    Following the Supreme Court`s decisions in Escondido and Tacoma, it is sometimes difficult to remember FERC`s view of its role in the licensing process and how that view has shaped FERC`s adoption of the NEPA review process. To this day, FERC struggles with reconciling its rules with the NEPA review process. A short historical review of FERC`s efforts in implementing NEPA helps in understanding why FERC does what it does in the environmental context. The first time FERC (then the Federal Power Commission ({open_quotes}FPC{close_quotes})) announced its role in implementing NEPA was in the Commission`s Notice of Proposed Rulemaking issued in response to the Council on Environmental Quality ({open_quotes}CEQ{close_quotes}) regulations in 1979. In the preamble, the commission noted that executive departments were bound by CEQ regulations, but the Commission, as an independent regulatory agency, was not. In its Notice, the Commission stated its concern that under the CEQ referral process, the FPC`s environmental review may be subject to a CEQ review outside of the Commission`s NEPA process.

    The FERC study concludes that U.S. peak demand can be reduced by as much as 188 GW -- roughly 20 percent -- under the most aggressive scenario. More moderate -- and realistic -- scenarios produce smaller but still significant reductions in peak demand. The FERC report is quick to point out that these are estimates of the potential, not projections of what could actually be achieved. The main varieties of demand response programs include interruptible tariffs, direct load control (DLC), and a number of pricing schemes.

    In evaluating mergers, FERC should adopt the approach of the federal antitrust agencies to prevent firms from gaining and exercising market power. Doing so will require changes in everything from how FERC defines product and geographic markets, and how market concentration, entry conditions and cost saving are evaluated, to how discovery is conducted - in short, to virtually every aspect of how FERC reaches a merger decision. Reliance on competition to benefit consumers carries with it the necessity to preserve competition that is threatened by mergers or other structural changes. Faced with numerous mergers of large and medium-size electric utilities and the expectation of more to come, in January 1996 the Federal Energy Regulatory Commission requested comments on how it should evaluate mergers. This paper addresses that need. Section I explains how FERC and the federal antitrust agencies have responded to the competitive issues raised by utility mergers during the past decade. Section II introduces the analytical approach used by the antitrust agencies to evaluate mergers. Section III highlights features of the electric power industry that make analysis of market power unusually complex. Section IV evaluates FERC`s past reliance on comparable open access transmission as a sufficient remedy for competitive concerns relating to the availability, reliability and pricing of transmission service. Section V suggests changes to FERC`s merger policy that would make it consistent with antitrust principles and FERC`s public interest responsibilities. The final section draws conclusions.

    In spite of assumptions to the contrary, this nation will not enjoy competitive power markets until the Federal Energy Regulatory Commission (FERC) uses its bully pulpit to require establishment of--and prescribe minimum authorities for--properly sized ISOs that administer efficient transmission pricing. In 1989, the FERC recognized that getting transmission pricing right is the crucial first step in the process of creating a competitive electricity market. A lot has happened in the ensuing eight years. There is now a competitive wholesale market, and retail competition is beginning in many states. Yet, FERC has not made any progress in taking that crucial first step. Unless FERC abandons the present archaic system of transmission pricing promptly, competition will produce a long list of unintended adverse effects. The short-term effects will include markets too small to support effective competition and misleading price signals that induce buyers and sellers to make decisions that waste resources. The long-term effects will include large investments in capital assets at the wrong locations, and ill-informed antitrust and regulatory decisions. These effects will also create scores of entities with a powerful vested interest in retaining the status quo forever. As the British have discovered, once that happens, it is almost impossible to abandon an inefficient pricing system.

    This paper reports that the Federal Regulatory Commission has changed Order 636, its U.S. pipeline rate unbundling rule, to meet major objections raised to it.     The author believes that wholesale markets in the United States would have a greater likelihood of ultimately benefiting consumers if the Federal Energy Regulatory Commission did not have the mandate under the Federal Power Act (FPA) to ensure that wholesale prices are ''just and reasonable.'' However, he continues to believe that the FERC cannot avoid having an ex post criteria for asssessing whether market prices are just and reasonable. Moreover, changes in the design and regulatory oversight of U.S. wholesale electricity markets in recent years, including the recent Supreme Court decision, have caused him to believe even more strongly in the guardrails-for-market-outcomes approach. Finally, several questions are addressed which relate to the pricing of fixed-price, long-term contracts and the impact of these obligations on the behavior of suppliers in short-term wholesale markets that are directly relevant to answering the two major questions that the Supreme Court remanded to FERC in its recent decision.

    The Federal Energy Regulatory Commission`s (FERC) Order 888 is perhaps the most important and far reaching FERC electricity order in decades. The consequences on the structure of the industry and how the industry is regulated are significant departures from past methods and regulatory philosophy. This will undoubtedly have a dramatic impact on the manner in which state public utility commissions, which are also undergoing or considering dramatic change, regulate their jurisdictional electric utilities. This report summarizes and discusses the actions that the FERC is taking and their profound repercussions on the industry and state commissions. The report is not a comprehensive summary of the entire order. Rather, it is intended to highlight the order`s more important features and discuss what this could mean for the states. The report is organized into eight sections; the first seven address Order 888 and the last section (section 8) addresses Order 889. Section 1 through 5 summarize and discuss the main features of Order 888. Section 6 (on jurisdiction) and Section 7 (on property rights) interpret the likely consequences of the order. Section 8, summarizes the FERC`s Open Access Same Time System (OASIS) and discusses some concerns about its real-world application.

    By vacating the Federal Energy Commission's (FERC) Order 745 in Electric Power Supply Association vs. FERC (EPSA, 2014) the U.S. Court of Appeals for the D.C Circuit injected uncertainty into the future of demand response (DR) resources in U.S. wholesale markets. Many possible future scenarios in which DR continues to be available to provide capacity for resource adequacy would need to rely on a potential checkerboard of policies promulgated by state utility commissions. However, the states that will be most directly impacted by the potential implications from the EPSA ruling are precisely those that have the fewest policies currently in place to promote retail program development.

    In large part, FERC's determination of market power is based on an analysis that focuses on the ability of power suppliers to foreclose' other potential power suppliers by withholding transmission access to the buyer. The authors believe that this analysis is flawed because the conditions it considers are neither necessary nor sufficient for the existence of market power. That is, it is possible that market-based rates can be subject to market power even if no transmission supplier has the ability to foreclose some power suppliers; conversely, it is possible that no market power exists despite the ability to foreclose other suppliers. This paper provides a critical analysis of FERC's market-power determinations. The concept of market power is defined and its relationship to competition is discussed in Section 1, while a framework for evaluating the existence of market power is presented in Section 2. In Section 3, FERC's recent order in Terra Comfort is examined using this framework. A brief preview of FERC's order in TECO Power Services comprises Section 4. Overall conclusions are presented in Section 5.

    During the past three years, government and private organizations have issued more than a dozen studies of the benefits and costs of Regional Transmission Organizations (RTOs). Most of these studies have focused on benefits that can be readily estimated using traditional production-cost simulation techniques, which compare the cost of centralized dispatch under an RTO to dispatch in the absence of an RTO, and on costs associated with RTO start-up and operation. Taken as a whole, it is difficult to draw definitive conclusions from these studies because they have not examined potentially much larger benefits (and costs) resulting from the impacts of RTOs on reliability management, generation and transmission investment and operation, and wholesale electricity market operation. This report: (1) Describes the history of benefit-cost analysis of FERC electricity restructuring policies; (2)Reviews current practice by analyzing 11 RTO benefit-cost studies that were published between 2002 and 2004 and makes recommendations to improve the documentation of data and methods and the presentation of findings in future studies that focus primarily on estimating short-run economic impacts; and (3) Reviews important impacts of FERC policies that have been overlooked or incompletely treated by recent RTO benefit-cost studies and the challenges to crafting more comprehensive assessments of these impacts based on actual performance, including impacts on reliability management, generation and transmission investment and operation, and wholesale electricity market operation.

    This final environmental impact statement (FEIS) has been prepared for the Federal Energy Regulatory Commission (Commission) to consider modifications to the existing Lower Mokelumne River Project (LMRP) (FERC Project No. 2916-004) in California. Chinook salmon and steelhead trout populations in the lower Mokelumne River have experienced recent declines and fish kills associated, in part, with discharges from Camanche Dam. The California Department of Fish and Game and the California Sportfishing Protection Alliance have asked the Commission to investigate and correct these problems. A wide range of different mitigation actions has been proposed by parties participating in the scoping of this proceeding, and staff has evaluated these proposed actions in this assessment. The staff is recommending a combination of flow and non-flow modifications to the existing license, including new minimum flow and minimum pool elevation requirements at Camanche Reservoir, ramping rates on dam releases, interim attraction and out-migrant spike flows, instream habitat improvements, and a series of studies and monitoring to determine feasible means for solving off-site fish passage problems.

This paper reports that it plans to begin construction of the 443 MMcfd expansion in mid-July after obtaining further federal, state, and local permits.     During the past sixty years when electric power has been a pervasively regulated industry, no comparable epidemic of mergers or related consolidations has broken out. There have been a few sporadic efforts at merger, but nothing like the present phenomenon. While pervasively regulated, electric utilities apparently saw little advantage in merger. They also probably correctly thought that their regulators, especially the state regulators, would not view merger activities with great favor. But above all, the utilities did not perceive the risk-the risk of bankruptcy-that deregulation has brought. Before the energy crisis of the 1970`s, the most significant risk encountered by the investor-owned electric utility industry was of a government take-over in the 1930`s or of the encroachment of public power at various times and places. Otherwise, the industry led a blissful life of guaranteed franchises, ever-expanding revenues, ever-declining costs and cost-plus regulation. In the 1970`s and 1980`s came the agonies of inflation, fuel shortages, cost overruns and plant disallowances. For the most part, however, the regulators saw to it that the industry continued to recover its costs, after a fashion. With competition only a gleam in professorial eyes, only a few mergers were announced and consummated. The floodgates opened with passage of the Energy Policy Act of 1992. Competition, centered on the generation segment of the classic trio of generation, transmission and distribution, loomed larger and larger. And with competition in generation came bedeviling risk. For with deregulation, the government presumably will cease to be concerned that the generating parts of the industry recover their costs. The electricity business thus has lost its oldest friend. Where there was once manageable or at least calculable risk, there is now formidable fear of the unknown and the potentially disastrous. 109 refs.

    The major theme of this report is that the Western Power Exchange (WEPEX) Applications prevent the Independent System Operator (ISO) from clearing the market, and that this is the root of the most important problems. The proposed rules at fault (1) prevent the Power Exchange (PX) and other Scheduling Coordinators from passing on all of their bids to the ISO, and (2) prevent the ISO from dispatching beyond the point at which congestion is eliminated. Although it is generally accepted that these restrictions prevent the ISO from achieving the least-cost dispatch, many other consequences of this market-clearing failure have not been widely recognized. These include sub-optimal dispatches by the PX when the system is uncongested, congestion charges that reward power flow in the congested direction, and incentives for Scheduling Coordinators to ignore known intra-zone congestion. But the most pernicious effect of failing to clear the market may be decreased system reliability. Four minor themes will also be considered but in less detail. Most importantly the author describes several examples of unequal treatment for the PX. Second, he discusses the ambiguities introduced by zonal pricing. WEPEX`s zonal system is based on a view of congestion that largely ignores loop flow and consequently has not been well defined. Third, WEPEX appears to have invented a new definition of the transmission congestion contract (TCC) that is based on actual instead of pre-specified flows. The author shows that this ruins the incentive properties of TCCs, but that this problem is partially rectified by the market in TCCs. Lastly, he discusses losses. The WEPEX proposal intentionally avoids marginal-cost pricing of losses. What has not been recognized is that it significantly increases use of the power grid. Because this effect is greatest during peak usage, it will necessitate costly grid expansion.

    In recent contests over regulatory jurisdiction between the Federal Energy Regulatory Commission (FERC) and local utility commissions, the courts have defended the FERC's exclusive regulatory authority over interstate rates against state commission encroachment. Moreover, in Nantahala, the Court applied an expansive interpretation of what constitutes an impermissible interference with the FERC's jurisdiction. By not limiting the holding to rates per se the Court drove home the message that local public utility commissions have a duty not to interfere, in any manner, in the area of the FERC's exclusive domain - regulation of interstate wholesale rates.

    The Public Utility Regulatory Policies Act of 1978 (PURPA) is designed to promote energy conservation, the efficient use of utility resources, and equitable rates. PURPA specifically directs the Federal Energy Regulatory Commission (FERC) to encourage small power production from renewable resources (and also cogeneration of electric energy as well as heat) by setting standards under which facilities qualify for interconnection, and guidelines for sales between utilities and independent facilities. The way FERC carries out this mandate may critically affect the development of solar alternatives to electric power production from fossil and nuclear resources. This report comments on proposed FERC regulations and suggests ways to encourage small power production within the PURPA mandate. In addition, some internal strains within PURPA are analyzed that seem to limit the effectiveness with which FERC can encourage independent facilities, and possible modifications to PURPA are suggested. 255 references.

    The FERC's failure to investigate the Entergy/GSU merger's effects on market power may force other agencies to examine electric utility mergers on their own. The competitive effects of the proposed merger Entergy and Gulf States Utilities (GSU) will not be further investigated by the Federal Energy Regulatory Commission (FERC), according to a January 1993 order. The FERC's primary justification is that the [open quotes]open access[close quotes] transmission conditions offered by the merging parties eliminated concern over market power in transmission and bulk power. The FERC's reasoning is flawed. If the merger were to lead to an increase in market power, the proposed transmission conditions would not prevent the merged firm from exercising that power. The FERC also justifies its decision not to investigate the competitive effects of the merger on the grounds that no intervenor had demonstrated that present competition between the two systems is more than de minimis. This is not an appropriate standard. Intervenors demonstrated that Entergy's and GSU's transmission system offer alternative contract routes for bulk power between generators and customers. Even if Entergy and GSU both do not actually sell significant amounts of the same transmission-service, an antitrust evaluation should consider whether the availability of a second, independent route constrains the pricing of the first. The FERC's reasoning indicates that it has lost its way in carrying out its responsibilities to protect consumers. Open access to transmission systems may play an important role in increasing competition in bulk power markets. However, the FERC's goal should be to promote competition, not merely to open access for its own sake. In its enthusiasm to secure [open quotes]open access[close quotes], the FERC appears willing to ignore possible reductions in competition.

Two primary methods for data collection are Renewable Energy Certificate (REC) tracking and power flow estimates. Data from regional REC tracking systems, state agencies, and utility compliance reports help understand how cross-state transactions have been used to meet RPS compliance. Data on regional renewable energy flow use generator-specific information primarily sourced from EIA, SNL Energy, and FERC Form 1 filings. The renewable energy examined through this method may or may not have actually been used to meet RPS compliance.

    The last 5 years have been one of the most exciting times for the energy storage industry. We have seen significant advancements in the regulatory process to make accommodations for valuing and monetizing energy storage for what it provides to the grid. The most impactful regulatory decision for the energy storage industry has come from California, where the California Public Utilities Commission issued a decision that mandates procurement requirements of 1.325 GW for energy storage to 3 investor-own utilities in 4 stages: in 2014, 2016, 2018, and 2020. Furthermore, at the Federal level, FERCs Order 755, requires the transmission operators to develop pay for performance tariffs for ancillary services. This has had direct impact on the market design of US competitive wholesale markets and the monetization of fast responding grid assets. While this order is technology neutral, it clearly plays into the fast-responding capability of energy storage technologies. Today PJM, CAISO, MISO, NYISO, and NE-ISO have implemented Order 755 and offer new tariff for regulation services based on pay-for-performance principles. Furthermore, FERC Order 784, issued in July 2013 requires transmission providers to consider speed and accuracy in determining the requirements for ancillary services. In November 2013, FERC issued Order 972, which revises the small generator interconnection agreement which declares energy storage as a power source. This order puts energy storage on par with existing generators. This paper will discuss the implementation of FERCs Pay for Performance Regulation order at all ISOs in the U.S. under FERC regulatory authority (this excludes ERCOT). Also discussed will be the market impacts and overall impacts on the NERC regulation performance indexes. The paper will end with a discussion on the California and Ontario, Canada procurement mandates and the opportunity that it may present to the energy storage industry.

    Gas storage operators are facing increased and more complex responsibilities for managing storage operations under Order 636 which requires unbundling of storage from other pipeline services. Low cost methods that improve the accuracy of inventory verification are needed to optimally manage this stored natural gas. Migration of injected gas out of the storage reservoir has not been well documented by industry. The first portion of this study addressed the scope of unaccounted for gas which may have been due to migration. The volume range was estimated from available databases and reported on an aggregate basis. Information on working gas, base gas, operating capacity, injection and withdrawal volumes, current and non-current revenues, gas losses, storage field demographics and reservoir types is contained among the FERC Form 2, EIA Form 191, AGA and FERC Jurisdictional databases. The key elements of this study show that gas migration can result if reservoir limits have not been properly identified, gas migration can occur in formation with extremely low permeability (0.001 md), horizontal wellbores can reduce gas migration losses and over-pressuring (unintentionally) storage reservoirs by reinjecting working gas over a shorter time period may increase gas migration effects.

    States should participate in coordinated transmission planning through regional transmission groups, while reserving their right to pass upon transmission planning. This would smooth an otherwise difficult transition, as FERC and state regulators seek to facilitate a competitive bulk power market that ignores arbitrary jurisdiction lines. Since the Federal Energy Regulatory Commission issued its Policy Statement on Regional Transmission Groups, two RTG`s, the Western Regional Transmission Association and the Southwest Regional Transmission Association, have gained conditional approval from FERC. A third, the Northwest Regional Transmission Association, files its governing agreement with the Commission, seeking FERC`s approval. Price setting within RTGs and information exchanges involved in planning the grid raise questions of the legality of these collective actions under the antitrust laws. All three agreements allow for exchanges of commercial and planning information, but, conspicuously, do not set transmission prices. For the moment, therefore, antitrust liability for RTGs would arise out of the information exchanges involved in planning the grid. In addition, with FERC pushing for `restructuring` at the wholesale level through open access and the states becoming aggressive in trying to institute competition at the consumer level through retail wheeling, issues of federal-state jurisdiction in transmission have come to the fore.

    This conference is one of several activities initiated by FERC, DOE and NARUC to improve the dialogue between Federal and State regulators and policymakers. I am pleased to be here to participate in this conference and to address, with you, electricity issues of truly national significance. I would like to commend Ashley Brown and the NARUC Electricity Committee for its foresight in devising a conference on these issues at this critical juncture in the regulation of the electric utility industry. I also would like to commend Chairman Allday and the FERC for their efforts to improve communication between Federal and State electricity regulators; both through FERC`s Public Conference on Electricity Issues that was held last June, and through the FERC/NARUC workshops that are scheduled to follow this conference. These collaborative efforts are important and necessary steps in addressing successfully the many issues facing the electric utility industry those who regulate it, and those who depend upon it - in other words, about everyone.

    The issue of antitrust remedies available in electric cases is far from settled. The courts and the Federal Energy Regulatory Commission (FERC) have taken various paths in the last year. On the one hand are the Chanute and Alabama Power cases which appear to encourage competition in the public interest. Using such inclusive criteria as potential anticompetitive affects could give great leeway in ordering wheeling or other forms of interconnection. Most of the cases, however, seem intent on restricting federal jurisdiction over antitrust remedies. The FERC appears ready to relinquish its role in ordering wheeling by asserting that wheeling can only be compelled for energy or conservation reasons not for fostering competition. After a honeymoon period of making price-squeeze allegations easier to prove, the courts seem to be considering price-squeeze cases strictly as antitrust litigation rather than as antitrust utility regulatory cases, thereby invoking a greater burden of proof. In their efforts not to be too swift in interfering with the market or promoting competition, the courts seem to have lost sight of the function of preventing discrimination. It appears clear that the courts and the commission will be increasingly reluctant to impose wheeling as a remedy. The Supreme Court at least, in denying certiorari in the Alabama Power case, has left an opening for redress through potential anticompetitive affects, although they may be nebulous at best.

    The world-wide movement to restructure the electric and power and energy industry is now well underway in the United States. The most recent thrust came this year, with the Federal Energy Regulatory Commission`s (FERC`s) issuance on April 24th of new regulations designed to open the interconnected transmission grid to all qualified wholesale users. Other movements have been in the many forms of earlier statutes and regulations promulgated in 1978 to make more efficient use of fuels burned; utility diversification efforts; utility creation of affiliate and subsidiary organizations and operations; introduction into the market of private non-utility power developers; utilities obtaining clearance from the Securities and Exchange Commission (SEC) to venture in international markets; massive mergers and acquisitions; bankruptcies; the entry into the market of nonutility power marketers and brokers, including entities from the gas and securities industries not previously involved in the electric power and energy industry; additional congressional consideration of outright repeal of Holding Company legislation dating back to 1935; some states entering into an era of abandoning the control past in favor of complete re-regulation of the industry on the basis of performance; the coming of Independent System Operators (ISO`s), Regional Transmission Groups (RTG`s), and the possible coming of Capacity Reservation Tariffs (CRT`s), to name a few.

    The Southwest Regional Transmission Association (SWRTA) plans to file this month at the Federal Energy Regulatory Commission (FERC) for recognition as a regional transmission group (RTG), pursuant to the FERC's July 1993 policy statement on RTGs. As the provision of electricity becomes less regulated and more competitive, many industry observers expect RTGs to play a key role in increasing the efficiency of our nation's electricity supply system. What exactly is an RTG There are as many definitions as there are interested parties. SWRTA's working group has spent over two years turning an idea into an RTG. Along the way they have learned a few important things about the FERC, congressional intent, the amended Federal Power Act, the dynamics of large groups, and fairness. This article describes the creation of the SWRTA RTG.

    Federal Energy Regulatory Commission (FERC) Order No. 436 is the latest in a series of major regulatory initiatives that have impacted gas pricing, pipeline contracting provisions, spot market sales, and transportation. The policy followed by FERC reflects a faith in the free market to efficiently allocate resource at reasonable cost to consumers. In responding to deregulation mandates while retaining regulation of the price of old gas and of interstate transportation and sales for resale, FERC is unbundling gas costs from the fixed costs of providing service in hopes of improving price signals. It is also pushing pipelines to provide open access to inject competition. The long-term commitments needed by producers may be incompatible with the oscillations caused by market restructuring, but there is a possibility that the new approach will work.

    The commission`s new direction on gathering issues has now been commenced. Implementation of those orders will raise a host of corollary issues. Subsequent orders are likely to refine and further define matters relating to spin-downs and spin-offs. Of course, several court appeals of FERC orders which adopted the Northwest conditional authority approach are pending. Rehearing and appeals of the most recent gathering orders are also likely. While FERC`s course is clearer now, the courts will ultimately review whether the course is permissible. The full unbundling of gathering costs from mainline transmission costs and production area rate design are significant matters which still remain and require immediate commission attention. The potential for mischief and competitive disadvantage to competing pipelines are inconsistent with the underlying concepts of Order No. 636.

    Single source precursors or pre-copolymers of single source precursors are subjected to microwave radiation to form particles of a I-III-VI.sub.2 material. Such particles may be formed in a wurtzite phase and may be converted to a chalcopyrite phase by, for example, exposure to heat. The particles in the wurtzite phase may have a substantially hexagonal shape that enables stacking into ordered layers. The particles in the wurtzite phase may be mixed with particles in the chalcopyrite phase (i.e., chalcopyrite nanoparticles) that may fill voids within the ordered layers of the particles in the wurtzite phase thus produce films with good coverage. In some embodiments, the methods are used to form layers of semiconductor materials comprising a I-III-VI.sub.2 material. Devices such as, for example, thin-film solar cells may be fabricated using such methods.

    Ancillary services are those functions performed by the equipment and people that generate, control, and transmit electricity in support of the basic services of generating capacity, energy supply, and power delivery. The Federal Energy Regulatory Commission (FERC) defined such services as those `necessary to support the transmission of electric power from seller to purchaser given the obligations of control areas and transmitting utilities within those control areas to maintain reliable operations of the interconnected transmission system.` The nationwide cost of ancillary services is about $12 billion a year, roughly 10% of the cost of the energy commodity. More important than the cost, however, is the necessity of these services for bulk-power reliability and for the support of commercial transactions. FERC`s landmark Order 888 included a pro forma tariff with provision for six key ancillary services. The Interconnected Operations Services Working Group identified another six services that it felt were essential to the operation of bulk-power systems. Several groups throughput the United States have created or are forming independent system operators, which will be responsible for reliability and commerce. To date, the electricity industry (including traditional vertically integrated utilities, distribution utilities, power markets and brokers, customers, and state and federal regulators) has paid insufficient attention to these services. Although the industry had made substantial progress in identifying and defining the key services, much remains to be doe to specify methods to measure the production, delivery, and consumption of these services; to identify the costs and cost-allocation factors for these services; and to develop market and operating rules for their provision and pricing. Developing metrics, determining costs, and setting pricing rules are important because most of these ancillary services are produced by the same pieces of equipment that

    Although nucleons account for nearly all the visible mass in the universe, they have a complicated structure that is still incompletely understood. The first indication that nucleons have an internal structure, was the measurement of the proton magnetic moment by Frisch and Stern (1933) which revealed a large deviation from the value expected for a point-like Dirac particle. The investigation of the spatial structure of the nucleon, resulting in the first quantitative measurement of the proton charge radius, was initiated by the HEPL (Stanford) experiments in the 1950s, for which Hofstadter was awarded the 1961 Nobel prize. The first indication of a non-zero neutron charge distribution was obtained by scattering thermal neutrons off atomic electrons. The recent revival of its experimental study through the operational implementation of novel instrumentation has instigated a strong theoretical interest. Nucleon electro-magnetic form factors (EMFFs) are optimally studied through the exchange of a virtual photon, in elastic electron-nucleon scattering. The momentum transferred to the nucleon by the virtual photon can be selected to probe different scales of the nucleon, from integral properties such as the charge radius to scaling properties of its internal constituents. Polarization instrumentation, polarized beams and targets, and the measurement of the polarization of the recoiling nucleon have been essential in the accurate separation of the charge and magnetic form factors and in studies of the elusive neutron charge form factor.

The natural gas industry has scouted out the territory, and the same regulatory agency that oversaw that transition will be establishing a few boundaries for the electric utility industry as well. The agency in charge is the Federal Energy Regulatory Commission (FERC), says Elizabeth A. Moler, chair of the FERC in Washington, D.C. The electric power industry, she adds, already is responding positively to the new competitive environment. For example, {open_quotes}state regulators are taking advantage of the opportunities afforded by FERC`s new regulations to provide choice to customers at the retail level,{close_quotes} Moler says. However, potential abuses on the new open market include price fixing and other unfair practices. {open_quotes}A utility that controls all of the generation within a large geographic area may yet control prices.     A bipolar pulse forming transmission line module for linear induction accelerators having first, second, third, fourth, and fifth planar conductors which form an interleaved stack with dielectric layers between the conductors. Each conductor has a first end, and a second end adjacent an acceleration axis. The first and second planar conductors are connected to each other at the second ends, the fourth and fifth planar conductors are connected to each other at the second ends, and the first and fifth planar conductors are connected to each other at the first ends via a shorting plate adjacent the first ends. The third planar conductor is electrically connectable to a high voltage source, and an internal switch functions to short a high voltage from the first end of the third planar conductor to the first end of the fourth planar conductor to produce a bipolar pulse at the acceleration axis with a zero net time integral. Improved access to the switch is enabled by an aperture through the shorting plate and the proximity of the aperture to the switch.

    There has been much activity in the measurement of the elastic electromagnetic proton and neutron form factors in the last decade, and the quality of the data has greatly improved by performing double polarization experiments, in comparison with previous unpolarized data. Here we review the experimental data base in view of the new results for the proton, and neutron, obtained at JLab, MAMI, and MIT-Bates. The rapid evolution of phenomenological models triggered by these high-precision experiments will be discussed, including the recent progress in the determination of the valence quark generalized parton distributions of the nucleon, as well as the steady rate of improvements made in the lattice QCD calculations.

  20. The antitrust wild card and electricity restructuring

    If competitive policy issues in electricity restructuring are not addressed soon--preferably in federal legislation--it`s likely that someone will use the antitrust wild card to achieve its ends. Experience teaches that this may not be the best way to make public policy. As the electric utility industry restructures, it is widely assumed that Congress, the state legislatures, and regulators will set the ground rules for the restructured markets. Experience to date would seem to confirm this view: California`s restructuring legislation, FERC`s Order 888, and the restructuring proceedings in numerous states are all examples. And yet, there remains another player whose role could be equally important: The federal judiciary. While court decisions under the antitrust laws have had little influence to date on the industry`s direction, there is reason to believe that their role could increase dramatically. Certainly this is the history of other industries that have undergone similar transformations. The authors expect that forces at work in the electric utility industry could lead to antitrust actions playing a far greater role in the industry`s future than most observers currently expect. The electric utility industry has already experienced a close brush with the potential for antitrust rulings to unravel critical elements of regulatory policy on restructuring. The DC Circuit`s now famous (or infamous) dicta in the Cajun Electric Power case illustrated how a simple antitrust principle--the prohibition on so-called tying arrangements--could defeat the FERC`s policy with respect to utilities` recovery of billions of dollars of stranded costs. The FERC rebutted that dicta in its remand decisions and elsewhere, and it appears that the issue in now moot in the Cajun litigation itself. But the tying arrangement argument is far from dead.

    The Department of Energy has operated nuclear facilities at the Idaho National Engineering Laboratory (INEL) to support national interests for several decades. Since 1953, it has supported the development of technologies for the storage and reprocessing of spent nuclear fuels (SNF) and the resultant wastes. However, the 1992 decision to discontinue reprocessing of SNF has left nearly 768 MT of SNF in storage at the INEL with unspecified plans for future dispositioning. Past reprocessing of these fuels for uranium and other resource recovery has resulted in the production of 3800 M{sup 3} calcine and a total inventory of 7600 M{sup 3} of radioactive liquids (1900 M{sup 3} destined for immediate calcination and the remaining sodium-bearing waste requiring further treatment before calcination). These issues, along with increased environmental compliance within DOE and its contractors, mandate operation of current and future facilities in an environmentally responsible manner. This will require satisfactory resolution of spent fuel and waste disposal issues resulting from the past activities. A national policy which identifies requirements for the disposal of SNF and high level wastes (HLW) has been established by the Nuclear Waste Policy Act (NWPA) Sec.8,(b) para(3)) [1982]. The materials have to be conditioned or treated, then packaged for disposal while meeting US Environmental Protection Agency (EPA) and Nuclear Regulatory Commission (NRC) regulations. The spent fuel and HLW located at the INEL will have to be put into a form and package that meets these regulatory criteria. The emphasis of Idaho Chemical Processing Plant (ICPP) future operations has shifted toward investigating, testing, and selecting technologies to prepare current and future spent fuels and waste for final disposal. This preparation for disposal may include mechanical, physical and/or chemical processes, and may differ for each of the various fuels and wastes.

    In forming a heliostat having a main support structure and pivoting and tilting motors and gears and a mirror module for reflecting solar energy onto a collector, the improvement characterized by a method of forming the mirror module in which the mirror is laid upon a solid rigid supporting bed in one or more sections, with or without focusing; a mirror backing sheet is applied by first applying respective thin layers of silicone grease and, thereafter, progressively rolling application to eliminate air bubbles; followed by affixing of a substrate assembly to the mirror backing sheet to form a mirror module that does not curve because of thermally induced stresses and differential thermal expansion or contraction effects. The silicone grease also serves to dampen fluttering of the mirror and protect the mirror backside against adverse effects of the weather. Also disclosed are specific details of preferred embodiments.

    A process of forming high-density compacts of a powdered ceramic material is described by agglomerating the powdered ceramic material with a heat- decompossble binder, adding a heat-decompossble lubricant to the agglomerated material, placing a quantity of the material into a die cavity, pressing the material to form a compact, pretreating the compacts in a nonoxidizing atmosphere to remove the binder and lubricant, and sintering the compacts. When this process is used for making nuclear reactor fuel elements, the ceramic material is an oxide powder of a fissionsble material and after forming, the compacts are placed in a cladding tube which is closed at its ends by vapor tight end caps, so that the sintered compacts are held in close contact with each other and with the interior wall of the cladding tube.

    A method of forming a boron nitride. The method comprises contacting a metal article with a monomeric boron-nitrogen compound and converting the monomeric boron-nitrogen compound to a boron nitride. The boron nitride is formed on the same or a different metal article. The monomeric boron-nitrogen compound is borazine, cycloborazane, trimethylcycloborazane, polyborazylene, B-vinylborazine, poly(B-vinylborazine), or combinations thereof. The monomeric boron-nitrogen compound is polymerized to form the boron nitride by exposure to a temperature greater than approximately 100.degree. C. The boron nitride is amorphous boron nitride, hexagonal boron nitride, rhombohedral boron nitride, turbostratic boron nitride, wurzite boron nitride, combinations thereof, or boron nitride and carbon. A method of conditioning a ballistic weapon and a metal article coated with the monomeric boron-nitrogen compound are also disclosed.

    Of the many radionuclides and contaminants in the tank wastes stored at the Hanford site, technetium-99 (99Tc) is one of the most challenging to effectively immobilize in a waste form for ultimate disposal. Within the Hanford Tank Waste Treatment and Immobilization Plant (WTP), the Tc will partition between both the high-level waste (HLW) and low-activity waste (LAW) fractions of the tank waste. The HLW fraction will be converted to a glass waste form in the HLW vitrification facility and the LAW fraction will be converted to another glass waste form in the LAW vitrification facility. In both vitrification facilities, the Tc is incorporated into the glass waste form but a significant fraction of the Tc volatilizes at the high glass-melting temperatures and is captured in the off-gas treatment systems at both facilities. The aqueous off-gas condensate solution containing the volatilized Tc is recycled and is added to the LAW glass melter feed. This recycle process is effective in increasing the loading of Tc in the LAW glass but it also disproportionally increases the sulfur and halides in the LAW melter feed which increases both the amount of LAW glass and either the duration of the LAW vitrification mission or the required supplemental LAW treatment capacity.

    In a second development order, spin-forming equipment was again evaluated using the test shape, a hemispherical shell. In this second development order, pure vanadium and alloy titanium (Ti-6Al-4V) were spin-formed, as well as additional copper and 21-6-9 stainless. In the first development order the following materials had been spin-formed: copper (alloy C11000 ETP), 6061 aluminum, 304L stainless steel, 21-6-9 stainless steel, and tantalum-2.5% tungsten. Significant challenges included properly adjusting the rotations-per-minute (RPM), cracking at un-beveled edges and laser marks, redressing of notches, surface cracking, non-uniform temperature evolution in the titanium, and cracking of the tailstock. Lessons learned were that 300 RPM worked better than 600 RPM for most materials (at the feed rate of 800 mm/min); beveling the edges to lower the stress reduces edge cracking; notches, laser marks, or edge defects in the preform doom the process to cracking and failure; coolant is required for vanadium spin-forming; increasing the number of passes to nine or more eliminates surface cracking for vanadium; titanium develops a hot zone in front of the rollers; and the tailstock should be redesigned to eliminate the cylindrical stress concentrator in the center.

The first and second planar conductors are connected to each other at the first end, and the first and fourth planar conductors are connected to each other at the second end via a shorting plate. The third planar conductor is electrically connectable to a high voltage source, and an internal switch functions to short at the first end a high voltage from the third planar conductor to the fourth planar conductor to produce a bipolar pulse at the acceleration axis with a zero net time integral. Improved access to the switch is enabled by an aperture through the shorting plate and the proximity of the aperture to the switch.

    Three cylindrical rollers are rotatably mounted equidistant from the center of a hollow tool head on radii spaced 120.degree. apart. Each roller has a thin flange; the three flanges lie in a single plane to form an internal circumferential rib in a rotating tubular workpiece. The tool head has two complementary parts with two rollers in one part of the head and one roller in the other part; the two parts are joined by a hinge. A second hinge, located so the rollers are between the two hinges, connects one of the parts to a tool bar mounted in a lathe tool holder. The axes of rotation of both hinges and all three rollers are parallel. A hole exposing equal portions of the three roller flanges is located in the center of the tool head. The two hinges permit the tool head to be opened and rotated slightly downward, taking the roller flanges out of the path of the workpiece which is supported on both ends and rotated by the lathe. The parts of the tool head are then closed on the workpiece so that the flanges are applied to the workpiece and form the rib. The tool is then relocated for forming of the next rib.

    The Federal Energy Regulatory Commission (FERC) Order 636 prompted an increase of natural gas market centers (trading hubs) across the United States and Canada. These regulations allow customers (end users) to select services directly from producers and marketers. Pipeline companies must provide transportation unbundled from sales services, provide open access to transportation, and provide open access to storage. FERC Order 636-B also requires market centers to be fairly small, i.e., a 30-mile radius around a central point. Some market centers are designed to offer a variety of physical services, including storage, parking, wheeling, pooling, balancing, and peaking. Financial or transactional services, such as title transfers, capacity release, nomination, electronic trading, risk management, and credit are also being offered. The Electronic Bulletin Board (EBB) services through these centers will provide a variety of information on pricing; weather; cash trading to match bids; physical gas offers; as well as financial, regulatory, and industry news.

    The Justice Department`s Guidelines don`t tell us very much about today`s (or tomorrow`s) electric market. However many electric utilities remain after this merger wave, competition will be forever changed. Earlier this year, the Federal Energy Regulatory Commission (FERC) issued a Notice of Inquiry (NOI) on merger policy, seeking advice on how to adapt old practices to a changing industry. Then, in July, it voted 3-2 to require a hearing on the proposed merger of Baltimore Gas & Electric and Potomac Electric Power. The majority expressed concern that applicants had defined relevant markets too broadly and inferred competition where market power might exist. The dissenting commissioners favored approval without hearing, noting that no intervenors had presented substantive claims that the merger would increase market power. Whether or not the FERC proceeds to a more activist policy on mergers, it must reevaluate the methods it uses to determine their effects on competition.

    All mergers affect competition, some by creating superior competitors and others by creating potential monopolists. The Antitrust Improvements Act of 1976 requires prescreening of proposed mergers to identify those that are likely to affect competition adversely. To implement that law, the US Department of Justice`s merger guidelines contain prescreening procedures that attempt a compromise between theoretical rigor, limited data, expeditious processing and consistency. This article discusses the following topics: the guidelines and their relevence, the problems encountered in applying them to electricity markets; FERC`s merger policy and deemphasizing antitrust markets for capacity and energy; critique of capacity and energy markets; general considerations of antitrust activism; general conclusions on the relationship between regulation and antitrust.

    Although recent court decisions about natural gas carriage and discount sales programs may cause problems for users in the short term, in the long run they could provide open access on non-discriminatory terms. The programs will continue current operation until July, and the final impact of the decisions will depend upon the response of the Federal Energy Regulatory Commission (FERC) to the court's nullification of its programs. A lapse before establishing new rules could be disruptive. Arguments that the programs boost pipeline profits and unfairly aid dual-fuel users led to the court decision. Refusal to transport gas could generate anti-trust suits against pipelines. FERC expects to issue final rules by the end of summer.

    In 2005, the Federal Energy Regulatory Commission (FERC) began discussing regulatory policy for reactive-power procurement and pricing in competitive electricity markets. This paper summarizes findings from a unique, interdisciplinary program of public-interest research that lays a formal foundation for evaluating aspects of FERC staff recommendations and offers early insights that should be useful in guiding policy implementation, specifically by: (1) clarifying the consumers and economic characteristics of reactive power as a basis for creating incentives to appropriately price it, (2) defining specific challenges in creating a competitive market for reactive power as well as new tools needed to help ensure such a market functions efficiently, and (3) demonstrating the importance of accounting for the physical characteristics of the transmission network in planning for reactive power and avoiding the exercise of market power by suppliers.

    In April 1996, the Federal Regulatory Commission (PERC) approved Orders 888 and 889 and released a draft rule for public comment on capacity reservation tariffs (CRTs). Order No. 888 requires electric utilities to file transmission tariffs that would allow transmission access to third parties who want to conduct wholesale transactions, and Order No. 889 requires transmission-owning utilities to set up open access, same-time information systems (OASIS), using commercial software and Internet protocols. This paper discusses these Orders in detail, as well as some of the issues before FERC with implications for renewables, which include: transmission pricing; transmission terms and conditions; reassignment of transmission capacity; defining state and FERC jurisdiction over transmission and distribution; the pricing of ancillary services; and the adoption and implementation of independent system operators.

  20. CERAMIC WASTE FORM DATA PACKAGE

    The purpose of this data package is to provide information about simulated crystalline waste forms that can be used to select an appropriate composition for a Cold Crucible Induction Melter (CCIM) proof of principle demonstration. Melt processing, viscosity, electrical conductivity, and thermal analysis information was collected to assess the ability of two potential candidate ceramic compositions to be processed in the Idaho National Laboratory (INL) CCIM and to guide processing parameters for the CCIM operation. Given uncertainties in the CCIM capabilities to reach certain temperatures throughout the system, one waste form designated 'Fe-MP' was designed towards enabling processing and another, designated 'CAF-5%TM-MP' was designed towards optimized microstructure. Melt processing studies confirmed both compositions could be poured from a crucible at 1600{degrees}C although the CAF-5%TM-MP composition froze before pouring was complete due to rapid crystallization (upon cooling). X-ray diffraction measurements confirmed the crystalline nature and phase assemblages of the compositions. The kinetics of melting and crystallization appeared to vary significantly between the compositions. Impedance spectroscopy results indicated the electrical conductivity is acceptable with respect to processing in the CCIM. The success of processing either ceramic composition will depend on the thermal profiles throughout the CCIM. In particular, the working temperature of the pour spout relative to the bulk melter which can approach 1700{degrees}C. The Fe-MP composition is recommended to demonstrate proof of principle for crystalline simulated waste forms considering the current configuration of INL's CCIM. If proposed modifications to the CCIM can maintain a nominal temperature of 1600{degrees}C throughout the melter, drain, and pour spout, then the CAF-5%TM-MP composition should be considered for a proof of principle demonstration.
