    One of the dangers in policy debates, especially those involving many complex and interrelated subjects, is that the debate will plunge into the depths of details to the exclusion of firmly establishing overarching logic and principles. Sometimes this is because it is extremely difficult for the human brain simultaneously to think of many things at many levels. Sometimes it is because that central logic is forgotten along the way or, worse, never in place to begin with. The policy debate on electricity industry restructuring is no exception. This danger of concentrating on the details and obscuring the central principles permeates the wide-ranging restructuring debates, and certainly has contaminated questions about the subissue of the Public Utility Holding Company Act (PUHCA).

    In examining the workings of the Public Utility Holding Company Act (PUHCA) and considering its possible repeal, it is best to go back to the original purposes of PUHCA and analyze whether those purposes are still relevant and, if so, whether the 1935 Act accomplished its goal. Indeed, one might ask, {open_quotes}Are the abuses which gave rise to PUHCA back in the 1930`s now eradicated such that outright repeal is warranted?{close_quotes} One is reminded of that old quote from Santayana, {open_quotes}Those who cannot remember the past are condemned to repeat it.{close_quotes} There is not a more appropriate time to heed that saying than now. To lay the foundation, we need to step back in time and place ourselves in the shoes of the policy makers at the time that PUHCA was debated.

    This EIS analyzes the significant environmental impacts that could occur if various technologies for management and disposal of high-level and transuranic wastes from commercial nuclear power reactors were to be developed and implemented. This EIS will serve as the environmental input for the decision on which technology, or technologies, will be emphasized in further research and development activities in the commercial waste management program. The action proposed in this EIS is to (1) adopt a national strategy to develop mined geologic repositories for disposal of commercially generated high-level and transuranic radioactive waste (while continuing to examine subseabed and very deep hole disposal as potential backup technologies) and (2) conduct a R and D program to develop such facilities and the necessary technology to ensure the safe long-term containment and isolation of these wastes. The Department has considered in this statement: development of conventionally mined deep geologic repositories for disposal of spent fuel from nuclear power reactors and/or radioactive fuel reprocessing wastes; balanced development of several alternative disposal methods; and no waste disposal action. This volume contains written public comments and hearing board responses and reports offered on the draft statement.

    A NIOSH analysis showed that at age 50 approximately 90% of coal miners have a hearing impairment, yet noise included hearing loss is 100% preventable. The article discusses requirements of the MSHA regulations, 30 CFR Part 62 - occupational noise exposure (2000) and a 2008-MSHA document describing technologically achievable and promising controls for several types of mining machinery. Hearing protection is still required for exposure to greater than 90 dBA. These are now commercially available ways to determine how much attenuation an individual gets from a given hearing protector, known as 'fit testing'. 3 refs., 1 fig., 1 tab., 1 photo.

    Hearings held in Santa Fe, New Mexico and Washington, DC brought testimony from public officals, representatives of mining industries, environmentalists, Indians, and interested citizens and organizations on a proposal to lease public lands in the San Juan Basin for coal mining and a bill (H.R. 1575) designating the Bisti Badlands Wilderness. At issue was the Department of Interior's (DOI's) plan, already in evidence in the Powder River sale, to change the procedure for coal leasing to make these lands more readily available to private industry. Despite New Mexico's economic problems, state officials and concerned citizens generally opposed the type of resource management offered by DOI. There was preference for a slower, phased approach to leasing while transportation, environmental, and other problems are resolved. Additional statements and communications follow the testimony of over 100 witnesses.

    Members of Congress, representatives from the Environmental Protection Agency, as well as city officials were among those testifying at a hearing on unfair private party lawsuits against cities and towns. These lawsuits seriously threaten to undermine the Superfund program. This bill focuses on blocking opportunistic and costly lawsuits by large corporate polluters against innocent cities and towns. The problem is caused by cities and towns hauling their garbage to landfills, where industry brings millions of gallons of liquid hazardous waste. These old landfills have now become Superfund sites because industrial hazardous wastes were deliberately disposed with the garbage.

    New York City's proposal to dump contaminated dredge spoil six miles out in the Atlantic Ocean prompted a hearing on the possible environmental and economic effects. Test samples taken in 1981 showed unacceptable levels of polychlorinated biphenyls (PCBs), while samples taken in 1983 were approved by the Army Corps of Engineers for dumping. Questions about the sampling procedures, siltation, and contamination of fish and beaches were raised. The 21 witnesses included local and state officials of the affected areas and representatives of the Corps, environmental groups, and the fishing industry. (DCK)

    Public officials and health officers of Seymour, Indiana along with representatives of a Seymour recycling company, the local League of Women Voters, and the Environmental Protection Agency (EPA) testified during three days of hearings on conditions at the Seymour, Indiana dump site. Besides reviewing efforts to clean up the site using Superfund money, the Subcommittee's purpose was to understand how hazardous dump sites develop and how cleanup implementation can be improved. At issue was the potential for sweetheart deals between EPA and recycling companies in order to preserve Superfund money. The witnesses reviewed the lengthy litigation process involving the site and the cleanup process. Material submitted for the record from witnesses and other interested parties follows the testimony.

    Achieving uniform concentration within liquid holding tanks can often times be a difficult task for the nuclear chemical process industry. This is due to the fact that nuclear criticality concerns require these tanks to be designed with high internal aspect ratios such that the free movement of fluid is greatly inhibited. To determine the mixing times required to achieve uniform concentrations within these tanks, an experimental program was conducted utilizing pencil tanks, double-pencil tanks, and annular tanks of varying geometries filled with salt-water solutions (simulant for nitric acid actinide solutions). Mixing was accomplished by air sparging and/or pump recirculation. Detailed fluid mechanic mixing models were developed --from first principles--to analyze and interpret the test results. These nondimensional models show the functionality of the concentration inhomogeneity (defined as the relative standard deviation of the true concentration within the tank) in relationship to the characteristic mixing time--among other variables. The results can be readily used to scale tank geometries to sizes other than those studied here.

    Water holding capacities of fly ashes from different thermal power plants in Eastern India have been compared. Moreover, the effect of size fractionation (sieving) on the water holding capacities has also been determined. The desorption rate of water held by the fly ash fractions at ambient temperature (25-30{sup o}C) has been investigated. The effect of mixing various size fractions of fly ash in increasing the water holding capacities of fly ash has been studied. It is observed that the fly ash obtained from a thermal power plant working on stoker-fired combustor has the highest water holding capacity, followed by the one that works on pulverized fuel combustor. Fly ash collected from super thermal power plant has the least water holding capacity (40.7%). The coarser size fractions of fly ashes in general have higher water holding capacities than the finer ones. An attempt has been made to correlate the results obtained, with the potential use in agriculture.

    Preservation and hold time of radionuclides must account for both nuclear half-lives and nonnuclear loss mechanisms, but variations in the latter are often neglected. Metals-based defaults are inappropriate for long-lived non-metals C-14 and I-129, which are vulnerable to chemical and biological volatilization. Non-acidification is already widely practiced for them. Recommended addition measures from radiological and chemical literature include glass containers where possible, water filtration where possible, headspace minimization, light shielding, cold (4°C) storage and unfiltered water hold time of 28 days. Soil hold time may need to be shortened when water-logged, excessively sandy, or still adjusting to significant new contamination.

    Nine witnesses testified over three days of hearings on water contamination due to illegal dumping of hazardous wastes and the administration of the Superfund Law to clean up designated sites. The witnesses were asked to evaluate the overall effect of the program and to consider whether Superfund has a positive or negative effect on the development of more environmentally benign technology. A focus for the testimony was on the Seymour waste site. The witnesses included representatives of the aluminum, automobile, chemical, and high technology industries, who were among the 24 industries making a settlement with the Environmental Protection Agency. Additional material submitted for the record by the witnesses and others follows the testimony.

    Representatives of the Environmental Protection Agency in charge of enforcing waste programs and the Department of Justice testified at a hearing on the Seymour, Indiana recycling center, which has become a toxic waste dump. The committee's purpose was to determine how the situation developed, why the federal government was slow to litigate against parties in the case who did not settle, and why those who did settle were released without further liability. The ultimate objective is to assure adequate resources to address ground water problems through the Superfund program and to avoid similar situations in the future. The witnesses described their role in the enforcement procedure. Material received from witnesses and other interested parties for the record follows their testimony.

    The Savannah River National Laboratory (SRNL) was tasked with preparing and shipping samples for Hg speciation by Eurofins Frontier Global Sciences, Inc. in Seattle, WA on behalf of the Savannah River Remediation (SRR) Mercury Task Team.i,ii The tenth shipment of samples was designated to include Modular Caustic Side Solvent Extraction Unit (MCU) Strip Effluent Hold Tank (SEHT) and MCU Decontaminated Salt Solution Hold Tank (DSSHT) materials from processing Salt Batch 7b. The MCU SEHT (MCU-15-722) and DSSHT (MCU-15-709) samples were pulled on June 15, 2015. All MCU samples were received at SRNL on June 16, 2015. The DSSHT sample was moved the same day to refrigeration, while the SEHT sample was placed in the Shielded Cells. On July 9, 2015 it was opened and an aliquot diluted 1:100 with Eurofins deionized water and a portion of the diluted sample transferred to a Teflon® bottle prior to moving it to refrigeration that same day. All samples were kept in the dark and refrigerated until final dilutions were prepared for shipment to Eurofins.

    Purpose: We used Real-Time Position Management (RPM) to evaluate breath hold amplitude and variability when gating with a visually monitored deep inspiration breath hold technique (VM-DIBH) with retrospective cine image chest wall position verification. Methods: Ten patients with left-sided breast cancer were treated using VM-DIBH. Respiratory motion was passively collected once weekly using RPM with the marker block positioned at the xiphoid process. Cine images on the tangent medial field were acquired on fractions with RPM monitoring for retrospective verification of chest wall position during breath hold. The amplitude and duration of all breath holds on which treatment beams were delivered were extracted from the RPM traces. Breath hold position coverage was evaluated for symmetric RPM gating windows from ± 1 to 5 mm centered on the average breath hold amplitude of the first measured fraction as a baseline. Results: The average (range) breath hold amplitude and duration was 18 mm (3–36 mm) and 19 s (7–34 s). The average (range) of amplitude standard deviation per patient over all breath holds was 2.7 mm (1.2–5.7 mm). With the largest allowable RPM gating window (± 5 mm), 4 of 10 VM-DIBH patients would have had ≥ 10% of their breath hold positions excluded by RPM. Cine verification of the chest wall position during the medial tangent field showed that the chest wall was greater than 5 mm from the baseline in only 1 out of 4 excluded patients. Cine images verify the chest wall/breast position only, whether this variation is acceptable in terms of heart sparing is a subject of future investigation. Conclusion: VM-DIBH allows for greater breath hold amplitude variability than using a 5 mm gating window with RPM, while maintaining chest wall positioning accuracy within 5 mm for the majority of patients.

    Strip Effluent Hold Tank (SEHT) and Decontaminated Salt Solution Hold Tank (DSSHT) samples from several of the ''microbatches'' of Integrated Salt Disposition Project (ISDP) Salt Batch (''Macrobatch'') 5 have been analyzed for {sup 238}Pu, {sup 90}Sr, {sup 137}Cs, and by Inductively Coupled Plasma Emission Spectroscopy (ICPES). The results indicate good decontamination performance within process design expectations. While the data set is sparse, the results of this set and the previous set of results for Macrobatch 4 samples indicate generally consistent operations. The DSSHT samples show continued presence of titanium, likely from leaching of the monosodium titanate in the Actinide Removal process (ARP).

    A peak detect-and-hold circuit eliminates errors introduced by conventional amplifiers, such as common-mode rejection and input voltage offset. The circuit includes an amplifier, three switches, a transistor, and a capacitor. During a detect-and-hold phase, a hold voltage at a non-inverting in put terminal of the amplifier tracks an input voltage signal and when a peak is reached, the transistor is switched off, thereby storing a peak voltage in the capacitor. During a readout phase, the circuit functions as a unity gain buffer, in which the voltage stored in the capacitor is provided as an output voltage. The circuit is able to sense signals rail-to-rail and can readily be modified to sense positive, negative, or peak-to-peak voltages. Derandomization may be achieved by using a plurality of peak detect-and-hold circuits electrically connected in parallel.

    Key catalysts for Marcellus Shale drilling in New York were identified. New York remains the only state in the nation with a legislative moratorium on high-volume hydraulic fracturing, as regulators and state lawmakers work to balance the advantages of potential economic benefits while protecting public drinking water resources and the environment. New York is being particularly careful to work on implementing sufficiently strict regulations to mitigate the environmental impacts Pennsylvania has already seen, such as methane gas releases, fracturing fluid releases, flowback water and brine controls, and total dissolved solids discharges. In addition to economic and environmental lessons learned, the New York Department of Environmental Conservation (DEC) also acknowledges impacts to housing markets, security, and other local issues, and may impose stringent measures to mitigate potential risks to local communities. Despite the moratorium, New York has the opportunity to take advantage of increased capital investment, tax revenue generation, and job creation opportunities by increasing shale gas activity. The combination of economic benefits, industry pressure, and recent technological advances will drive the pursuit of natural gas drilling in New York. We identify four principal catalysts as follows: Catalyst 1: Pressure from Within the State. Although high-volume hydraulic fracturing has become a nationally controversial technology, shale fracturing activity is common in every U.S. state except New York. The regulatory process has delayed potential economic opportunities for state and local economies, as well as many industry stakeholders. In 2010, shale gas production accounted for $18.6 billion in federal royalty and local, state, and federal tax revenues. (1) This is expected to continue to grow substantially. The DEC is under increased pressure to open the state to the same opportunities that Alabama, Arkansas, California, Colorado, Kansas, Louisiana, Montana

    Strip Effluent Hold Tank (SEHT) and Decontaminated Salt Solution Hold Tank (DSSHT) samples from several of the 'microbatches' of Integrated Salt Disposition Project (ISDP) Salt Batch ('Macrobatch') 3 have been analyzed for {sup 238}Pu, {sup 90}Sr, {sup 137}Cs, and by Inductively Coupled Plasma Emission Spectroscopy (ICPES). The results indicate good decontamination performance within process design expectations. While the data set is sparse, the results of this set and the previous set of results for Macrobatch 3 samples indicate consistent operations. However, the Decontamination Factors for plutonium and strontium removal have declined in Macrobatch 3, compared to Macrobatch 2. This may be due to the differences in the Pu concentration or the bulk chemical concentrations in the feed material. SRNL is considering the possible reasons for this decline. The DSSHT samples show continued presence of titanium, likely from leaching of the monosodium titanate in ARP. During operation of the ISDP, quantities of salt waste are processed through the Actinide Removal Process (ARP) and MCU in batches of {approx}3800 gallons. Monosodium titanate (MST) is used in ARP to adsorb actinides and strontium from the salt waste and the waste slurry is then filtered prior to sending the clarified salt solution to MCU. The MCU uses solvent extraction technology to extract cesium from salt waste and concentrate cesium in an acidic aqueous stream (Strip Effluent - SE), leaving a decontaminated caustic salt aqueous stream (Decontaminated Salt Solution - DSS). Sampling occurs in the Decontaminated Salt Solution Hold Tank (DSSHT) and Strip Effluent Hold Tank (SEHT) in the MCU process. The MCU sample plan requires that batches be sampled and analyzed for plutonium and strontium content by Savannah River National Lab (SRNL) to determine MST effectiveness.     Alloy 617 is the leading candidate material for an intermediate heat exchanger for the very high temperature reactor. To evaluate the behavior of this material in the expected service conditions, strain-controlled cyclic tests that include long hold times up to 240 minutes at maximum tensile strain were conducted at 850°C. In terms of the total number of cycles to failure, the fatigue resistance decreased when a hold time was added at peak tensile strain. Increases in the tensile hold duration degraded the creep-fatigue resistance, at least to the investigated strain controlled hold time of up to 60 minutes at the 0.3% strain range and 240 minutes at the 1.0% strain range. The creep-fatigue deformation mode is considered relative to the lack of saturation, or continually decreasing number of cycles to failure with increasing hold times. Additionally, preliminary values from the 850°C creep-fatigue data are calculated for the creep-fatigue damage diagram and have higher values of creep damage than those from tests at 950°C.

    Evaluating the effectiveness of public participation in EIA related decisions is of crucial importance for developing a better understanding of overall EIA effectiveness. This paper aims to contribute to the professional debate by establishing a country specific evaluation framework for Pakistan, which, it is suggested, could also potentially be used in other developing countries. The framework is used to evaluate performance of public participation in EIA in terms of 40 attributes for four selected projects from the province of Punjab. The evaluation is based on interviews with stakeholders, review of EIA reports as well as public hearing proceedings and environmental approval conditions. The evaluation of the selected projects revealed an overall weak influence of public participation on substantive quality of EIA and on the final decision. Overall, EIA public participation has succeeded in providing a more egalitarian environment. Furthermore, it appears fair to say that sufficient time for submitting written comments on EIA reports as well as for raising concerns during public hearings had been given. Also, public consultation was significantly contributing to educating participants. Despite some impediments, it is argued that public participation in EIA is gradually gaining ground in Pakistan. Recommendations to enhance EIA public participation effectiveness in Pakistan include applying a more proactive approach which should take place before EIA is conducted and before site selection for development projects is happening.

    The pounding of the gavel in the Senate Foreign Relations Committee hearing room on Tuesday served as the starting gun signaling the beginning of the Senate's race toward a July finish line: US ratification of the chemical weapons treaty. President Clinton sent the treaty to Congress for Senate consent to ratification and for House and Senate approval of implementing legislation soon after the US signed it on Jan. 13. But the crush of other Congressional business--domestic legislation and other arms control agreements--has, in the words of one Congressional staffer, kept this accord off the members' radar screens.'' That is, until this week, when the Senate Foreign Relations Committee held its first in a series of hearings on the Chemical Weapons Convention (CWC). At the hearing, top officials from the State Department and the Arms Control Disarmament Agency offered an overview of the treaty and US obligations under it. After the committees get past a general understanding of the accord's requirements, they will begin probing for problems. Issues likely to be explored include the treaty's verifiability; its effect on industry, and especially whether confidential business information can be protected; the US's ability to meet the accord's chemical weapons destruction schedule; and Russia's ability to destroy its chemical stocks. Costs that the US will bear to support the international organization now being set up to implement and monitor the treaty, and financial aid to the Russians for destruction of their chemical arms, also will be scrutinized.

    The formation of silicon (Si) in its -Sn form is known to be nucleation limited, with an undetermined period of time between when critical pressure for the trans- formation is reached and when the transformation actually occurs. In this letter, we use nanoindentation to apply critical pressure to diamond cubic Si and hold the sample under pressure to promote deformation via phase transformation and crystalline defects. We report that the number of indents in which phase transformation is observed increases with increasing hold time. Interestingly, the number of indents in which crystalline defects are observed also increase with increasing holdmore » time, suggesting crystalline defects are also nucleation limited. Raman spectroscopy and cross-sectional transmission electron microscopy is used to show that these two deformation mechanisms are mutually exclusive under the indentation conditions used within this letter.« less

    Radiation treatment to the left breast is associated with increased cardiac morbidity and mortality. The deep inspiration breath-hold technique (DIBH) can decrease radiation dose delivered to the heart and this may facilitate the treatment of the internal mammary chain nodes. The aim of this review is to critically analyse the literature available in relation to breath-hold methods, implementation, utilisation, patient compliance, planning methods and treatment verification of the DIBH technique. Despite variation in the literature regarding the DIBH delivery method, patient coaching, visual feedback mechanisms and treatment verification, all methods of DIBH delivery reduce radiation dose to the heart. Further research is required to determine optimum protocols for patient training and treatment verification to ensure the technique is delivered successfully.

    The high potential cost of storage, treatment and disposal of radioactive wastes places a premium on the longevity of installed HEPA filters in situations in radioactive processing facilities where dust capacity is a life determining factor. Previous work investigated the dust holding capacity v pressure drop characteristics of different designs of HEPA filter and also the effect of using graded density papers. This paper records an investigation of the effect of media area variation on the dust holding capacity of the {open_quotes}deep-pleat{close_quotes} design of HEPA filter. As in the previously reported work two test dusts (carbon black and sub micron sodium chloride) in the range (0.15 - 0.4{mu}m) were used. Media area adjustment was effected by varying the number of separators within the range 60 - 90. Results with the coarser dust allowed an optimum media area to be identified. Media areas greater or smaller than this optimum retained less dust than the optimum for the same terminal pressure drop. Conversely with the finer sodium chloride aerosol the dust holding capacity continued to increase up to the maximum area investigated. 7 refs., 4 figs.

    An advanced austenitic alloy, HT-UPS (high temperature-ultrafine precipitate strengthened), is a candidate material for the structural components of fast reactors and energy-conversion systems. HT-UPS provides improved creep resistance through a composition based on 316 stainless steel (SS) with additions of Ti and Nb to form nano-scale MC precipitates in the austenitic matrix. The low cycle fatigue and creep-fatigue behavior of a HT-UPS alloy has been investigated at 650 C, 1.0% total strain, and an R ratio of -1 with hold times as long as 9000 sec at peak tensile strain. The cyclic deformation response of HT-UPS is compared to that of 316 SS. The cycles to failure are similar, despite differences in peak stress profiles and the deformed microstructures. Cracking in both alloys is transgranular (initiation and propagation) in the case of continuous cycle fatigue, while the primary cracks also propagate transgranularly during creep-fatigue cycling. Internal grain boundary damage as a result of the tensile hold is present in the form of fine cracks for hold times of 3600 sec and longer and substantially more internal cracks are visible in 316 SS than HT-UPS. The dislocation substructures observed in the deformed material are different. An equiaxed cellular structure is observed in 316 SS, whereas tangles of dislocations are present at the nanoscale MC precipitates in HT-UPS and no cellular substructure is observed.

    The paper reports on the first experiments with plasma-dust formations in dc gas discharge plasma for He-Ar mixture. It is shown that under the conventional conditions of the experiments with dusty structures in plasma, the choice of light and heavy gases for the mixture suppresses electron heating in electric field and results in a supersonic jet with high Mach numbers. Distribution functions for drifting ions in the gas mixture are calculated for various mixture concentrations, electric field strengths and gas pressures.

    Faced with a serious hydrogen sulfide (H{sub 2}S) corrosion problem in two sludge holding tanks in 1993, the city of Concord, New Hampshire, repaired the deteriorating substrate by using a conventional acrylic-modified cementitious resurfacer and a coal tar epoxy (CTE) coating system. CTE failure occurred within 2 years, leading to more severe coating delamination. Restoration was delayed for 10 years, which caused extensive chemical attack on the concrete substrate-upwards of 2 in. (50 mm) of concrete loss. This article explains how one of these tanks was restored and prepared for another 15+ years of service.

    A Hearing Officer issued a Decision in which he determined that an individual’s access authorization should be granted. In reaching this determination, the Hearing Officer found that the individual had resolved security concerns under Criteria H and J associated with her excessive consumption of alcohol in college and a determination from a DOE-contractor Psychologist (DOE-Psychologist), that, despite possessing good judgment and reliability, the Individual suffered from Alcohol-Related Disorder, Not Otherwise Specified, and had been a user of alcohol habitually to excess in the past. To demonstrate adequate evidence of rehabilitation, the DOE Psychologist opined that the Individual would have to demonstrate a pattern of responsible alcohol consumption consisting of drinking only 2 to 3 alcoholic beverages per occasion. At the hearing, the Individual presented testimonial evidence indicating that, since receiving the DOE Psychologist’s report, she has complied with the DOE Psychologist’s recommendations with regard to alcohol use and had consulted a Counselor. Pursuant to a recommendation from the Counselor, the Individual abstained from alcohol for the two months prior to the hearing. After listening to the hearing testimony, both the DOE Psychologist and the Counselor believed that the Individual had resolved any doubts regarding her judgment and reliability arising from her past alcohol use. Given the evidence produced at the hearing, the Hearing Officer found that the Individual had resolved the Criteria H and J concerns and that the Individual should be granted a security clearance.

    These three days of hearings were held to discuss the factors contributing to the present dependency on foreign sources for strategic and critical minerals and materials and on the struggle for control over Persian Gulf energy and African minerals. The principal witness, Secretary of the Interior James G. Watt, outlined the new administration's policies for developing domestic resources. Policies for maintaining a strong mining industry and development on public lands will be tied to a sound economic base in order to reduce inflation and interest rates. Other witnesses included members of Congress, representatives of the mining industry, and government agencies. The hearing record includes their testimony, answers to questions posed to government agencies, and additional material submitted for the record. (DCK)
