    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    The advantages of ocean thermal energy conversion (OTEC) for Hawaii, its institutional support, projected contributions of OTEC in the future, and environmental concerns are discussed. Three experimental OTEC facilities in Hawaii are described, and the many regulations that must be observed and permits needed are described. Applicability of existing federal laws in regulating commercial-scale OTEC plants is examined, and applicable Coast Guard regulations and maritime laws are discussed briefly. Questions of state-federal relations, particularly regarding Hawaii's archipelagic claims and coastal zone, are addressed. (LEW)

    The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. The pertinent categories of state and local regulations and programs are explained, then detailed analysis is conducted on the covered products and regulations. Issues relating to the timing of preemption of state regulations are discussed, as well as issues relating to burden of proof, contents of petitions for exemptions from preemption, criteria for evaluating petitions, and procedural and other issues.     With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. This paper will discuss ERCs, why the disposal of ERCs by Federal agencies is a pressing issue, and how Federal agencies can dispose of ERCs under existing Federal property laws and regulations.

    In 2005, the Environmental Protection Agency (EPA) finalized two regulations, the Clean Air Interstate Rule (CAIR) and the Clean Air Mercury Rule CAMR, that would reduce emissions from coal-fired power plants in the United States. Both CAIR and CAMR are included in the Annual Energy Outlook 2006 reference case. The EPA has received 11 petitions for reconsideration of CAIR and has provided an opportunity for public comment on reconsidering certain aspects of CAIR. Public comments were accepted until January 13, 2006. The EPA has also received 14 petitions for reconsideration of CAMR and is willing to reconsider certain aspects of the rule. Public comments were accepted for 45 days after publication of the reconsideration notice in the Federal Register. Several states and organizations have filed lawsuits against CAMR. The ultimate decision of the courts will have a significant impact on the implementation of CAMR.

The mines were stratified by tonnage per year and employment. Mail and personal interview surveys were conducted for each stratum.     The Risk Management Program (RMP) rule, Section 112(r) of the Clean Air Act (CAA), was signed on May 24 and finalized on June 20. RMP is one of the most comprehensive, technically based regulatory programs for preventing, detecting and responding to accidental hazardous materials releases to have been issued in recent times. Although facilities have three years to comply, EPA estimates that the rule will affect an estimated 66,000 facilities that store highly hazardous or acutely toxic materials. The 1990 CAA Amendments are designed to prevent accidental releases of highly hazardous chemicals from stationary sources. Two significant regulatory programs that have emerged from the revised CAA are the Process Safety Management (PSM) standard and RMP. PSM is designed to protect employees and regulated by the Occupational Safety and Health Administration. RMP`s purpose is to protect the public and the environment from highly hazardous chemicals. It authorizes EPA to create a list of substances (distinct from the list generated under PSM) known to cause serious adverse effects and to implement a program for accidental chemical release prevention.

    This research focuses on the regulatory politics of mountaintop removal mining for coal within the Appalachian states of West Virginia and Kentucky. Based on Administrative Presidency concepts suggesting that chief executives seek more control and influence over agency program decisions, this article analyzes President George W. Bush's efforts to promote the development of coal resources within these states despite statutory constraints posed by federal environmental laws. The analysis demonstrates that President Bush effectively achieved his energy production goals by combining the use of discretionary authority with staff controls, executive orders, and regulatory initiatives to lessen industry compliance costs with environmental regulatory requirements.

    Utility regulators increasingly take responsibility for the [open quotes]extemalities[close quotes] associated with their decisions, meaning the economic and social costs related to rate decisions or other kinds of authorizations. Yet, when Congress adopted the National Environmental Policy Act of 1969 (NEPA), it intervened to ensure protection of the natural environment, not from abuses by the citizenry but from the activities of the federal government itself. Comprised of action forcing procedures, NEPA was designed to infuse the decisional processes of federal agencies with a broad awareness of the environmental consequences of their actions. NEPA encourages decisionmakers to counterbalance the organic statutory and political missions of their departments or agencies with a sensitivity to the ecological consequences of their directives and authorizations. This paper examines how the requirements of NEPA have fared in the environment of classical public utility regulation at the Federal Energy Regulatory Commission. Commission proceedings did not evidence any widely held opinion that economic regulation of the gas industry is hostile to the NEPA process.

These rules were promulgated by the US Environmental Protection Agency (EPA) on September 23, 1988, and became effective December 22, 1988. These regulations are required by Subtitle I of the Resource Conservation and Recovery Act of 1976. Using the methods and language of economic analysis, it also encompasses the broad social and political scope of the energy crisis, which is described as primarily a battle over the appropriate distribution of income within society, rather than the manifestation of some massive failure of markets and institutions to allocate the nation's resources effectively. One of the author's conclusions is that when policymakers address the income-transfer issue, they should use the straightforward mechanism of general income tax and welfare legislation. The book analyzes such topics as the position of the US oil industry in the international market, the Entitlements Program, and the effects of the Emergency Petroleum Allocation Act of 1973, the Energy Policy and Conservation Act of 1974, and the Crude Oil Windfall Profits Tax Act of 1980. 196 references, 30 figures, 35 tables.

The U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office is considered five options for management of the buried TRU waste. One option is to leave the waste in-place if the disposal can meet the requirements of Title 40 Code of Federal Regulations (CFR) Part 191, 'Environmental Radiation Protection Standard for Management and Disposal of Spent Nuclear Fuel, High-Level, and Transuranic Radioactive Wastes'. This paper describes analyses that assess the likelihood that TRU waste in shallow land burial can meet the 40 CFR 191 standards for a geologic repository. The simulated probability of the cumulative release exceeding 1 and 10 times the 40 CFR 191.13 containment requirements is estimated to be 0.009 and less than 0.0001, respectively. The cumulative release is most sensitive to the number of groundwater withdrawal wells drilled through the disposal trench. The mean total effective dose equivalent for a member of the public is estimated to reach a maximum of 0.014 milliSievert (mSv) at 10,000 years, or approximately 10 percent of the 0.15 mSv 40 CFR 191.15 individual protection requirement. The dose is predominantly from inhalation of short-lived Rn-222 progeny in air produced by low-level waste disposed in the same trench. The transuranic radionuclide released in greatest amounts, Pu-239, contributes only 0.4 percent of the dose. The member of public dose is most sensitive to the U-234 inventory and the radon emanation coefficient. Reasonable assurance of compliance with the Subpart C groundwater protection standard is provided by site characterization data and hydrologic processes modeling which support a conclusion of no groundwater pathway within 10,000 years.     Estimation of the costs associated with implementation of the Resource Conservation and Recovery Act (RCRA) regulations for non-hazardous and hazardous material disposal in the utility industry are provided. These costs are based on engineering studies at a number of coal-fired power plants in which the costs for hazardous and non-hazardous disposal are compared to the costs developed for the current practice design for each utility. The relationship of the three costs is displayed. The emphasis of this study is on the determination of incremental costs rather than the absolute costs for each case (current practice, non-hazardous, or hazardous). For the purpose of this project, the hazardous design cost was determined for minimum versus maximum compliance.

    Following the issuance of Title 10 Code of Federal Regulations Part 835 (10 CFR 835), {open_quotes}Occupational Radiation Protection,{close_quotes} in the Federal Register on 14 December 1993, all DOE facilities subject to the rule provisions were required to submit a radiation protection program that Sets forth the plans, schedules, and other measures for achieving compliance with the rule by 1 January 1996. Numerous DOE facilities identified areas of the rule where their facility needed either (1) a clarification of the intent and expectation of a provisions or (2) an exemption from the provisions. In response, the DOE Office of Worker Protection Programs and Hazards Management (EH-52) prepared and disseminated eight Radiological Control Technical Positions (RCTPs). These RCTPs provided clarifications of DOE`s intent and expectations for compliance with specific provisions of the rule. EH-52 also processed requests for exemptions from provisions of 10 CFR 835 received from twelve different DOE facilities. The DOE issued 21 separate responses to these facilities, each one addressing the specific exepemtion request. Each response contained (1) an Exemption Decision and (2) a Technical Position discussing the basis for either denying or granting with conditions, as applicable, the exemption request.

    The Savannah River Site (SRS) is a 310-square-mile United States Department of Energy nuclear facility located along the Savannah River (SRS) near Aiken, South Carolina. Nuclear weapons material production began in the early 1950s, utilizing five production reactors. In the early 1990s all SRS production reactor operations were terminated. The first reactor closure end state declaration was recently institutionalized in a Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) Early Action Record of Decision. The decision for the final closure of the 318,000 square foot 105-P Reactor was determined to be in situ decommissioning (ISD). ISD is an acceptable and cost effective alternative to off-site disposal for the reactor building, which will allow for consolidation of remedial action wastes generated from other cleanup activities within the P Area. ISD is considered protective by the regulators, U. S. Environmental Protection Agency (US EPA) and the South Carolina Department of Health and Environmental Control (SCDHEC), public and stakeholders as waste materials are stabilized/immobilized, and radioactivity is allowed to naturally decay, thus preventing future exposure to the environment. Stakeholder buy-in was critical in the upfront planning in order to achieve this monumental final decision. Numerous public meetings and workshops were held in two different states (covering a 200 mile radius) with stakeholder and SRS Citizens Advisory Board participation. These meetings were conducted over an eight month period as the end state decision making progressed. Information provided to the public evolved from workshop to workshop as data became available and public input from the public meetings were gathered. ISD is being considered for the balance of the four SRS reactors and other hardened facilities such as the chemical processing canyons.

    This compilation includes in the first two sections the reporting and recordkeeping requirements applicable to US Nuclear Regulatory Commission (NRC) licensees and applicants and to members of the public. It includes those requirements codified in Title 10 of the code of Federal Regulations, Chapter 1, on December 31, 1993. It also includes, in a separate section, any of those requirements that were superseded or discontinued between January 1992 and December 1993. Finally, the appendix lists mailing and delivery addresses for NRC Headquarters and Regional Offices mentioned in the compilation. The Office of Information Resources Management staff compiled this listing of reporting and recordkeeping requirements to briefly describe each in a single document primarily to help licensees readily identify the requirements. The compilation is not a substitute for the regulations, and is not intended to impose any new requirements or technical positions. It is part of NRC`s continuing efforts to comply with the Paperwork Reduction Act of 1980 and the Office of Management and Budget regulations that mandate effective and efficient Federal information resources management programs.

    Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.

    ]. This method is based on the performance of the closed-loop system during a step response experiment [10], [11]. In this article we present a method for optimizing the step response of a closed-loop system consisting of a PID controller and an unknown plant with a discrete version of extremum seeking (ES). Specifically, ES is used to minimize a cost function similar to that used in [10], [11], which quantifies the performance of the PID controller. ES, a non-model-based method, iteratively modifies the arguments (in this application the PID parameters) of a cost function so that the output of the cost function reaches a local minimum or local maximum. In the next section we apply ES to PID controller tuning. We illustrate this technique through simulations comparing the effectiveness of ES to other PID tuning methods. Next, we address the importance of the choice of cost function and consider the effect of controller saturation. Furthermore, we discuss the choice of ES tuning parameters. Finally, we offer some conclusions.

Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. We establish a simple and general extension of a recently developed bounded form of ES to a general class of oscillatory functions, including functions discontinuous with respect to time, such as triangle or square waves with dead time. We establish our main results by combining a novel idea for oscillatory control with an extension of functional analytic techniques originally utilized by Kurzweil, Jarnik, Sussmann, and Liu in the late 80s and early 90s and recently studiedmore » by Durr et al.     In this work, we present a form of extremum seeking (ES) in which the unknown function being minimized enters the systems dynamics as the argument of a cosine or sine term, thereby guaranteeing known bounds on update rates and control efforts. We present general n-dimensional optimization and stabilization results as well as 2D vehicle control, with bounded velocity and control efforts. For application to autonomous vehicles, tracking a source in a GPS denied environment with unknown orientation, this ES approach allows for smooth heading angle actuation, with constant velocity, and in application to a unicycle-type vehicle results in control ability as if the vehicle is fully actuated. Our stability analysis is made possible by the classic results of Kurzweil, Jarnik, Sussmann, and Liu, regarding systems with highly oscillatory terms. In our stability analysis, we combine the averaging results with a semi-global practical stability result under small parametric perturbations developed by Moreau and Aeyels.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

    The Department of Energy`s (DOE) Federal Relighting Initiative (FRI), under the Federal Energy Management Program (FEMP), has developed a comprehensive process to assist federal agencies in meeting the nation`s energy mandate. This mandate states that federal facilities must use 20% less energy by the year 2000, based on 1985 consumption levels. Because lighting accounts for about 40% of total federal electricity consumption, the FRI was conceived to help reduce energy use in this important area while improving lighting quality and increasing productivity through relighting. Selected federal rules and regulations provide guidance on the types of energy efficiency techniques required, life-cycle costing methods and lighting levels that should be employed to achieve the federal mandate. Although the central focus of this paper is on the environment, this paper takes the perspective that the energy efficiency gains achieved through the FRI would produce both environmental and economic benefits for the United States. For example, improvements in energy efficiency would reduce electricity demand, and would consequently reduce the emissions associated with fossil fuel combustion for power production.     The Department of Energy's (DOE) Federal Relighting Initiative (FRI), under the Federal Energy Management Program (FEMP), has developed a comprehensive process to assist federal agencies in meeting the nation's energy mandate. This mandate states that federal facilities must use 20% less energy by the year 2000, based on 1985 consumption levels. Because lighting accounts for about 40% of total federal electricity consumption, the FRI was conceived to help reduce energy use in this important area while improving lighting quality and increasing productivity through relighting. Selected federal rules and regulations provide guidance on the types of energy efficiency techniques required, life-cycle costing methods and lighting levels that should be employed to achieve the federal mandate. Although the central focus of this paper is on the environment, this paper takes the perspective that the energy efficiency gains achieved through the FRI would produce both environmental and economic benefits for the United States. For example, improvements in energy efficiency would reduce electricity demand, and would consequently reduce the emissions associated with fossil fuel combustion for power production.     A transistorized voltage regulator which provides very close voitage regulation up to about 180 deg F is described. A diode in the positive line provides a constant voltage drop from the input to a regulating transistor emitter. An amplifier is coupled to the positive line through a resistor and is connected between a difference circuit and the regulating transistor base which is negative due to the difference in voltage drop across thc diode and the resistor so that a change in the regulator output causes the amplifier to increase or decrease the base voltage and current and incrcase or decrease the transistor impedance to return the regulator output to normal.     Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    Pacific Northwest National Laboratory (PNNL) conducted in-depth research of state-level rainwater harvesting regulations for the Federal Energy Management Program (FEMP) to help federal agencies strategically identify locations conducive to rainwater harvesting projects. Currently, rainwater harvesting is not regulated by the federal government but rather it is up to individual states to regulate the collection and use of rainwater. There is no centralized information on state-level regulations on rainwater harvesting maintained by a federal agency or outside organization. To fill this information gap, PNNL performed detailed internet searches for each state, which included state agencies, universities, Cooperative Extension Offices, city governments, and related organizations. The state-by-state information on rainwater harvesting regulations was compiled and assembled into an interactive map that is color coded by state regulations. The map provides a visual representation of the general types of rainwater harvesting policies across the country as well as general information on the state programs if applicable. The map allows the user to quickly discern where rainwater harvesting is supported and regulated by the state. This map will be available on the FEMP website by September 2015.

    The Clean Air Act Amendments of 1990 established a rigorous timetable for EPA to develop and implement an unprecedented number of regulatory and policy initiatives. EPA has made great progress in meeting these mandates; however, much remains to be done if the Act`s health and environmental goals are to be achieved. EPA must issue dozens of additional regulations, guidance documents, and studies and reports over the next several years. The largest group of remaining rulemakings will be those controlling air toxics emissions. Other significant actions will include final rulemakings on emission standards for non-road engines, emissions standards for municipal and medical waste combustion, enhanced emissions monitoring, Federal operating permits, and newsource review simplification. EPA also must accelerate and expand a host of activities to ensure that the Agency and the States are implementing and enforcing the Act effectively. For example, EPA must assess hundreds of SIP revisions, as well as 120 State and local permit programs, and provide technical assistance to States and sources. Ms. Nichols will present EPA`s will present EPA`s plans for implementing these activities over the next several years. She will present a summary of the Agency`s current achievements under the 1990 amendments and EPA`s framework for completing the challenging tasks that lie ahead.
