    The US Supreme Court this term is expected to rule on whether Congress has authorized the states to impose the full array of mineral taxes on production from Indian reservations. In the case under consideration, Blackfeet Tribe of indians V. Montana, the tribes claim that the states no longer have congressional authorization to tax mineral leases under the Indian Mineral Leasing Act of 1938 or joint ventures under the Indian Mineral Development Act of 1982. Operators claim it is unfair for mineral production on Indian reservations alone to be subject to double taxation.

    The Indian Energy Resource Development Program, authorized by Title XXVI of the 1992 Energy Policy Act, provides funding to American Indian tribes to develop Indian renewable energy and other energy resources. In fiscal years 1994 and 1995, 35 grants totaling $6.5 million were awarded to 29 tribes and Alaskan native corporations in 13 states. The projects cover the development range from feasibility studies to purchase and installation of equipment for commercial projects. Technologies include photovoltaics, biomass, wind, building energy efficiency, hydroelectricity, integrated resource planning, coal-fired cogeneration, and multi-sector natural gas. The Title XXVI program provides an important opportunity for assessing the technical and economic feasibility of renewable energy on Indian lands, and also for demonstrating DOE-developed technologies in real-life settings.

    The Umatilla Anadromous Fisheries Habitat Project (UAFHP) is an ongoing effort to protect, enhance, and restore riparian and instream habitat for the natural production of anadromous salmonids in the Umatilla River Basin, Northeast Oregon. Flow quantity, water temperature, passage, and lack of in-stream channel complexity have been identified as the key limiting factors in the basin. During the 2007 Fiscal Year (FY) reporting period (February 1, 2007-January 31, 2008) primary project activities focused on improving instream and riparian habitat complexity, migrational passage, and restoring natural channel morphology and floodplain function. Eight fisheries habitat enhancement projects were implemented on Meacham Creek, Camp Creek, Greasewood Creek, Birch Creek, West Birch Creek, and the Umatilla River. Specific restoration actions included: (1) rectifying five fish passage barriers on four creeks, (2) planting 1,275 saplings and seeding 130 pounds of native grasses, (3) constructing two miles of riparian fencing for livestock exclusion, (4) coordinating activities related to the installation of two off-channel, solar-powered watering areas for livestock, and (5) developing eight water gap access sites to reduce impacts from livestock. Baseline and ongoing monitoring and evaluation activities were also completed on major project areas such as conducting photo point monitoring strategies activities at the Meacham Creek Large Wood Implementation Project site (FY2006) and at all existing easements and planned project sites. Fish surveys and aquatic habitat inventories were conducted at project sites prior to implementation. Monitoring plans will continue throughout the life of each project to oversee progression and inspire timely managerial actions. Twenty-seven conservation easements were maintained with 23 landowners. Permitting applications for planned project activities and biological opinions were written and approved.     On June 25--27, 1995, at Mesa Verde National Park in southwestern Colorado, the Center for Resource Management (CRM), organized and sponsored a conference in conjunction with the Navajo Nation, EPA, and Bechtel Group, Inc., to deal with issues associated with developing renewable energy resources on Indian lands. Due to the remoteness of many reservation homes and the cost of traditional power line extensions, a large percentage of the Indian population is today without electricity or other energy services. In addition, while they continue to develop energy resources for export, seeing only minimal gain in their own economies, Indian people are also subject to the health and environmental consequences associated with proximity to traditional energy resource development. Renewable energy technologies, on the other hand, are often ideally suited to decentralized, low-density demand. These technologies--especially solar and wind power--have no adverse health impacts associated with generation, are relatively low cost, and can be used in applications as small as a single home, meeting power needs right at a site. Their minimal impact on the environment make them particularly compatible with American Indian philosophies and lifestyles. Unfortunately, the match between renewable energy and Indian tribes has been hampered by the lack of a comprehensive, coordinated effort to identify renewable energy resources located on Indian lands, to develop practical links between Indian people`s needs and energy producers, and to provide the necessary training for tribal leaders and members to plan, implement, and maintain renewable energy systems. Summaries of the presentations are presented.

This assessment was conducted to supplement documentation related to the Storm Water Pollution Prevention Plan for Construction Activities and to ensure that disturbed vegetation and soil at various locations are being restored. This report provides the following information for each site being monitored by the Idaho National Laboratory Environmental Support and Services: • Summary of each site • Assessment of vegetation status and site stabilization at each location • Actions and Resolutions for each site. Ten disturbed sites were evaluated for this assessment. Six have achieved final stabilization. The remaining four sites not meeting the criteria for final stabilization will be evaluated again in the next fiscal year.

    During fiscal year 1993, the reserves generated $440 million in revenues, a $33 million decrease from the fiscal year 1992 revenues, primarily due to significant decreases in oil and natural gas prices. Total costs were $207 million, resulting in net cash flow of $233 million, compared with $273 million in fiscal year 1992. From 1976 through fiscal year 1993, the Naval Petroleum and Oil Shale Reserves generated $15.7 billion in revenues for the US Treasury, with expenses of $2.9 billion. The net revenues of $12.8 billion represent a return on costs of 441 percent. See figures 2, 3, and 4. In fiscal year 1993, production at the Naval Petroleum and Oil Shale Reserves at maximum efficient rates yielded 25 million barrels of crude oil, 123 billion cubic feet of natural gas, and 158 million gallons of natural gas liquids. The Naval Petroleum and Oil Shale Reserves has embarked on an effort to identify additional hydrocarbon resources on the reserves for future production. In 1993, in cooperation with the US Geological Survey, the Department initiated a project to assess the oil and gas potential of the program`s oil shale reserves, which remain largely unexplored. These reserves, which total a land area of more than 145,000 acres and are located in Colorado and Utah, are favorably situated in oil and gas producing regions and are likely to contain significant hydrocarbon deposits. Alternatively the producing assets may be sold or leased if that will produce the most value. This task will continue through the first quarter of fiscal year 1994.

Five disturbed sites were evaluated for this assessment. Four sites are recommended to be removed from the annual assessment, and one is recommended for continued evaluation. New sites are also identified for future monitoring as part of the annual assessment.

    This report summarizes activities of the Hanford Cultural Resources Laboratory (HCRL) during fiscal year 1989. The HCRL provides support for managing the archaeological, historical, and cultural resources of the Hanford Site, Washington, in a manner consistent with the National Historic Preservation Act of 1966, the Archaeological Resources Protection Act of 1979, and the American Indian Religious Freedom Act of 1978. A major task in FY 1989 was completion and publication of the Hanford Cultural Resources Management Plan, which prioritizes tasks to be undertaken to bring the US Department of Energy -- Richland Operations into compliance with federal statutes, relations, and guidelines. During FY 1989, six tasks were performed. In order of priority, these were conducting 107 cultural resource reviews, monitoring the condition of 40 known prehistoric archaeological sites, assessing the condition of artifact collections from the Hanford Site, evaluating three sites and nominating two of those to the National Register of Historic Places, developing an education program and presenting 11 lectures to public organizations, and surveying approximately 1 mi{sup 2} of the Hanford Site for cultural resources. 7 refs., 4 figs., 4 tabs.

    Whether a tribe can tax is now but old rhetoric. How to tax has become the more crucial question. Tribes must develop taxing schemes that are reasonable and competitive. How public services are linked to taxation, as well as who are the recipients of those services, is weighed heavily in considering whether other taxing entities interfere with tribal governments. The Merrion Decision, which upheld the authority of a tribe to impose taxes on minerals extracted from tribal lands, serves as a milestone in Indian taxation; however, the decision itself pointed to possible pitfalls unless tribes judiciously exercise judgement in their use of the power to tax. 39 references.

    The U.S. Environmental Protection Agency (EPA) launched the RE-Powering America's Land initiative to encourage development of renewable energy on potentially contaminated land and mine sites. EPA collaborated with the U.S. Department of Energy's (DOE's) National Renewable Energy Laboratory (NREL) and the Mille Lacs Band of Chippewa Indians to evaluate the wind resource and examine the feasibility of a wind project at a contaminated site located on the Mille Lacs Indian Reservation in Minnesota. The wind monitoring effort involved the installation of a 60-m met tower and the collection of 18 months of wind data at multiple heights above the ground. This report focuses on the wind resource assessment, the estimated energy production of wind turbines, and an assessment of the economic feasibility of a potential wind project sited this site.

The tribe is now investigating the feasibility of commercial scale development of a wind power project on tribal lands. The proposed project is a joint effort between the tribe and its subcontractor and consultant, SeaWest Consulting.

    The Upper Skagit Indian Tribe lands consist of 550 acres of the Bow Hill Complex with reservation and new development economic lands located in Skagit County, Washington, adjacent to Interstate 5. The strategic energy plan would complete an assessment of the existing economic enterprises including hotel, convention center, and casino, plus potential green energy sources to serve the existing and developing facilities. The strategic energy analysis would complete an assessment of 50 acres acquired in October 2004, to build more low-income houses, and identify energy improvements for the existing fully developed 74 acres of the Helmick Road Reservation established in 1981.

    The annual program summary provides stakeholders within the hydrogen community with a snapshop of important advances that have occurred in the National Hydrogen Program over the fiscal year, including industry interactions and cooperation. The document will also be used to encourage additional potential industrial partners to join the Hydrogen Program Team. Fiscal Year 1994 marked a turning point for the Hydrogen Program, with a budget that grew significantly. The focus of the program was broadened to include development of hydrogen production technologies using municipal solid waste and biomass, in addition to an increased emphasis on industrial involvement and near-term demonstration projects. In order to maintain its near- and long-term balance, the Hydrogen Program will continue with basic, fundamental research that provides the long-term, high-risk, high-payoff investment in hydrogen as an energy carrier.

    The Mississippi Band of Choctaw Indians (MBCI) always seeks new opportunities to diversify its economy and create new career opportunities for tribal members, which is the purpose of this feasibility study. The MBCI will study the feasibility of locating a renewable energy installation on tribal lands. The technologies to be utilized in the renewable energy installation will be those that can readily handle poultry litter, either alone or in combination with wood residues. The purpose of the study is to determine whether such an installation can be both economically sustainable and consistent with the cultural, social, and economic goals of the tribe. The feasibility study will result in the development of a thorough business plan that will allow the MBCI to make an informed decision regarding this project.

    The Tribes strategic energy planning effort is divided into three phases: (1) Completing an Energy Resource Assessment; (2) Developing a Long-Term Strategic Energy Plan; and (3) Preparing a Strategic Energy Implementation Plan for the Samish Homelands. The Samish Indian Nation developed a comprehensive Strategic Energy plan to set policy for future development on tribal land that consists of a long-term, integrated, systems approach to providing a framework under which the Samish Community can use resources efficiently, create energy-efficient infrastructures, and protect and enhance quality of life. Development of the Strategic Energy plan will help the Samish Nation create a healthy community that will sustain current and future generations by addressing economic, environmental, and social issues while respecting the Samish Indian Nation culture and traditions.

The statements have been prepared in accordance with the Office of Management and Budget Bulletin No. 94-01, Form and Content for Agency Financial Statements, and were developed in accordance with the hierarchy of accounting standards described therein. The overview provides a narrative on the Department of Energy`s mission, activities, and accomplishments.     The mission of the Department of Energy's (DOE's) Office of Environmental Management (EM) is to clean up the environmental legacy of nuclear weapons research and production during the Cold War. That mission includes cleaning up nuclear waste, contaminated groundwater and soil, nuclear materials, and contaminated facilities covering two million acres of land in thirty-five states. EM's principal program goals include timely completion of tank waste treatment facilities, reduction of the life-cycle costs and acceleration of the cleanup of the Cold War legacy, and reduction of the EM footprint. The mission of the EM Technology Innovation and Development program is to transform science and innovation into practical solutions to achieve the EM mission. During fiscal year 2010 (October 2009-September 2010), EM focused upon accelerating environmental cleanup by expeditiously filling identified gaps in available knowledge and technology in the EM program areas. This report describes some of the approaches and transformational technologies in tank waste processing, groundwater and soil remediation, nuclear materials disposition, and facility deactivation and decommissioning developed during fiscal year 2010 that will enable EM to meet its most pressing program goals.

    The Waste Management Program is pleased to issue the Fiscal Year 1998 Progress Report presenting program highlights and major accomplishments of the last year. This year-end update describes the current initiatives in waste management and the progress DOE has made toward their goals and objectives, including the results of the waste management annual performance commitments. One of the most important program efforts continues to be opening the Waste Isolation Pilot Plant (WIPP), located near Carlsbad, New Mexico, for the deep geologic disposal of transuranic waste. A major success was achieved this year by the West Valley Demonstration Project in New York, which in June completed the project`s production phase of high-level waste processing ahead of schedule and under budget. Another significant accomplishment this year was the award of two privatization contracts for major waste management operations, one at Oak ridge for transuranic waste treatment, and one at Hanford for the Tank Waste Remediation System privatization project. DOE is proud of the progress that has been made, and will continue to pursue program activities that allow it to safely and expeditiously dispose of radioactive and hazardous wastes across the complex, while reducing worker, public, and environmental risks.

    Located in Uncasville, Connecticut, the Mohegan Tribe of Indians of Connecticut is in an area classified by EPA as ozone non-attainment. The air shed of the reservation receives trans-boundary ozone and its precursors from upwind non-Native American sources. Therefore, conservation, prevention, and mitigation of air pollution are important. Use of sustainable energy is preferred.

    U.S. Department of Energy (DOE) employees and contractors frequently work with Indian tribes or nations as part of their jobs. The purpose of this guide is to help DOE employees and contractors initiate contact with tribes and build effective relationships. DOE maintains a unique government-to government relationship with tribal nations. This guide presents an overview of the history of the relationship between the tribes and the Federal government, as well as the laws and Executive Orders that define that relationship. The guide discusses the Federal government’s trust responsibility to the tribes, tribal treaty rights, and the Department of Energy’s American Indian policy. The guide also discusses important cultural differences that could lead to communication problems if not understood and provides examples of potential cultural misunderstandings. In particular the guide discusses tribal environmental beliefs that shape tribal responses to DOE actions. The guide also provides pointers on tribal etiquette during meetings and cultural ceremonies and when visiting tribal reservations. Appendix 1 gives examples of the tribal nations with whom DOE currently has Memoranda of Understanding. While this guide provides an introduction and overview of tribal relations for DOE staff and contractors, DOE has also designated Tribal Issues Points of Contacts at each of its facilities. A list of these Points of Contact for all DOE facilities is provided in Appendix 2. DOE staff and contractors should consult with the appropriate tribal representatives at their site before initiating contact with a tribal nation, because many tribes have rules and procedures that must be complied with before DOE staff or contractors may go on tribal lands or conduct interviews with tribal members. Appendix 3 is the complete DOE American Indian Policy. Appendices 4-6 are Executive Orders that govern the relationship of all federal agencies with tribal nations. DOE employees and staff are

    The Little Traverse Bay Bands of Odawa Indians is located in the northern part of lower Michigan on approximately 590 acres of land. The tribe originally had no consistent vision or strategic plan concerning its energy use. This project had three objectives. The first objective was to produce a comprehensive energy plan for the tribe. The second objective was to create an energy organization and tribal energy code. The third objective was to increase the capacity of the tribe for better understanding (through active tribal participation), capability, knowledge and awareness of energy issues through bimonthly articles in the tribal newsletter and two energy workshops. The vision, strategic plan, and code will provide the focus, direction and guidelines as the tribe seeks to develop renewable energy and energy efficiency.

    The Mississippi Band of Choctaw Indians (MBCI) always seeks new opportunities to diversify its economy and create new career opportunities for tribal members, which is the purpose of this feasibility study.     Marginal land provides an alternative potential for food and bioenergy production in the face of limited land resources; however, effective assessment of marginal lands is not well addressed. Concerns over environmental risks, ecosystem services and sustainability for marginal land have been widely raised. The objective of this study was to develop a hierarchical marginal land assessment framework for land use planning and management. We first identified major land functions linking production, environment, ecosystem services and economics, and then classified land resources into four categories of marginal land using suitability and limitations associated with major management goals, including physically marginal land, biologically marginal land, environmental-ecological marginal land, and economically marginal land. We tested this assessment framework in south-western Michigan, USA. Our results indicated that this marginal land assessment framework can be potentially feasible on land use planning for food and bioenergy production, and balancing multiple goals of land use management. We also compared our results with marginal land assessment from the Conservation Reserve Program (CRP) and land capability classes (LCC) that are used in the US. The hierarchical assessment framework has advantages of quantitatively reflecting land functions and multiple concerns. This provides a foundation upon which focused studies can be identified in order to improve the assessment framework by quantifying high-resolution land functions associated with environment and ecosystem services as well as their criteria are needed to improve the assessment framework.

    This report describes the various programs of the Office of Small and Disadvantaged Business Utilization designed to ensure small businesses have an equitable opportunity to do business with the Department of Energy. In addition, this report covers 33 organizational components of the Department and details the extent to which small business firms are participating in the procurement process as well as efforts taken to ensure continued involvement. During fiscal year 1992, the Department met or exceeded its percentage and dollar goals for 8(a) concerns, labor surplus area set-asides, and for-subcontracting to small businesses. The Department`s contract awards to small businesses totaled $3.1 billion (17.3 percent of the 18.1 billion the Department spent on contracts), which consisted of Departmental prime contracts and management and operating contracts. During fiscal year 1992, the Department awarded contracts totaling $307 million to small disadvantaged businesses under Section 8(a) of the U.S. Small Business Act. This total represents 1.7 percent of all prime contracts over $25,000 awarded by the Department during that period. The Department and its management and operating contractors awards to women-owned businesses and labor surplus area set-asides totaled $327 million and $596 million, respectively. The achievements in small business subcontracting for fiscal year 1992 was $234 million, including $23 million to small disadvantaged firms.

  8. Hanford Site Groundwater Monitoring for Fiscal Year 2000

    This report presents the results of groundwater and vadose zone monitoring and remediation for fiscal year 2000 on the U.S. Department of Energy's Hanford Site, Washington. The most extensive contaminant plumes are tritium, iodine-129, and nitrate, which all had multiple sources and are very mobile in groundwater. Carbon tetrachloride and associated organic constituents form a relatively large plume beneath the central part of the Site. Hexavalent chromium is present in smaller plumes beneath the reactor areas along the river and beneath the central part of the site. Strontium-90 exceeds standards beneath each of the reactor areas, and technetium-99 and uranium are present in the 200 Areas. RCRA groundwater monitoring continued during fiscal year 2000. Vadose zone monitoring, characterization, remediation, and several technical demonstrations were conducted in fiscal year 2000. Soil gas monitoring at the 618-11 burial ground provided a preliminary indication of the location of tritium in the vadose zone and in groundwater. Groundwater modeling efforts focused on 1) identifying and characterizing major uncertainties in the current conceptual model and 2) performing a transient inverse calibration of the existing site-wide model. Specific model applications were conducted in support of the Hanford Site carbon tetrachloride Innovative Treatment Remediation Technology; to support the performance assessment of the Immobilized Low-Activity Waste Disposal Facility; and in development of the System Assessment Capability, which is intended to predict cumulative site-wide effects from all significant Hanford Site contaminants.

    The Ecological Monitoring and Compliance program, funded through the U. S. Department of Energy/Nevada Operations Office, monitors the ecosystem of the Nevada Test Site and ensures compliance with laws and regulations pertaining to NTS biota. This report summarizes the program's activities conducted by Bechtel Nevada during fiscal year 1998. Twenty-one sites for seven projects were surveyed for the presence of state or federally protected species. Three projects were in or near habitat of the threatened desert tortoise and required special clearance and transect surveys. All geospatial data collected were entered into Bechtel Nevada's Ecological Geographic Information system for use in ongoing ecosystem management of the NTS.

    This report addresses the land use impacts of past and future energy development and summarizes the major federal and state legislation which influences the potential land use impacts of energy facilities and can thus influence the locations and timing of energy development. In addition, this report describes and presents the data which are used to measure, and in some cases, predict the potential conflicts between energy development and alternative uses of the nation's land resources. The topics section of this report is divided into three parts. The first part describes the myriad of federal, state and local legislation which have a direct or indirect impact upon the use of land for energy development. The second part addresses the potential land use impacts associated with the extraction, conversion and combustion of energy resources, as well as the disposal of wastes generated by these processes. The third part discusses the conflicts that might arise between agriculture and energy development as projected under a number of DOE mid-term (1990) energy supply and demand scenarios.

    The US Department of Energy`s (DOE) changing mission, coupled with the need to apply appropriate cleanup standards for current and future environmental restoration, prompted the need for a process to determine preferred Future Land Uses for DOE-owned sites. DOE began the ``Future Land Use`` initiative in 1994 to ensure that its cleanup efforts reflect the surrounding communities` interests in future land use. This plan presents the results of a study of stakeholder-preferred future land uses for the Brookhaven National Laboratory (BNL), located in central Long Island, New York. The plan gives the Laboratory`s view of its future development over the next 20 years, as well as land uses preferred by the community were BNL ever to cease operations as a national laboratory (the post-BNL scenario). The plan provides an overview of the physical features of the site including its history, topography, geology/hydrogeology, biological inventory, floodplains, wetlands, climate, and atmosphere. Utility systems and current environmental operations are described including waste management, waste water treatment, hazardous waste management, refuse disposal and ground water management. To complement the physical descriptions of the site, demographics are discussed, including overviews of the surrounding areas, laboratory population, and economic and non-economic impacts.

    Leakage occurs whenever actions to mitigate greenhouse gas emissions in one part of the world unleash countervailing forces elsewhere in the world so that reductions in global emissions are less than emissions mitigation in the mitigating region. While many researchers have examined the concept of industrial leakage, land-use policies can also result in leakage. We show that land-use leakage is potentially as large as or larger than industrial leakage. We identify two potential land-use leakage drivers, land-use policies and bioenergy. We distinguish between these two pathways and run numerical experiments for each. We also show that the land-use policy environment exerts a powerful influence on leakage and that under some policy designs leakage can be negative. International offsets are a potential mechanism to communicate emissions mitigation beyond the borders of emissions mitigating regions, but in a stabilization regime designed to limit radiative forcing to 3.7 2/m2, this also implies greater emissions mitigation commitments on the part of mitigating regions.

    During this fiscal year the information available in the fields of geology and hydrology of the Columbia Plateau was consolidated and two reports were issued summarizing this information. In addition, the information on engineered barriers was consolidated and a report summarizing the research to date on waste package development and design of borehole seals was prepared. The waste package studies, when combined with the hydrologic integration, revealed that even under extreme disruptive conditions, a repository in basalt with appropriately designed waste packages can serve as an excellent barrier for containment of radionuclides for the long periods of time required for waste isolation. On July 1, 1980, the first two heater tests at the Near-Surface Test Facility were started and have been successfully operated to this date. The papers on the Near-Surface Test Facility section of this report present the results of the equipment installed and the preliminary results of the testing. In October 1979, the US Department of Energy selected the joint venture of Kaiser Engineers/Parsons Brinckerhoff Quade and Douglas, Inc., to be the architect-engineer to produce a conceptual design of a repository in basalt. During the year, this design has progressed and concept selection has now been completed. This annual report presents a summary of the highlights of the work completed during fiscal year 1980. It is intended to supplement and summarize the nearly 200 papers and reports that have been distributed to date as a part of the Basalt Waste Isolation Project studies.

  19. Hanford Site Groundwater Monitoring for Fiscal Year 1999

    This report presents the results of groundwater and vadose zone monitoring and remediation for fiscal year 1999 on the US. Department of Energy's Hanford Site, Washington. Water-level monitoring was performed to evaluate groundwater flow directions, to track changes in water levels, and to relate such changes to evolving disposal practices. Measurements for site-wide maps were conducted in June in past years and are now measured in March to reflect conditions that are closer to average. Water levels over most of the Hanford Site continued to decline between June 1998 and March 1999. The most widespread radiological contaminant plumes in groundwater were tritium and iodine-129. Concentrations of carbon-14, strontium-90, technetium-99, and uranium also exceeded drinking water standards in smaller plumes. Cesium-137 and plutonium exceeded standards only near the 216-B-5 injection well. Derived concentration guide levels specified in US Department of Energy Order 5400.5 were exceeded for plutonium, strontium-90, tritium, and uranium in small plumes or single wells. Nitrate and carbon tetrachloride are the most extensive chemical contaminants. Chloroform, chromium, cis-1,2dichloroethylene, cyanide, fluoride, and trichloroethylene also were present in smaller areas at levels above their maximum contaminant levels. Metals such as aluminum, cadmium, iron, manganese, and nickel exceeded their maximum contaminant levels in filtered samples from numerous wells; however, in most cases, they are believed to represent natural components of groundwater. ''Resource Conservation and Recovery Act of 1976'' groundwater monitoring continued at 25 waste management areas during fiscal year 1999: 16 under detection programs and data indicate that they are not adversely affecting groundwater; 6 under interim status groundwater quality assessment programs to assess contamination; and 2 under final status corrective-action programs.     This report presents the results of groundwater and vadose zone monitoring and remediation for fiscal year 2003 (October 2002 through September 2003) on the U.S. Department of Energy's Hanford Site, Washington. The most extensive contaminant plumes in groundwater are tritium, iodine-129, and nitrate, which all had multiple sources and are very mobile in groundwater. The largest portions of these plumes are migrating from the central Hanford Site to the southeast, toward the Columbia River. Concentrations of tritium, nitrate, and some other contaminants continued to exceed drinking water standards in groundwater discharging to the river in some locations. However, contaminant concentrations in river water remained low and were far below standards. Carbon tetrachloride and associated organic constituents form a relatively large plume beneath the central part of the Hanford Site. Hexavalent chromium is present in smaller plumes beneath the reactor areas along the river and beneath the central part of the site. Strontium-90 exceeds standards beneath all but one of the reactor areas, and technetium-99 and uranium are present in the 200 Areas. Uranium exceeds standards in the 300 Area in the south part of the Hanford Site. Minor contaminant plumes with concentrations greater than standards include carbon-14, cesium-137, cis-1,2-dichloroethene, cyanide, fluoride, plutonium, and trichloroethene. Monitoring for the ''Comprehensive Environmental Response, Compensation, and Liability Act'' is conducted in 11 groundwater operable units. The purpose of this monitoring is to define and track plumes and to monitor the effectiveness of interim remedial actions. Interim groundwater remediation in the 100 Areas continued with the goal of reducing the amount of chromium (100-K, 100-D, and 100-H) and strontium-90 (100-N) reaching the Columbia River. The objective of two interim remediation systems in the 200 West Area is to prevent the spread of carbon tetrachloride and technetium-99

    This report provides estimates of the amount of land required by past and future energy development in the United States and examines major federal legislation that regulates the impact of energy facilities on land use. An example of one land use issue associated with energy development - the potential conflict between surface mining and agriculture - is illustrated by describing the actual and projected changes in land use caused by coal mining in western Indiana. Energy activities addressed in the report include extraction of coal, oil, natural gas, uranium, oil shale, and geothermal steam; uranium processing; preparation of synfuels from coal; oil refineries; fossil-fuel, nuclear, and hydro-electric power plants; biomass energy farms; and disposal of solid wastes generated during combustion of fossil fuels. Approximately 1.1 to 3.3 x 10/sup 6/ acres were devoted to these activities in the United States in 1975. As much as 1.8 to 2.0 x 10/sup 6/ additional acres could be required by 1990 for new, nonbiomass energy development. The production of grain for fuel ethanol could require an additional 16.9 to 55.7 x 10/sup 6/ acres by 1990. Federal laws that directly or indirectly regulate the land-use impacts of energy facilities include the National Environmental Protection Act, Clean Air Act, Federal Water Pollution Control Act, Surface Mining Control and Reclamation Act, and Coastal Zone Management Act. The major provisions of these acts, other relevant federal regulations, and similar state and local regulatons are described in this report. Federal legislation relating to air quality, water quality, and the management of public lands has the greatest potential to influence the location and timing of future energy development in the United States.
