, and the five facilities ultimately led to development of a net technical umbrella organization for groundwater. On April 25, 1991, the GWPO was authorized to be set up within ORNL thereby establishing a central coordinating office that would develop a consistent technical and administrative direction for the groundwater programs of all facilities and result in compliance with all relevant U.S. Environmental Protection Agency (EPA) regulations such as RCRA and Comprehensive Environmental Restoration, Compensation and Liability Act (CERCLA) as well as U.S. Department of Energy (DOE) regulations and orders. For example, DOE Order 5400.1, issued on November 9, 1988, called for each DOE facility to develop an environmental monitoring program for all media (e.g., air, surface water, and groundwater).

    The primary purpose of this contract was to provide technical analyses, studies, and reviews related to land use/water issues and energy resource development in support of the activities of the Office of Environmental Analysis, Office of Environment, Safety and Health. Tasks under this contract included: Issue Papers. Energetics provided issue papers on a number of specific energy and environmental issue areas. Each issue paper consisted of a systematic review and analysis of major factors (technical, legal, environmental, economic, energy, health and social) that could enter into DOE`s environmental/energy policy decisions; Special Analyses. Energetics conducted special in-depth technical analyses as requested by the Contracting Officer`s Technical Representative (COTR); and Critical Review and Evaluation of Program Reports. Energetics performed critical reviews of a number of technical reports arising from DOE program activities. These documents included issue papers and reports resulting from special technical analyses of specific issues, technologies, or broad areas of concern. Reviews focused on both the technical and programmatic impact of the report. Energetics made recommendations and gave input to assist DOE in determining the environmental impacts of energy policies and projects.

    pivotal year for the Procurement and Property Department. A provision of the management contract that was signed fives years ago required us to achieve cost savings of $30M. I am proud to announce that this last fiscal year we reached that goal, in large part due to the implementation of eBuy, and the negotiation of strategic sourcing contracts. Our last wall-to-wall inventory exceeded all the Department of Energy's (DOE) national targets and DOE approved the LBNL property system unconditionally. Of the total inventory, 92.3% or 25,601 assets were accounted for using barcode scanning that made the inventory process much more efficient. The effective management of the American Recovery and Reinvestment Act (ARRA) funds was strengthened by the continued successful partnership that LBNL shares with our DOE Site Office. They provided authority, support and clarity to this very complex task. The Laboratory's ARRA Stimulus Committee played a critical role in assuring internal controls, compliance with DOE regulations and quality financial management. The LBNL Budget Officer led a DOE complex-wide effort to identify and share how various DOE facilities track and report ARRA-funded projects, share best practices, evaluate issues and discuss solutions. LBNL has been recognized as a leader in this process and will continue to share knowledge and best practices with other DOE laboratories. Continuous education of our staff as well as the greater Laboratory population was still a major focus of the OCFO. With the help of many OCFO senior managers and staff that acted as subject-matter experts, the Core Financial Management Program was completely re-engineered and resulted in a revised classroom and web-based curriculum that will be formally rolled out Lab-wide in early FY2011.
