    The Army Corps of Engineers, Pacific Ocean Division, participated in the interagency case study of sea level rise for Yap State in the Federated States of Micronesia. The study, on behalf of the National Oceanic and Atmospheric Administration, was in support of the Intergovernmental Panel on Climate Change. Engineering and environmental analyses indicate that resources within Yap State at risk from a 1.0 meter rise in sea level by the year 2100 are substantial, including coral reefs, sea grass beds, wetlands, native mangrove forests, groundwater, archaeological and cultural resources, and shoreline infrastructure. Severe constraints associated with land ownership patterns have helped prevent the potential for greater impact. Yet these same constraints will likely hinder future decisions regarding retreat, accommodation, or protection strategies. As a result, there are special institutional and cultural challenges that face Yap in developing and implementing appropriate responses to accelerated sea level rise. These are made more difficult with the many uncertainties associated with current predictions regarding the greenhouse effect.

  14. Renewable Energy Prices in State-Level Feed-in Tariffs: Federal Law Constraints and Possible Solutions

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    A project undertaken to provide the Bonneville Power Administration (BPA) with information needed to conduct environmental assessments and meet requirements of the National Environmental Policy Act (NEPA) and the Pacific Northwest Electric Power Planning and Conservation Act (Regional Act) is described. Access to information on environmental effects would help BPA fulfill its responsibilities to coordinate power generation on the Columbia River system, protect uses of the river system (e.g., irrigation, recreation, navigation), and enhance fish and wildlife production. Staff members at BPA identified the need to compile and index information resources that would help answer environmental impact questions. A computer retrieval system that would provide ready access to the information was envisioned. This project was supported by BPA to provide an initial step toward a compilation of environmental impact information. Scientists at Pacific Northwest Laboratory (PNL) identified, gathered, and evaluated information related to environmental effects of water level on uses of five study reservoirs and developed and implemented and environmental data retrieval system, which provides for automated storage and retrieval of annotated citations to published and unpublished information. The data retrieval system is operating on BPA's computer facility and includes the reservoir water-level environmental data. This project was divided into several tasks, some of which were conducted simultaneously to meet project deadlines. The tasks were to identify uses of the five study reservoirs, compile and evaluate reservoir information, develop a data entry and retrieval system, identify and analyze research needs, and document the data retrieval system and train users. Additional details of the project are described in several appendixes.

    This paper discusses command and control issues relating to the operation of Incident Command Posts (ICPs) and Emergency Operations Centers (EOCs) in the surrounding area jurisdictions following the detonation of an Improvised Nuclear Device (IND). Although many aspects of command and control will be similar to what is considered to be normal operations using the Incident Command System (ICS) and the National Incident Management System (NIMS), the IND response will require many new procedures and associations in order to design and implement a successful response. The scope of this white paper is to address the following questions: Would the current command and control framework change in the face of an IND incident? What would the management of operations look like as the event unfolded? How do neighboring and/or affected jurisdictions coordinate with the state? If the target areas command and control infrastructure is destroyed or disabled, how could neighboring jurisdictions assist with command and control of the targeted jurisdiction? How would public health and medical services fit into the command and control structure? How can pre-planning and common policies improve coordination and response effectiveness? Where can public health officials get federal guidance on radiation, contamination and other health and safety issues for IND response planning and operations?

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    This record of siting a geologic repository for high-level radioactive wastes (HLW) and spent fuel describes the many investigations that culminated on December 22, 1987 in the designation of Yucca Mountain (YM), as the site to undergo detailed geologic characterization. It recounts the important issues and events that have been instrumental in shaping the course of siting over the last three and one half decades. In this long task, which was initiated in 1954, more than 60 regions, areas, or sites involving nine different rock types have been investigated. This effort became sharply focused in 1983 with the identification of nine potentially suitable sites for the first repository. From these nine sites, five were subsequently nominated by the U.S. Department of Energy (DOE) as suitable for characterization and then, in 1986, as required by the Nuclear Waste Policy Act of 1982 (NWPA), three of these five were recommended to the President as candidates for site characterization. President Reagan approved the recommendation on May 28, 1986. DOE was preparing site characterization plans for the three candidate sites, namely Deaf Smith County, Texas; Hanford Site, Washington; and YM. As a consequence of the 1987 Amendment to the NWPA, only the latter was authorized to undergo detailed characterization. A final Site Characterization Plan for Yucca Mountain was published in 1988. Prior to 1954, there was no program for the siting of disposal facilities for high-level waste (HLW). In the 1940s and 1950s, the volume of waste, which was small and which resulted entirely from military weapons and research programs, was stored as a liquid in large steel tanks buried at geographically remote government installations principally in Washington and Tennessee.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

    Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

    The Department of Energy`s (DOE) Federal Relighting Initiative (FRI), under the Federal Energy Management Program (FEMP), has developed a comprehensive process to assist federal agencies in meeting the nation`s energy mandate. This mandate states that federal facilities must use 20% less energy by the year 2000, based on 1985 consumption levels. Because lighting accounts for about 40% of total federal electricity consumption, the FRI was conceived to help reduce energy use in this important area while improving lighting quality and increasing productivity through relighting. Selected federal rules and regulations provide guidance on the types of energy efficiency techniques required, life-cycle costing methods and lighting levels that should be employed to achieve the federal mandate. Although the central focus of this paper is on the environment, this paper takes the perspective that the energy efficiency gains achieved through the FRI would produce both environmental and economic benefits for the United States. For example, improvements in energy efficiency would reduce electricity demand, and would consequently reduce the emissions associated with fossil fuel combustion for power production. These reduced emissions include carbon dioxide, which is associated with the potential for global climate change, and heavy metals, which pose a potential health threat to humans and aquatic ecosystems. Economic benefits of the FRI would include reduced federal expenditures on energy or, possibly, avoiding new power plant construction.This paper begins with a brief overview of the FRI process. Next, current lighting energy use in federal buildings is evaluated and the potential future energy savings achievable through full implementation of the FRI are estimated. The paper then translates these energy savings into avoided emissions of carbon dioxide and heavy metals and into avoided fuel expenditures.

    The CILogon-HA project extended the existing open source CILogon service (initially developed with funding from the National Science Foundation) to provide credentials at multiple levels of assurance to users of DOE facilities for collaborative science. CILogon translates mechanism and policy across higher education and grid trust federations, bridging from the InCommon identity federation (which federates university and DOE lab identities) to the Interoperable Global Trust Federation (which defines standards across the Worldwide LHC Computing Grid, the Open Science Grid, and other cyberinfrastructure). The CILogon-HA project expanded the CILogon service to support over 160 identity providers (including 6 DOE facilities) and 3 internationally accredited certification authorities. To provide continuity of operations upon the end of the CILogon-HA project period, project staff transitioned the CILogon service to operation by XSEDE.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    This paper examines the factors that threaten the future of the Russian Federation (RF). The observations are based on a study that focused on eight republics: Mordova, Udmurtia, Tatarstan, Mari El, Bashkortostan, Kabardino-Balkaria, Buryatia, and Altay Republic. These republics were selected for their geographic and economic significance to the RF. Tatarstan, Bashkortostan, Udmurtia, and Mari El are located on important supply routes, such as the Volga River and the trans-Siberian railroad. Some of these republics are relatively wealthy, with natural resources such as oil (e.g., Tatarstan and Bashkortostan), and all eight republics play significant roles in the military-industrial complex. The importance of these republics to the RF contrasts to the relative insignificance of the independence-minded Northern Caucasus area. The author chose not to examine the Northern Caucasus region (except Kabardino-Balkaria) because these republics may have only a minor impact on the rest of the RF if they secede. Their impact would be minimized because they lie on the frontiers of the RF. Many Russians believe that {open_quotes}it might be best to let such a troublesome area secede.{close_quotes}

    This report summarizes the broad range of activities that are focused on meeting the President's Executive Order on Federal Energy Management promulgated to meet energy savings goals and encourage more efficient management of all federal energy resources. These activities are reported semiannually under the auspices of the Federal Energy Resource Modernization (FERM) Coordinating Committee, and as such include activities undertaken from April 1, 1992, through September 30, 1992. The activities reported are classified into four major categories: (1) technology-base support, which includes development of processes, software, metering and monitoring equipment and strategies, and other tools for federal energy managers to better understand and characterize their energy resources; (2) federal energy systems testing and monitoring; (3) federal energy systems revitalization projects at federal installations in cooperation with the utilities serving the sites; and (4) energy supply, distribution and end-use conservation assessment for federal agencies and/or facilities. Lighting systems and air conditioning projects at federal facilities, especially military bases are updated.

    Measuring the Economic Impacts of Federal Investments in Research evaluates approaches to measuring the returns on federal research investments. This report identifies new methodologies and metrics that can be developed and used for assessing returns on research across a wide range of fields (biomedical, information technology, energy, agriculture, environment, and other biological and physical sciences, etc.), while using one or more background papers that review current methodologies as a starting point for the discussion. It focuses on tools that are able to exploit available data in the relatively near term rather than on methodologies that may require substantial new data collection. Over the last several years, there has been a growing interest in policy circles in identifying the payoffs from federal agency research investments, especially in terms of economic growth, competitiveness, and jobs. The extraordinary increase in research expenditures under the American Recovery and Reinvestment Act (ARRA) of 2009 and the President's commitment to science and technology (S&T) funding increases going forward have heightened the need for measuring the impacts of research investments. Without a credible analysis of their outcomes, the recent and proposed increases in S&T funding may not be sustained, especially given competing claims for federal funding and pressures to reduce projected federal budget deficits. Motivated by these needs and requirements, Measuring the Economic Impacts of Federal Investments in Research reviews and discusses the use of quantitative and qualitative data to evaluate the returns on federal research and development (R&D) investments. Despite the job-focused mandate of the current ARRA reporting requirements, the impact of S&T funding extend well beyond employment.     The Federal Fleet Conversion Task Force was created by Executive Order 12844, signed by President Clinton on April 21, 1993. In the Order, the President directed that purchases of alternative fueled vehicles by the Federal Government be substantially increased beyond the levels required by current law. The President charged the Task Force with developing recommendations for carrying out the Executive Order, with special emphasis on setting a course that will lead to the widespread use of alternative fueled vehicles by Federal, State, and local government fleets, by private fleets and, ultimately, by individuals. The chief recommendation of the Task Force is the establishment of a Presidential Clean Cities Initiative. To support creation of the Presidential Initiative, the Task Force identified 38 cities and regions, prioritized into three tiers, for concentrating the Initiative`s efforts in Fiscal Years 1994 through 1996. This concentration of effort is key to the effectiveness of the Initiative. The 38 cities and regions would receive priority funding for Federal vehicle purchases and for infrastructure development. In addition, the Task Force has made specific recommendations for overcoming numerous regulatory, economic, and technical barriers that have slowed the introduction of alternative fueled vehicles into general use.

    Approximately 1.6 billion people worldwide do not have access to electricity, and roughly 2.4 billion people rely on traditional biomass fuels to meet their heating and cooking needs. Lack of access to and use of energy - or energy poverty - has been recognized as a barrier to reaching the Millennium Development Goals (MDGs) and other targeted efforts to improve health and quality of life. Reducing reliance on traditional biomass can substantially reduce indoor air pollution-related morbidity and mortality; increasing access to lighting and refrigeration can improve educational and economic opportunities. Though targeted electrification efforts have had success within Latin America and East Asia (reaching electrification rates above 85%), sub-Saharan Africa has maintained electrification rates below 25% (IEA 2004).

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services

    This report contains the results of a study required by section 162 of the Energy Policy Act of 1992 (EPAct). It outlines options for financing energy and water conservation measures at Federal facilities as required by Part 3 of Title V of the National Energy Policy and Conservation Act (NECPA) (42 U.S.C. 8251 et seq.) as amended by EPAct. It addresses: (1) the estimated Federal financial investment necessary to install energy and water conservation measures to meet NECPA and Executive Order requirements; (2) the use of revolving funds and other funding mechanisms which offer stable, long-term financing of energy and water conservation measures; and (3) the means for capitalizing such funds. On March 8, 1994, President Clinton signed Executive Order 12902. This Executive Order is an aggressive mandate to improve energy efficiency and water conservation in Federal buildings nationwide. This Executive Order is designed to meet and exceed requirements for Federal energy and water efficiency that were contained in section 152 of EPAct. Section 152 mandated that Federal agencies use all cost effective measures with less than a ten year payback to reduce energy consumption in their facilities by 20% by the year 2000 compared to 1985 levels. In addition, Executive Order 12902 established a requirement to use cost effective measures to reduce energy use by fiscal year 2005 by 30% compared to 1985 energy use. This report provides estimates for the energy and water conservation investments needed to achieve the NECPA and Executive Order goals as well as estimates for the contribution from various funding sources and a review of the mechanisms for funding these investments.

The purpose was to provide an estimate of the national potential for combined heat and power (also known as CHP; cogeneration; or cooling, heating, and power) applications at federal facilities and the associated costs and benefits including energy and emission savings. The report provides a broad overview for the U.S. Department of Energy (DOE) and other agencies on when and where CHP systems are most likely to serve the government's best interest. FEMP's mission is to reduce the cost to and environmental impact of the federal government by advancing energy efficiency and water conservation, promoting the use of renewable energy, and improving utility management decisions at federal sites. FEMP programs are driven by its customers: federal agency sites. FEMP monitors energy efficiency and renewable energy technology developments and mounts ''technology-specific'' programs to make technologies that are in strong demand by agencies more accessible. FEMP's role is often one of helping the federal government ''lead by example'' through the use of advanced energy efficiency/renewable energy (EERE) technologies in its own buildings and facilities. CHP was highlighted in the Bush Administration's National Energy Policy Report as a commercially available technology offering extraordinary benefits in terms of energy efficiencies and emission reductions. FEMP's criteria for emphasizing a technology are that it must be commercially available; be proven but underutilized; have a strong constituency and momentum; offer large energy savings and other benefits of interest to federal sites and FEMP mission; be in demand; and carry sufficient federal market potential.     The Federal Methanol Fleet Project concluded with the termination of data collection from the three fleet sites in February 1991. The Lawrence Berkeley Laboratory (LBL) completed five years of operation, Argonne National Laboratory (ANL) completed its fourth year in the project, and Oak Ridge National Laboratory (ORNL) completed its third. Twenty of the thirty-nine vehicles in the fleet were powered by fuel methanol (typically M85, 85 % methanol, 15 % unleaded gasoline, although the LBL fleet used M88), and the remaining control vehicles were comparable gasoline vehicles. Over 2.2 million km (1.4 million miles) were accumulated on the fleet vehicles in routine government service. Data collected over the years have included vehicle mileage and fuel economy, engine oil analysis, emissions, vehicle maintenance, and driver acceptance. Fuel economies (on an energy basis) of the methanol and gasoline vehicles of the same type were comparable throughout the fleet testing. Engine oil analysis has revealed higher accumulation rates of iron and other metals in the oil of the methanol vehicles, although no significant engine damage has been attributed to the higher metal content. Vehicles of both fuel types have experienced degradation in their emission control systems, however, the methanol vehicles seem to have degraded their catalytic converters at a higher rate. The methanol vehicles have required more maintenance than their gasoline counterparts, in most cases, although the higher levels of maintenance cannot be attributed to ``fuel-related`` repairs. According to the daily driver logs and results from several surveys, drivers of the fleet vehicles at all three sites were generally satisfied with the methanol vehicles.

    This publication is a numerical record of what has happened since Congress gave authority to the Secretary of the Interior in 1953 to lease the federal portion of the Continental Shelf for oil and gas. The publication updates and augments the first Federal Offshore Statistics, published in December 1983. It also extends a statistical series published annually from 1969 until 1981 by the US Geological Survey (USGS) under the title Outer Continental Shelf Statistics. The USGS collected royalties and supervised operation and production of minerals on the Outer Continental Shelf (OCS) until the Minerals Management Service (MMS) took over these functions in 1982. Some of the highlights are: of the 329.5 million acres offered for leasing, 37.1 million acres were actually leased; total revenues for the 1954 to 1983 period were $68,173,112,563 and for 1983 $9,161,435,540; a total of 22,095 wells were drilled in federal waters and 10,145 wells were drilled in state waters; from 1954 through 1983, federal offshore areas produced 6.4 billion barrels of oil and condensate, and 62.1 trillion cubic feet of natural gas; in 1983 alone production was 340.7 million barrels of oil and condensate, and 3.9 trillion cubic feet of gas; and for the second straight year, no oil was lost in 1983 as a result of blowouts in federal waters. 8 figures, 66 tables.
