    On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

    This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. Only RODs from landfill sites were evaluated so that the results of the analysis can be used to support the remedy selection process for the Sanitary Landfill at the Savannah River Site (SRS).

    The EPA Draft Document on EMF and Cancers grew out of an earlier effort by EPA to track biological effects literature relative to radio-frequency (RF) exposure. Scope of the document was broadened to include extremely low frequency electric and magnetic fields prior to an announcement in 1986 that EPA would formally review the whole area of non-ionizing radiation. An extensive survey of the relevant bioeffects and epidemiologic literature was carried out, and writing on the document began in earnest on the document sometime in 1989. In its draft form, the document reviewed the literature on mechanisms of Interaction between electromagnetic fields and biological tissue, EMF epidemiologic studies, supporting evidence for carcinogenicity and research needs. In the early summer of 1990, a draft of the document was reviewed by some 22 individuals within the EPA and other government agencies. It was also sent out for external review to an additional 9 qualified scientists who had worked in the area and were familiar with EMF-related literature in epidemiology, biology, and physics. Many of the comments sent to EPA from this first review, prior to release of the draft for public comment, were strikingly similar to those resulting from the second (public) review process. Thus, it appears that much of the controversy that was later associated with the document could have been avoided had the authors been diligent in following the recommendations of the initial set of reviewers.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

    The Environmental Protection Agency`s proposed rule for the management and disposal of high-level waste (Draft Standard, 40 CFR 191) was reviewed and analyzed using the risk assessment methodology developed at Sandia National Laboratories. The methodology was exercised on hypothetical repository systems in basalt, bedded salt, and tuff. Among the issues addressed were achievability, release limits, uncertainty, and compliance. The proposed release limits were also analyzed in terms of their relationship to the health effects. The uncertainty in the input parameters of the deterministic models was taken into account in calculating releases to the accessible environment. Extensions to an existing compliance-assessment methodology are suggested that would allow one to incorporate the uncertainty associated with the frequency of occurrence of scenarios. The results indicate that, in general, the standards are achievable and the release limits are sufficiently conservative. 23 references, 6 figures, 3 tables.

    The Waste Isolation Pilot Plant (WIPP) is a US Department of Energy (DOE) facility for the permanent disposal of transuranic waste from defense activities. In 1996, the DOE submitted the Title 40 CFR Part 191 Compliance Certification Application for the Waste Isolation Pilot Plant (CCA) to the US Environmental Protection Agency (EPA). The CCA included a probabilistic performance assessment (PA) conducted by Sandia National Laboratories to establish compliance with the quantitative release limits defined in 40 CFR 191.13. An experimental program to collect data relevant to the actinide source term began around 1989, which eventually supported the 1996 CCA PA actinide source term model. The actinide source term provided an estimate of mobile dissolved and colloidal Pu, Am, U, Th, and Np concentrations in their stable oxidation states, and accounted for effects of uncertainty in the chemistry of brines in waste disposal areas. The experimental program and the actinide source term included in the CCA PA underwent EPA review lasting more than 1 year. Experiments were initially conducted to develop data relevant to the wide range of potential future conditions in waste disposal areas. Interim, preliminary performance assessments and actinide source term models provided insight allowing refinement of experiments and models. Expert peer review provided additional feedback and confidence in the evolving experimental program. By 1995, the chemical database and PA predictions of WIPP performance were considered reliable enough to support the decision to add an MgO backfill to waste rooms to control chemical conditions and reduce uncertainty in actinide concentrations, especially for Pu and Am. Important lessons learned through the characterization, PA modeling, and regulatory review of the actinide source term are (1) experimental characterization and PA should evolve together, with neither activity completely dominating the other, (2) the understanding of physical processes

    This paper presents an overview of the ozone human exposure and health risk analyses developed under sponsorship of the U.S. Environmental Protection Agency (EPA). These analyses are being used in the current review of the national ambient air quality standards (NAAQS) for ozone. The analyses consist of three principal steps: (1) estimating short-term ozone exposure for particular populations (exposure model); (2) estimating population response to exposures or concentrations (exposure-response or concentration-response models); and (3) integrating concentrations or exposure with concentration-response or exposure-response models to produce overall risk estimates (risk model). The exposure model, called the probabilistic NAAQS exposure model for ozone (pNEM/03), incorporates the following factors: hourly ambient ozone concentrations; spatial distribution of concentrations; ventilation state of individuals at time of exposure; and movement of people through various microenvironments (e.g., outdoors, indoors, inside a vehicle) of varying air quality. Exposure estimates are represented by probability distributions. Exposure-response relationships have been developed for several respiratory symptom and lung function health effects, based on the results of controlled human exposure studies. These relationships also are probabilistic and reflect uncertainties associated with sample size and variability of response among subjects. The analyses also provide estimates of excess hospital admissions in the New York City area based on results from an epidemiology study. Overall risk results for selected health endpoints and recently analyzed air quality scenarios associated with alternative 8-hour NAAQS and the current 1-hour standard for outdoor children are used to illustrate application of the methodology.

    The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

    Emissions of nitrogen oxides (NOx) and, subsequently, atmospheric levels of nitrogen dioxide (NO₂) have decreased over the U.S. due to a combination of environmental policies and technological change. Consequently, NO₂ levels have decreased by 30–40% in the last decade. We quantify NO₂ trends (2005–2013) over the U.S. using surface measurements from the U.S. Environmental Protection Agency (EPA) Air Quality System (AQS) and an improved tropospheric NO₂ vertical column density (VCD) data product from the Ozone Monitoring Instrument (OMI) on the Aura satellite.We demonstrate that the current OMI NO₂ algorithm is of sufficient maturity to allow a favorable correspondence of trendsmore » and variations in OMI and AQS data. Our trend model accounts for the non-linear dependence of NO₂ concentration on emissions associated with the seasonal variation of the chemical lifetime, including the change in the amplitude of the seasonal cycle associated with the significant change in NOx emissions that occurred over the last decade. The direct relationship between observations and emissions becomes more robust when one accounts for these non-linear dependencies. We improve the OMI NO₂ standard retrieval algorithm and, subsequently, the data product by using monthly vertical concentration profiles, a required algorithm input, from a high-resolution chemistry and transport model (CTM) simulation with varying emissions (2005-2013). The impact of neglecting the time-dependence of the profiles leads to errors in trend estimation, particularly in regions where emissions have changed substantially. For example, trends calculated from retrievals based on time-dependent profiles offer 18% more instances of significant trends and up to 15% larger total NO₂ reduction versus the results based on profiles for 2005.     In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    In this study, we developed and evaluated a brief training program for grant reviewers that aimed to increase inter-rater reliability, rating scale knowledge, and effort to read the grant review criteria. Enhancing reviewer training may improve the reliability and accuracy of research grant proposal scoring and funding recommendations. Seventy-five Public Health professors from U.S. research universities watched the training video we produced and assigned scores to the National Institutes of Health scoring criteria proposal summary descriptions. For both novice and experienced reviewers, the training video increased scoring accuracy (the percentage of scores that reflect the true rating scale values), inter-rater reliability, and the amount of time reading the review criteria compared to the no video condition. The increase in reliability for experienced reviewers is notable because it is commonly assumed that reviewers—especially those with experience—have good understanding of the grant review rating scale. Our findings suggest that both experienced and novice reviewers who had not received the type of training developed in this study may not have appropriate understanding of the definitions and meaning for each value of the rating scale and that experienced reviewers may overestimate their knowledge of the rating scale. Lastly, the results underscore the benefits of and need for specialized peer reviewer training.

    What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    U.S. EPA`s Wood Products Initiative has resulted in the settlement with Louisiana-Pacific (L-P) for over eleven million dollars in fines and much more in expenditures for corporate environmental improvements. EPA claimed that L-P`s corporate environmental structure inadequately addressed the environmental requirements of the Clean Air Act. L-P failed to obtain the necessary permits and provide the permitting authorities with accurate and complete information on air emissions. The author concentrates on the steps companies must follow to ensure that adequate permitting is obtained. The paper states clearly the expectations EPA has of permitting authorities and permit applicants. A checklist of criteria necessary to avoid permitting dilemmas is presented, along with practical advice for environmental managers responsible for permitting and interactions with regulatory authorities. The steps of source identification, emissions quantification, control technology selection, and permit completion are detailed.

    The quantitative procedures associated with noncancer risk assessment include reference dose (RfD), benchmark dose, and severity modeling. The RfD, which is part of the EPA risk assessment guidelines, is an estimation of a level that is likely to be without any health risk to sensitive individuals. The RfD requires two major judgments: the first is choice of a critical effect(s) and its No Observed Adverse Effect Level (NOAEL); the second judgment is choice of an uncertainty factor. This paper discusses major assumptions and limitations of the RfD model.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

  19. Improving Remedial Effectiveness at U.S. Department of Energy through Optimization Review and Performance Basis

    The U.S. Department of Energy (DOE), Office of Environmental Management (EM) conducted its first Remediation Process Optimization (RPO) review in 2004, following the methodology and guidance issued by the Interstate Technology and Regulatory Council (ITRC). The intent of this paper is to briefly summarize the following: (1) the overall benefits of the review process toward improving remedial effectiveness and efficiency at DOE, (2) the types and objectives of completed reviews, and (3) how RPO facilitates technology transfer and is complementary to performance-based environmental management (PBEM). Contract reform began in 1993, at the U.S. Department of Energy (DOE) as a result of the Government Performance and Results Act, followed by recommendations from oversight groups. The precedence of using management and operating (M and O) contracts at DOE facilities, exempt from open competition by definition, shifted to performance basis. Since 1994, DOE has competed over 70% of its then existing M and O contracts; most now contain specific performance objectives, measures, and targets that focus on results in mission critical areas. In 2001, DOE's Office of Environmental Management (EM) integrated performance-based contracting as a core business process. EM resolved to manage cleanup as a project, encourage innovative contracting strategies, as well as incentives to accelerate risk reduction and cleanup. DOE's efforts to implement performance-based environmental management (PBEM) were further realized by establishing a centralized Office of Acquisitions and the Consolidated Business Center, which support all EM procurements. In 2004, EM began conducting Remediation Process Optimization (RPO) reviews at select field sites, following the methodology published in the 2004 ITRC guidance. To date, EM has completed nine RPO reviews, including: pump and treat system optimization, monitoring program optimization, in situ barrier performance improvement, remedial design review

  1. Treatment of Lignin Precursors to Improve their Suitability for Carbon Fibers: A Literature Review

    Lignin has been investigated as a carbon fiber precursor since the 1960s. Although there have been a number of reports of successful lignin-based carbon fiber production at the lab scale, lignin-based carbon fibers are not currently commercially available. This review will highlight some of the known challenges, and also the reported methods for purifying and modifying lignin to improve it as a precursor. Lignin can come from different sources (e.g. hardwood, softwood, grasses) and extraction methods (e.g. organosolv, kraft), meaning that lignin can be found with a diversity of purity and structure. The implication of these conditions on lignin as carbon fiber precursor is not comprehensively known, especially as the lignin landscape is evolving. The work presented in this review will help guide the direction of a project between GrafTech and ORNL to develop lignin carbon fiber technology, as part of a cooperative agreement with the DOE Advanced Manufacturing Office.

  2. Review of recent theories and experiments for improving high-power microwave window breakdown thresholds

    Dielectric window breakdown is a serious challenge in high-power microwave (HPM) transmission and radiation. Breakdown at the vacuum/dielectric interface is triggered by multipactor and finally realized by plasma avalanche in the ambient desorbed or evaporated gas layer above the dielectric. Methods of improving breakdown thresholds are key challenges in HPM systems. First, the main theoretical and experimental progress is reviewed. Next, the mechanisms of multipactor suppression for periodic rectangular and triangular surface profiles by dynamic analysis and particle-in-cell simulations are surveyed. Improved HPM breakdown thresholds are demonstrated by proof-of-principle and multigigawatt experiments. The current theories and experiments of using dc magnetic field to resonantly accelerate electrons to suppress multipactor are also synthesized. These methods of periodic profiles and magnetic field may solve the key issues of HPM vacuum dielectric breakdown.

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation. Both the CVPs Monitoring Path and Stipulated Path procedures are summarized and reviewed. Several examples are provided to illustrate how to calculate DSM program energy savings using the CVPSs.

    US Environmental Protection Agency has proposed a vehicle control system for reducing gasoline vapors that can escape into the environment during refueling of motor vehicles. It has also has been proposed that gasoline refiners lower the volatility of commercial fuels in summer to reduce vehicle evaporative emissions. EPA said nationwide emissions of volatile organic compounds (VOC), a major contributor to the formation of urban ozone, could be reduced as much as 10% under the proposed pollution-control measures.

    This report presents information and materials from a peer review workshop organized by EPA`s Risk Assessment Forum for Region 5 and the Office of Solid Waste and Emergency Response. The subject of the peer review was a draft document prepared by Region 5 assessing risk at an incinerator operated by Waste Technologies Industries (WTI) in East Liverpool, Ohio. This report summarizes the discussions that took place at the peer review workshop. The report opens with an overview of the workshop and a history of EPA`s WTI incinerator risk assessment activities (section 1), then presents the chairperson`s summary (section 2) and the five work group chairs` summaries (section 3). The body of the report ends with highlights of the peer reviewers` preliminary comments and of the comments offered by workshop observers (section 4).

    The purpose of this report is two-fold. First, the risk assessment methodology for both RESRAD and the EPA’s tools is reviewed. This includes a review of the EPA’s justification for 2 using a dose-to-risk conversion factor to reduce the dose-based protective ARAR from 15 to 12 mrem/yr. Second, the models and parameters used in RESRAD and the EPA PRG and DCC Calculators are compared in detail, and the results are summarized and discussed. Although there are suites of software tools in the RESRAD family of codes and the EPA Calculators, the scope of this report is limited to the RESRAD (onsite) code for soil contamination and the EPA’s PRG and DCC Calculators also for soil contamination.

  7. The preparation for and survival of an EPA Title IV and Title V facility audit

    As part of the 1990 Clean Air Act Amendments, major facilities are required to obtain federally enforceable operating permits (Title V). In a separate permitting action, the electric utilities with units generating more then 25 megawatts are required to obtain permits for NO{sub x} and SO{sub x}, the emissions which contribute to acid rain (Title IV). The Title IV permit is included as part of the Title V permit. This paper will use an actual audit experience at a coal fired generation facility as a case study for the preparation for and outcome of an EPA Title IV Level 3 audit. The paper will document the procedures for preparation, the audit process, and the outcome. The audit is part of the EPA's process for review of the record keeping and instrument calibration methods outlined in Title IV. Both types of permits have many different record keeping and monitoring requirements as well as separate reporting requirements which are submitted to both federal; state and local regulatory agencies for review and evaluation. Title IV units include very specific instrument calibration/audit requirements, and Title V has compliance testing and monitoring requirements. Alliant Power was notified in August 1998 of the intent of EPA Region VII to conduct a Level 3 audit at the Lansing Generation Station. The US EPA and the State of Iowa intended to review all Title IV record keeping (Level 1), continuous emission monitoring calibrations and linearity testing (Level 2) and observe the annual Relative Accuracy Testing Audit performed by an outside contractor. In addition, during this facility site visit, the compliance with Title V permit requirements was also audited.

Black-Right-Pointing-Pointer System-boundary settings often vary largely in reviewed studies. Black-Right-Pointing-Pointer Existing LCA guidelines give varying recommendations in relation to several key issues. - Abstract: Twenty-five comparative cycle assessments (LCAs) addressing food waste treatment were reviewed, including the treatment alternatives landfill, thermal treatment, compost (small and large scale) and anaerobic digestion. The global warming potential related to these treatment alternatives varies largely amongst the studies. Large differences in relation to setting of system boundaries, methodological choices and variations in used input data were seen between the studies. Also, a number of internal contradictions were identified, many times resulting in biased comparisons between alternatives. Thus, noticed differences in global warming potential are not found to be a result of actual differences in the environmental impacts from studied systems, but rather to differences in the performance of the study. A number of key issues with high impact on the overall global warming potential from different treatment alternatives for food waste were identified through the use of one-way sensitivity analyses in relation to a previously performed LCA of food waste management. Assumptions related to characteristics in treated waste, losses and emissions of carbon, nutrients and other compounds during the collection, storage and pretreatment, potential energy recovery through combustion, emissions from composting, emissions from storage and land use of bio-fertilizers and chemical fertilizers and eco-profiles of substituted goods were all identified as highly relevant for the outcomes of this type of comparisons.     The US Environmental Protection Agency is proposing a regulation for the protection of the public and radioactive contamination at sites that are to be cleaned up and released for public use. The rule will apply to sites under the control of Federal agencies, and will impose limits on radiation doses to individuals living or working on a site following cleanup; it will thereby provide site owners and managers with uniform, consistent cleanup criteria for planning and carrying out remediation. This paper presents an overview of EPA`s approach to assessing some of the beneficial and adverse effects associated with various possible values for the annual dose limit. In particular, it discusses the method developed to determine how the choice of cleanup criterion affects (1) the time-integrated potential numbers of non-fatal and fatal radiogenic cancers averted among future populations, (2) the occurrence of radiogenic cancers among remediation workers and the public caused by the cleanup process itself, and (3) the volumes of contaminated soil that may require remediation. The analytic methods described here were used to provide input data and assumptions for the Regulatory Impact Analysis (RIA) that supports the proposed regulation; the RIA also considered non-radiological benefits and costs (i.e., public health, economic, and ecological) of the standards. 56 refs., 4 figs., 6 tabs.

  6. Corporate planning for compliance with EPA`s proposed risk management program rule

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

  7. Voluntary Environmental auditing in light of EPA`s criminal enforcement initiatives

    With the advent and encouragement of recent initiatives by EPA and state environmental regulators for the development and use by business entities of voluntary environmental compliance and audit programs has come an increased concern over the potential for criminal prosecution of individuals charged with the responsibility for ensuring environmental compliance. With the EPA avoiding the issue of whether audit findings will be used as evidence in a joint civil and criminal investigation (i.e., multi-media inspection), a sense of heightened concern has been prevalent in the regulated community. This paper will address the use of audit methodologies that incorporate law enforcement/criminal investigatory techniques as well as suggested attorney-client reporting structure that should be applied in auditing in order to prevent/mitigate the potential for criminal enforcement actions. The goals of the paper are to enable both corporate compliance managers and environmental auditors to be aware of the potential pitfalls and/or liabilities associated with compliance audit findings. Additionally, to educate auditors on when and how to take further steps, through the use of investigatory interviewing techniques, in order to develop answers to questionable data and/or confirm findings of the environmental audit to avoid civil and criminal penalties. The goals of an environment audit should be to avoid both civil and criminal prosecution through the advanced identification of liabilities and the subsequent development of protocols to achieve compliance. However, oftentimes the use of a pre-established {open_quotes}checklist.

    The paper summarises a literature review into waste management practices across Africa as part of a study to assess methods to reduce carbon emissions. Research shows that the average organic content for urban Municipal Solid Waste in Africa is around 56% and its degradation is a major contributor to greenhouse gas emissions. The paper concludes that the most practical and economic way to manage waste in the majority of urban communities in Africa and therefore reduce carbon emissions is to separate waste at collection points to remove dry recyclables by door to door collection, compost the remaining biogenic carbon waste in windrows, using the maturated compost as a substitute fertilizer and dispose the remaining fossil carbon waste in controlled landfills.

    The Ozone Transport Commission`s (OTC) Nitrogen Oxides (NO{sub x}) Budget Program will implement the emissions reduction goal of the 1994 Memorandum of Understanding between its twelve member states and the District of Columbia. The program will achieve its significant NO{sub x} reductions from electric utilities and industrial boilers using a {open_quotes}cap-and-trade{close_quotes} approach modeled after the US Environmental Protection Agency`s sulfur dioxide emissions trading under the Acid Rain Program. The similarity of the two programs has led to the development of an important partnership between the OTC states and EPA`s Acid Rain Division, Over the past two years, Acid Rain Program staff have shared their technical expertise and assisted extensively in the development of the program`s rules. Leveraging the investment EPA made in the systems used to run the Acid Rain Program, the OTC states have asked the Acid Rain Division to administer the data systems for them, and together are working to expand its existing Emissions Tracking System and to modify a clone of the sulfur dioxide Allowance Tracking System, to fulfill the unique requirements of the NO{sub x} Budget Program. This partnership is an important example of the new type of cooperation and sharing of expertise and resources that should develop between EPA and states as they launch multi-state programs to address regional pollution problems that defy a single-state solution.

    Many U. S. nuclear power plants are approaching 40 years of age and there is a desire to extend their life for up to 100 total years. Safety-related cables were originally qualified for nuclear power plant applications based on IEEE Standards that were published in 1974. The qualifications involved procedures to simulate 40 years of life under ambient power plant aging conditions followed by simulated loss of coolant accident (LOCA). Over the past 35 years or so, substantial efforts were devoted to determining whether the aging assumptions allowed by the original IEEE Standards could be improved upon. These studies led to better accelerated aging methods so that more confident 40-year lifetime predictions became available. Since there is now a desire to potentially extend the life of nuclear power plants way beyond the original 40 year life, there is an interest in reviewing and critiquing the current state-of-the-art in simulating cable aging. These are two of the goals of this report where the discussion is concentrated on the progress made over the past 15 years or so and highlights the most thorough and careful published studies. An additional goal of the report is to suggest work that might prove helpful in answering some of the questions and dealing with some of the issues that still remain with respect to simulating the aging and predicting the lifetimes of safety-related cable materials.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

  12. Application of EPA regulations to low-level radioactive waste

    The survey reported here was conducted with the intent of identifying categories of low-level radioactive wastes which would be classified under EPA regulations 40 CFR Part 261 as hazardous due to the chemical properties of the waste. Three waste types are identified under these criteria as potential radioactive mixed wastes: wastes containing organic liquids; wastes containing lead metal; and wastes containing chromium. The survey also indicated that certain wastes, specific to particular generators, may also be radioactive mixed wastes. Ultimately, the responsibility for determining whether a facility's wastes are mixed wastes rest with the generator. However, the uncertainties as to which regulations are applicable, and the fact that no legal definition of mixed wastes exists, make such a determination difficult. In addition to identifying mixed wastes, appropriate methods for the management of mixed wastes must be defined. In an ongoing study, BNL is evaluating options for the management of mixed wastes. These options will include segregation, substitution, and treatments to reduce or eliminate chemical hazards associated with the wastes listed above. The impacts of the EPA regulations governing hazardous wastes on radioactive mixed waste cannot be assessed in detail until the applicability of these regulations is agreed upon. This issue is still being discussed by EPA and NRC and should be resolved in the near future. Areas of waste management which may affect generators of mixed wastes include: monitoring/tracking of wastes before shipment; chemical testing of wastes; permits for treatment of storage of wastes; and additional packaging requirements. 3 refs., 1 fig., 2 tabs.

    A new catalog of seismicity at magnitudes above 2.5 for the period 1923-2008 in the Iran region is assembled from arrival times reported by global, regional, and local seismic networks. Using in-country data we have formed new events, mostly at lower magnitudes that were not previously included in standard global earthquake catalogs. The magnitude completeness of the catalog varies strongly through time, complete to about magnitude 4.2 prior to 1998 and reaching a minimum of about 3.6 during the period 1998-2005. Of the 25,722 events in the catalog, most of the larger events have been carefully reviewed for proper phase association, especially for depth phases and to eliminate outlier readings, and relocated. To better understand the quality of the data set of arrival times reported by Iranian networks that are central to this study, many waveforms for events in Iran have been re-picked by an experienced seismic analyst. Waveforms at regional distances in this region are often complex. For many events this makes arrival time picks difficult to make, especially for smaller magnitude events, resulting in reported times that can be substantially improved by an experienced analyst. Even when the signal/noise ratio is large, re-picking can lead to significant differences. Picks made by our analyst are compared with original picks made by the regional networks. In spite of the obvious outliers, the median (-0.06 s) and spread (0.51 s) are small, suggesting that reasonable confidence can be placed in the picks reported by regional networks in Iran. This new catalog has been used to assess focal depth distributions throughout Iran. A principal result of this study is that the geographic pattern of depth distributions revealed by the relatively small number of earthquakes (~167) with depths constrained by waveform modeling (+/- 4 km) are now in agreement with the much larger number of depths (~1229) determined using reanalysis of ISC arrival-times (+/-10 km), within their

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    Carbon capture and sequestration (CCS) is an option to mitigate impacts of atmospheric carbon emission. Numerous factors are important in determining the overall effectiveness of long-term geologic storage of carbon, including leakage rates, volume of storage available, and system costs. Recent efforts have been made to apply an existing probabilistic performance assessment (PA) methodology developed for deep nuclear waste geologic repositories to evaluate the effectiveness of subsurface carbon storage (Viswanathan et al., 2008; Stauffer et al., 2009). However, to address the most pressing management, regulatory, and scientific concerns with subsurface carbon storage (CS), the existing PA methodology and tools must be enhanced and upgraded. For example, in the evaluation of a nuclear waste repository, a PA model is essentially a forward model that samples input parameters and runs multiple realizations to estimate future consequences and determine important parameters driving the system performance. In the CS evaluation, however, a PA model must be able to run both forward and inverse calculations to support optimization of CO{sub 2} injection and real-time site monitoring as an integral part of the system design and operation. The monitoring data must be continually fused into the PA model through model inversion and parameter estimation. Model calculations will in turn guide the design of optimal monitoring and carbon-injection strategies (e.g., in terms of monitoring techniques, locations, and time intervals). Under the support of Laboratory-Directed Research & Development (LDRD), a late-start LDRD project was initiated in June of Fiscal Year 2010 to explore the concept of an enhanced performance assessment system (EPAS) for carbon sequestration and storage.     The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

    The services provided under this contract include both theoretical and experimental research for development of an appropriate technology for treatment of petroleum hydrocarbons in source water for reverse osmosis (RO) systems. This report evaluates and screens the candidate technologies identified during the literature review in accordance with the approved Technology Evaluation Plan. A short-list of technologies that warrant further study is recommended to be carried forward to the experimental phase. The contamination problems due to petroleum hydrocarbons have been long recognized. However, the treatment technologies available for treatment of petroleum contaminated media are still very limited. Major limitations relative to treatment of petroleum hydrocarbons include: exact chemical composition is not defined; aerobic treatment processes are not effective for breaking down heavy petroleum hydrocarbons; anaerobic treatment processes are slow; and physical/chemical treatment processes are expensive and there is usually additional waste produced during treatment of the contaminated media.

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions

    This paper provides a global overview of the design, implementation, and evolution of building energy codes. Reflecting alternative policy goals, building energy codes differ significantly across the United States, the European Union, and China. This review uncovers numerous innovative practices including greenhouse gas emissions caps per square meter of building space, energy performance certificates with retrofit recommendations, and inclusion of renewable energy to achieve “nearly zero-energy buildings”. These innovations motivated an assessment of an aggressive commercial building code applied to all US states, requiring both new construction and buildings with major modifications to comply with the latest version of the ASHRAE 90.1 Standards. Using the National Energy Modeling System (NEMS), we estimate that by 2035, such building codes in the United States could reduce energy for space heating, cooling, water heating and lighting in commercial buildings by 16%, 15%, 20% and 5%, respectively. Impacts on different fuels and building types, energy rates and bills as well as pollution emission reductions are also examined.

    The objectives of gaseous waste management for the recycling of nuclear used fuel is to reduce by best practical means (ALARA) and below regulatory limits, the quantity of activity discharged to the environment. The industrial PUREX process recovers the fissile material U(VI) and Pu(IV) to re-use them for the fabrication of new fuel elements e.g. recycling plutonium as a Mixed Oxide (MOX) fuel or recycling uranium for new enrichment for Pressurized Water Reactor (PWR). Meanwhile the separation of the waste (activation and fission product) is performed as a function of their pollution in order to store and avoid any potential danger and release towards the biosphere. Raffinate, that remains after the extraction step and which contains mostly all fission products and minor actinides is vitrified, the glass package being stored temporarily at the recycling plant site. Hulls and end pieces coming from PWR recycled fuel are compacted by means of a press leading to a volume reduced to 1/5th of initial volume. An organic waste treatment step will recycle the solvent, mainly tri-butyl phosphate (TBP) and some of its hydrolysis and radiolytic degradation products such as dibutyl phosphate (HDPB) and monobutyl phosphate (H2MBP). Although most scientific and technological development work focused on high level waste streams, a considerable effort is still under way in the area of intermediate and low level waste management. Current industrial practices for the treatment of gaseous effluents focusing essentially on Iodine-129 and Krypton-85 will be reviewed along with the development of novel technologies to extract, condition, and store these fission products. As an example, the current industrial practice is to discharge Kr-85, a radioactive gas, entirely to the atmosphere after dilution, but for the large recycling facilities envisioned in the near future, several techniques such as 1) cryogenic distillation and selective absorption in solvents, 2) adsorption on activated

    The purpose of the New Mexico Environmental Evaluation Group (EEG) is to conduct an independent technical evaluation of the Waste Isolation Pilot Plant (WIPP) Project to ensure the protection of the public health and safety and the environment. The WIPP Project, located in southeastern New Mexico, is being constructed as a repository for the disposal of transuranic (TRU) radioactive wastes generated by the national defense programs. The EEG was established in 1978 with funds provided by the U.S. Department of Energy (DOE) to the State of New Mexico. Public Law 100-456, the National Defense Authorization Act, Fiscal Year 1989, Section 1433, assigned EEG to the New Mexico Institute of Mining and Technology and continued the original contract DE-AC04-79AL10752 through DOE contract DE-AC04-89AL58309. The National Defense Authorization Act for Fiscal Year 1994, Public Law 103-160, continues the authorization. EEG performs independent technical analyses of the suitability of the proposed site; the design of the repository, its planned operation, and its long-term integrity; suitability and safety of the transportation systems; suitability of the Waste Acceptance Criteria and the generator sites` compliance with them; and related subjects. These analyses include assessments of reports issued by the DOE and its contractors, other federal agencies and organizations, as they relate to the potential health, safety and environmental impacts from WIPP. Another important function of EEG is the independent environmental monitoring of background radioactivity in air, water, and soil, both on-site and off-site.

    The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'. This presentation would go over those changes that are expected to be finished by this spring. (authors)

    This report summarizes research performed at Sandia National Laboratories (SNL) in collaboration with the Environmental Protection Agency (EPA) to assess microarray quality on arrays from two platforms of interest to the EPA. Custom microarrays from two novel, commercially produced array platforms were imaged with SNL's unique hyperspectral imaging technology and multivariate data analysis was performed to investigate sources of emission on the arrays. No extraneous sources of emission were evident in any of the array areas scanned. This led to the conclusions that either of these array platforms could produce high quality, reliable microarray data for the EPA toxicology programs. Hyperspectral imaging results are presented and recommendations for microarray analyses using these platforms are detailed within the report.

    The purpose of this paper is to describe multiple studies of wind and solar integration that have found CO2 reductions of approximately 30%. These studies can be viewed in several ways, including as viable paths to compliance with the EPA rule, alternative ''bookend cases'' to compare to compliance based largely on natural gas, or something in between. The studies in this paper represent a body of work that can help inform the public discussion surrounding the cost and reliability impacts of complying with the proposed EPA CPP.

  10. Plant toxicity studies made publicly available by EPA and the TSCA Interagency Testing Committee

    The purpose of this presentation is to briefly describe the ITC, describe the Toxic Substances Control Act (TSCA) Test Submissions (TSCATS) database and how the EPA makes unpublished health and safety studies publicly available through TSCATS as a result of ITC testing recommendations and other activities and to describe some of the unpublished plant toxicity studies that are available tin TSCATS. In 1976, under section 4(e) of the Toxic Substances Control Act (TSCA), the US Congress created the ITC to implement the initial phases of testing TSCA-regulable chemicals. Congress directed the ITC to: (1) make testing decisions on about 70,000 chemicals, (2) develop the TSCA Section 4(e) Priority Testing List, (3) coordinate chemical testing and (4) revise the List at least every six months. The creation, structure, functions and contributions of the ITC from 1977 to 1992 have been previously described. TSCATS is an EPA database. It is an online pointer file that identifies all the unpublished studies that have been submitted to EPA under TSCA sections 4 and 8 and as For Your Information studies. Most of the studies in TSCATS were submitted by manufacturers of chemicals that ITC has added to the Priority Testing List because EPA has published Federal Register notices requesting that manufacturers of ITC chemicals submit unpublished data under TSCA section 8 or conduct testing and submit the data that were developed under TSCA section 4. Data from plant toxicity studies indexed in TSCATS will be presented.

    DuPont reversed its voluntary commitment to phase out CFC production at the end of 1994 to prevent a possible shortage for automotive air conditioning repairs.     The Environmental Protection Agency's (EPA) Region 5 Chicago Regional Laboratory (CRL) developed a method titled Analysis of Diisopropyl Methylphosphonate, Ethyl Hydrogen Dimethylamidophosphate, Isopropyl Methylphosphonic Acid, Methylphosphonic Acid, and Pinacolyl Methylphosphonic Acid in Water by Multiple Reaction Monitoring Liquid Chromatography/Tandem Mass Spectrometry: EPA Version MS999. This draft standard operating procedure (SOP) was distributed to multiple EPA laboratories and to Lawrence Livermore National Laboratory, which was tasked to serve as a reference laboratory for EPA's Environmental Reference Laboratory Network (ERLN) and to develop and validate analytical procedures. The primary objective of this study was to validate and verify the analytical procedures described in EPA Method MS999 for analysis of the listed phosphonic acids and surrogates in aqueous samples. The gathered data from this validation study will be used to: (1) demonstrate analytical method performance; (2) generate quality control acceptance criteria; and (3) revise the SOP to provide a validated method that would be available for use during a homeland security event. The data contained in this report will be compiled, by EPA CRL, with data generated by other EPA Regional laboratories so that performance metrics of EPA Method MS999 can be determined.

This presentation is condensed from a full day course focusing on hands-on techniques for conducting an air quality/energy management review of your operation or plant. The stringent (Non-attainment for PM{sub 10}, Ozone and CO) South Coast Air Quality Management District (SCAQMD) of Southern California rules and regulations are applied to the die casting (metals) industry as well as other production processes. Examples and a case study of real energy intensive production facilities will be used. Developing options for air quality improvement with energy cost control are the key goals of the presentation. Also, the review techniques can be used to determine the {open_quotes}maximum potential to emit{close_quotes} as required for the new Federal EPA, Title V requirements.   20. EPA programs to reduce NO{sub x} and particulate matter emissions from electric utility sources and the possible impact of deregulation on those EPA programs

    At the same time that the electric utility industry is in the midst of deregulation, it could be hit with numerous additional regulatory burdens. For example, EPA now plans to decide by July 1997 whether to make major changes to the current ozone and particulate matter ambient standards -- changes which could force utilities to reduce significantly both their nitrogen oxide (NO{sub x}) and sulfur dioxide (SO{sub 2}) emissions. Even if EPA does not adopt new ambient standards, though, many electric utilities still face the prospect of making additional NO{sub x} reductions if they are found to be contributing to ozone levels in areas that are not meeting the current ozone ambient standards. Several multi-state groups -- notably the Ozone Transport Assessment Group (OTAG) and the Northeast Ozone Transport Commission (OTC) -- are evaluating programs that could lead to calls for additional NO{sub x} reductions from power plants in ozone nonattainment areas and from plants located outside the nonattainment areas but found to be contributing to ozone levels in those areas. And these multi-state groups are motivated not only by pollution levels they see now, but also by what they fear will be increased pollution levels as a result of deregulation. This paper examines the status of the major rulemakings now underway that could force substantial additional reductions in electric utility NO{sub x} and SO{sub 2} emissions. It also discusses the impacts that deregulation could have in those rulemakings.
