    Two federal district judges have recently opened the door for negligence suits aimed specifically an environmental consultants. In William Levy and Harper Realty, Inc. v. Versar, Inc., the respective courts allowed negligence-based claims to survive motions to dismiss, suggesting environmental consultants who fail to discover and/or disclose contamination on the properties they are investigating may be liable for considerable damages, including remediation costs and the economic losses suffered as a result of a claimant`s reliance on the environmental consultant`s work product. These cases poses great concern for environmental consultants. This paper will review these cases in detail, and other legal issues of concern to environmental consultants. It will also review the steps consultants can take to limit their liability, including obtaining errors and omissions insurance, using properly drafted environmental services agreements, properly training their employees, effectively communicating about risks with their clients, and other risk management techniques. In light of the exorbitant costs of environmental clean up, and the expansive breadth of liability imposed by federal environmental laws, consultants need to understand the potential causes of action that can be brought against them. Two federal district judges from Illinois have recently opened the door for negligence suits aimed specifically at environmental consultants, in William Levy and Harper Realty, Inc. v. Versar Inc. This paper will analyze the versar and Mobil Oil cases in detail. It will also explore other issues on professional liability generally of concern to environmental consultants. Finally, suggestion are briefly offered to guide environmental consultants as they embark on clean up activities, to reduce their potential liability to third parties.

    Energy economists have long argued the benefits of real time pricing (RTP) of electricity. Their basis for modeling customers response to short-term fluctuations in electricity prices are based on theories of rational firm behavior, where management strives to minimize operating costs and optimize profit, and labor, capital and energy are potential substitutes in the firm's production function. How well do private firms and public sector institutions operating conditions, knowledge structures, decision-making practices, and external relationships comport with these assumptions and how might this impact price response? We discuss these issues on the basis of interviews with 29 large (over 2 MW) industrial, commercial, and institutional customers in the Niagara Mohawk Power Corporation service territory that have faced day-ahead electricity market prices since 1998. We look at stories interviewees told about why and how they respond to RTP, why some customers report that they can't, and why even if they can, they don't. Some firms respond as theorized, and we describe their load curtailment strategies. About half of our interviewees reported that they were unable to either shift or forego electricity consumption even when prices are high ($0.50/kWh). Reasons customers gave for why they weren't price-responsive include implicit value placed on reliability, pricing structures, lack of flexibility in adjusting production inputs, just-in-time practices, perceived barriers to onsite generation, and insufficient time. We draw these observations into a framework that could help refine economic theory of dynamic pricing by providing real-world descriptions of how firms behave and why.

    We compute the third order gauge invariant action for scalar-graviton interactions in the Jordan frame. We demonstrate that the gauge invariant action for scalar and tensor perturbations on one physical hypersurface only differs from that on another physical hypersurface via terms proportional to the equation of motion and boundary terms, such that the evolution of non-Gaussianity may be called unique. Moreover, we demonstrate that the gauge invariant curvature perturbation and graviton on uniform field hypersurfaces in the Jordan frame are equal to their counterparts in the Einstein frame. These frame independent perturbations are therefore particularly useful in relating results in different frames at the perturbative level. On the other hand, the field perturbation and graviton on uniform curvature hypersurfaces in the Jordan and Einstein frame are non-linearly related, as are their corresponding actions and n-point functions.

    The Bonneville Power Administration (BPA) contracted with the Pacific Northwest National Laboratory (PNNL) to provide technical analytical support for system-wide fish passage information (BPA Project No. 2006-010-00). The goal of this project was to produce rigorous technical analysis products using independent analysts and anonymous peer reviewers. In the past, regional parties have interacted with a single entity, the Fish Passage Center to access the data, analyses, and coordination related to fish passage. This project provided an independent technical source for non-routine fish passage analyses while allowing routine support functions to be performed by other well-qualified entities.

    The Petroleum Technology Transfer Council (PTTC) is a unique not-for-profit network that focuses on transferring Exploration and Production (E&P) technology to the domestic oil and natural gas producing industry. PTTC connects producers, technology providers and innovators, academia, research and development (R&D) consortiums and governments. Local affordable workshops delivered by Regional Lead Organizations (RLOs), which are typically a university or geological survey, are a primary tool. PTTC also maintains a website network, issues a national newsletter, provides a column in a major trade publication, and exhibits at major industry events. It also encourages industry to ask technology-related questions, striving to find relevant answers that will save questioners significant time. Working since late 1993, the PTTC network has a proven track record of providing industry with technology insights they can apply. Volunteers at the regional and national level provide key guidance regarding where to focus technical effort and help connect PTTC with industry. At historical funding levels, PTTC had been able to hold well more than 100 workshops per year, drawing 6,000+ attendees. As funding decreased in the early 2000s, the level of activity decreased and PTTC sought a merger with the American Association of Petroleum Geologists (AAPG), becoming an AAPG-managed organization at the start of FY08. This relationship with AAPG was terminated by mutual consent in May 2011 and PTTC once again operates independently. Chris Hall, California continued to serve as Chairman of the Board of Directors until December 2013. At the time PTTC reorganized into a RLO led organization with Mary Carr and Jeremy Viscomi as co-Executive Directors. Jerry Anderson became the Chairman of the PTTC Board of Directors and Chris Hall continues to serve on the Board. Workshop activity stabilized at 55-65 workshops per year averaging 3,100 attendees.     Two Western groups - Shell and a consortium made up of Agip, Conoco, and Total - have offered to buy the refining operations of Chemopetrol Litvinov and Kaucuk Kralupy, both in the Czech republic. Meanwhile, Amoco, Neste, and PCD are looking at the possibility of acquiring some of the plastics plants at Litvinov. Amoco is interested in the polypropylene operations, Neste in polyethylene, and PCD in both. The two Czech firms are included in the second wave of privatization, which will begin in midyear. So far, there have been no offers for the 80,000-m.t./year polystyrene and 60,000-m.t./year styrene butadiene rubber operations belonging to Kralupy, although Atochem representatives recently visited the plants. Litvinov is carrying out revamping operations at its core unit, a 12-year-old, 450,000-m.t./year ethylene plant. The plant, currently running at 400,000 m.t./year, supplies downstream plants, Neratovice, and sells on the export markets. An existing ethylene pipeline between Litvinov and Bohlen in eastern Germany, which used to supply an average 100,000 m.t./year of ethylene to Bohen in exchange for naphtha, is virtually unused. One proposal involves reactivating this exchange to secure ethylene feedstock for plants in eastern Germany. According to some sources, a preliminary decision has been made to shut down the 100,000-m.t./year ethylene plant at Leuna and possibly to expand the Bohlen cracker by 100,000 m.t./year, to 400,000 m.t./year by the late 1990s.

    Section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (NDAA) requires the U.S. Department of Energy (DOE) to consult with the U.S. Nuclear Regulatory Commission (NRC) for certain non-high level waste (HLW) determinations. The NDAA also requires NRC to monitor DOE's disposal actions related to those determinations to assess compliance with NRC regulations in 10 CFR Part 61, Subpart C. The NDAA applies to DOE activities that will remain within the States of South Carolina and Idaho. DOE has chosen to, under DOE Order 435.1, engage in consultation with NRC for similar activities in the State of Washington and New York, however, the NRC has no monitoring responsibilities. In 2007, the NRC developed a draft Final Report for Interim Use entitled, NUREG-1854: NRC Staff Guidance for Activities Related to U.S. Department of Energy Waste Determinations. Since the law was enacted, the DOE and NRC have consulted on three waste determinations within the affected States: (1) the Saltstone Disposal Facility at the Savannah River Site (SRS) within the State of South Carolina in 2005, (2) the INTEC Tank Farm at the Idaho National Laboratory within the State of Idaho in 2006, and (3) the F Tank Farm at SRS in 2011. After the end of consultation and issuance by DOE of the final waste determination, monitoring began at each of these sites, including the development of monitoring plans. In addition to the NDAA sites, DOE has requested NRC consultation support on both individual tanks and the entire C Tank Farm at the Hanford Nuclear Reservation in the State of Washington. DOE also requested consultation of waste determinations performed on the melter and related feed tanks at the West Valley site in New York that would be disposed offsite. In the next few years, NRC and DOE will consult on the last of the NDAA waste determinations for a while, the H Tank Farm waste determination at SRS. DOE may identify other activities in the future but largely

    In consultation with the NRC, DOE issued a waste determination for the F-Area Tank Farm (FTF) facility in March 2012. The FTF consists of 22 underground tanks, each 2.8 to 4.9 million liters in capacity, used to store liquid high-level waste generated as a result of spent fuel reprocessing. The waste determination concluded stabilized waste residuals and associated tanks and auxiliary components at the time of closure are not high-level and can be disposed of as LLW. Prior to issuance of the final waste determination, during the consultation phase, NRC staff reviewed and provided comments on DOE's revision 0 and revision 1 FTF PAs that supported the waste determination and produced a technical evaluation report documenting the results of its multi-year review in October 2011. Following issuance of the waste determination, NRC began to monitor DOE disposal actions to assess compliance with the performance objectives in 10 CFR Part 61, Subpart C. To facilitate its monitoring responsibilities, NRC developed a plan to monitor DOE disposal actions. NRC staff was challenged in developing a focused monitoring plan to ensure limited resources are spent in the most cost-effective manner practical. To address this challenge, NRC prioritized monitoring areas and factors in terms of risk significance and timing. This prioritization was informed by NRC staff's review of DOE's PA documentation, independent probabilistic modeling conducted by NRC staff, and NRC-sponsored research conducted by the Center for Nuclear Waste Regulatory Analyses in San Antonio, TX.   20. The independent verification process in decommissioning, decontamination, and reutilization activities - description, benefits, and lessons learned

    Oak Ridge National Laboratory Environmental Technology Section has been performing Independent Verification (IV) activities for U.S. DOE sites since 1986. DOE has successfully used IV in the Uranium Mill Tailings Remedial Action Program, Decontamination and Decommissioning projects, and Formerly Utilized Sites Remedial Action Projects/Surplus Facilities Management Program. Projects that have undergone IV range from small residential properties to large, industrial sites. The IV process provides a third-party review conducted by an independent organization. The purpose is to verify accuracy and completeness of contractor field measurements and final documentation, evaluate the credibility of procedures, and independently assess post-cleanup conditions versus decommissioning project plans and release criteria. Document reviews of plans, dose models, procedures, and reports are some IV activities undertaken. Independent measurements are also collected during field visits to confirm the contractor`s findings. Corrective actions for discrepancies are suggested if necessary. Finally, archival and reporting of the final site environmental conditions for project closeout and certification are completed. The IV contractor reports to DOE headquarters and acts as a quality assurance feedback mechanism. An IV also provides additional assurance that projects are planned, carried out, and documented properly. Decommissioning projects benefit from the IV process by: (1) cost and time savings from early identification of potential problems, (2) assurance that cleanup meets regulatory guidelines, and (3) technical reviews and consultation with experts in field instrumentation, sampling strategy, etc. Some lessons learned from the IV process include avoiding: (1) improper survey techniques, (2) reporting data in units not comparable with guideline values, (3) premature release of surfaces, (4) poor decommissioning project planning, (5) misapplication of release guidelines. 20 refs.

    It is proposed that environmental professionals consider adding early community consultation to the other activities they engage in when making an environmental impact assessment. When all parties affected by a proposed project are involved in preliminary planning, problems can be defined and mutually acceptable alternatives developed that go a long way toward making a project politically as well as economically feasible. The Environmental Impact Review (EIR) that is then prepared for the modified project would be much less subject to pressures to slant the data to meet the demands of certain interest groups, freeing professionals to do their work as they know it ought to be done. Such a process would also greatly increase the chances that the recommendations of the EIR would be implemented, rather than overlooked. Ways to design an early community involvement process are illustrated by two case studies.

    This report documents an Independent Technical Review (ITR) of the facilities, organizations, plans, and activities required to transition particular elements of the Mound Plant from Defense Program (DP) funded operation as appropriate either to community developed reuse or safe deactivation leading to decontamination and decommissioning (D&D). The review was conducted at the request of the Dr. Willis Bixby, Deputy Assistant Secretary, U.S. Department of Energy EM-60, Office of Facility Transition and Management and is a consensus of the nine member ITR Team. Information for the review was drawn from documents provided to the ITR Team by the Miamisburg Area Office (MB) of the DOE, EG&G, the City of Miamisburg, and others; and from presentations, discussions, interviews, and facility inspections at the Mound Plant during the weeks of March 14 and March 28, 1994. During the week of April 25, 1994, the ITR Team met at Los Alamos, New Mexico to develop consensus recommendations. A presentation of the core recommendations was made at the Mound Plant on May 5, 1994. This is an independent assessment of information available to, and used by, the Mound Plant personnel. Repetition of the information is not meant to imply discovery by the ITR Team. Team members, however, acting as independent reviewers, frequently assess the information from a perspective that differs significantly from that of the Mound Plant personnel. The report is based on information obtained and conditions observed during the March 1994 review interval. The ITR process and normal site work often initiate rapid, beneficial changes in understanding and organization immediately following the review. These changes frequently alter conditions observed during the review, but the report does not address changes subsequent to the review interval.

    Consolidated Nuclear Security (CNS) Pantex took the initiative to organize a Review Panel of subject matter experts to independently assess the adequacy of the Pantex Tripping Man Analysis methodology. The purpose of this report is to capture the details of the assessment including the scope, approach, results, and detailed Appendices. Along with the assessment of the analysis methodology, the panel evaluated the adequacy with which the methodology was applied as well as congruence with Department of Energy (DOE) standards 3009 and 3016. The approach included the review of relevant documentation, interactive discussion with Pantex staff, and the iterative process of evaluating critical lines of inquiry.

    The first part of this report reviews recent developments at the interface between lattice work on QCD with light dynamical quarks, effective field theory and low energy precision experiments. Then I discuss how dispersion theory can be used to analyze the low energy structure of the {pi}{pi} scattering amplitude in a model independent manner. This leads to an exact formula for the mass and width of the lowest few resonances, in terms of observable quantities. As an application, I consider the pole position of the {sigma}, paying particular to error propagation in the numerical analysis. The report is based on work done in collaboration with Irinel Caprini and Gilberto Colangelo.

    We present a new model-independent dynamic feedback technique, rotation rate tuning, for automatically and simultaneously tuning coupled components of uncertain, complex systems. The main advantages of the method are: 1) It has the ability to handle unknown, time-varying systems, 2) It gives known bounds on parameter update rates, 3) We give an analytic proof of its convergence and its stability, and 4) It has a simple digital implementation through a control system such as the Experimental Physics and Industrial Control System (EPICS). Because this technique is model independent it may be useful as a real-time, in-hardware, feedback-based optimization scheme for uncertain and time-varying systems. In particular, it is robust enough to handle uncertainty due to coupling, thermal cycling, misalignments, and manufacturing imperfections. As a result, it may be used as a fine-tuning supplement for existing accelerator tuning/control schemes. We present multi-particle simulation results demonstrating the schemes ability to simultaneously adaptively adjust the set points of twenty two quadrupole magnets and two RF buncher cavities in the Los Alamos Neutron Science Center Linear Accelerators transport region, while the beam properties and RF phase shift are continuously varying. The tuning is based only on beam current readings, without knowledge of particle dynamics. We also present an outline of how to implement this general scheme in software for optimization, and in hardware for feedback-based control/tuning, for a wide range of systems.

The project being reported is to contribute to an understanding of the economic and behavioral processes that take place within a firm, and without it. Three main topics are treated. One is the representation of the characteristics of the members of an organization, to the extent to which characteristics seem pertinent to the processes of interest. The second is the appropriate management of the processes of change by an organization. The third deals with the competitive striving towards an economic equilibrium among the members of a society in the large, on the theory that this process might be modeled in a way which is similar to the one for the intra-organizational ones. This volume covers mainly the first topic.

  4. TRAC-PF1 independent assessment

    This report documents the Los Alamos results of the second assessment phase, independent assessment for TRAC-PF1. We documented the results of the developmental assessment for TRAC-PF1 in an earlier report. This report described calculations run with the released versions of TRAC-PF1. We analyzed separate-effects tests in the Semiscale facility to investigate natural-circulation and reflux cooling. We analyzed integral tests from the Semiscale and the Loss-of-Fluid Test facilities to explore the small- and intermediate-break loss-of-coolnt-accident (LOCA) capability and the non-LOCA capability. We also analyzed the loss-of-feedwater transient in the Crystal River plant. The results show reasonably good agreement with the data, but indicate that improvements are required for the critical-flow model and the interphasic-condensation model. 38 refs., 224 figs., 19 tabs.

  6. Estimated parameters as independent variables - with an application to the costs of electric-generating units

    The cost of a piece of capital equipment, like an electric-generating unit, is a function of a variety of unit-specific attributes. Some of these attributes can be observed directly without error (such as size), but others (such as the reliability or efficiency of the equipment), cannot be. However, estimates of the unobservable quality attributes can often be obtained from time-series data on expost performance, and these estimates can in turn be used as data on the unobservable attributes that appear as exogenous variables in a cost equation. The authors consider estimation of linear models in which observation-specific (firm, plant, household, individual) attributes appear as exogenous variables, but these attributes cannot be observed directly. Rather, they assume that estimates of the relevant observation-specific attributes, along with the associated covariance matrix, can be computed using data on variables (such as ex post performance) that do not appear directly in the primary model of interest. A maximum-likelihood technique for using such estimates as independent variables in cross-section regression analysis is derived. The solution to the measurement-error problem is interpretable as nonlinear (Theil-Goldberger) mixed estimation. The method is applied to the estimation of a construction cost relationship for electric-generating units.

    The Petroleum Technology Transfer Council (PTTC) continued pursuing its mission of assisting U.S. independent oil and gas producers with timely, informed technology decisions during Fiscal Year 2004 (FY04). PTTC has active grassroots programs through its 10 Regional Lead Organizations (RLOs) and 2 satellite offices. They bring research and academia to the table via their association with geological surveys and engineering departments. The regional directors interact with independent oil and gas producers through technology workshops, resource centers, websites, newsletters, technical publications and other cooperative outreach efforts. PTTC's Headquarters (HQ) staff receives direction from a National Board of Directors predominantly comprised of American natural gas and oil producers to plan and manage the overall technology transfer program. PTTC HQ implements a comprehensive communications program by interconnecting the talents of the National Board, 10 Regional Producer Advisory Groups (PAG) and the RLOs with industry across the U.S. PTTC effectively combines federal funding through the Department of Energy's (DOE) Office of Fossil Energy, namely the Strategic Center for Natural Gas and Oil with state and industry contributions to share application of upstream technologies. Ultimately, these efforts factor in to provide a safe, secure and reliable energy supply for American consumers. This integrated resource base, combined with industry volunteers guiding PTTC's activities and the dedication of national and regional staff, are achieving notable results regarding domestic production figures. PTTC is increasingly recognized as a critical resource for information and access to technologies by providing direct contact with research, development and demonstration (RD&D) results. A key to the program is demonstrating proven technologies that can be applied broadly and rapidly. This technical progress report summarizes PTTC's accomplishments during FY04. Activities

    The Petroleum Technology Transfer Council (PTTC) was established by domestic crude oil and natural gas producers, working in conjunction with the Independent Petroleum Association of America (IPAA), the U.S. Department of Energy (DOE) and selected universities, in 1994 as a national not-for-profit organization. Its goal is to transfer Exploration and Production (E&P) technology to the domestic upstream petroleum industry, in particular to the small independent operators. PTTC connects producers, technology providers and innovators, academia, and university/industry/government research and development (R&D) groups. From inception PTTC has received federal funding through DOE's oil and natural gas program managed by the National Energy Technology Laboratory (NETL). With higher funding available in its early years, PTTC was able to deliver well more than 100 workshops per year, drawing 6,000 or more attendees per year. Facing the reality of little or no federal funding in the 2006-2007 time frame, PTTC and the American Association of Petroleum Geologists (AAPG) worked together for PTTC to become a subsidiary organization of AAPG. This change brings additional organizational and financial resources to bear for PTTC's benefit. PTTC has now been 'powered by AAPG' for two full fiscal years. There is a clear sense that PTTC has stabilized and is strengthening its regional workshop and national technology transfer programs and is becoming more entrepreneurial in exploring technology transfer opportunities beyond its primary DOE contract. Quantitative accomplishments: PTTC has maintained its unique structure of a national organization working through Regional Lead Organizations (RLOs) to deliver local, affordable workshops. During the contract period PTTC consolidated from 10 to six regions efficiency and alignment with AAPG sections.     The DOE Hydrogen Program is supporting research, development, and demonstration activities to overcome the barriers to the integration of hydrogen into the Nation`s energy infrastructure. Much work is required to gain acceptance of hydrogen energy system concepts and to develop them for implementation. A systems analysis database has been created that includes a formal documentation of technology characterization profiles and cost and performance information. Through a systematic and quantitative approach, system developers can understand and address important issues and thereby assure effective and timely commercial implementation. This project builds upon and expands the previously developed and tested pathway model and provides the basis for a consistent and objective analysis of all hydrogen energy concepts considered by the DOE Hydrogen Program Manager. This project can greatly accelerate the development of a system by minimizing the risk of costly design evolutions, and by stimulating discussions, feedback, and coordination of key players and allows them to assess the analysis, evaluate the trade-offs, and to address any emerging problem areas. Specific analytical studies will result in the validation of the competitive feasibility of the proposed system and identify system development needs. Systems that are investigated include hydrogen bromine electrolysis, municipal solid waste gasification, electro-farming (biomass gasifier and PEM fuel cell), wind/hydrogen hybrid system for remote sites, home electrolysis and alternate infrastructure options, renewable-based electrolysis to fuel PEM fuel cell vehicle fleet, and geothermal energy used to produce hydrogen. These systems are compared to conventional and benchmark technologies. Interim results and findings are presented. Independent analyses emphasize quality, integrity, objectivity, a long-term perspective, corporate memory, and the merging of technical, economic, operational, and programmatic expertise.

  16. Development of a farm-firm modelling system for evaluation of herbaceous energy crops

    A complete analysis is performed to simulate biomass production incorporated into a realistic whole farm situation, including or replacing a typical crop mix. Representative farms are constructed to accommodate such simulation. Four management systems are simulated for each firm, with each simulation depicting a different crop mix and/or use of different farming technologies and production methods. The first simulation was a base farm plan in which the operator would maintain the historical crop mix for the area, participate in all price support programs, and not participate in either a conservative reserve or a biomass production program. In the second simulation, the operator would again maintain the historical crop mix, would not participate in a conservation reserve or biomass production program, and would be ineligible to participate in any price support system. The third simulation introduced the Conservation Reserve Program (CRP) and included participation in all price support programs. The fourth simulation introduced a biomass crop production enterprise (switchgrass) as an alternative to enrolling highly erodible cropland in the CRP and allowed participation in price support programs. Simulations were made for three farms, two in West Tennessee and on in South Georgia. Results indicate that erosion is likely to be reduced more by the diversion of cropland to permanent vegetative cover on farms similar to the more highly erodible West Tennessee farms than on the less erodible Tift County, Georgia farm. Equivalent reductions in erosion rates result from entering highly erodible cropland in the CRP and from production of switchgrass as a biomass energy crop. Both switchgrass and CRP farm plans result in decreased net returns from the base plan, although the biomass farm plans are, in general, more profitable than the CRP plans.

    On October 6, 1997, the Department of Energy (DOE) announced it had agreed to sell all of the Government`s interest in Naval Petroleum Reserve Number 1 (NPR-1) to Occidental Petroleum Corporation for $3.65 billion. This report presents the results of the independent certified public accountants` agreed-upon procedures work on the Preliminary Settlement Statement of the Purchase and Sale Agreement between DOE and Occidental. To fulfill their responsibilities, the Office of Inspector General contracted with the independent public accounting firm of KPMG Peat Marwick LLP to conduct the work for them, subject to their review. The work was done in accordance with the Statements on Standards for Attestation Engagements issued by the American Institute of Certified Public Accountants. As such, the independent certified public accountants performed only work that was agreed upon by DOE and Occidental. This report is intended solely for the use of DOE and Occidental and should not be used by those who have not agreed to the procedures and taken responsibility for the sufficiency of the procedures for their purposes. However, this report is a matter of public record, and its distribution is not limited. The independent certified public accountants identified over 20 adjustments to the Preliminary Settlement Statement that would result in a $10.8 million increase in the sale price.

    The First Community Consultation on the Responsible Collection and Use of Samples for Genetic Research was held in Bethesda, Maryland, on September 25-26, 2000. The consultation was convened by the National Institute of General Medical Sciences (NIGMS) of the National Institutes of Health (NIH). Approximately 120 individuals participated in the consultation, half from a broad range of communities and populations, and half from government. The participants shared their views and concerns about population- and community-based genetic research, expanding the focus of the meeting from the collection and use of blood or other tissue samples for genetic research to broader issues and concerns about the conduct of genetic research in general with populations and communities.

    In this paper, an ICA-based approach is proposed for hyperspectral image analysis. It can be viewed as a random version of the commonly used linear spectral mixture analysis, in which the abundance fractions in a linear mixture model are considered to be unknown independent signal sources. It does not require the full rank of the separating matrix or orthogonality as most ICA methods do. More importantly, the learning algorithm is designed based on the independency of the material abundance vector rather than the independency of the separating matrix generally used to constrain the standard ICA. As a result, the designed learning algorithm is able to converge to non-orthogonal independent components. This is particularly useful in hyperspectral image analysis since many materials extracted from a hyperspectral image may have similar spectral signatures and may not be orthogonal. The AVIRIS experiments have demonstrated that the proposed ICA provides an effective unsupervised technique for hyperspectral image classification.

    Global temperature series have contributions from different sources, such as volcanic eruptions and El Nino Southern Oscillation variations. We investigate independent component analysis as a technique to separate unrelated sources present in such series. We first use artificial data, with known independent components, to study the conditions under which ICA can separate the individual sources.     Independent Environmental Impact Assessment (EIA) follow-up verifiers such as monitoring agencies, checkers, supervisors and control officers are active on various construction sites across the world. There are, however, differing views on the value that these verifiers add and very limited learning in EIA has been drawn from independent verifiers. This paper aims to appraise how and to what extent independent EIA follow-up verifiers add value in major construction projects in the developing country context of South Africa. A framework for appraising the role of independent verifiers was established and four South African case studies were examined through a mixture of site visits, project document analysis, and interviews. Appraisal results were documented in the performance areas of: planning, doing, checking, acting, public participating and integration with other programs. The results indicate that independent verifiers add most value to major construction projects when involved with screening EIA requirements of new projects, allocation of financial and human resources, checking legal compliance, influencing implementation, reporting conformance results, community and stakeholder engagement, integration with self-responsibility programs such as environmental management systems (EMS), and controlling records. It was apparent that verifiers could be more creatively utilized in pre-construction preparation, providing feedback of knowledge into assessment of new projects, giving input to the planning and design phase of projects, and performance evaluation. The study confirms the benefits of proponent and regulator follow-up, specifically in having independent verifiers that disclose information, facilitate discussion among stakeholders, are adaptable and proactive, aid in the integration of EIA with other programs, and instill trust in EIA enforcement by conformance evaluation.     A model-independent treatment of dark-matter particle elastic scattering has been developed, yielding the most general interaction for WIMP-nucleon low-energy scattering, and the resulting amplitude has been embedded into the nucleus, taking into account the selection rules imposed by parity and time-reversal. One finds that, in contrast to the usual spin-independent/spin-dependent (SI/SD) formulation, the resulting cross section contains six independent nuclear response functions, three of which are associated with possible velocity-dependent interactions. We find that current experiments are four orders of magnitude more sensitive to derivative couplings than is apparent in the standard SI/SD treatment, which necessarily associated such interactions withmore » cross sections proportional to v2T ~ 10⁻⁶, where vT is the WIMP velocity relative to the center of mass of the nuclear target.« less

    Protec Fuel Management project objectives are to help design, build, provide, promote and supply biofuels for the greater energy independence, national security and domestic economic growth through job creations, infrastructure projects and supply chain business stimulants. Protec Fuel has teamed up with station owners to convert 5 existing retail fueling stations to include E85 fuel to service existing large number of fleet FFVs and general public FFVs. The stations are located in high flex fuel vehicle locations in the state of TX. Under the project name, “Job Creation and Petroleum Independence with E85 in Texas,” Protec Fuel identified and successfully opened stations strategically located to maximize e85 fueling success for fleets and public. Protec Fuel and industry affiliates and FFV manufacturers are excited about these stations and the opportunities as they will help reduce emissions, increase jobs, economic stimulus benefits, energy independence and petroleum displacement.

    New halo-independent lower bounds on the product of the dark matter-nucleon scattering cross section and the local dark matter density that are valid for annual modulations of dark matter direct detection signals are derived. They are obtained by making use of halo-independent bounds based on an expansion of the rate on the Earth’s velocity that were derived in previous works. In combination with astrophysical measurements of the local energy density, an observed annual modulation implies a lower bound on the cross section that is independent of the velocity distribution and that must be fulfilled by any particle physics model. In order to illustrate the power of the bounds we apply them to DAMA/LIBRA data and obtain quite strong results when compared to the standard halo model predictions. We also extend the bounds to the case of multi-target detectors.

    The Bonneville Power Administration (BPA) contracted with the Pacific Northwest National Laboratory (PNNL) to provide technical analytical support for system-wide fish passage information (BPA Project No. 2006-010-00). The goal of this project was to produce rigorous technical analysis products using independent analysts and anonymous peer reviewers. This project provided an independent technical source for non-routine fish passage analyses while allowing routine support functions to be performed by other well-qualified entities. The Independent Technical Analysis Process (ITAP) was created to provide non-routine analysis for fish and wildlife agencies and tribes in particular and the public in general on matters related to juvenile and adult salmon and steelhead passage through the mainstem hydrosystem. The process was designed to maintain the independence of analysts and reviewers from parties requesting analyses, to avoid potential bias in technical products. The objectives identified for this project were to administer a rigorous, transparent process to deliver unbiased technical assistance necessary to coordinate recommendations for storage reservoir and river operations that avoid potential conflicts between anadromous and resident fish. Seven work elements, designated by numbered categories in the Pisces project tracking system, were created to define and accomplish project goals as follows: (1) 118 Coordination - Coordinate technical analysis and review process: (a) Retain expertise for analyst/reviewer roles. (b) Draft research directives. (c) Send directive to the analyst. (d) Coordinate two independent reviews of the draft report. (e) Ensure reviewer comments are addressed within the final report.
